El 15 d’agost de 2016, la cap del Departament de Formació i Selecció, una vegada elaborat el Pla de Formació de Seguretat i Emergències, que inclou l’oferta de cursos de les àrees de policia, emergències, seguretat, bombers i protecció civil per al segon semestre de l’any 2016, i les instruccions aplicables, va emetre un informe proposta sobre aquesta oferta, amb la finalitat d’aprovar la convocatòria corresponent.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">2. En la sessió de 8 de setembre de 2016, el Consell de Direcció, en exercici de la funció que estableix l’article 11.2 <em>e</em> del Decret 31/2012, de 13 d’abril, pel qual s’aproven els Estatuts de l’Escola Balear d’Administració Pública, va aprovar el Pla de Formació de Seguretat i Emergències, que inclou l’oferta de cursos per al segon semestre de l’any 2016 dirigits al personal de les àrees de policia, emergències, seguretat, bombers i protecció civil (annex 1), i les instruccions per les quals es regeixen aquests cursos (annexos 2 i 3).</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Fonaments de dret</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">1. D’acord amb el que estableix l’article 12 de la Llei 3/2007, de 27 de març, de la funció pública de la Comunitat Autònoma de les Illes Balears, correspon a l’Escola Balear d’Administració Pública (EBAP) la formació, la capacitació i el perfeccionament del personal al servei de l’Administració autonòmica i de les entitats que en depenen. Així mateix, aquesta norma afegeix que, en els termes que s’estableixin, correspon a l’EBAP la realització d’activitats formatives i de selecció del personal al servei de les altres administracions de l’àmbit territorial de les Illes Balears.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">2. L’article 1 del Decret 191/1996, de 25 d’octubre, pel qual es regulen les condicions generals de les activitats formatives que organitza la Conselleria d’Interior (actualment, Conselleria d’Hisenda i Administracions Públiques), indica que l’Institut Balear d’Administració Pública (actualment, Escola Balear d’Administració Pública) és el principal instrument de la política formativa de l’Administració pública de les Illes Balears, i elabora periòdicament diferents plans de formació que responen als principis d’eficàcia i de qualitat de les activitats formatives, amb la finalitat d’afavorir la participació del personal al servei de l’Administració.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">3. L’article 5.9 del Decret 31/2012, de 13 d’abril, pel qual s’aproven els Estatuts de l’Escola Balear d’Administració Pública, inclou, entre les seves funcions, la promoció, l’organització i la gestió de la formació de capacitació, reciclatge i perfeccionament del personal dels cossos de policia local i, si escau, autonòmica; dels integrants dels serveis de prevenció i extinció d’incendis; del voluntariat de protecció civil; del personal de salvament i de rescat, i dels serveis públics d’emergències sanitàries extrahospitalàries en l’àmbit territorial de la comunitat autònoma de les Illes Balears.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4. L’article 28.1 de Llei 4/2013, de 17 de juliol, de coordinació de les policies locals de les Illes Balears disposa que, d’acord amb l’article 3 d’aquesta llei, correspon a la conselleria competent en matèria de coordinació de policies locals, mitjançant l’Escola Balear d’Administració Pública, l’exercici de les competències relacionades amb la formació dels membres dels cossos de policia local per assegurar-ne l’homogeneïtzació i la coordinació, a més d’altres que tengui atribuïdes.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">5. La Llei 59/2003, de 19 de desembre, de signatura electrònica, regula aquest tipus de signatura, la seva eficàcia jurídica i la prestació de serveis de certificació.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">D’acord amb les atribucions que m’atorga l’article 9 del Decret 31/2012, dict la següent</span></span></p> <p style="text-align: center;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>RESOLUCIÓ</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">1. Aprovar la convocatòria de cursos que s’ofereixen al personal de les àrees de policia, emergències, seguretat, bombers i protecció civil de les Illes Balears segons el Pla de Formació de Seguretat i Emergències aprovat pel Consell de Direcció de l’EBAP per al segon semestre de l’any 2016, d’acord amb el que estableix l’annex 1 d’aquesta Resolució.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">2. Publicar les instruccions generals que regeixen el desenvolupament d’aquest pla de formació, aprovades pel Consell de Direcció, d’acord amb el que estableix l’annex 2 d’aquesta Resolució.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">3. Publicar les instruccions específiques que regeixen el desenvolupament d’aquest pla de formació, aprovades pel Consell de Direcció, d’acord amb el que estableix l’annex 3 d’aquesta Resolució.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4. Publicar aquesta Resolució en el <em>Butlletí Oficial de les Illes Balears</em>.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Interposició de recursos </strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">Contra aquesta Resolució —que exhaureix la via administrativa— es pot interposar un recurs potestatiu de reposició davant la presidenta de l’EBAP en el termini d’un mes, comptador a partir de l’endemà d’haver-se publicat en el <em>Butlletí Oficial de les Illes Balears</em>, d’acord amb l’article 117 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú, i l’article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l’Administració de la Comunitat Autònoma de les Illes Balears.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos, comptadors des de l’endemà d’haver-se publicat aquesta Resolució en el <em>Butlletí Oficial de les Illes Balears</em>, d’acord amb l’article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; El període d’inscripció estarà relacionat amb les dates del curs, i es concedirà un mínim de set dies naturals per poder inscriure’s a l’activitat formativa.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">3.3. Són d’aplicació a aquests plans de formació les noves formes d’inscripció a les accions formatives —modalitat d’inscripció de «darrer minut»—, aprovades mitjançant la Resolució de la presidenta de l’EBAP d’11 de juliol de 2009 (BOIB núm. 110, de 30 de juliol de 2009).</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punt 4. Material didàctic dels cursos</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4.1. És d’aplicació a aquests plans de formació la Instrucció del gerent de l’Escola Balear d’Administració Pública (EBAP) de 2 de novembre de 2011 per la qual l’EBAP deixa de reproduir material didàctic en format de paper i en format de CD per als cursos que organitza. Llevat d’excepcions degudament justificades, el material didàctic dels cursos es publicarà en el repositori de material que hi ha a la pàgina web &lt;http://ebap.caib.es&gt;.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4.2. En cap cas, el material didàctic no s’enviarà per correu electrònic. Transcorregut un mes des que acabi el curs, el material didàctic s’eliminarà del repositori.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punt 5. Llistes de persones admeses </strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">5.1. L’EBAP publicarà a la pàgina web &lt;http://ebap.caib.es&gt; la llista de persones admeses i també comunicarà individualment l’admissió mitjançant l’adreça electrònica adscrita al número de registre de personal o, si escau, l’adreça electrònica facilitada en la sol·licitud en paper o en la matrícula per Internet.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">5.2. En el cas que les persones sol·licitants hagin canviat d’adreça electrònica, n’han d’informar l’EBAP. També han d’informar l’EBAP si ja no és operativa l’adreça electrònica que facilitaren en un principi.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">5.3. En el cas dels empleats públics de la Comunitat Autònoma de les Illes Balears, l’admissió als cursos, sigui quin sigui l’horari d’impartició, no suposa cap autorització de l’EBAP per a deixar el lloc de feina si el curs coincideix amb l’horari laboral. </span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punt 6. Anul·lació i modificació dels cursos i resolució de casos especials</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">6.1. L’EBAP, per desenvolupar millor les funcions que té encomanades, pot suprimir cursos, organitzar-ne de no programats amb anterioritat per necessitats puntuals que hagin sorgit, efectuar-ne diverses edicions sempre que les circumstàncies ho aconsellin així, i modificar-ne, si és pertinent, els continguts, la durada, les dates i els programes anunciats per a adaptar-los als requeriments de la formació.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">6.2. Correspon a la cap del Departament de Formació i Selecció de l’EBAP, a proposta dels caps d’estudis corresponents, i una vegada consultat el Servei Jurídic de l’EBAP, resoldre els dubtes, les confusions o les incidències que puguin sorgir sobre l’aplicació d’aquestes instruccions, o sobre els casos concrets que no s’hi prevegin o sorgeixin de manera excepcional.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">6.3. Els comportaments i les actituds dels participants que impedeixin que els cursos es desenvolupin amb normalitat podran donar lloc a l’exclusió del alumnes, o a modificar o cancel·lar els cursos, amb l’informe justificatiu de la cap del Departament de Formació i Selecció de l’EBAP, a proposta dels caps d’estudis corresponents.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punt 7. Llista d’espera</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">7.1. En totes les activitats formatives es poden establir places de reserva per a cobrir les baixes o les renúncies que hi hagi. La llista d’espera es publicarà a la pàgina web &lt;http://ebap.caib.es&gt; en el moment de la selecció, i s’actualitzarà, permanentment, de manera interna.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">7.2. En qualsevol cas, correspon a l’EBAP la confirmació i la comunicació de l’admissió a un curs.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punt 8. Obligació d’assistència i comunicació de baixa. Penalització</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>8.1. Modalitat presencial</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">8.1.1 Amb la sol·licitud es contreu l’obligació d’assistir o accedir a l’activitat formativa, segons la modalitat d’impartició. Si no es pot assistir a un curs, s’ha de comunicar per escrit a l’EBAP i s’ha de justificar, com a mínim, cinc dies hàbils abans de començar-lo. El fet de no comunicar una baixa serà causa d’exclusió, durant un any, per a altres cursos que l’EBAP organitzi amb posterioritat.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">Això no obstant, l’assistència a un mínim del 50&nbsp;% de l’activitat formativa no representa motiu de penalització.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">8.1.2. Les absències superiors als límits fixats (20&nbsp;%), encara que estiguin justificades, suposen la pèrdua del dret a obtenir el certificat d’assistència i el certificat d’aprofitament que es regulen en el punt 10 d’aquestes instruccions.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">8.1.3. Les persones admeses tenen l’obligació d’assistir a la primera hora del primer dia del curs. En el cas que no hi assisteixin sense haver-ho justificat prèviament a l’EBAP, la seva plaça podrà ser ocupada per persones que hi assisteixin en la modalitat de «darrer minut», d’acord amb el que estableix la Resolució de la presidenta de l’EBAP d’11 de juliol de 2009.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">8.1.4. Les persones en la situació d’incapacitat temporal —excepte les que estan en situació de llicència per maternitat o paternitat i excedència per maternitat o paternitat, o cura de familiars— no poden assistir a cap de les activitats formatives dels plans de Formació Policial; de Voluntaris de Protecció Civil, i de Seguretat, Emergències i Bombers, que hi ha en l’annex 1 d’aquesta Resolució. Aquesta circumstància s’ha de comunicar per escrit, perquè, si escau, es pugui cobrir la plaça vacant amb una altra persona i per a evitar la penalització.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>8.2. Modalitat en línia</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">Els cursos de la modalitat en línia corresponents al Pla de Formació Policial; al Pla de Formació de Seguretat, Emergències i Bombers, i al Pla de Formació de Voluntaris de Protecció Civil de 2016 es regeixen per les instruccions del Pla de Formació General i de Formació Sectorial de 2016.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punt 9. Nombre de persones assistents</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">9.1. En general, els cursos han de tenir entre quinze i trenta alumnes. Aquesta xifra pot augmentar o disminuir només en el cas que la matèria del curs o l’estructura de l’activitat formativa ho permetin o recomanin.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">9.2. Es poden suspendre els cursos que tenguin un nombre d’inscrits i no exclosos inferior al 70&nbsp;% de les places ofertes o menys de quinze persones inscrites i no excloses a Mallorca; o inferior al 70&nbsp;% o menys de deu persones inscrites i no excloses a Menorca i a Eivissa; o inferior al 70&nbsp;% o menys de set persones inscrites i no excloses a Formentera.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punt 10. Certificats d’aprofitament o d’assistència</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">10.1. Les activitats objecte d’aquesta convocatòria donen lloc a obtenir el certificat d’assistència o d’aprofitament, segons correspongui.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">10.2. Certificat d’assistència</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">10.2.1. El certificat d’assistència es lliurarà als alumnes que acreditin una assistència, com a mínim, del 80 % de les hores lectives del curs. No es computaran les signatures dels assistents que corresponguin als dies en què la persona interessada hagi estat en la condició d’incapacitat temporal.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">10.2.2. L’única forma de demostrar l’assistència a un curs és mitjançant la signatura; per això, els alumnes s’han d’assegurar que han signat el full de control d’entrada i de sortida de cada una de les sessions del curs a què assisteixin.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">10.2.3. D’altra banda, la falsificació de la signatura suposa la pèrdua del dret a certificat i l’exclusió dels cursos de l’EBAP durant un any. En qualsevol cas, la signatura ha de coincidir amb la del DNI o amb la de la sol·licitud d’inscripció. La penalització es farà extensible a la persona autora de la falsificació, independentment de totes les altres accions que s’ajustin al dret que es puguin dur a terme.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">10.2.4. En cap cas, els cursos de la modalitat en línia no donen lloc a obtenir el certificat d’assistència.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">10.3. Certificat d’aprofitament</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">L’obtenció del certificat d’aprofitament obliga a demostrar el coneixement de les matèries del curs. Aquest coneixement serà avaluat mitjançant la superació de proves escrites o orals, treballs o altres exercicis relacionats amb el contingut de l’activitat formativa, o mitjançant l’avaluació continuada certificada pel professorat.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">10.4. Avaluació de la transferència</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">L’EBAP pot establir els mecanismes necessaris per a avaluar la transferència de la formació al lloc de treball de l’alumnat, amb l’objectiu de valorar la contribució de la formació a la millora de l’acompliment individual i organitzacional.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punt 11. Llista de persones amb dret al certificat d’aprofitament o al certificat d’assistència. Sol·licitud de certificat i reclamacions</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">11.1. En el termini d’un mes, comptador des de l’acabament del curs, l’EBAP publicarà a la pàgina web &lt;http://ebap.caib.es&gt; la llista de persones participants que tenen dret al certificat d’assistència o al certificat d’aprofitament.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">11.2. Es poden presentar reclamacions en el termini de trenta dies naturals, comptadors a partir de l’endemà d’haver estat publicada la llista de persones participants que tenen dret al certificat d’assistència o al certificat d’aprofitament. Una vegada finalitzat aquest termini i resoltes les reclamacions, l’acta del curs serà definitiva.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">11.3. Per a matricular-s’hi, s’ha d’accedir a la pàgina web &lt;http://ebap.caib.es&gt;; a continuació, s’ha d’accedir a &lt;Plans de formació de l’EBAP 2016&gt;; a continuació, s’ha d’accedir al pla específic; finalment, s’ha d’accedir a la matriculació mitjançant la fitxa de cada curs.</span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><em>b)</em> Mitjançant l’imprès habilitat a aquest efecte, en el qual ha de fer constar totes les dades que es demanen, inclosa l’adreça electrònica, que és l’eina per a comunicar l’admissió als cursos. La manca de dades pot ser motiu d’exclusió. Les sol·licituds s’han de presentar en el Registre General de l’EBAP, en el de la Conselleria d’Hisenda i Administracions Públiques, o d’acord amb qualsevol de les formes que determina la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú.</span></span></p> <div style="page-break-after: always;"> <span style="display: none;">&nbsp;</span></div> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punt 2. S’ha d’emplenar la sol·licitud completament, inclosa l’adreça de correu electrònic, que és l’eina que s’utilitza per a comunicar l’admissió als cursos de formació. S’ha d’escriure el codi complet del curs. No s’admetrà cap sol·licitud sense les dades professionals de la persona. En cas de no trobar-se en situació d’actiu, s’han de consignar les dades de la darrera situació professional. </span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">2.2. En el moment d’emplenar la sol·licitud, s’ha de signar una declaració de responsabilitat sobre la veracitat de les dades consignades inclosa en el mateix tràmit telemàtic, o en l’imprès de sol·licitud.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">2.3. Els requisits d’alguns cursos s’han d’acreditar juntament amb la sol·licitud i de manera individualitzada. Quan el requisit faci referència a la necessitat de presentar una proposta de la prefectura, la proposta ha de preveure una justificació sobre la idoneïtat de l’alumne o l’alumna per al curs en qüestió.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">2.4. En cas de presentar-se la sol·licitud per via telemàtica, aquesta documentació s’ha de presentar a l’EBAP o mitjançant correu electrònic.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punt 3. Requisits i condicions preferents</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">3.1. Quan el pla de formació estableixi persones destinatàries preferents per a participar en l’activitat formativa, l’EBAP comprovarà que les persones interessades compleixen les condicions preferents. En cas de no haver-hi aspirants suficients, l’EBAP podrà fer extensiva l’activitat formativa a aspirants que no compleixin les condicions preferents, però que tenguin un perfil que s’adeqüi al contingut del curs.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">3.2. Quan un curs estableixi un requisit excloent per a participar en l’activitat formativa, no s’admetran les sol·licituds de les persones interessades que no el compleixin.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punt 4. Selecció</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4.1. Només s’admetran les sol·licituds que compleixin els requisits que estableix la convocatòria corresponent.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4.2. Si el nombre de sol·licituds d’una determinada activitat supera el nombre de places previst, l’EBAP en farà la selecció corresponent.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">Els criteris de prelació de la selecció són els següents:</span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">1r. El personal adscrit a una administració local que no sigui promotora de formació.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4.3. Hi ha cursos en què s’haurà de superar una prova de selecció amb uns criteris d’avaluació determinats prèviament.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4.4. Si hi ha activitats presencials les dates de les quals coincideixin parcialment o totalment, les persones interessades només seran admeses en una activitat. Les sol·licituds s’han de presentar en el Registre General de l’EBAP, en el de la Conselleria d’Hisenda i Administracions Públiques, o d’acord amb qualsevol de les formes que determina la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punt 2. Presentació de documentació </strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">2.1. S’ha d’emplenar la sol·licitud completament, inclosa l’adreça de correu electrònic, que és l’eina que s’utilitza per a comunicar l’admissió als cursos de formació. S’ha d’escriure el codi complet del curs. No s’admetrà cap sol·licitud sense les dades de l’agrupació a la qual pertany la persona.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">2.2. En qualsevol de les dues modalitats, el cap o la cap d’agrupació ha de presentar a l’EBAP una llista del personal que proposa per a cadascun dels cursos, amb l’ordre de prelació per ser admès. Per tenir l’opció de ser admesos, el requisit és la proposta del cap o la cap d’agrupació. </span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punt 3. Requisits i condicions preferents</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">3.1. Quan el pla de formació estableixi persones destinatàries preferents per a participar en l’activitat formativa, l’EBAP comprovarà que les persones interessades compleixen les condicions preferents. En cas de no haver-hi aspirants suficients, l’EBAP podrà fer extensiva l’activitat formativa a aspirants que no compleixin les condicions preferents, però que tenguin un perfil que s’adeqüi al contingut del curs.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">3.2. Quan el curs estableixi un requisit excloent per a participar en l’activitat formativa, no s’admetran les sol·licituds de les persones interessades que no el compleixin.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punt 4. Selecció</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4.1. Només s’admetran les sol·licituds que compleixin els requisits que s’estableixen en la convocatòria corresponent.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4.2. Si el nombre de sol·licituds d’una determinada activitat supera el nombre de places previst, l’EBAP en farà la selecció corresponent.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">Els criteris de prelació de la selecció són els següents:</span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">1r. El fet que els sol·licitants no estiguin immersos en la incoació d’un expedient disciplinari.</span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">5è. El personal adscrit a una administració local que no sigui promotora de formació.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4.3. Hi ha cursos en què s’haurà de superar una prova de selecció amb uns criteris d’avaluació determinats prèviament.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4.4. Si hi ha cursos els horaris dels quals coincideixin parcialment o totalment, les persones interessades només seran admeses en un curs.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4.5. Per a matricular-s’hi, s’ha d’accedir a la pàgina web &lt;http://ebap.caib.es&gt;; a continuació, s’ha d’accedir a &lt;Plans de formació de l’EBAP 2016&gt;; a continuació, s’ha d’accedir al pla específic; finalment, s’ha d’accedir a la matriculació mitjançant la fitxa de cada curs.</span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><em>b)</em> Mitjançant l’imprès habilitat a aquest efecte, en el qual ha de fer constar totes les dades que se sol·liciten, inclosa l’adreça electrònica, que és l’eina per a comunicar l’admissió als cursos. La manca de dades pot ser motiu d’exclusió. Els requisits d’alguns cursos s’han d’acreditar juntament amb la sol·licitud i de manera individualitzada.
