	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;De conformitat amb allò previst a l'article 8, de la llei 30/1992, de 26 de novembre, de règim jurídic de les administracions publiques i procediment administratiu comú, es fa public la assignatura del següent conveni: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;Conveni de col·laboració entre el Consell Insular de Formentera i el Club Tennis Illa de Formentera, per fomentar, promocionar, organitzar i executar el Tennis al Municipi de Formentera, amb la redacció que a continuació es recull:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="center"&gt;
	&lt;strong&gt;&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;REUNITS&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;El Sr. Jaume Ferrer Ribas, major d’edat, amb DNI (...), amb domicili, a efectes de notificacions, a la plaça de la Constitució núm. 1, Sant Francesc Xavier, Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family: 'times new roman', times, serif;"&gt;El Sr. Josep Lairon Hernandis, major d’edat, amb DNI (...), i domicili a efectes de comunicació al (...), (...) Formentera.&lt;/span&gt;&lt;/p&gt;
&lt;h1 align="center"&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;INTERVENEN&lt;/span&gt;&lt;/span&gt;&lt;/h1&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;El Sr. Jaume Ferrer Ribas, president del Consell Insular de Formentera, qui actua en nom i representació d’aquesta Corporació, amb CIF P0702400C i amb domicili a la plaça de la Constitució núm. 1, de Sant Francesc Xavier, en virtut de l’Acte del Ple del Consell Insular de Formentera de data 11 de junt de 2011, d’acord amb l’article 136 del Reglament Orgànic del Consell Insular de Formentera (ROC) i en virtut de l’article 21.1.b) de la Llei 7/1985, de 2 d’abril, reguladora de les bases de règim local, de la Llei Orgànica 5/1985, de 19 de juny, de règim electoral general i de l’article 9 de la Llei 8/2000, de 27 d’octubre, de consells insulars. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family: 'times new roman', times, serif;"&gt;El Sr. Josep Lairon Hernandis, president del Club Tennis Illa de Formentera, qui actua en representació del citat Club, el qual disposa de CIF G57285876, i domicili a efecte de notificacions al carrer Eivissa número 2, segons l'Acta de l’Assemblea General Extraordinària del Club Tennis Illa de Formentera, de data 26 d’octubre de 2012.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family: 'times new roman', times, serif;"&gt;Ambdues parts actuen en representació de les seves respectives entitats, es reconeixen mútuament plena capacitat jurídica per obrar, i.&lt;/span&gt;&lt;/p&gt;
&lt;p align="center"&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;&lt;strong&gt;MANIFESTEN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong style="font-family: 'times new roman', times, serif;"&gt;Primer.- &lt;/strong&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt;L’article 70.9 de la Llei Orgànica 2/1983, de 25 de febrer, modificada per la Llei Orgànica 1/2007, de 28 de febrer, de reforma de l’Estatut d’Autonomia de les Illes Balears, estableix que una de les competències pròpies dels Consells Insulars és: “Esport i lleure. Foment i promoció de les&amp;nbsp; activitats esportives i de lleure.”&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong style="font-family: 'times new roman', times, serif;"&gt;Segon.- &lt;/strong&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt;Que el Consell Insular de Formentera està interessat en promocionar activament l'esport del Tennis, a l'illa de Formentera.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong style="font-family: 'times new roman', times, serif;"&gt;Tercer.- &lt;/strong&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt;Que el Club Tennis Illa de Formentera té la voluntat que hi hagi una promoció, una&amp;nbsp; planificació, una organització i una execució del Tennis al municipi de Formentera.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong style="font-family: 'times new roman', times, serif;"&gt;Quart.-&lt;/strong&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt; Que és voluntat del Consell Insular de Formentera col·laborar amb el Club Tennis Illa de Formentera, perquè es dugui a terme la programació del Tennis.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong style="font-family: 'times new roman', times, serif;"&gt;Cinquè.- &lt;/strong&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt;Que la importància de l’esport va ser recollida en el conjunt de principis rectors de la política social i econòmica de la Constitució Espanyola, i així el seu article 43.3 estableix que els poders públics fomentaran l’educació física i l’esport, i facilitaran l’adequada utilització del lleure.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family: 'times new roman', times, serif;"&gt;La Llei 14/2006, de 17 d’octubre, de l’esport de les Illes Balears, en la seva exposició de motius&amp;nbsp; disposa: “&lt;/span&gt;&lt;em style="font-family: 'times new roman', times, serif;"&gt;L’esport, entès com l’expressió de l’activitat física, reglada o no, és un bé per a la societat i cal tenir-ne cura, potenciar-lo i possibilitar que tota la ciutadania de les Illes tingui opcions de practicar-lo, de forma individual o formant part de les diferents i necessàries organitzacions esportives que el gestionen i que són igualment valorades i necessàries en la societat.”&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family: 'times new roman', times, serif;"&gt;Així mateix, l’article 3 de l’esmentada Llei de l’esport, disposa: “ &lt;/span&gt;&lt;em style="font-family: 'times new roman', times, serif;"&gt;L’activitat física i l’esport són funcions socials que contribueixen al desenvolupament i a la formació integral de les persones i a la millora de la seva qualitat de vida.”&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family: 'times new roman', times, serif;"&gt;L’article 11 apartat a) de la Llei 14/2006, de 17 d’octubre, estableix que una de les competències dels consells insulars és&lt;/span&gt;&lt;em style="font-family: 'times new roman', times, serif;"&gt;: ”Col·laborar, dins el seu àmbit territorial, amb les altres administracions i amb les entitats en el bon desenvolupament de l’esport base&lt;/em&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt;.”; i el mateix article al seu apartat d), disposa: “&lt;/span&gt;&lt;em style="font-family: 'times new roman', times, serif;"&gt;Impulsar delegacions insulars de les federacions esportives reconegudes per aquestes a l’àmbit de les Illes Balears i assessorar-les pel que fa als aspectes que puguin ser d’utilitat, en coordinació amb la federació esportiva &lt;/em&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt;corresponent.”&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong style="font-family: 'times new roman', times, serif;"&gt;Sisè.- &lt;/strong&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt;L’article 176 de la Llei 20/2006, de 15 de desembre, municipal i de règim local de les Illes Balears, que disposa: &lt;/span&gt;&lt;em style="font-family: 'times new roman', times, serif;"&gt;“les entitats locals poden atorgar ajudes econòmiques a entitats privades que realitzin activitats d'interès públic que complementin o supleixin les de l’entitat local”,&lt;/em&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt; i l’article 22.2.&lt;/span&gt;&lt;em style="font-family: 'times new roman', times, serif;"&gt;c&lt;/em&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt; de la Llei 38/2006, de 17 de novembre, general de subvencions, disposa&lt;/span&gt;&lt;em style="font-family: 'times new roman', times, serif;"&gt;:” l’Administració podrà concedir subvencions de forma directa, amb caràcter excepcional, sempre que s’acreditin raons d'interès públic, social, econòmic o humanitari&lt;/em&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt;”, i la normativa autonòmica en vigor, concretament la disposició addicional segona del Decret legislatiu 2/2005, de 28 de desembre, Text Refós de la Llei de Subvencions de les Illes Balears.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong style="font-family: 'times new roman', times, serif;"&gt;Setè.-&lt;/strong&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt; L’Àrea d’Esports del consell Insular de Formentera, va informar favorablement la redacció d’un de conveni de col·laboració amb l’únic Club de Tennis que hi ha l'illa de Formentera, per a la promoció, planificació i foment del Tennis al municipi de Formentera, en data 22 de maig de 2013, el qual s’ha d’entendre com una relació jurídica exempta de l’aplicació del Reial Decret legislatiu 3/2011, de 14 de novembre, pel qual s’aprova el text refòs de la Llei de Contractes del Sector Públic, segons el disposat al seu article 4.1 d ).&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;En virtut de l’exposat anteriorment, ambdues parts acorden formalitzar aquest conveni, d’acord amb les següents&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong style="font-family: 'times new roman', times, serif;"&gt;CLÀUSULES&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong style="font-family: 'times new roman', times, serif;"&gt;Primera.- &lt;/strong&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt;El Consell Insular de Formentera realitzarà una aportació de 30.000,00 euros, IVA inclòs, per a l’efectiva realització de la promoció del Tennis, amb càrrec a la partida pressupostària 2015,341,48000,01 dels pressupostos generals del Consell Insular de Formentera, per l’any 2015.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong style="font-family: 'times new roman', times, serif;"&gt;Segona.-&lt;/strong&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt; Que el Club Tennis Illa de Formentera es farà càrrec de la promoció, planificació, organització i execució del Tennis a Formentera.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong style="font-family: 'times new roman', times, serif;"&gt;Tercera.-&lt;/strong&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt; Que el Club Tennis Illa de Formentera es farà càrrec del manteniment bàsic de l’ús diari de la instal·lació a la qual diàriament es practica el tennis a Formentera.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family: 'times new roman', times, serif;"&gt;Aquest manteniment, entre d’altres aspectes, comporta:&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family: 'times new roman', times, serif;"&gt;1. Mantenir en perfecte estat de neteja i decòrum la instal·lació, complint en tot moment amb les condicions higièniques, sanitàries i de qualsevol tipus establertes per la normativa d’aplicació.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family: 'times new roman', times, serif;"&gt;2. La neteja s’estendrà a la totalitat de la instal·lació esportiva, incloent terres, paviments horitzontals i verticals, portes, finestres mobiliari i altres estris, serveis higiènics, dutxes o qualsevol altre anàleg existent.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong style="font-family: 'times new roman', times, serif;"&gt;Quarta.-&lt;/strong&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt; El Club Tennis Illa de Formentera, haurà de presentar davant el Consell Insular de Formentera, un mes abans de l’inici de la temporada esportiva, la programació anual de les activitats a realitzar.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong style="font-family: 'times new roman', times, serif;"&gt;Cinquena.-&lt;/strong&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt; En la publicitat de les activitats realitzades pel Club Tennis Illa de Formentera a les instal·lacions municipals de Formentera, haurà d’aparèixer en tot moment el logotip del Consell Insular de Formentera, com a entitat col·laboradora.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong style="font-family: 'times new roman', times, serif;"&gt;Sisena.&lt;/strong&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt; El Club Tennis Illa de Formentera presentarà al Departament d’intervenció del Consell Insular de Formentera, els documents (factures originals o compulsades, etc.) que acreditin que efectivament s’ha realitzat la despesa. El primer termini de presentació de les justificacions, serà fins a l’1 de juliol de 2015, i el segon, fins al&amp;nbsp; 15 de gener de 2016.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong style="font-family: 'times new roman', times, serif;"&gt;Setena.- &lt;/strong&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt;De forma prèvia als dos pagaments&amp;nbsp; de les quantitats esmentades a la clàusula dotzena, un tècnic de l'Àrea d'Esports del Consell de Formentera, emetrà un informe en el que es faci constar si efectivament s’està realitzant aquesta promoció de l’esport del tennis, i si la forma és l’adequada.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong style="font-family: 'times new roman', times, serif;"&gt;Vuitena.- &lt;/strong&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt;El Consell Insular de Formentera supervisarà el desenvolupament de les activitats esmentades en aquest conveni de col·laboració i informarà al Club de tennis de qualsevol incidència que s’hagi pogut produir, perquè en tingui coneixement, i pugui realitzar les gestions pertinents al respecte. En el cas que el Club no realitzi les actuacions al respecte, el Consell podrà prendre les mesures pertinents.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong style="font-family: 'times new roman', times, serif;"&gt;Novena&lt;/strong&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt;.- El Club Tennis Illa de Formentera es responsabilitza de què la programació esportiva vinculada a aquest conveni de col·laboració, faci servir el logotip del Consell Insular de Formentera, de forma correcta.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong style="font-family: 'times new roman', times, serif;"&gt;Desena.-&lt;/strong&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt; El Club Tennis Illa de Formentera s’ajustarà a les tarifes establertes en l’Ordenança fiscal reguladora de la taxa per la utilització privativa de les instal·lacions municipals i la prestació de serveis o realització d’activitats esportives, la qual disposa:.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;&lt;em&gt;(::.)&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;
	&lt;span style="font-family: 'times new roman', times, serif;"&gt;El Club Tennis Illa de Formentera podrà efectuar una bonificació als seus socis sobre el preu total del lloguer de les pistes de tennis.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong style="font-family: 'times new roman', times, serif;"&gt;Onzena.-&lt;/strong&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt; El Club podrà realitzar a les instal·lacions, les millores i tota mena d'obres que consideri necessàries per adaptar-les al bon funcionament dels serveis que ha de prestar.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family: 'times new roman', times, serif;"&gt;A la finalització d’aquest conveni, restaran en benefici del Consell Insular de Formentera les obres o millores que s’hagin dut a terme en les instal·lacions, i no se’n puguin separar&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family: 'times new roman', times, serif;"&gt;Els béns fungibles (pilotes, raquetes, material esportiu divers,etc...), a la finalització d’aquest conveni, restaran en benefici del Consell Insular de Formentera. &amp;nbsp;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong style="font-family: 'times new roman', times, serif;"&gt;Dotzena.-&lt;/strong&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt; La forma de pagament d’aquest conveni és la següent: el Consell Insular de Formentera abonarà al Club Tennis Illa de Formentera un 50% de la quantitat total, és a dir, quinze mil euros (15.000,00), en el moment de la signatura del conveni, i el 50% restant (15.000,00 euros), en el moment en què el Club realitzi la primera justificació del conveni, com a màxim el dia 1 de juliol del 2015.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family: 'times new roman', times, serif;"&gt;Abans de la finalització d’aquest conveni, i abans de signar un nou conveni, s’haurà de justificar la totalitat de l’import del conveni.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family: 'times new roman', times, serif;"&gt;D’acord amb els articles 42 i ss del Reial decret 887/2206, de 21 de juliol, Reglament de subvencions, en relació amb l’article 17 de la Llei 38/2003, de 17 de novembre, general de subvencions , s’eximeix al Club Tennis Illa de Formentera de la presentació de garantia.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong style="font-family: 'times new roman', times, serif;"&gt;Tretzena.-&lt;/strong&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt; Atès els pactes establerts amb els treballadors del Consell Insular de Formentera, aquest assumirà el descompte del 55% de les quotes que el Club Tennis Illa de Formentera ha de efectuar als treballadors de la Corporació.&amp;nbsp;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family: 'times new roman', times, serif;"&gt;El Club de Tennis Illa de Formentera haurà de presentar a l’Àrea d’esports del Consell Insular de Formentera, una relació mensual, en la que constin els usuaris que gaudeixen d’aquest descompte, i la factura pertinent.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong style="font-family: 'times new roman', times, serif;"&gt;Catorzena.-&lt;/strong&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt; Aquest conveni és vigent des del dia de la seva signatura fins al dia 15 de gener de 2016&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong style="font-family: 'times new roman', times, serif;"&gt;Quinzena.-&lt;/strong&gt;&lt;span style="font-family: 'times new roman', times, serif;"&gt; Aquest conveni es podrà resoldre, amb audiència prèvia de les parts, entre d’altres, per les causes següents:&lt;/span&gt;&lt;/p&gt;
&lt;ul&gt;
	&lt;li&gt;
		&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;El mutu acord entre les parts, que s’ha de formalitzar per escrit&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;
		&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;L’incompliment de les obligacions essencials de les parts.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;
	&lt;span style="font-family: 'times new roman', times, serif;"&gt;En el cas que la resolució del conveni fos per l’incompliment per part del Club Tennis Illa de Formentera, aquest haurà de reintegrar les quantitats percebudes com aportació econòmica derivada del conveni.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;&lt;strong&gt;Setzena.-&lt;/strong&gt; Donada la naturalesa juridicoadministrativa d’aquest conveni de col·laboració, les qüestions litigioses que puguin derivar-se de la interpretació, l'execució i, si s'escau, la resolució d’aquest conveni s’ha de sotmetre a la jurisdicció contenciosa administrativa, segons l’establert a la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;I en prova de conformitat, ambdues parts signen aquest conveni de col·laboració per duplicat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
