290 text/html 2015-05-23 565398 9206 CAIB 2015-05-22 ca 28020 CAIB 28023 ![CDATA[Acord del Consell de Govern de 22 de maig de 2015 pel qual es declaren zones especials de conservació (ZEC) trenta llocs d’importància comunitària (LIC) de les Illes Balears]] 2015-05-23 ca ![CDATA[<p> <span style="font-family:times new roman,times,serif;font-size:12px;">La xarxa ecològica europea Natura 2000 s’ha configurat en aplicació de la Directiva&nbsp;92/43/CEE del Consell, de 21 de maig de 1992, relativa a la conservació dels hàbitats naturals i de la flora i la fauna silvestres (Directiva d’hàbitats) i de la Directiva 2009/147/CE del Parlament Europeu i del Consell, de 30 de novembre de&nbsp;2009, relativa a la conservació de les aus silvestres (Directiva d’aus), ambdues transposades a l’ordenament jurídic espanyol mitjançant la Llei 42/2007, de 13 de desembre, del patrimoni natural i de la biodiversitat.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La xarxa Natura 2000 està formada pels llocs d’importància comunitària (LIC), per les zones especials de conservació (ZEC) i per les zones d’especial protecció per a les aus (ZEPA), i té com a finalitat garantir l’estat de conservació favorable dels tipus d’hàbitats naturals i dels hàbitats de les espècies pels quals aquests esmentats espais s’han inclòs en la xarxa Natura 2000.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La Comissió Europea, mitjançant la Decisió 2006/613/CE, adoptà una llista inicial de LIC per a la regió biogeogràfica mediterrània d’acord amb la Directiva&nbsp;92/43/CEE. En aquesta llista s’integraven els LIC de les Illes Balears que prèviament havia proposat el Consell de Govern de 3 de març de 2006 i els LIC que s’havien proposat en el Decret 29/2006, de 24 de març, pel qual s’aprova l’ampliació de la llista de LIC a l’àmbit de les Illes Balears. A aquests, s’hi han d’afegir onze LIC de basses temporals mediterrànies a Menorca i Formentera que es varen proposar mitjançant l’Acord del Consell de Govern de 24 de setembre de&nbsp;2010, aprovats per la Decisió 2012/9/UE de la Comissió, de 18 de novembre de&nbsp;2011, per la qual s’adopta, de conformitat amb la Directiva 92/43/CE del Consell, la cinquena llista actualitzada de llocs d’importància comunitària de la regió biogeogràfica mediterrània.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">De la mateixa manera, mitjançant un acord del Consell de Govern, el dia 12 de juliol de 2013 es va aprovar la proposta d’ampliació de la llista de LIC en l’àmbit de les Illes Balears amb la incorporació de l’espai Puig Malet i Santa Eularieta, que va ser aprovada per la Decisió 2015/74 de la Comissió, de 3 de desembre de 2014, per la qual s’adopta la vuitena llista actualitzada de llocs d’importància comunitària de la regió biogeogràfica mediterrània.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">D’acord amb els articles 4 i 6 de la Directiva d’hàbitats i 44 i 45 de la Llei 42/2007, les comunitats autònomes, amb un tràmit previ d’informació pública, han de declarar ZEC els LIC, a més de les ZEPA, en l’àmbit territorial propi, i fixar les mesures de conservació necessàries que responguin a les exigències ecològiques dels tipus d’hàbitats naturals i de les espècies d’interès comunitari presents en aquestes àrees.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les mesures de conservació han d’implicar els plans o els instruments de gestió adequats i les mesures reglamentàries, administratives o contractuals apropiades. La declaració de les ZEC s’ha d’aprovar al més aviat possible i com a màxim en un termini de sis anys des de l’adopció de la llista inicial de LIC per a la regió biogeogràfica mediterrània.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Per a la declaració de ZEC, cal que el pla o l’instrument de gestió hagi estat aprovat amb anterioritat o que s’aprovi conjuntament amb aquesta declaració, d’acord amb l’article 42.3 de la Llei 42/2007. Les ZEPA, però, no cal que compleixin aquest requisit, atès que no estan afectades per les disposicions d’aquest article de la Llei. Tanmateix, segons la jurisprudència del Tribunal de Luxemburg, “els estats han de garantir que la classificació d’un lloc com a ZEPA impliqui automàticament i simultàniament l’aplicació d’un règim de protecció i conservació conforme amb el dret comunitari”.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">D’acord amb la Llei 5/2005, de 26 de maig, per a la conservació dels espais de rellevància ambiental (LECO), modificada per la Llei 6/2009, de 17 de novembre, de mesures ambientals per impulsar les inversions i l’activitat econòmica a les Illes Balears, correspon al Consell de Govern, mitjançant un acord, la declaració com a ZEC dels LIC que hagin estat seleccionats i designats per la Comissió Europea, seguint el procediment que estableix l’article 9 de la LECO.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Així, en compliment de l’article 9.2 <em>a</em> de la LECO, el 2 d’agost de 2013 el Consell de Govern va acordar iniciar el procediment per declarar ZEC els LIC de les Illes Balears que figuren en l’annex I de l’Acord i facultar el conseller d’Agricultura, Medi Ambient i Territori per a la tramitació administrativa que correspon per elaborar els documents dels plans o els instruments de gestió de les ZEC.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">D’acord amb l’article 38.3 de la Llei 5/2005, els plans o els instruments de gestió de les ZEC s’han d’aprovar per mitjà d’un decret del Govern de les Illes Balears.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En l’elaboració dels plans de gestió s’han seguit les directrius de conservació de la xarxa Natura 2000 a Espanya, aprovades per l’Acord de la Conferència Sectorial de Medi Ambient de 13 de juliol de 2011, que recull la Resolució de 21 de setembre de&nbsp;2011 de la Secretaria d’Estat de Canvi Climàtic (BOE núm. 244, de 10 d’octubre de 2011).</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Així mateix, s’ha seguit un procés de participació pública en el qual els esborranys dels plans de gestió de la Serra de Tramuntana, de l’Arxipèlag de Cabrera i de ses Salines d’Eivissa i Formentera es varen sotmetre a l’audiència dels titulars de drets i interessos legítims mitjançant les associacions i les entitats representatives, les associacions amb objectius de conservació ambiental i la ciutadania possiblement interessada. També hi varen participar les administracions competents en ordenació del territori i urbanística, els ajuntaments afectats i els consells insulars. Aquestes aportacions i les contestacions motivades s’han materialitzat en dos informes, un sobre la primera part del document —la diagnosi—, i l’altre sobre la segona part —els objectius i les mesures de gestió.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els tres plans de gestió i l’expedient de declaració de trenta ZEC, entre d’altres, s’han sotmès a informació pública durant un període d’un mes, segons es va anunciar en el BOIB núm. 131, de 27 de setembre de 2014, en el tauler d’anuncis dels consells insulars i dels ajuntaments afectats i en dos diaris de les illes afectades.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">D’altra banda, entre les ZEC declarades s’inclouen les d’àmbit maritimoterrestre incloses en els plans de gestió Natura 2000 de la Serra de Tramuntana, de l’Arxipèlag de Cabrera i de ses Salines d’Eivissa i Formentera, a les quals s’ha reconegut la continuïtat ecològica de l’ecosistema marí amb l’espai natural terrestre (informes de 24 d’octubre de 2014 del director general de Sostenibilitat de la Costa i del Mar, del Ministeri d’Agricultura, Alimentació i Medi Ambient, i de 18 de febrer de 2015 del director de l’Institut Espanyol d’Oceanografia). D’acord amb la Llei 42/2007, correspon al Govern de les Illes Balears declarar ZEC aquestes LIC i gestionar-les.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els plans de gestió Natura 2000 de la Serra de Tramuntana, de l’Arxipèlag de Cabrera i de ses Salines d’Eivissa i Formentera i la declaració de les trenta ZEC s’han sotmès als informes dels serveis jurídics de la Conselleria d’Agricultura, Medi Ambient i Territori, de la Comissió de Coordinació de Política Territorial i de la Secretaria General sobre la correcció del procediment seguit i la valoració de les al·legacions presentades.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Atès que en la sessió d’avui el Consell de Govern ha aprovat, mitjançant un decret, els plans de gestió dels LIC objecte d’aquest Acord, el Consell de Govern, a proposta del conseller d’Agricultura, Medi Ambient i Territori, en la sessió de dia 22 de maig de 2015 adoptà, entre d’altres, l’Acord següent:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">“<strong>Primer.</strong> Declarar zones especials de conservació (ZEC) els llocs d’importància comunitària (LIC) que es recullen en l’annex I.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Segon.</strong> Informar que els límits geogràfics, els hàbitats i les espècies pels quals aquests LIC es declaren ZEC figuren en el Pla de Gestió Natura 2000 de la Serra de Tramuntana, el Pla de Gestió Natura 2000 de l’Arxipèlag de Cabrera i el Pla de Gestió Natura 2000 de ses Salines d’Eivissa i Formentera, que s’han aprovat en aquesta sessió.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Tercer.</strong> Facultar el conseller d’Agricultura, Medi Ambient i Territori per trametre aquest Acord i l’annex al Ministeri d’Agricultura, Alimentació i Medi Ambient, per mitjà del procediment que estableix l’Ordre AAA/2230/2013, de 25 de novembre, per la qual es regula el procediment de comunicació entre les administracions autonòmiques, estatal i comunitària de la informació oficial dels espais protegits Xarxa Natura 2000, perquè aquest ho comuniqui a la Comissió Europea.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Quart.</strong> Notificar aquest Acord i l’annex als consells de Mallorca, Eivissa i Formentera i a tots els ajuntaments a l’àmbit territorial dels quals pertany alguna de les ZEC.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Cinquè</strong>.
