	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;RESOLUCIÓ D'AL·LEGACIONS I APROVACIÓ DEFINITIVA DE MODIFICACIÓ DE L'ORDENANÇA FISCAL DE LA TAXA DE RECOLLIDA, TRANSPORT I TRACTAMENT DELS RESIDUS SÒLIDS.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;El Ple de l'Ajuntament de Valldemossa en la sessió extraordinària de dia 22 de desembre de 2015 ha adoptat el següent acord:&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Resultant que per acord plenari de data 09 de novembre de 2015 es va acordar inicialment la modificació de l'ordenança de la Taxa de recollida, transport i tractament de residus sòlids.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Resultant que dins del termini d'informació publica s'ha formulat per part del Grup Municipal Popular un escrit d'al·legacions.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Vist l'informe emès pel tècnic redactor de l'ordenança.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Vist l'informe favorable de Secretària pel que fa a la tramitació de la modificació de l'ordenança i del seu contingut que s'ajusta a l'establert en l'art. 24.2 del RDL 2/2004, de 5 de març, pel qual s'aprova el text refós de la llei reguladores de les hisendes locals.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Vist l'informe favorable de la Comissió Informativa d'Hisenda.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;La Corporació per vuit vots a favor de l'equip de govern i dues abstencions del PP acorda&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;1º. Estimar parcialment l'al·legació del Grup Municipal Popular.&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;2º. Aprovar definitivament la modificació de l'ordenança fiscal i ordenar la seva publicació en el BOIB&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Contra el present acord definitiu de modificació de la referida ordenança fiscal, els interessats podran interposa recurs contenciós administratiu davant la Sala del Contenciós del Tribuna Superior de Justícia de les Illes Balears, en el termini de dos mesos explicats a partir de l'endemà al de la publicació del present acord en el BOIB.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;TAXA DE RECOLLIDA, TRANSPORT I TRACTAMENT DELS RESIDUS SÒLIDS.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;span style="color: black;"&gt;Article 1.&amp;nbsp; Fonament i naturalesa&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;En ús de les facultats concedides pels articles 133.2 i 142 de la Constitució i per l’article 106 de la Llei 7/1985, de 2 d’abril, reguladora de les bases de règim local, i de conformitat amb allò que disposen els articles 15 a 19 del Reial decret legislatiu 2/2004, de 5 de març, pel qual s’aprova el text refós de la Llei reguladora de les hisendes locals, aquest Ajuntament estableix la taxa per recollida, transport i tractament dels residus sòlids urbans, que s’ha de regir per aquesta Ordenança fiscal, les normes de la qual acompleixen el que preveu l’article 57 del RDLEG 2/2004 esmentat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;span style="color: black;"&gt;Article 2. Fet imposable&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;1. Constitueix el fet imposable de la taxa la prestació del servei de recepció obligatòria i recollida domiciliària, transport i tractament de fems i residus sòlids urbans, d’habitatges, allotjaments i locals o establiments on s’exerceixin activitats industrials, comercials, professionals, artístiques i de serveis. Es consideren urbans a aquest efecte tots els béns que tributin pel concepte d’IBI urbà. En el cas de les tarifes incloses dins l’epígraf de disseminats, el servei no inclou la recollida domiciliària de residus sòlids urbans.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;2. Així mateix, també constitueix el fet imposable de la taxa la prestació del servei de recepció obligatòria, transport i tractament de residus sòlids urbans, d’habitatges, allotjaments i locals o establiments on s’exerceixin activitats industrials, comercials, professionals, artístiques i de serveis, ubicats fora dels nuclis de població.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;3. A aquest efecte, es consideren residus domiciliaris i residus sòlids urbans les restes i deixalles d’alimentació o detritus procedents de la neteja normal de locals o habitatges i s’exclouen d’aquest concepte els residus de tipus industrial, les runes d’obres, els detritus humans, les matèries i materials contaminants, corrosius o perillosos, o la recollida o l’abocament dels quals exigeixi adoptar mesures higièniques, profilàctiques o de seguretat especials.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;4. No està subjecte a la taxa la prestació voluntària o a instància de part dels serveis següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;a) La recollida de fems i residus no qualificats de domiciliaris i urbans d’indústries, hospitals i laboratoris.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;b) La recollida d’escòries i cendres de calefaccions centrals.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;c) La recollida de runes d’obres.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;5. La liquidació i el pagament de la taxa de recollida i eliminació de residus no implica cap tipus de legalització de les edificacions ni de les activitats, sinó el simple fet de contribuir amb les despeses del servei de recepció obligatòria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;span style="color: black;"&gt;Article 3. Subjecte passiu&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;1. Són subjectes passius contribuents les persones físiques i jurídiques i les entitats a què es refereix la Llei general tributària, que ocupen o utilitzen els habitatges i locals ubicats en els llocs, places, carrers o vies públiques en què es presta el servei, i també els ubicats fora del nucli urbà que gaudeixen del servei mitjançant la xarxa de contenidors i punts d’aportació, ja sigui com a persona propietària o usufructuària, com rellogada, arrendatària o, fins i tot, en precari.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;2. Té la consideració de subjecte passiu substitut del contribuent la persona propietària dels habitatges o locals, qui pot repercutir, si s’escau, les quotes satisfetes sobre les persones usuàries del servei.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;span style="color: black;"&gt;Article 4.&amp;nbsp; Responsables&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;1. Han de respondre solidàriament de les obligacions tributàries del subjecte passiu les persones físiques o jurídiques a què es refereixen els articles 35 a 43 de la Llei 58/2003, de 17 de desembre, general tributària.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;2. Són responsables subsidiaris els administradors de les societats i els síndics, els interventors o liquidadors de fallides, concursos, societats i entitats en general, en els supòsits i amb l’abast que assenyala l’article 43 de la Llei general tributària.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;3. Han d’actuar com a obligades tributàries, atès que són les deutores principals, les persones usuàries del servei.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;span style="color: black;"&gt;Article 5.&amp;nbsp; Quota tributària&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;1. La quota tributària general consisteix en una quantitat fixa, per unitat de local, que s’ha de determinar en funció de la naturalesa i la destinació dels immobles i de la categoria del lloc, plaça, carrer o via pública on estiguin ubicats. En ella hi repercuteixen, els costos derivats del tractament i eliminació per part del Consell de Mallorca i aquells altres derivats de la gestió municipal, tal com figura a l’Estudi econòmic de la taxa de residus de 2016. A aquest efecte, s’han d’aplicar les tarifes següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;

	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;b) Per ser admeses al programa ITR, les persones interessades han d’estar al corrent de pagament de la taxa per recollida, transport i tractament dels residus sòlids, i han de sol·licitar-ne l’adhesió, mitjançant l’imprès de compromís, abans del &lt;u&gt;31 de gener &lt;/u&gt;de l’any d’aplicació, i han d’acceptar les condicions següents:&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;- Consentir l'accés al seu habitatge, establiment o local amb el seu propietari o responsable, de persones autoritzades per l'Ajuntament Valldemossa per controlar que es separin efectivament les fraccions de residus (paper, vidre, envasos i rebuig).&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;- Han de consentir el control dels residus que dipositin en les àrees d’aportació i en el Parc Verd.&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;- Han d’adjuntar còpia del rebut de l’any anterior. &lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Les sol·licituds d’adhesió al programa ITR presentades amb posterioritat al &lt;u&gt;31 de gener &lt;/u&gt;seran incorporades per a que tenguin efectes l’any següent.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;c) En el cas de no complir les condicions establertes en l’apartat b) anterior, es perdrà el dret a la bonificació de la quota i s’haurà d’abonar la taxa ordinària corresponent.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;d) Així mateix, també es pot sol·licitar la inclusió dels immobles deshabitats en el programa ITR. Els interessats hauran de demostrar que l’habitatge ha estat buit presentant amb la sol·licitud els rebuts d’energia elèctrica dels sis mesos anteriors.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;span style="color: black;"&gt;Article 7.&amp;nbsp; Acreditació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;1. S’acredita la taxa i neix l’obligació de contribuir quan s’inicia la prestació del servei, entenent-se iniciada, atesa la seva naturalesa de recepció obligatòria, quan estigui establert i en funcionament el servei municipal de recollida de fems domiciliaris, transport i tractament, en els carrers o llocs on figurin els habitatges o locals utilitzats per les persones contribuents subjectes a la taxa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;2. Una vegada que el servei esmentat s’hagi establert i posat en funcionament, les quotes s’acrediten el primer dia de cada any, excepte que l’acreditació de la taxa es produeixi amb posterioritat a la data esmentada. En aquest cas, la primera quota s’acredita el primer dia del &lt;/span&gt;trimestre&lt;span style="color: black;"&gt; natural següent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;span style="color: black;"&gt;Article 8. Declaració i ingrés&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;1. Durant els trenta dies hàbils següents a la data en què s’acrediti la taxa per primera vegada, els subjectes passius han de formalitzar-ne la inscripció en matrícula, per a la qual cosa han de presentar la declaració d’alta i fer l’ingrés de la quota corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;2. Quan es conegui qualsevol variació de les dades que figurin en la matrícula, tant si és d’ofici com per comunicació de les persones interessades, s’han de dur a terme les modificacions corresponents, les quals han de tenir efecte a partir del &lt;/span&gt;trimestre&lt;span style="color: black;"&gt; següent al de la data en què s’hagi efectuat la declaració.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;3. Les quotes s’han de cobrar anualment mitjançant el rebut derivat de la matrícula.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;span style="color: black;"&gt;Article 9. Pagament fraccionat&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;1. Les persones contribuents poden sol·licitar el pagament fraccionat, que sempre ha de ser trimestral. A aquest efecte, la persona interessada l’ha de sol·licitar expressament a l’Ajuntament abans del 15 de febrer de l’any en curs.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;2. L’acolliment al sistema fraccionat de pagament es prorroga automàticament per a l’exercici següent, sempre que la persona interessada no manifesti la seva renúncia expressa i no tengui deutes pendents de pagament en període executiu.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;3. Si la persona sol·licitant incorre en l’impagament de qualsevol càrrec del sistema fraccionat, aquest quedarà sense cap efecte.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;4. El sistema fraccionat de pagament no suposa cap alteració dels terminis per exercir els recursos pertinents ni de qualsevol altre aspecte de la gestió tributària, que s’ha de regir per la seva normativa específica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;span style="color: black;"&gt;Article 10. Infraccions i sancions&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;- Pel que fa a la qualificació d’infraccions tributàries i a les sancions que corresponguin en cada cas, cal atenir-se a allò que disposa la Llei general tributària.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;span style="color: black;"&gt;-&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: black;"&gt; Es sancionarà el dipòsit de residus al terme municipal, de qualsevol tipus, no produïts en aquest, o aportats per persones que no estan incloses com a subjectes actius a l’epigraf 3 de la&lt;/span&gt; l’Ordenança Fiscal de la Taxa de recollida, transport i tractament dels residus sòlids de Valldemossa, de l’any en curs.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;span style="color: black;"&gt;Disposició addicional&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;Els Serveis Socials Municipals estudiaran la situació d’aquelles persones que per causes socials no puguin cumpir els requeriments de l’Ordenança, trobant la solució proporcional més adient.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;span style="color: black;"&gt;Disposició final&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;Aquesta Ordenança entra en vigor l’1 de gener de 2016 i serà vigent fins que es modifiqui o es derogui.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
