Aquesta llei ha estat actualitzada per la 4/2009, de Serveis socials de les Illes Balears, essent, aquesta, l’actual marc normatiu que regula els serveis socials de l’Ajuntament.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">&nbsp;</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>TÍTOL I.- DISPOSICIONS GENERALS.-</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 1. Objecte del Reglament dels centres municipals de serveis socials </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Aquest Reglament té per objecte regular les competències, organització i funcionament dels centres municipals de serveis socials de l'Ajuntament de Palma amb la finalitat de millorar l’atenció de les necessitats socials dels ciutadans d’accés als recursos, suport a les unitats de convivència, mobilitzar recursos per l’allotjament alternatiu, prevenció i inserció social i foment de la solidaritat i cohesió de les comunitats dels barris.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 2. Organització dels serveis socials municipals</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els serveis socials municipals per poder complir la missió que li té encomanada l’Ajuntament de Palma, organitza la seva estructura en serveis centrals, centres municipals de serveis socials i serveis de Ciutat.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Integren els serveis socials la direcció política, la direcció tècnica, les unitats tècniques i la unitat administrativa.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’establiment de les directrius i les línies estratègiques de l’Àrea corresponen a la direcció político-tècnica, així com la coordinació dels recursos humans, tècnics i econòmics.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les unitats tècniques tenen com a funció la gestió de programes, el suport als centres municipals de serveis socials, la gestió directa de serveis de Ciutat i la coordinació interàrees i amb altres administracions.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Són funcions de la unitat administrativa donar suport administratiu i de manteniment de les infraestructures municipals de serveis socials.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els centres municipals de serveis socials constitueixen l’equipament fonamental per oferir els serveis socials comunitaris, dotats de recursos humans i materials necessaris per al desenvolupament de les prestacions bàsiques del sistema públic de serveis socials.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els serveis de Ciutat atenen a la població de l’àmbit territorial del municipi en funció d’unes característiques determinades i bàsicament s’identifiquen com a serveis especialitzats i específics.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 3. &nbsp;Tipologia de serveis socials</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La tipologia de serveis socials municipals a la ciutat de Palma seguint la llei 4/2009 de Serveis socials de les Illes Balears, és: serveis socials comunitaris i serveis socials especialitzats.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els serveis socials comunitaris són la porta d’entrada al sistema de serveis socials i són la garantia de proximitat a les persones usuàries i als seus àmbits personal, familiar i social.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els serveis socials especialitzats són serveis, programes o actuacions de Ciutat i adreçada a col·lectius menys nombrosos amb necessitats determinades.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 4. &nbsp;Els serveis socials comunitaris de Palma</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els serveis socials comunitaris poden ser bàsics i específics.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els serveis socials comunitaris bàsics són serveis universals i polivalents i es desenvolupen mitjançant equips interdisciplinars en els centres municipals de serveis socials amb el suport i les directrius de les unitats centrals.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els serveis socials comunitaris específics centren la seva intervenció en col·lectius vulnerables de característiques homogènies facilitant-los la inserció i la normalització social .</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 5. Titulars de dret d’accés als centres municipals de serveis socials </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Amb caràcter general són titulars de dret d’accés als serveis socials comunitaris els ciutadans de Palma inclosos a l’article 5 de la llei 4/2009 de Serveis socials de les Illes Balears i prioritàriament aquells ciutadans de Palma que es trobin en situació de necessitat social.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’accés als centres municipals de serveis socials es realitza segons el barri on viu la persona i segons aquest se li assignarà un &nbsp;centre &nbsp;determinat.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les persones sense sostre seran ateses per la xarxa d’inclusió social si bé, els centres municipals de serveis socials, si s’escau, procuraran la correcte derivació als recursos que atenen a aquest col·lectiu.</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>TÍTOL II.- L’ORGANITZACIÓ I FUNCIONAMENT DELS CENTRES MUNICIPALS DE SERVEIS SOCIALS.- </strong></span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Capítol Primer.- L’organització dels serveis socials comunitaris.- </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 6. &nbsp;El centre de serveis socials</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El centre de serveis socials respon al nivell d’atenció primària, cosa per la qual son la porta d’entrada al sistema de serveis socials i estan distribuïts &nbsp;per criteris territorials.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Cada territori que atén un centre de serveis socials es denomina sector i és una agrupació de zones estadístiques.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Des dels centres de serveis socials s’ofereixen els serveis socials comunitaris bàsics i específics, oferint, per tant, atenció social individualitzada a les demandes dels veïns de Palma i realitzant intervencions comunitàries als barris.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les funcions dels serveis socials comunitaris bàsics i específics, desenvolupades des dels centres de serveis socials, estan subjectes a la legislació sectorial vigent.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 7.&nbsp; Coordinació</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Des dels centres municipals de serveis socials es promouran acords amb altres serveis municipals territorials&nbsp; per oferir una atenció integral.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Igualment es promourà la coordinació amb altres nivells d’atenció del sistema públic així com amb les entitats, associacions i grups del territori amb la finalitat d’establir actuacions conjuntes.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 8.&nbsp; Organització territorial dels centres de serveis socials de Palma</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els serveis socials comunitaris de Palma s’organitzen territorialment en sectors i barris.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El sector és una divisió de la ciutat que respecta la integritat dels barris (zones estadístiques) i que parteix de la divisió realitzada a l’any 1985 al primer Pla des serveis socials.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El barri és la unitat bàsica sobre la qual s’organitza tota la informació territorial. El barri es correspon amb el concepte de zona estadística, definida al pla general d’ordenació urbana vigent a Palma.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Actualment Palma compta amb nou sectors, a cada un dels quals hi ha un centre municipals de serveis socials. La creació d’un nou sector es produirà per la superació dels 99.999 habitants tal com marca la llei 4/2009 de Serveis socials de les Illes Balears o sense superar aquesta quantitat per criteris de millora en l’atenció a la ciutadania.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La distribució territorial del municipi de Palma queda reflectida a l’annex I del present reglament.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Per criteris organitzats i de proximitat a la població pot haver-hi més d’un punt d’atenció al sector.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Cada sector haurà de comptar amb els següents perfils professionals: treballador social, treballador familiar, educador social, psicòleg i auxiliar administratiu.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Per a la distribució de professionals es tindran en compte criteris de població, de demanda (volum i intensitat) i altres circumstàncies.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El cap de sector dirigeix el centre municipal de serveis socials, fet que implica la direcció i coordinació dels diferents serveis socials comunitaris bàsics i alguns específics del territori del sector.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 9. Horari d’atenció</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’horari d’atenció al públic als centres municipals de serveis socials és de 9h. a 14h. de dilluns a divendres i de 16,30h. a 18.30h. els dimarts. Si bé es realitzen intervencions fora d’aquest horari.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Es procurarà, en la mesura que sigui possible, l’atenció a persones que tenen dificultats d’accés a l’horari establert.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Sempre que el centre municipal de serveis socials romangui obert hi haurà més d’un professional al centre.</span></p> <div style="page-break-after: always;"> <span style="display: none;">&nbsp;</span></div> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Capítol&nbsp; Segon.- Estructura programàtica dels centres municipals de serveis socials.-</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 10. La planificació dels serveis socials </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els serveis socials comunitaris dissenyaran la seva intervenció a partir d’una estructura programàtica basada en criteris de diagnòstic social, emprant indicadors i variables prèviament establerts.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El procés de diagnòstic ha de cobrir dues dimensions: el territori i els sectors de població i ha de permetre prioritzar la intervenció a barris o zones concretes i nivells d’intervenció sobre els diferents sectors de població.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els documents que recullen l’estructura programàtica són: Pla estratègic, Programes i Plans de sector.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El Pla estratègic estarà liderat per la direcció de l’Àrea, establirà les prioritats i els objectius generals i serà quadriennal.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els Plans de sector i Programes respondran a objectius generals del Pla estratègic i tindran una vigència inferior al Pla Estratègic.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els plans de sector s’avaluaran anualment amb la participació de tots els professionals implicats.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 11. La programació dels centres municipals de serveis socials: el Pla de sector</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El Pla de sector és l’instrument de planificació on es descriuen les prioritats d’intervenció per a cada sector de serveis socials. Tindrà una periodicitat biennal i ha de recollir com a mínim:</span></p> <ol> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Identificació del territori que compren el sector. Principals característiques</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Diagnòstic Social</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Línies d’intervenció</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Recurs humà</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Infraestructura</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Pressupost</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Avaluació</span></li> </ol> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El cap de sector és el responsable de l’elaboració del Pla de sector amb la participació de l’equip del centre.</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Capítol tercer.- El personal tècnic dels centres municipals de serveis socials.-</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 12. Personal suficient i format</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els centres municipals de serveis socials han de tenir el personal suficient amb la formació, la titulació, els coneixements, les aptituds i l’estabilitat laboral per garantir la qualitat en la prestació dels serveis socials.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En qüestió de ràtios professionals els centres de serveis socials s’ajustaran a la normativa vigent en aquesta matèria.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els centres de serveis socials comptaran amb els perfils professionals de treballador social, psicòleg, educador social, auxiliar administratiu i treballadora familiar.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 13. Participació en la planificació</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El personal dels serveis socials comunitaris ha de participar en la planificació, el seguiment de la gestió i l’avaluació dels Plans de sector i de l’Àrea de Benestar Social en general.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 14. Mesures de suport i protecció al personal tècnic</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Seguint la llei 4/2009 de Serveis socials de les Illes Balears:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. La corporació municipal garanteix als tècnics la supervisió, el suport tècnic i la formació permanent &nbsp;( mitjançant un Pla de Formació) que els permeti donar una resposta adequada a les necessitats i les demandes de la població.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Els professionals de serveis socials han de tenir el suport administratiu, els mitjans materials necessaris i les condicions laborals adequades per acomplir amb eficàcia, eficiència i qualitat la seva tasca professional.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. L’Ajuntament adoptarà, en relació al seu personal, mesures destinades a protegir la identitat i les altres circumstàncies personals, si cal.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">4. La corporació municipal garantirà mesures de prevenció i atenció davant situacions que afectin l’estat emocional, cognitiu i físic dels professionals. Així com davant agressions, tant físiques com verbals, amenaces i altres conductes que vulnerin la integritat física i emocional del professional.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Aquestes mesures englobaran la protecció jurídica, física i emocional. Quan la gravetat dels fets ho requereixi l’Ajuntament presentarà la denúncia pertinent.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Per a tal efecte se constituirà una comissió formada per un representat de la direcció política, el cap de servei, la direcció tècnica, el cap de sector corresponent i el professional o professionals afectats.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 15. Deontologia professional</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El personal tècnic de serveis socials ha de complir els deures relatius a la deontologia professional. En els casos de presumpte incompliment s’ha de remetre informe exposant la circumstància a la direcció tècnica qui resoldrà o bé l’elevarà al Comitè d’Ètica de les Illes Balears regulat pel decret 62/2010 per a la seva resolució.</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>TÍTOL III.- L’ATENCIÓ EN ELS CENTRES MUNICIPALS DE SERVEIS SOCIALS: LA INTERVENCIÓ INDIVIDUAL-FAMILIAR I LA INTERVENCIÓ COMUNITÀRIA</strong></span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Capítol primer.- L’atenció en els centres municipals de serveis socials.-</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 16. Atenció en els centres municipals de serveis socials</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L'atenció a les necessitats de les persones-famílies en situació d'exclusió social pot ser realitzada:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">- des d'una atenció amb una finalitat individual: a través d'una intervenció individual o d'una intervenció grupal de persones en situació similar</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">- des d'una atenció amb una&nbsp; finalitat col·lectiva: a través d'una intervenció grupal adreçada a la comunitat o a través d’una intervenció comunitària</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Capítol segon.- La intervenció individual-familiar.-</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 17. Intervenció individual i familiar</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La intervenció individual-familiar es basa en la personalització de l’atenció, és a dir, en l’adaptació del procés d’ajuda a la situació de cada persona partint més de les seves capacitats que de les dificultats.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En l’atenció individual i familiar s’estableix una relació entre persones que presenten una situació de dificultat social&nbsp; i el personal tècnic encomanat per la seva atenció. Està basada en la voluntat de la persona de canviar una situació de necessitat mitjançant l’assessorament, consell tècnic i mobilització de recursos que s’ofereix des dels centres de serveis socials. En la majoria de casos es tracta d’un procés de canvi de la situació de necessitat a una altra de millora.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les persones que es troben en situació de necessitat però no volen realitzar cap tipus de canvi en la seva situació no poden ser objecte d’intervenció per part dels serveis socials comunitaris, a excepció d’aquelles tramitacions de dret subjectiu d’acord amb els que estableixen els instruments que regulen les prestacions. En aquests casos els serveis socials comunitaris poden sensibilitzar respecte a la necessitat de canviar la situació i posar en coneixement del&nbsp; servei&nbsp; corresponent quan es valori que la situació es tant greu que vulnera la integritat de la mateixa persona i/o de terceres persones.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">És un abordatge en equip interprofessional i en xarxa amb altres professionals de serveis implicats i d’entitats. Es complementa amb actuacions grupals i comunitàries.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">&nbsp;El cap de sector vetllarà per la polivalència dels professionals que compaginaran el treball individual amb el grupal i comunitari segons les ràtios establertes per la direcció.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 18. Intervenció grupal amb finalitat individual</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’atenció individual es pot fer persona a persona, és a dir, a través d’intervenció individual-familiar; o es pot fer a través d’una intervenció grupal amb finalitat individual, adreçada a persones amb característiques semblants–demanda, situació i necessitats psicosocials. Ambdues formes d’intervenir suposen una finalitat de canvi individual &nbsp;-capacitar en habilitats, donar informació en grup, formar hàbits, afavorir la capacitat d’inserció social-.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 19. Professional de referència</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Totes les persones que siguin ateses pels serveis socials comunitaris se’ls assignarà un professional de referència o responsable de cas.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En cas que es substitueixi el professional de referència el cap de sector vetllarà per l’establiment dels mecanismes adequats de traspàs de casos per facilitar la continuïtat dels processos de treball.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En cas de no substitució del professional o mentre se substitueix, el cap de sector valorarà si el cas requereix una continuïtat en l’atenció o bé es pot estar a l’espera de la demanda de l’usuari. En qualsevol cas es traspassarà al professional que correspongui per agenda de primeres acollides, descomptant-se de la disponibilitat de la mateixa.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El professional de referència té les funcions següents:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">a) Canalitzar les diverses prestacions que la persona o la unitat de convivència necessita, vetllar per la globalitat de les intervencions i per la coordinació entre l’equip &nbsp;de professionals dels serveis socials i els d’altres xarxes de benestar social, afavorir la presa de decisions i agilitzar-les, la custòdia i responsabilitat de l’expedient&nbsp; físic de la persona atesa, així com del tancament del mateix i vetllarà per l’elaboració conjunta del diagnòstic, pronòstic, pla de feina i avaluació de tot l’equip de cas, si s’escau.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">b) Prestar informació relativa al seu expedient, en qualsevol moment del procés d’intervenció, a la persona usuària sempre d’acord amb la legislació de protecció de dades. Així com a professionals de serveis d’altres administracions que ho requereixin en els casos amb intervenció conjunta.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els protocols d’atenció individual defineixen els perfils professionals responsables de l’expedient segons la situació de dificultat.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les demandes de canvi de professional seran ateses i valorades pel cap de sector. Si la valoració de canvi és positiva, aquest li assignarà el primer professional que tingui disponibilitat en primeres acollides.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els professionals podran demanar al cap de sector inhibir-se o retirar-se d’un cas quan hi hagi causes motivades com per exemple enemistat manifesta, relacions de vincle familiar o personal o circumstàncies vitals coincidents amb la persona que impedeixin l’adequada distància en la relació d’ajuda.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 20. Pla individual &nbsp;d’inserció social</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La intervenció individual-familiar requerirà d’un pla individual-familiar d’inserció social &nbsp;que té per objecte la individualització i personalització de l’atenció a partir de &nbsp;&nbsp;&nbsp;l’elaboració conjunta entre personal tècnic i persona usuària del diagnòstic, el pla de feina i l’avaluació de la intervenció.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">No obstant, no tots els casos atesos des dels centres municipals de serveis socials necessiten l’elaboració d’un pla individualitzat, ja què es resolen amb informacions, orientacions, derivacions o pel caràcter assistencial i de contenció que els cal. Al igual que quan es tracta de &nbsp;prestacions garantides.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 21. Expedient</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’expedient inclou la sèrie ordenada de documentació d’una persona i, si escau, de la seva família on ha de constar, com a mínim, el següent:</span></p> <ol style="list-style-type:lower-alpha;"> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Les dades d’identificació</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">La història social</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">La valoració</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Els acords-contracte d’inserció social</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">El pla individual d’inserció social</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">L’avaluació</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">El full d’autorització ús dades usuari</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">El full de drets i deures</span></li> </ol> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els expedients de serveis socials tenen un doble suport: el físic i el digital. Dins el suport físic hi pot haver informació annexa i complementària recollida als fulls de procés del cas consistent en apunts, anàlisi, hipòtesi de feina i informes d’altres serveis.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els professionals que tinguin accés a la documentació que consta en l’expedient estan subjectes al deure de mantenir el secret sobre les dades consultades. La consulta d’un expedient per part de professionals que no realitzen intervencions al mateix, sempre serà motivada. El seu incompliment pot ser causa de sanció.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els professionals que intervenen tenen l’obligació de mantenir actualitzada la informació relativa a la persona usuària o unitat de convivència, a les intervencions que s’hi duen a terme i als recursos mobilitzats.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els expedients no es deixaran a l’abast de&nbsp; persones alienes a l’ organització. Es tindrà especial cura en les dependències d’atenció al públic. Finalitzada la jornada laboral els expedients es guardaran en arxius que romandran tancats en clau. El professional referent serà el responsable de la custòdia&nbsp; de l’expedient&nbsp; físic, així com d’establir els mecanismes necessaris per impedir l’accés al mateix de persones no autoritzades.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els expedients no es poden treure de les dependències municipals. En cas de trasllat obligatori s’adoptaran mesures dirigides a impedir l’accés a la informació i a la seva manipulació.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El cap de sector podrà demanar la retirada del centre municipal dels expedients físics que faci cinc anys o més que estiguin tancats.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 22. Accés a la informació de l’expedient</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Segons la llei 4/2009 de Serveis socials de les Illes Balears tot ciutadà pot sol·licitar l’accés al seu expedient de serveis socials comunitaris. En aquests casos es procedirà de la següent manera:</span></p> <ol style="list-style-type:lower-alpha;"> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Sol·licitud formal via instància on faci constar les dades d’identificació&nbsp; i motiu de la sol·licitud.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Entrega a l’interessat amb acusament de rebut del document que apareix al sistema informatiu com a “Còpia de l’expedient” &nbsp;amb segell on indiqui l’autenticitat de la documentació entregada.</span></li> </ol> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 23. Tancament de l’expedient</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">És el moment en el qual l'equip i la persona-família fan una valoració conjunta del grau de consecució dels objectius i dels resultats assolits. Caldrà una pre-avaluació de l'equip, que sempre que es pugui, s'ha de consensuar amb la persona/família.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L'avaluació final ha d'incloure:</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">1.- Motiu del tancament.</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">2.- Situació final del cas. Canvis en la situació i problemàtiques inicials.</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">3.- Grau de consecució dels objectius pactats amb la família.</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">4.- Grau de disponibilitat de recursos i prestacions.</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">5.- Valoració del procés del cas.</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">6.- Observacions.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els motius de tancament de l’expedient poden ser els següents:</span></p> <ul> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Assoliment total dels objectius acordats</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Assoliment parcial dels objectius acordats</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Decisió explícita de la persona/família. S’ha d’especificar el servei</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Altres.</span></li> </ul> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Un cop tancat l’expedient i no haver transcorregut més de sis mesos si la persona/família realitza una nova demanda se li assignarà el mateix professional.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 24. Traspàs dels expedients entre centres</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Per a la realització d’un traspàs sempre s’haurà tancat prèviament l’expedient.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Seguint el procediment establert al document tècnic sobre el traspàs d’expedients, l’auxiliar administratiu farà el traspàs administratiu al nou centre municipal de serveis socials. El professional responsable del cas farà el traspàs tècnic de l’expedient i acordarà amb el professional receptor els terminis i el procés a seguir.</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Capítol tercer.- La intervenció comunitària.-</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 25. Intervenció comunitària</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La intervenció comunitària té la finalitat de fomentar la recerca de solucions a problemes socials que hi ha a un territori concret. Una recerca que es fa des de la participació i implicació de tècnics de serveis socials, tècnics d’altres serveis, veïnats i entitats.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Es fonamenta en els següents criteris:</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">1.- Detecció i diagnòstic de les necessitats o dificultats socials existents.</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">2.- Realitzar un disseny rigorós del que passa i del que es vol fer.</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">3.- Participació de la població en els canvis</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">4.- Participació de les entitats i co-responsabilitat comunitària</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">5.- Intervenció en equip</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">6.- Abordatge en xarxa. Treball amb els serveis implicats.</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">7.- Planificació avaluació contínua</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La intervenció comunitària en el marc dels serveis socials comunitaris s’ordena, segons l’article 6 del decret 48/2011 de Coordinació dels serveis socials comunitaris bàsics, des de la planificació d’una zona que contempli objectius que permetin desenvolupar projectes/actuacions adreçats a:</span></p> <ol style="list-style-type:lower-alpha;"> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">grups en situació de risc</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">suport a entitats</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">prevenció social</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">reinserció social</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">foment de la convivència i de la solidaritat</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">creació de xarxes associatives i solidàries</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">coproducció de recursos comunitaris</span></li> </ol> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El cap de sector vetllarà per la polivalència dels professionals que compaginaran el treball individual amb el grupal i comunitari segons les ràtios establertes per la direcció.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 26. Intervenció grupal amb finalitat comunitària</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’atenció comunitària es pot prestar des de dues formes bàsiques: intervencions grupals amb finalitat col·lectiva com per exemple els grups intergeneracionals, o bé des d’intervencions comunitàries, que suposen crear xarxa associativa i solidària, coproduir un servei-activitat-recurs amb una entitat, crear una plataforma d’entitats d’un barri que persegueix la seva millora. Tot i que una mateixa intervenció pot evolucionar en el temps i tenir les dues vessants.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Aquesta intervenció grupal no persegueix un canvi individual de cada participant sinó que proveeix la comunitat d'un recurs que facilita la inserció social.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 27. Els&nbsp; barris prioritaris i les zones d’atenció preferent.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els barris prioritaris són aquells en què es dona una situació de necessitat social superior a la resta de barris en determinats sectors de població. La catalogació de les necessitats es fa a través&nbsp; del diagnòstic social basat en&nbsp; indicadors de vulnerabilitat que posen de manifest la necessitat de prioritzar la intervenció.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les zones d’atenció preferent estan regulades per l’article 12 del decret 48/2011 de Coordinació dels serveis socials comunitaris bàsics i concentren major nombre de persones en situació de vulnerabilitat social. La declaració de zona d’atenció preferent obliga a l’Ajuntament a prioritzar les actuacions de totes les àrees municipals realitzant un pla integral que incorpora accions d’habitatge, urbanisme, educació, joventut, esports entre d’altres.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 28. Professional de referència </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els projectes i actuacions han de tenir un professional responsable del mateixos, així com un equip de projecte que serà&nbsp; interprofessional.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El professional responsable té les funcions següents:</span></p> <ol style="list-style-type:lower-alpha;"> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Canalitzar les demandes d’entitats i/o serveis, vetllar per la globalitat de les intervencions i per la coordinació entre els professionals del projecte/actuació i els d’altres serveis/entitats implicades, afavorir la presa de decisions i agilitzar-les, la custòdia i responsabilitat de la carpeta de projecte i vetllar per l’elaboració conjunta del projecte/actuació i l’avaluació.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Prestar informació relativa al desenvolupament del projecte/actuació, en qualsevol moment del procés d’intervenció.</span></li> </ol> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El catàleg de prevenció social indica la responsabilitat segons la tipologia dels projectes/actuacions.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 29. Projectes i actuacions</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els projectes són l’instrument metodològic que permet concretar les prioritats marcades al Pla de Sector&nbsp; i desenvolupar-les mitjançant activitats organitzades entorn a objectius.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les actuacions són intervencions més concretes i específiques que no requereixen l’amplitud i desplegament d’un projecte; poden tenir entitat per sí mateixes o poden estar vinculades a un projecte.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El document que emmarca metodològicament la intervenció comunitària és el catàleg de prevenció social.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El pressupost dels projectes/actuacions haurà de generar una reserva de crèdit al pressupost anual vigent de la Regidoria de Benestar social de l’Ajuntament de Palma.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els pressuposts dels projectes que tinguin una duració superior a un any hauran de ser aprovats en cada exercici pressupostari.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els projectes presentaran com a guió mínim:</span></p> <p style="margin-left:35.45pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">1.- Identificació del projecte&nbsp;</span></p> <p style="margin-left:35.45pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">2.- Diagnòstic Social. Punt de Partida</span></p> <p style="margin-left:35.45pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">3.- Objectiu General&nbsp;</span></p> <p style="margin-left:35.45pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">4.- Objectius Operatius</span></p> <p style="margin-left:35.45pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">5.- Activitats</span></p> <p style="margin-left:35.45pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">6.- Pressupost&nbsp;</span></p> <p style="margin-left:35.45pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">7.- Avaluació del projecte</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els projectes/actuacions han de disposar d’una carpeta de projecte. Aquesta consistirà en un dossier-expedient amb tota la informació relativa al desenvolupament de la intervenció i material de suport. Hi han de figurar els fulls d’inscripció i autorització per menors i el d’autorització dret d’imatge, si s’escau.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els professionals del projecte/actuació tenen l’obligació de mantenir actualitzada la informació relativa al desenvolupament de la intervenció i als recursos mobilitzats.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El professional referent serà el responsable de la custòdia&nbsp; de la carpeta de projecte.</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>TÍTOL IV.- LES PRESTACIONS DELS SERVEIS SOCIALS COMUNITARIS</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 30. Prestacions </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les prestacions del sistema públic de serveis socials poden ser tècniques, econòmiques o tecnològiques.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Segons l’article 5 del decret 56/2011 de 20 de maig pel qual s’aprova la cartera bàsica de serveis socials les prestacions del sistema de serveis socials poden ser garantides per a tothom o bé no garantides i ser atorgades segons la disponibilitat pressupostària.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 31. Prestacions tècniques</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Tal com queda recollit a la llei 4/2009 de Serveis socials a les Illes Balears a l’article 21:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Les prestacions tècniques són els serveis i les intervencions que duen a terme els equips professionals que s’adrecen a la prevenció, el diagnòstic, la valoració, la protecció, la promoció de l’autonomia, l’atenció i la inserció de les persones, les unitats de convivència i els grups en situació de necessitat social.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Des dels serveis socials comunitaris es poden prestar, amb caràcter temporal o permanent, en el domicili, en l’entorn de la persona usuària, de forma ambulatòria i a centres. En aquest darrer cas poden ser de règim diürn. Els serveis socials comunitaris mai prestaran serveis&nbsp; de règim nocturn, o residencial.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. L’aplicació de qualsevol tipus de prestació social ha d’anar acompanyada de l’aplicació de prestacions tècniques adaptades en cada cas.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 32. Prestacions econòmiques</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Són prestacions econòmiques, seguint la llei 4/2009 de Serveis socials de les Illes Balears, les aportacions dineràries que tenen com a finalitat atendre determinades situacions de necessitat en què es troben les persones que no disposen de recursos econòmics suficients per fer-hi front i no estan en condicions d’aconseguir-ne o rebre’n d’altres fonts.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 33. Prestacions tecnològiques</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Tal com queda recollit a la llei 4/2009 de serveis socials a les Illes Balears a l’article 23:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Són prestacions tecnològiques les que per mitjà d’un producte atenen les necessitats socials de la persona i es poden associar amb altres prestacions.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Tenen aquesta consideració les prestacions següents:</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">a) L’assistència tecnològica i la teleassistència domiciliària.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">b) Les ajudes instrumentals destinades a mantenir o millorar l’autonomia personal, o a afavorir la inserció social.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">c) Les de naturalesa semblant que s’estableixin normativament.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 34. Cartera de serveis socials de l’Ajuntament de Palma</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Segons l’article 24 de la llei 4/2009 de serveis socials la cartera de serveis socials és l’instrument que determina el conjunt de prestacions del sistema públic de serveis socials, incloent-hi totes les prestacions tècniques, econòmiques i tecnològiques.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El decret 56/2011 de 20 de&nbsp; maig aprova la cartera bàsica de serveis socials de les Illes Balears. Tal i com s’explicita a l’article 27 de la llei 4/2009 de Serveis socials l’Ajuntament de Palma aprovarà la seva cartera de serveis una vegada ho hagi fet el Consell de Mallorca.</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Titol V. ELS DRETS I DEURES DE LES PERSONES USUÀRIES DELS SERVEIS SOCIALS COMUNITARIS. RÈGIM SANCIONADOR.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 35. Drets de les persones usuàries </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les persones usuàries dels serveis socials comunitaris gaudiran dels drets que els hi confereix l’article 7 de la llei 4/2009 de serveis socials:</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">a) Dret a accedir al sistema de serveis socials en condicions d’igualtat sense discriminació per raó de lloc de naixement, idioma, ètnia, sexe, orientació sexual, estat civil, situació familiar, edat, discapacitat, religió, ideologia, opinió o qualsevol altra condició personal o social.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">b) Dret a rebre informació suficient i verídica, en termes comprensibles, sobre les prestacions i els recursos disponibles i sobre els requisits necessaris per accedir als serveis, i també sobre altres recursos de protecció social i sobre les competències de les administracions públiques en aquest àmbit. Per fer-ho efectiu, s’ha de disposar dels ajuts i els suports necessaris per comprendre la informació que els sigui donada si tenen dificultats derivades del desconeixement de la llengua, si tenen alguna discapacitat o per altres raons que ho justifiquin.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">c) Dret a rebre la valoració de la seva situació i, si és procedent, la valoració de les necessitats socials dels familiars o de les persones que en tenen cura, en un llenguatge clar i entenedor.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">d) Dret a disposar d’un pla individual d’inserció social d’acord amb la valoració de la seva situació, que han d’aplicar tècnicament professionals mitjançant procediments reconeguts i acreditats.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">e) Dret a estar informades del procés d’intervenció social i a participar en l’elecció dels serveis o les prestacions entre les opcions que els presentin les administracions, sempre que aquests fets no vagin en contra del normal desenvolupament de l’atenció o perjudiquin a qualcuna de les parts que hi intervenen.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">f) Dret a rebre informació prèvia amb relació a qualsevol intervenció que els afecti, per tal que hi puguin donar consentiment específic i lliure, excepte en situacions que suposin un risc per a la integritat de les persones i per requeriment judicial. El consentiment ha de ser en tot cas per escrit quan la intervenció impliqui ingrés en un centre residencial. El consentiment de les persones incapacitades i de les persones menors d’edat l’atorga els pares o tutors.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">g) Dret a renunciar a les prestacions i als serveis concedits en els termes establerts per la legislació vigent, llevat que la renúncia afecti els interessos de les persones menors d’edat o de persones incapacitades o presumptament incapaces.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">h) Dret a la confidencialitat respecte de la informació que coneguin els serveis socials, d’acord amb la legislació de protecció de dades de caràcter personal.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">i) Dret a l’accés, en qualsevol moment, al seu expedient individual, d’acord amb el que estableix la legislació vigent, i en tot el que no vulneri el dret a la intimitat de terceres persones.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">j) Dret a l’assignació de personal professional de referència, en els termes establerts reglamentàriament.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">k) Dret a la participació tal i com regula el títol IV de la llei 4/2009.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">l) Dret a rebre serveis de qualitat i a conèixer els estàndards establerts a aquest efecte.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">m) Dret a suggerir i a fer reclamacions.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">n) Dret a la continuïtat de la prestació dels serveis en les condicions establertes o convingudes.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">o) Dret a ser orientades cap a altres recursos alternatius que siguin necessaris.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 36. Deures de les persones usuàries </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les persones usuàries dels serveis socials comunitaris tindran els deures que els hi confereix l’article 8 de la llei 4/2009 de serveis socials:</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">a) Complir les normes, els requisits, les condicions i els procediments establerts en les prestacions i els serveis; seguir el programa d’atenció i les orientacions que s’hagin acordat amb el personal professional competent, i comprometre’s a participar activament en el procés.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">b) Facilitar informació verídica sobre les circumstàncies personals, familiars i econòmiques, sempre que el seu coneixement sigui necessari per valorar i atendre la seva situació, i també comunicar les variacions que es produeixin.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">c) Destinar la prestació econòmica a la finalitat per a la qual fou concedida.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">d) Acudir a les entrevistes a les quals les citi el personal professional dels serveis socials.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">e) Contribuir al finançament del cost del servei quan es tingui capacitat econòmica i així s’estableixi normativament.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">f) Informar a la major brevetat possible sobre qualsevol canvi que es produeixi quant a la seva situació personal, familiar, social i econòmica, que pugui donar lloc a modificar, suspendre o extingir la prestació.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">g) Signar el contracte assistencial pertinent amb l’entitat prestadora del servei quan així es requereixi.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">h) Mantenir en tot moment un comportament adequat i respectuós amb els professionals així com amb la resta d’usuaris que coincideixin en els centres i/o en les activitats en les quals participen.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">A l‘obertura&nbsp; d’un expedient les persones usuàries signaran davant el professional de referència un full on es recullin els seus drets i deures.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Als participants d’intervencions grupals i comunitàries se’ls informarà dels drets i deures en relació a les activitats que es duran a terme. En els casos que la naturalesa de l’activitat ho requereixi, bàsicament activitats grupals, els participants signaran&nbsp; l’acceptació dels drets i deures.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 37.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Infraccions i sancions de les persones usuàries.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">A més de la normativa vigent s’estableixen tres nivells d’infraccions:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1.- Són infraccions lleus de les persones usuàries o beneficiàries de prestacions les següents:</span></p> <ul> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">No facilitar la informació sobre els canvis en la situació personal, familiar, econòmica i social.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">No complir els acords relacionats amb el servei o prestació concedida</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">La manca de respecte als professionals, a altres persones usuàries o visitants del centre</span></li> </ul> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2.- Són infraccions greus de les persones usuàries o beneficiàries de prestacions les següents:</span></p> <ul> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Falsejar dades a l’Administració</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">No comunicar als professionals els canvis o les alteracions de les circumstàncies o dels requisits que varen determinar la concessió del recurs/prestació</span></li> </ul> <ul> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Produir danys a les instal·lacions del centre, altres dependències municipals o locals on es dugui a terme la intervenció</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">No destinar la prestació a la finalitat per a la qual s’ha concedit</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">No complir de forma reiterada i continua els acords relacionats amb el servei, la prestació o el recurs concedit</span></li> </ul> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3.- Se considerarà infracció molt greu l’agressió física o psicològica al personal que presta el servei, així com les amenaces que suposin un risc per a la integritat dels professionals.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El professional que tingui coneixement d’una acció/omissió de les descrites anteriorment serà el que insti l’inici del procediment sancionador que a continuació es detalla.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">S’estableixen tres nivells de sancions:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1.- &nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Per a les infraccions lleus s’advertirà verbalment a la persona usuària. El professional&nbsp; i el cap de sector convocaran una entrevista amb la persona per aquest fi. Es deixarà constància dins l’expedient/carpeta de projecte dels fets mitjançant la diligència de Fer constar.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2.- &nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Les infraccions greus suposaran el tancament temporal, d’entre dos a sis mesos de l’expedient. Ara bé, quan a l’expedient hi hagi intervencions dirigides a menors amb processos positius, com és ara beques d’inserció en risc i recursos per a la integració educativa, laboral i social dels menors, sols es tancaran les referides als adults amb la intenció de preservar dits processos.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Se crearà una comissió integrada pel professional afectat, el cap de sector, l’equip de cas o de projecte i dos professionals del centre&nbsp; per determinar la durada del tancament de l’expedient i en el cas d’intervencions grupals i comunitàries per determinar el tipus i durada de la sanció.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’acta de la comissió servirà per informar als usuaris i es guardarà l’original a l’expedient/carpeta de projecte. El cap de sector i el professional en donaran coneixement a l’usuari convocant una entrevista per a tal fi.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3.- &nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Les infraccions molt greus suposaran interrupció immediata del servei fins que la comissió dictamini les mesures a prendre. En la intervenció individual-familiar el tancament de l’expedient serà com a mínim de sis mesos.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Per a aquestes infraccions la comissió estarà integrada &nbsp;per un representat de la direcció política, el cap de servei, la direcció tècnica, el cap de sector corresponent i el professional o professionals afectats.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La comissió tindrà en compte el reconeixement dels danys causats i la voluntat de reparació dels mateixos per part de l’agressor.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’acta de la comissió servirà per informar als usuaris i es guardarà l’original a l’expedient. El cap de sector i la direcció tècnica en donaran coneixement a les persones usuàries convocant una entrevista per a tal fi.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 38.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Presentació i tràmit de demandes, suggeriments, felicitacions i reclamacions</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Quan una persona usuària dels serveis socials comunitaris vulgui realitzar un suggeriment, queixa, felicitació o reclamació pot realitzar-ho directament a través del cap de sector o mitjançant el sistema general que tingui l’Ajuntament per a atendre aquestes situacions.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Quan s’ha utilitzat el canal verbal el cap de sector o professional en qui delegui registrarà la queixa, suggeriment, felicitació o reclamació al web municipal a l’apartat de queixes i suggeriments.</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Titol VI. ELS DRETS I DEURES DELS PROFESSIONALS </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 39. &nbsp;&nbsp;&nbsp;&nbsp; Drets dels professionals </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els professionals dels serveis socials tenen, en l’exercici de les seves funcions, reconeguts tots els drets recollits en la legislació que sigui aplicable a l’àmbit on desenvolupen la seva activitat i, en particular els següents:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">a)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Dret a la dignitat. Els professionals dels serveis socials tenen, en l’exercici de les seves funcions, dret a la dignitat, és a dir, al reconeixement del seu valor intrínsec com a persones.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El seu exercici efectiu implica ser tractades amb el màxim respecte, amb correcció i comprensió, tant per part dels responsables del servei i de la resta de professionals, com per part dels usuaris.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">b)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Drets laborals. Les persones que exerceixen la seva activitat professional en els serveis socials tenen tots els drets que, en l’àmbit laboral o de la funció pública, els reconeguin la legislació i els convenis col·lectius o els acords reguladors de les condicions d’ocupació que siguin aplicables.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">c)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Dret a la formació. Les persones que treballin en els serveis socials tenen dret a accedir a la informació i orientació inicial, destinada a facilitar la seva adaptació a les característiques del servei o centre i beneficiar-se de la formació contínua, necessària per a desenvolupar la seva activitat professional, durant tota la seva vida activa, participant en la proposta dels seus continguts.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’Àrea de Benestar Social com a administració especial haurà de garantir un mínim anual de formació obligatòria.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En coordinació amb l’Escola Municipal de Formació s’establirà un pla anual de formació que doni resposta a les necessitats detectades en aquest sentit.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">d)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Dret a la participació. Els professionals dels serveis socials tenen dret a la participació en el desenvolupament i proposta de planificació de l’Àrea de Benestar Social.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En garantia de l’exercici efectiu d’aquest dret els professionals poden:</span></p> <ul> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Participar en els òrgans consultius i participatius previstos a la llei 4/2009 de Serveis socials de les Illes Balears &nbsp;i / o en altres que es creïn.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Presentar denúncies relatives al funcionament dels centres i serveis, que seran considerades per l’òrgan competent per iniciar, si s’escau, procediments d’inspecció.</span></li> </ul> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">e)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Dret a qualitat del servei. Els professionals dels serveis socials tenen dret a disposar dels mitjans necessaris per garantir la prestació d’un servei en condicions que responguin als criteris de qualitat exigits per la normativa corresponent.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En garantia del seu exercici efectiu els professionals poden instar l’Ajuntament a:</span></p> <ul> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Que exerceixi, de conformitat amb la normativa vigent, les funcions que els corresponguin en matèria d’autorització, registre, homologació i inspecció, en garantia del compliment dels requisits materials, funcionals i de personal que els siguin exigibles.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Que se’ls informi adequadament dels requisits materials, funcionals i de personal aplicables al servei.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Que es posi a la seva disposició manuals de bona pràctica professional que orientin sobre les pautes d’actuació més adequades al correcte exercici de les seves funcions, en les seves relacions amb les persones usuàries i amb els altres professionals.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Que promogui la millora en la qualitat dels serveis mitjançant la realització d’avaluacions internes i externes.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Que es publiquin els resultats obtinguts en els procediments d’inspecció i avaluació, possibilitant el coneixement del funcionament dels serveis socials, el seu cost i el compliment o incompliment dels requisits materials, funcionals i de personal corresponents.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Que els requisits materials, funcionals i de personal es consideren en continu procés de revisió i sempre susceptibles de millora.</span></li> </ul> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El que disposen els apartats anteriors en cap cas legitima la negativa al desenvolupament de les funcions pròpies dels professionals dels serveis socials.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Article 40.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Obligacions dels professionals.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els professionals tenen, en l’exercici de les seves funcions, reconegudes totes les obligacions recollides en la legislació que sigui aplicable a l’àmbit on desenvolupen la seva activitat i, en particular, les següents:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">a)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Obligacions laborals. Els professionals tenen totes les obligacions que, en l’àmbit laboral o de la funció pública, els imposen la legislació i els convenis col· lectius o acords reguladors de les condicions d’ocupació que siguin aplicables.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els professionals tenen l’obligació de conèixer i complir la normativa vigent en l’àmbit dels serveis socials i la normativa municipal.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">b)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Deure de comunicació. Els professionals que exerceixen la seva activitat en els serveis socials tenen l’obligació de posar en coneixement de l’autoritat competent qualsevol situació que, segons ells, i basant-se en els elements de valoració dels quals</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">disposen, pogués comportar una vulneració de drets, en els termes previstos en la legislació vigent.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">c)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Compliment de les normes de convivència. Els professionals tenen l’obligació de guardar les normes de convivència i respecte mutu en els serveis i centres on desenvolupen la seva activitat i en qualsevol altre lloc relacionat amb aquesta.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">d)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Respecte a les persones. Els professionals tenen l’obligació de respectar tots els drets reconeguts en aquest Reglament i, en particular, el dret a la dignitat i privacitat de tots els altres professionals i usuaris dels serveis socials, així com el dret a la confidencialitat de la informació personal a la qual tinguin accés per raó de l’exercici de les seves funcions o per qualsevol altra raó.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Igualment, han de fer un ús responsable de la informació relativa a la persona usuària, sent respectuosos en l’obtenció d’aquesta, justificant la seva necessitat i sol·licitant el seu consentiment per utilitzar-la quan sigui necessari per a una intervenció coordinada i efectiva, en els termes previstos legalment.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Tenen l’obligació de mantenir, en les seves relacions amb altres professionals i usuaris, un comportament no discriminatori per raó de sexe, orientació sexual, estat civil, edat, creença o ideologia, pertinença a una minoria ètnica nacional o lingüística, nivell econòmic, així com per raó de discapacitat física, psíquica o sensorial, o per qualsevol altra condició personal o social.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Han de garantir la integritat, confidencialitat i seguretat de les opinions, criteris i decisions que els usuaris prenguin per si mateixos o a través del seu representant legal.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Tenen l’obligació de facilitar la participació dels usuaris en el disseny de la intervenció professional a realitzar.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En cas que sigui necessària la derivació de la persona usuària a un altre o altres serveis, el professional tindrà l’obligació de fer-ho de la manera més favorable per a ella, procurant la continuïtat de la intervenció.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">e)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Respecte de les instal·lacions. Els professionals tenen l’obligació de respectar i utilitzar correctament els béns mobles i les instal·lacions dels centres de serveis socials en què presten els seus serveis i de qualsevol altre lloc relacionat amb les seves activitats.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">f)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Comunicació d’irregularitats. Els professionals tenen l’obligació de posar en coneixement del cap de sector o, si ho consideren necessari, de la direcció tècnica les irregularitats o anomalies que s’observin en el funcionament, l’organització o les instal·lacions del centre.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Disposició addicional primera</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Aquells serveis específics que pel seu objecte i activitat no queden completament recollits en aquest reglament tindran una reglamentació pròpia.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Disposició addicional segona</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Totes les denominacions que en aquest reglament apareixen en masculí s’han d’entendre referides també al femení<strong>.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Disposició final</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Aquest reglament, una vegada aprovat definitivament pel Ple de la Corporació, entrarà en vigor amb la publicació íntegra del seu text en el Butlletí Oficial de les Illes Balears .</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Disposició final segona</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Totes les estadístiques inclouran sistemàticament la variable sexe i es tindrà en compte a l’hora de la recollida de la informació com en els informes que es publiquin.</span></p> <p align="center"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Drets i deures de les persones usuàries</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Drets de les persones usuàries </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les persones usuàries dels serveis socials comunitaris gaudiran dels drets que els hi confereix l’article 7 de la llei 4/2009 de Serveis socials:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">a) Dret a accedir al sistema de serveis socials en condicions d’igualtat sense discriminació per raó de lloc de naixement, idioma, ètnia, sexe, orientació sexual, estat civil, situació familiar, edat, discapacitat, religió, ideologia, opinió o qualsevol altra condició personal o social.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">b) Dret a rebre informació suficient i verídica, en termes comprensibles, sobre les prestacions i els recursos disponibles i sobre els requisits necessaris per accedir als serveis, i també sobre altres recursos de protecció social i sobre les competències de les administracions públiques en aquest àmbit. Per fer-ho efectiu, s’ha de disposar dels ajuts i els suports necessaris per comprendre la informació que els sigui donada si tenen dificultats derivades del desconeixement de la llengua, si tenen alguna discapacitat o per altres raons que ho justifiquin.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">c) Dret a rebre la valoració de la seva situació i, si és procedent, la valoració de les necessitats socials dels familiars o de les persones que en tenen cura, en un llenguatge clar i entenedor.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">d) Dret a disposar d’un pla individual d’inserció social d’acord amb la valoració de la seva situació, que han d’aplicar tècnicament professionals mitjançant procediments reconeguts i acreditats.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">e) Dret a estar informades del procés d’intervenció social i a participar en l’elecció dels serveis o les prestacions entre les opcions que els presentin les administracions, sempre que aquests fets no vagin en contra del normal desenvolupament de l’atenció o perjudiquin a qualcuna de les parts que hi intervenen.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">f) Dret a rebre informació prèvia amb relació a qualsevol intervenció que els afecti, per tal que hi puguin donar consentiment específic i lliure, excepte en situacions que suposin un risc per a la integritat de les persones i per requeriment judicial. El consentiment ha de ser en tot cas per escrit quan la intervenció impliqui ingrés en un centre residencial.
