2016-09-20 ![CDATA[<p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els mitjans de comunicació són un element bàsic en la configuració de les societats modernes, ja que l’existència de pluralitat informativa és essencial per mantenir la salut democràtica d’un país. Entre els mitjans de comunicació, la premsa escrita impresa és el que té més tradició dins la nostra societat, si bé darrerament han aparegut noves plataformes de difusió de continguts basades en les tecnologies digitals, les quals han obligat a redefinir el mateix concepte de premsa escrita.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">D’altra banda, qualsevol societat normal es dota de mitjans de comunicació en la seva llengua pròpia. En el cas de les Illes Balears, els anys de proscripció de la llengua catalana del sistema educatiu i la manca d’hàbit de lectura en aquesta llengua han condicionat el naixement i la consolidació de publicacions en català. Avui, quan fa anys que el català s’ha incorporat al sistema educatiu i les manifestacions escrites en aquest idioma són presents en molts d’àmbits, el nombre potencial de lectors de mitjans escrits en català ha augmentat exponencialment.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La comunicació local, en el context de la comunicació global, representa la confirmació d’una realitat que, en el temps de les tecnologies de la informació i la comunicació, suposa l’afirmació i la pervivència de la identitat històrica de les Illes Balears. L’extensió i la implementació de les xarxes que faciliten la comunicació arreu del món fan que la informació local cobri més valor perquè aporta a la mera informació el concepte d’identitat cultural, el qual expressa el sentiment de pertinença a un lloc i a una comunitat. En un món globalitzat, la informació local té un paper indiscutible.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els poders públics disposen de l’activitat subvencionadora com un instrument eficaç per fomentar aquest tipus d’oferta. La Llei 3/1986, de 29 d’abril, de normalització lingüística a les Illes Balears, té, entre d’altres, l’objectiu de fomentar l’ús de la llengua catalana en tots els mitjans de comunicació social (article 1.2&nbsp;<em>c</em>). Així mateix, d’acord amb l’article 2 de la mateixa norma, el dret de saber i usar la llengua catalana implica poder rebre informació en català a tots els mitjans de comunicació social. D’altra banda, aquesta Llei, en l’article 27, estableix que el Govern autonòmic ha de promoure el coneixement i el desenvolupament de la llengua i la cultura catalanes, especialment des de la perspectiva de les Illes Balears, en tots els mitjans de comunicació social, mentre que en l’article 32 determina que els poders públics de la Comunitat Autònoma han de donar suport econòmic als mitjans de comunicació que emprin la llengua catalana de forma habitual, i que les mesures de suport econòmic i material que adopti el Govern per fomentar els mitjans de comunicació que emprin la llengua pròpia de les Balears s’han d’aplicar amb criteris objectius i sense discriminacions, dins les previsions pressupostàries.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Cal tenir en compte, a més, que el 2 d’abril de 2009 el Consell Social de la Llengua Catalana va aprovar el Pla General de Normalització Lingüística de les Illes Balears, un dels objectius del qual és incrementar la presència del català en la premsa, diària i no diària, d’abast general i de temàtiques específiques (infantil, esportiva, de societat, etc.).</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’article 1 de l’Ordre de la consellera d’Educació i Cultura d’1 de juliol de 2009 per la qual s’estableixen les bases reguladores de les subvencions en matèria d’educació i cultura preveu, entre les matèries que poden ser objecte de subvenció, la normalització de la llengua pròpia de les Illes Balears. Així mateix, d’acord amb l’article 3 d’aquesta Ordre es poden beneficiar dels ajuts en matèria de política lingüística les persones físiques, les persones jurídiques privades, les entitats sense finalitat lucrativa i les persones jurídiques públiques (ens públics i empreses públiques que desenvolupin qualsevol de les activitats que preveu l’Ordre).</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La Conselleria de Transparència, Cultura i Esports exerceix la competència en normalització de la llengua catalana a través de la Direcció General de Política Lingüística, d’acord amb el Decret 24/2015, pel qual s’estableixen les competències i l’estructura orgànica bàsica de les conselleries de l’Administració de la Comunitat Autònoma de les Illes Balears, segons la redacció del Decret 11/2016, d’11 de maig, de la presidenta de les Illes Balears, pel qual es modifica el Decret 24/2015, de 7 d’agost.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El Pla Estratègic de Subvencions de la Comunitat Autònoma de les Illes Balears per a l’any 2016, aprovat mitjançant un acord del Consell de Govern de 12 de febrer de 2016 i modificat mitjançant un acord del Consell de Govern de 23 de juny de 2016, preveu els ajuts destinats a la premsa local i a la de temàtica especialitzada escrites en català editades a les Illes Balears que es convoquen mitjançant aquesta Resolució, a la qual són aplicables la Llei 38/2003, de 17 de novembre, general de subvencions; el Decret legislatiu 2/2005, de 28 de desembre, pel qual s’aprova el text refós de la Llei de subvencions, i el Reial decret 887/2006, de 21 de juliol, pel qual s’aprova el Reglament de la Llei 38/2003, de 17 de novembre, general de subvencions.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">S’ha de tenir en compte, així mateix, que en l’exercici de 2016 hi ha disponibilitat pressupostària per atendre les despeses que derivin d’aquesta convocatòria d’ajuts, la qual ha rebut els informes previs favorables del Servei Jurídic de la Conselleria de Transparència, Cultura i Esports i de la Direcció General de Pressuposts i Finançament, i ha estat objecte de la fiscalització prèvia limitada de la Intervenció General de la Comunitat Autònoma de les Illes Balears.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Per tot això, dict la següent</span></p> <p align="center"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>RESOLUCIÓ</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Primer</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Aprovar la convocatòria d’ajuts públics, mitjançant subvencions, destinats a la premsa local i a la de temàtica especialitzada escrites en català a les Illes Balears per a l’any 2016.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Segon</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Aprovar les bases que regeixen aquesta convocatòria, que consten en l’annex 1.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Tercer </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Fixar els models de documents que s’han de presentar per participar en la convocatòria (annexos 2 a 7).</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Quart </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Ordenar la publicació d’aquesta Resolució en el <em>Butlletí Oficial de les Illes Balears</em>.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Interposició de recursos</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Contra aquesta Resolució, que exhaureix la via administrativa, s’hi pot interposar un recurs potestatiu de reposició davant la consellera de Transparència, Cultura i Esports en el termini d’un mes comptador des de l’endemà d’haver-se publicat, d’acord amb l’article 117 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú, i l’article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l’Administració de la Comunitat Autònoma de les Illes Balears.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Contra aquesta Resolució, també s’hi pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l’endemà d’haver-se publicat, d’acord amb l’article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">&nbsp; Objecte</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1.1. L’objecte d’aquesta convocatòria de subvencions és donar suport als projectes de la premsa local i als de la premsa de temàtica especialitzada escrites en català a les Illes Balears amb la finalitat de contribuir a consolidar l’espai de comunicació que s’expressa en aquesta llengua.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1.2. L’activitat subvencionada consisteix en l’edició, dins l’any 2015, d’una publicació local o de temàtica especialitzada escrites en català en suport imprès i/o digital.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>2. Import i partida pressupostària</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2.1. L’import total destinat a aquesta convocatòria de subvencions és de 175.000 euros. Es preveu desglossar l’import de la manera següent:</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">140.000 € per a la premsa local escrita en català</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">35.000 € per a la premsa de temàtica especialitzada escrita en català</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2.2. Aquests imports s’imputen a les partides pressupostàries següents:</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">40.000&nbsp;€ amb càrrec a la partida 26401&nbsp;455B01&nbsp;47000&nbsp;00</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">135.000&nbsp;€ amb càrrec a la partida 26401&nbsp;455B01&nbsp;48000&nbsp;00</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2.3. Ambdues distribucions són orientatives i es poden modificar una vegada avaluades les sol·licituds presentades.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>3. Beneficiaris</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els beneficiaris d’aquesta convocatòria de subvencions poden ser persones físiques, empreses o entitats sense ànim de lucre amb domicili social a les Illes Balears que tenen com a activitat, única o entre d’altres, l’edició de premsa local i de temàtica especialitzada escrites en català, i agrupacions de persones físiques, comunitats de béns o qualsevol altre tipus d’unitat econòmica o patrimoni separat que, tot i no tenir personalitat jurídica, es trobin en la situació que motiva la concessió d’aquestes subvencions.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>4. Requisits de les publicacions subvencionables</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">4.1. Les subvencions que es convoquen mitjançant aquesta Resolució es destinen a publicacions locals i a publicacions especialitzades editades a les Illes Balears en suport paper i/o digital.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">4.2. Per poder beneficiar-se d’una subvenció, les publicacions han de complir els requisits següents:</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>a)&nbsp;&nbsp;&nbsp;&nbsp; </em>Estar editada en llengua catalana, és a dir, que com a mínim el 90&nbsp;% dels continguts estiguin redactats en aquest idioma, i que els textos s’ajustin a les normes de correcció lingüística.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>b)&nbsp;&nbsp;&nbsp;&nbsp; </em>Tractar de continguts d’àmbit municipal, comarcal, insular o del conjunt de les Illes Balears, en el cas de les publicacions de premsa local.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>c)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </em>Tractar continguts de temàtiques específiques (infantil, esportiva, de societat, cultural, etc.), en el cas de les publicacions de caràcter especialitzat.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>d)&nbsp;&nbsp;&nbsp;&nbsp; </em>Publicar-se en el moment en què es publiqui aquesta convocatòria.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>e)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </em>Ajustar-se a la normativa sobre la propietat intel·lectual.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>5. Publicacions no subvencionables</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Queden excloses d’aquesta convocatòria les publicacions següents:</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>a)&nbsp;&nbsp;&nbsp;&nbsp; </em>Les publicacions periodístiques de premsa diària.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>b)&nbsp;&nbsp;&nbsp;&nbsp; </em>Els treballs de recerca o de comunicació científica i els treballs de caràcter literari o artístic.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>c)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </em>Les publicacions institucionals i les editades o coeditades per entitats públiques, per entitats privades amb participació majoritària d’institucions públiques en el finançament o en el govern de l’entitat, o per entitats privades per encàrrec d’institucions públiques.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>d)&nbsp;&nbsp;&nbsp;&nbsp; </em>Els butlletins d’empreses o entitats (associacions, fundacions o similars) el contingut dels quals s’adreça principalment als membres d’una empresa, d’una entitat determinada o d’una agrupació o federació d’entitats.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>e)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </em>Les editades per partits polítics, coalicions electorals, sindicats, organitzacions empresarials, col·legis professionals i associacions professionals que s’adrecen als seus socis.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>f)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </em>Les revistes escolars.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>g)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </em>Els reclams publicitaris i, en general, totes les publicacions el contingut de les quals sobrepassi el 50&nbsp;% de publicitat pròpia o aliena.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>h)&nbsp;&nbsp;&nbsp;&nbsp; </em>Les cartelleres de ràdio i de televisió.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>i)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </em>Les editades sota la forma de blogs (blog, audioblog, <em>openblog</em> i altres) o en xarxes socials.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>j)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </em>Les editades per proveïdors d’Internet, organitzacions que tenen com a activitat principal oferir serveis d’Internet a tercers (connectivitat, allotjament, disseny de webs i d’aplicacions, etc.), conegudes generalment com a ISP (<em>Internet service provider</em>), en el desenvolupament d’aquesta activitat.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>k)&nbsp;&nbsp;&nbsp;&nbsp; </em>Els suplements, és a dir, les publicacions que es distribueixen de manera conjunta amb una altra, encara que tenguin preu, numeració, data i capçalera propis.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>l)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </em>Les que tenguin continguts violents o discriminatoris.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>m)&nbsp;&nbsp; </em>Les editades per persones físiques, empreses, entitats sense ànim de lucre, agrupacions de persones físiques, comunitats de béns o qualsevol altre tipus d’unitat econòmica o patrimoni separat que, en finalitzar el termini de presentació de sol·licituds, tenguin pendent de complir qualsevol obligació assumida en la seva condició de beneficiàries d’altres ajuts concedits per al mateix objecte previst en aquesta Resolució.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>6. Despeses subvencionables</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Són subvencionables les despeses derivades de les tasques de redacció, edició, comercialització, publicitat i promoció, així com les derivades de la impressió i la distribució de la publicació impresa i les derivades de la publicació i la distribució de la publicació digital.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>7. Període d’imputació de les despeses</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Es poden subvencionar les despeses que s’hagin produït durant el període en què s’hagi dut a terme l’activitat subvencionable, que ha de quedar inclòs entre l’1 de gener i el 31 de desembre de 2015.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>8. Sol·licituds</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">8.1. S’ha de presentar una sol·licitud de subvenció per capçalera, entenent que una mateixa capçalera es pot publicar en suport imprès, inclòs el format electrònic, i/o en suport digital. Cada sol·licitud ha d’especificar el tipus de publicació (local o de temàtica especialitzada) per a la qual demana l’ajut, ja que no es poden acumular dos ajuts per a una mateixa capçalera.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">8.2. Les sol·licituds de subvenció s’han d’adreçar a la Direcció General de Política Lingüística segons el model que es proporciona en l’annex 2 i que es troba disponible a la seu d’aquesta Direcció General i a la pàgina web &lt;http://dgpoling.caib.cat&gt;.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">8.3. El termini per presentar les sol·licituds és de vint dies naturals comptador a partir de l’endemà d’haver-se publicat aquesta Resolució en el <em>Butlletí Oficial de les Illes Balears</em>. Les sol·licituds, i tota la documentació adjunta, s’han de presentar al Registre de la Conselleria de Transparència, Cultura i Esports, o bé als llocs que preveu l’article 38.4 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>9. Aquest document es troba a disposició dels sol·licitants a les oficines de la Direcció General de Política Lingüística (c. d’Alfons el Magnànim, 29, 1a planta, 07004 Palma) i a la web &lt;http://dgpoling.caib.cat&gt;. Si els sol·licitants han acreditat la veracitat de les dades bancàries a l’Administració anteriorment, no cal que ho tornin a fer.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">-&nbsp;&nbsp;&nbsp; Documentació relativa al compliment de les obligacions tributàries i amb la Seguretat Social:</span></p> <p style="margin-left:36.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>l)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </em>Una declaració de no estar sotmès a les prohibicions per ser beneficiari de la subvenció (annex 5).</span></p> <p style="margin-left:36.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>m)&nbsp;&nbsp; </em>Una autorització perquè la Conselleria de Transparència, Cultura i Esports efectuï les consultes telemàtiques necessàries a l’Agència Estatal de l’Administració Tributària i a la Tresoreria General de la Seguretat Social per comprovar que el sol·licitant es troba al corrent de les seves obligacions amb la Hisenda de la Comunitat Autònoma, de conformitat amb l’article 38.1 del Decret 75/2004, de 27 d’agost, de desplegament de determinats aspectes de la Llei de finances i de les lleis de pressuposts generals de la Comunitat Autònoma de les Illes Balears.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">-&nbsp;&nbsp;&nbsp; Documentació relativa al cost de les actuacions subvencionables:</span></p> <p style="margin-left:36.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>n)&nbsp;&nbsp;&nbsp;&nbsp; </em>Una relació de despeses subvencionables imputables al període en què s’ha duit a terme l’activitat dins l’any 2015. Aquestes despeses, que són l’import màxim que l’empresa o l’entitat sol·licitant pot percebre si se li concedeix la subvenció, s’han de desglossar per conceptes, amb una descripció detallada de cadascun dels conceptes.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>10. Obligacions dels beneficiaris</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">10.1. Els beneficiaris han de complir les obligacions següents:</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>a)&nbsp;&nbsp;&nbsp;&nbsp; </em>Acreditar davant la Conselleria de Transparència, Cultura i Esports, dins el termini que estableix la base 16, que l’activitat s’ha duit a terme i que s’han complert els requisits i les condicions que determinen la concessió de la subvenció.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>b)&nbsp;&nbsp;&nbsp;&nbsp; </em>Sotmetre’s a les actuacions de comprovació dels òrgans administratius de control financer i facilitar-los tota la informació que els requereixin.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>c)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </em>Deixar constància de la percepció i l’aplicació de la subvenció en la comptabilitat o en els llibres de registre de l’empresa o l’entitat, o, en el cas de no estar obligats a tenir-ne, en la documentació que els substitueixi.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>d)&nbsp;&nbsp;&nbsp;&nbsp; </em>Destinar l’import de la subvenció al finançament de la publicació objecte de l’ajut.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>e)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </em>Mantenir la publicació durant un període mínim de sis mesos a partir de la concessió de la subvenció i, durant aquest període, reflectir-hi la col·laboració de la Direcció General de Política Lingüística mitjançant la inclusió en la publicació del logotip institucional de la Direcció General, que es pot descarregar de la pàgina web &lt;http://mic.caib.cat&gt;.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">10.2. La constatació de l’incompliment d’alguna de les obligacions previstes en les lletres <em>a</em>, <em>b</em>, <em>c</em> i <em>d</em> de l’apartat anterior comporta el reintegrament de les quantitats percebudes. Si s’incompleix l’obligació prevista en la lletra <em>e</em>, s’ha de reintegrar la part de la subvenció percebuda proporcional a la fracció dels sis mesos en què el mitjà ha deixat de publicar-se.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>11. Comissió d’Avaluació</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">11.1. De conformitat amb l’article 9 de l’Ordre de la consellera d’Educació i Cultura d’1 de juliol de 2009 per la qual s’estableixen les bases reguladores de les subvencions en matèria d’educació i cultura, en relació amb l’article 19 del Text refós de la Llei de subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre, s’ha de constituir una comissió d’avaluació perquè examini les sol·licituds d’acord amb els criteris i els requisits establerts en aquesta convocatòria i emeti l’informe, degudament motivat, que ha de servir de base per elaborar la proposta de resolució.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">11.2. La Comissió d’Avaluació ha de tenir la composició següent:</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">-&nbsp;&nbsp;&nbsp; La presidenta, que és la directora general de Política Lingüística.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">-&nbsp;&nbsp;&nbsp; Tres vocals nomenats per la directora general de Política Lingüística entre els funcionaris d’aquesta Direcció General.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">-&nbsp;&nbsp;&nbsp; Un secretari, nomenat per la directora general de Política Lingüística entre el personal d’aquesta Direcció General.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>12. Règim del procediment i òrgan instructor</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">12.1. El procediment per concedir aquestes subvencions s’ha de tramitar en règim de concurrència competitiva d’acord amb les línies desglossades en la base 2.1, de conformitat amb l’article 17.1 del Text refós de la Llei de subvencions i amb l’article 6.1 de les bases reguladores de les subvencions en matèria d’educació i cultura, amb la finalitat de comparar en un únic procediment totes les sol·licituds presentades i d’establir una prelació entre aquestes sol·licituds d’acord amb els criteris de valoració fixats en l’apartat 14 d’aquesta convocatòria.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">12.2. L’òrgan competent per instruir el procediment de tramitació de les sol·licituds és la Direcció General de Política Lingüística.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>13. Esmena d’errors en les sol·licituds</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">13.1. Una vegada que la Comissió d’Avaluació hagi revisat totes les sol·licituds rebudes, ha d’elaborar una llista provisional d’admesos i exclosos, amb indicació de la causa d’exclusió provisional. Aquesta llista s’ha de publicar a la pàgina web de la Direcció General de Política Lingüística (&lt;http://dgpoling.caib.cat&gt;) i al tauler d’anuncis de la Conselleria de Transparència, Cultura i Esports.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">13.2. Els interessats disposen de deu dies hàbils a partir de l’endemà de la publicació de la llista provisional per esmenar les deficiències detectades en la seva sol·licitud. Les esmenes s’han de presentar als mateixos llocs que s’indiquen en l’apartat 8.2 d’aquesta convocatòria.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">13.3. D’acord amb el que disposa l’article 5.5 de les bases reguladores de les subvencions en matèria d’educació i cultura, en el cas que els interessats no esmenin les deficiències de la seva sol·licitud en el termini fixat, es considerarà que desisteixen de la seva petició.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>14. Criteris d’assignació i límits de les subvencions</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">14.1. Una vegada esmenades les deficiències de les sol·licituds i comprovat quines de les presentades dins termini compleixen els requisits prevists tant en aquesta convocatòria com en les lleis i les bases que la regulen, la Comissió d’Avaluació ha d’emetre un informe amb l’import de la subvenció que ha de rebre cada beneficiari. L’import cert que s’ha de destinar a cada sol·licitant amb dret a percebre la subvenció s’ha de calcular d’acord amb la puntuació que cadascun obtengui a partir del barem especificat en el punt següent, d’acord amb la fórmula següent:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">IC_Bx = [P_Bx / ∑ P_Bx...n] x 140.000&nbsp;€, en el cas de la premsa local</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">IC_Bx = [P_Bx / ∑ P_Bx...n] x 35.000&nbsp;€, en el cas de la premsa de temàtica especialitzada</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">On IC_Bx és l’import cert que s’ha de destinar al beneficiari X; P_Bx és la puntuació obtinguda pel beneficiari X aplicant el barem que es detalla en el punt 14.2, i ∑ P_Bx-nés el resultat de sumar les puntuacions obtingudes per tots els sol·licitants amb dret a subvenció aplicant el mateix barem.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">14.2. L’import màxim que pot rebre cada beneficiari és de 5.000&nbsp;€ per suport amb què s’editi la publicació (imprès o digital). En el cas que la publicació impresa distribueixi una edició electrònica, el màxim per aquest suport és de 7.500 €.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">14.4. D’acord amb l’article 20 del Text refós de la Llei de subvencions, l’import concedit no pot ser, en cap cas, una quantitat que, aïlladament o en concurrència amb ajuts de la mateixa Administració o d’altres entitats públiques o privades, superi el cost de l’activitat duita a terme per l’empresa o l’entitat beneficiària.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>15. Proposta de resolució, resolució i notificació</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">15.1. L’informe emès per la Comissió d’Avaluació després d’examinar i avaluar les sol·licituds ha de servir de base a la proposta de resolució de la directora general de Política Lingüística, la qual ha d’incloure la llista de beneficiaris als quals es proposa atorgar una subvenció, els punts obtinguts per cadascun i la quantia d’aquesta, així com la relació de sol·licituds excloses, amb indicació de la causa d’exclusió. La proposta de resolució s’ha de publicar a la pàgina web de la Direcció General (&lt;http://dgpoling.caib.cat&gt;) i als taulers d’anuncis de la Conselleria de Transparència, Cultura i Esports.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">15.2. Una vegada publicada la proposta de resolució els beneficiaris han de comunicar a la Direcció General de Política Lingüística si accepten la subvenció o hi renuncien. En qualsevol cas, si en el termini de cinc dies hàbils des de la publicació de la proposta de resolució el beneficiari no fa constar el contrari, s’entendrà que accepta la subvenció que se li ha adjudicat.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">15.3. A partir de la proposta de resolució de la directora general de Política Lingüística, la consellera de Transparència, Cultura i Esports ha de dictar la resolució de concessió definitiva, en la qual han de figurar la relació de beneficiaris als quals s’ha concedit la subvenció, els punts obtinguts per cadascun i les quantitats assignades, amb indicació de la partida pressupostària a la qual s’imputen aquestes quantitats, així com la relació dels sol·licitants als quals s’ha denegat l’ajut, amb indicació del motiu de la denegació.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">15.4. La resolució de concessió definitiva s’ha de dictar i publicar en el <em>Butlletí Oficial de les Illes Balears </em>en el termini de tres mesos comptadors des de la data d’acabament del termini per presentar les sol·licituds fixat en la base 8 d’aquesta convocatòria. Mitjançant la publicació de la resolució en el BOIB s’entén complert el tràmit de notificació a les persones interessades. Contra la resolució de concessió, que exhaureix la via administrativa, s’hi pot interposar un recurs potestatiu de reposició en el termini d’un mes comptador des de l’endemà d’haver-se publicat, o bé un recurs contenciós administratiu davant la Sala Contenciosa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l’endemà de la data de publicació.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>16. Justificació i pagament de la subvenció</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">16.1. Els beneficiaris de les subvencions disposen de vint dies naturals comptadors des de la data en què se’ls hagi notificat la resolució de concessió per aportar el compte justificatiu que figura en l’annex 7 degudament emplenat i acompanyat amb la documentació, la qual, d’acord amb la base 7 d’aquesta convocatòria, ha de referir-se exclusivament a actuacions i despeses duites a terme dins l’any 2015 i que corresponguin a despeses produïdes durant el període en què s’ha duit a terme l’activitat subvencionada; així, han d’aportar la documentació següent:</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>a)&nbsp;&nbsp;&nbsp;&nbsp; </em>Una memòria descriptiva que permeti comprendre les actuacions efectivament duites a terme, amb tota la informació necessària per interpretar correctament la justificació de despeses presentada i la imputació de les despeses a cada concepte.</span></p> <p style="margin-left:18.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>b)&nbsp;&nbsp;&nbsp;&nbsp; </em>La documentació justificativa de les despeses, que han de ser originals o bé còpies compulsades de les factures o altres documents de valor probatori equivalent. Aquesta documentació s’ha d’ajustar a les previsions establertes en el Reial decret 1496/2003, de 28 de novembre, pel qual s’aprova el Reglament pel qual es regulen les obligacions de facturació, i es modifica el Reglament de l’impost sobre el valor afegit. Si el beneficiari està exempt d’aquest impost, d’acord amb els articles 13, 14, 18 i 20 de la Llei 37/1992, de 28 de desembre, de l’impost sobre el valor afegit, ha de presentar el certificat que ho acrediti de la secció corresponent de l’Agència Tributària.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">16.2. Les factures originals i altres documents de valor probatori equivalent han de ser estampillats per la Conselleria de Transparència, Cultura i Esports i s’hi ha d’indicar l’import de la factura que justifica la subvenció. El pagament de les factures s’ha d’acreditar mitjançant un document, extracte o certificat bancari pel qual quedi provat que el beneficiari ha pagat efectivament les despeses justificades.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">16.3. En el cas que es detectin defectes en la documentació justificativa, s’ha de requerir els beneficiaris que els esmenin. Aquests disposen de deu dies hàbils, a partir del moment en què rebin el requeriment, per aportar la documentació que calgui per corregir les deficiències.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">16.4. L’import de la subvenció només s’ha d’abonar una vegada que el beneficiari hagi justificat que ha duit a terme les actuacions que fonamenten la concessió de l’ajut i les despeses que aquesta actuació ha suposat.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>17. Control</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">17.1. Els beneficiaris queden sotmesos a les mesures de fiscalització i control i al deure de col·laboració que preveuen els articles 48 i 49 del Text refós de la Llei de subvencions, així com als controls establerts en la legislació de finances i pressuposts de la Comunitat Autònoma de les Illes Balears quant a la concessió i el control dels ajuts públics. A més, han de facilitar tota la informació que els requereixin la Sindicatura de Comptes o altres òrgans de control extern.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">17.2. L’ocultació de qualsevol informació sobre els requisits de les publicacions o el compliment de les obligacions de les empreses o entitats beneficiàries dóna lloc a la revocació de la subvenció concedida en els termes prevists en la base 18.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">17.3. Per intensificar el control a fi d’evitar el frau en les declaracions encaminades a obtenir ajuts, l’Administració pot determinar si s’ha produït l’ocultació a què es refereix el paràgraf anterior per qualsevol mitjà de prova; en particular, mitjançant les dades que estiguin a l’abast de les administracions públiques.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>18. Revocació de la subvenció concedida</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">D’acord amb l’article 43 del Text refós de la Llei de subvencions, la subvenció s’ha de revocar quan, posteriorment a la resolució de concessió, l’empresa o l’entitat beneficiària incompleixi totalment o parcialment les obligacions o els compromisos concrets als quals està condicionada l’eficàcia de l’acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, l’acte de concessió queda sense efecte totalment o parcialment, i s’han de reintegrar les quantitats percebudes indegudament.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>19. Reintegrament de les subvencions concedides</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">19.1. Si es produeix alguna de les circumstàncies previstes en l’article 44 del Text refós de la Llei de subvencions, els beneficiaris tenen l’obligació de reintegrar, de manera total o parcial, les quantitats percebudes, juntament amb l’interès de demora calculat des del moment del pagament de la subvenció fins a la data de la resolució per la qual es determina el reintegrament.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">19.2. Les quantitats reintegrables tenen la consideració d’ingressos de dret públic i poden ser exigides per la via de constrenyiment.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>20.
