2016-10-03 text/html 585780 CAIB ca 11155 30036 CAIB 300 CAIB ![CDATA[<p> <span style="font-family:times new roman,times,serif;font-size:12px;">DICTAMEN DE LA COMISSIÓ INFORMATIVA D'HISENDA</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Vist l’article 8.1 de la Llei 38/2003, de 17 de novembre, té caràcter bàsic, fet pel qual tots els Ajuntaments que pretenguin atorgar subvencions han d’aprovar el seu Pla Estratègic de Subvencions corresponent.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Vist que l'Ajuntament d'Inca no té, ni ha tingut aprovat un Pla Estratègic de Subvencions per l'any 2016.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Vista la disposició addicional tretzena de la Llei 38/2003, de 17 de novembre, que estableix que els plans i els programes relatius a polítiques públiques sectorials que estiguin previstes en normes legals o reglamentàries tenen la consideració de plans estratègics de subvencions i en el termini de sis mesos a partir de la seva entrada en vigor del mateix (25 d’octubre de 2006), els plans estratègics de subvencions o dels plans i programes sectorials vigents s’adaptaran a allò establert en el mateix.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Vist l’article 10 de la LGS que preveu que el Pla Estratègic és instrument d’organització de les polítiques públiques que té com a finalitat el foment d’una activitat d’utilitat pública o interès social o de promoció d’una finalitat púbica - amb caràcter previ al naixement de les subvencions.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Vist que l’objectiu d’aquest equip de Govern per millorar l’eficàcia, l’eficiència i l’economia en els procediments administratius i que en la Legislació es preveu que es procedeixi a elaborar un Pla Estratègic de Subvencions.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Donat que el Pla Estratègic NO té una naturalesa reglamentaria, una vegada aprovat i modificat per l'òrgan competent es publiqui en el BOIB per general coneixement.&nbsp;</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Per això, es proposa, previ Dictamen de la Comissió Informativa d'Hisenda de data 1 de setembre de 2016, a l'Ajuntament en Ple, l'adopció dels següents</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>ACORDS</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Primer.- </strong>Aprovar el Pla Estratègic de Subvencions del l'any 2016 de l'Ajuntament d'Inca i de l'Institut Municipal d'Activitats Físiques de l'Ajuntament d'Inca, que s'incorpora com a annex a aquesta proposta.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Segon.- </strong>Que es publiqui en el Butlletí Oficial de les Illes Balears.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Pla Estratègic de Subvencions de l’Ajuntament d'Inca i de l'Institut Municipal Activitats Físiques de l'Ajuntament d'Inca, amb els texts següents:</span></p> <p align="center"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>&nbsp;</strong></span></p> <p align="center"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>PLA ESTRATÈGIC DE SUBVENCIONS 2016</strong></span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>PREÀMBUL</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’article 8.1 de la Llei 38/2003, de 17 de novembre, té caràcter bàsic, fet pel qual tots els Ajuntaments que pretenguin atorgar subvencions han d’aprovar el seu Pla Estratègic de Subvencions corresponent.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Cal tenir en compte la disposició addicional tretzena de la Llei 38/2003, de 17 de novembre, que estableix que els plans i els programes relatius a polítiques públiques sectorials que estiguin previstes en normes legals o reglamentàries tenen la consideració de plans estratègics de subvencions i en el termini de sis mesos a partir de la seva entrada en vigor del mateix (25 d’octubre de 2006), els plans estratègics de subvencions o dels plans i programes sectorials vigents s’adaptaran a allò establert en el mateix.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La Llei 38/2003, de 17 de novembre, General de Subvencions, suposa un pas més en el procés de perfeccionament i racionalització del sistema econòmic. Un dels principis que regeix la Llei és el de la transparència que, junt amb la gran varietat d’instruments que s’articulen en la Llei, afecta de forma directa en un increment dels nivells d’eficàcia i eficiència en la gestió de la despesa pública subvencional.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En aquest aspecte, una major informació sobre les subvencions farà possible eliminar les distorsions i interferències que puguin afectar al mercat, a més de facilitar la complementarietat i coherència de les actuacions de les diferents Administracions Públiques evitant qualsevol tipus de solapament.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Per millorar l’eficàcia, en la Legislació es preveu que es procedeixi a elaborar un Pla Estratègic de Subvencions - instrument d’organització de les polítiques públiques que té com a finalitat el foment d’una activitat d’utilitat pública o interès social o de promoció d’una finalitat púbica - amb caràcter previ al naixement de les subvencions.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Per això, aquest Ajuntament aprova el Pla Estratègic de Subvencions l’articulat del qual figura tot seguit.</span></p> <p align="center"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>CAPÍTOL I</strong><br /> <strong>DISPOSICIONS GENERALS</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 1.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’establiment de subvencions per part d’aquest Ajuntament durant el període de 2016 s’ajustarà allò que preveu aquest Pla.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 2.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’establiment efectiu de les subvencions previstes en aquest Pla requerirà la inclusió de les consignacions corresponents en els Pressupostos municipals de cada any i l’aprovació de les Ordenances que contenguin les bases reguladores de la seva concessió.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 3.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’establiment de subvencions queda supeditat al compliment dels objectius d’estabilitat pressupostària, fet pel qual les consignacions pressupostàries que s’aprovin i les bases reguladores de la seva concessió s’acomodaran en cada moment a aquests objectius.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 4.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’aprovació del Pla Estratègic de Subvencions no suposa la generació de cap dret a favor dels potencials beneficiaris, que no podran exigir cap indemnització o compensació en cas que el Pla no se porti a la pràctica en el seus propis termes.</span></p> <p align="center"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>CAPÍTOL II</strong><br /> <strong>BENIFICIARIS I MATÈRIES EN QUÈ S’ESTABLIRAN SUBVENCIONS</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 5.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’Ajuntament concedirà subvencions a favor de persones o Entitats privades amb la finalitat de fomentar la realització d’activitats d’utilitat pública o interès social o per promoure la consecució de fins públics atribuïts a la competència local.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 6.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’Ajuntament estableix per a l’any 2016 els següents objectius estratègics:</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Foment de la cultura: Música, cultura popular, manteniment i conservació de la cultura del municipi.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Millorar la qualitat educativa.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">3. Ajudar a les famílies per cobrar les despeses de material escolar i llibres de text.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">4. Foment de l’esport: Pràctiques esportives, associacionisme esportiu.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">5. Acció social: Suport econòmic a persones necessitades, a famílies amb menors en situació de risc, associacionisme i participació ciutadana.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">6. Foment de l'activitat empresarial i del treball.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">7. style="font-family:times new roman,times,serif;font-size:12px;"><strong>PREÀMBUL</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’article 8.1 de la Llei 38/2003, de 17 de novembre, té caràcter bàsic, fet pel qual tots els Ajuntaments que pretenguin atorgar subvencions han d’aprovar el seu Pla Estratègic de Subvencions corresponent.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Cal tenir en compte la disposició addicional tretzena de la Llei 38/2003, de 17 de novembre, que estableix que els plans i els programes relatius a polítiques públiques sectorials que estiguin previstes en normes legals o reglamentàries tenen la consideració de plans estratègics de subvencions i en el termini de sis mesos a partir de la seva entrada en vigor del mateix (25 d’octubre de 2006), els plans estratègics de subvencions o dels plans i programes sectorials vigents s’adaptaran a allò establert en el mateix.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La Llei 38/2003, de 17 de novembre, General de Subvencions, suposa un pas més en el procés de perfeccionament i racionalització del sistema econòmic. Un dels principis que regeix la Llei és el de la transparència que, junt amb la gran varietat d’instruments que s’articulen en la Llei, afecta de forma directa en un increment dels nivells d’eficàcia i eficiència en la gestió de la despesa pública subvencional.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En aquest aspecte, una major informació sobre les subvencions farà possible eliminar les distorsions i interferències que puguin afectar al mercat, a més de facilitar la complementarietat i coherència de les actuacions de les diferents Administracions Públiques evitant qualsevol tipus de solapament.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Per millorar l’eficàcia, en la Legislació es preveu que es procedeixi a elaborar un Pla Estratègic de Subvencions - instrument d’organització de les polítiques públiques que té com a finalitat el foment d’una activitat d’utilitat pública o interès social o de promoció d’una finalitat púbica - amb caràcter previ al naixement de les subvencions.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Per això, aquest Ajuntament aprova el Pla Estratègic de Subvencions l’articulat del qual figura tot seguit.</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>CAPÍTOL I<br /> DISPOSICIONS GENERALS</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 1.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’establiment de subvencions per part d’aquest Ajuntament durant el període de 2016 s’ajustarà allò que preveu aquest Pla.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 2.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’establiment efectiu de les subvencions previstes en aquest Pla requerirà la inclusió de les consignacions corresponents en els Pressupostos municipals de cada any i l’aprovació de les Ordenances que contenguin les bases reguladores de la seva concessió.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 3.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’establiment de subvencions queda supeditat al compliment dels objectius d’estabilitat pressupostària, fet pel qual les consignacions pressupostàries que s’aprovin i les bases reguladores de la seva concessió s’acomodaran en cada moment a aquests objectius.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 4.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’aprovació del Pla Estratègic de Subvencions no suposa la generació de cap dret en favor dels potencials beneficiaris, que no podran exigir cap indemnització o compensació en cas que el Pla no se porti a la pràctica en el seus propis termes.</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>CAPÍTOL II<br /> BENIFICIARIS I MATÈRIES EN QUÈ S’ESTABLIRAN roman,times,serif;font-size:12px;">L’Ajuntament concedirà subvencions a favor de persones o Entitats privades amb la finalitat de fomentar la realització d’activitats d’utilitat pública o interès
