CAIB 2016-05-07 CAIB ![CDATA[Proposta de resolució del secretari general i Resolució del vicepresident i conseller d’Innovació, Recerca i Turisme per la qual s’aproven les tarifes dels nous serveis de banda ampla per a l’execució dels encàrrecs de gestió que facin a la Fundació Balear d’Innovació i Tecnologia l’Administració de la Comunitat Autònoma de les Illes Balears i la resta de poders adjudicadors]] 13379 ![CDATA[<p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Fets</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El 17 de febrer de 2016, la Fundació Balear d’Innovació i Tecnologia presentà, davant la Secretaria General de la Vicepresidència i Conselleria d’Innovació, Recerca i Turisme, la documentació justificativa de les tarifes dels nous serveis de banda ampla que es proposen per a l’execució dels encàrrecs que facin a la Fundació Balear d’Innovació i Tecnologia l’Administració de la Comunitat Autònoma de les Illes Balears i la resta de poders adjudicadors.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Fonaments de dret</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. El Text refós de la Llei de contractes del sector públic, aprovat pel Reial decret legislatiu 3/2011, de 14 de novembre, i, en particular, els articles 4.1 <em>n</em> i 24.6.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. El Decret 14/2016, d’11 de març, pel qual s’aprova el text consolidat del Decret sobre contractació de la Comunitat Autònoma de les Illes Balears.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. La Llei 7/2010, de 21 de juliol, del sector públic instrumental de la Comunitat Autònoma de les Illes Balears.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">4. Els Estatuts de la Fundació Balear d’Innovació i Tecnologia, autoritzats per l’Acord del Consell de Govern de 26 de juliol de 2013, i, en particular, l’article 4.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">5. La Llei 12/2015, de 29 de desembre, de pressuposts generals de la Comunitat Autònoma de les Illes Balears per a l’any 2016.</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Proposta de resolució</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Propòs al vicepresident i conseller d’Innovació, Recerca i Turisme que dicti una resolució en els termes següents:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Aprovar les tarifes dels nous serveis de banda ampla aplicables als encàrrecs que facin a la Fundació Balear d’Innovació i Tecnologia l’Administració de la Comunitat Autònoma de les Illes Balears i la resta de poders adjudicadors, d’acord amb els punts següents:</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>a) </em>Les tarifes esmentades, aprovades pel Patronat de la Fundació el 18 de desembre de 2015, que inclouen tots els costs directes i indirectes imputables a l’encàrrec de gestió, a les quals caldrà afegir, si escau, l’impost sobre el valor afegit vigent, s’han d’aplicar en funció del tipus de servei i de les unitats contractades que s’assignin a l’execució dels encàrrecs en els termes que s’indiquen en l'annex d’aquesta Resolució.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>b) </em>En els casos en què per gestionar o executar millor els encàrrecs s’exigeixi o es faci recomanable la subcontractació d’activitats a terceres persones, les tarifes que hagi de percebre la Fundació Balear d’Innovació i Tecnologia per raó de l’encàrrec s’han d’incrementar per un import inherent al cost que ha d’atendre la Fundació per raó de la subcontractació de l’activitat o béns i serveis.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>c) </em>Sense perjudici d’aquestes tarifes d’aplicació general, es poden aprovar tarifes específiques pels encàrrecs que ho requereixen en consideració a les seves particularitats, per mitjà d’una altra resolució del vicepresident i conseller d’Innovació, Recerca i Turisme.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Notificar aquesta Resolució a la Fundació Balear d’Innovació i Tecnologia.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3.
