Números de l'1 al 151]] text/html CAIB CAIB 6689 2015-04-17 19725 2015-04-21 770 ca ![CDATA[<p> <span style="font-family:times new roman,times,serif;font-size:12px;">Intentades sense efecte les notificacions per correu certificat amb justificant de recepció, i sense haver-se pogut efectuar per ignorar-se el domicili o no haver-hi trobat les persones interessades, es procedeix, en compliment del que estableix l’article 59.4 de la Llei 30/1992 de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú – BOE de 27 de novembre –, a la publicació en el Butlletí Oficial de les Illes Balears, així com en els taulers de anuncis del Ajuntament de Santa Eulària des Riu de la següent proposta de resolució:</span></p> <p align="center"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>“DECRET DE DATA 09/04/2015</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Sra. María Ferrer Torres, Regidora Delegada a l'Àrea I d'Administració Local, Serveis Generals de l'Ajuntament de Santa Eulària des Riu, Eivissa, Balears, en exercici de les facultats que tenc delegades per l'Alcaldia en virtut de Decret de data 11 de juny de 2011.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Vist l’escrit de la Policia Local en el qual informa dels vehicles que es troben en la via pública, depòsit municipal o solars particulars en situació d’abandó.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">RESULTANT: Que d’acord amb el que estableix la Llei 11/99, que modifica el Reial decret legislatiu 339/90, de 2 de març, modificat per la Llei 5/97, de 24 de març, en allò que fa referència a la determinació de l’estat d’abandonament dels vehicles, s’estableix que </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">“es presumirà racionalment el seu abandonament en els següents casos:</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">A) Quan transcorrin més de dos mesos des que el vehicle hagi estat dipositat, desprès de la seva retirada de la via pública per l’autoritat competent.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">B) Quan es trobi estacionat per un període superior a un mes en el mateix lloc i presenti desperfectes que facin impossible el desplaçament pels seus propis mitjans o li faltin plaques de matriculació.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">C) S’entén igualment que té consideració de residu sòlid urbà quan el vehicle es trobi en les mateixes condiciones que en l’apartat b) anterior i aquest ubicat en finca privada, al final de la seua vida útil d’acord amb l’article 2 del Reial decret 1383 de 2002.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">RESULTANT: Que sobre la base de l’establert en l’art. 3.B) de la Llei de 10/98 de residus, s’entén que el vehicle abandonat és un residu sòlid urbà, i l’article 4.3, de la mateixa Llei, atorga competències a les entitats locals per a la gestió d’aquests.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">CONSIDERANT: Que els esmentats vehicles es troben en el supòsit anteriorment esmentat.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Aquesta Regidoria, a la vista dels fets assenyalats i en ús de les atribucions que li confereix la legislació vigent,</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>DISPÒS:</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1 El tractament com a residu sòlid urbà dels vehicles que a continuació es relacionen.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2 Notificar resolució als titulars dels vehicles les dades dels quals són coneguts, atorgant als titulars dels mateixos, basant-se en l'establert en l'Art. 40.1 de la Llei 10/98 de Residus, un termini de 15 dies des de la data de recepció de la notificació, perquè pugui aportar quantes al·legacions, documents o informacions estimi convenients.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3 Considerar abandonats i no identificats els vehicles continguts en la següent relació sense matrícula o que no figurin en el Registre Central de Vehicles de la Prefectura Provincial de Trànsit i, per tant, residu sòlid urbà. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Si no estau d’acord amb el contingut del decret disposau d’un termini de 15 dies, comptant des de l’endemà de la recepció d’aquesta notificació, per al·legar tot allò que considereu convenient per a la vostra defensa i per proposar les proves que cregueu oportunes. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Si en el termini de 15 dies no procediu a la retirada o no rebem noticies vostres, d’acord amb l’establert en la Llei 11/99, de 21 d’abril, de modificació de la Llei reguladora de les bases de règim local, i altres mesures per al desenvolupament local en matèria de trànsit, circulació de vehicles a motor i seguretat vial, en el seu article 2, es procedirà al seu tractament com a residu sòlid urbà, i s’iniciarà el corresponent expedient sancionador en base a l’article 34.3.b de la Llei 10/98 de residus, amb sanció entre 601,00 euros i 30.000 euros, i us informam que si procediu a la renúncia expressa de la titularitat del vehicle a favor de l’Ajuntament no s’incoarà expedient sancionador, entenent la seua participació segons el que disposa l’article 11 de l’esmentada Llei.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Aquesta renúncia o al·legacions han de presentar-se al Registre General de l’Ajuntament o al Registre Auxiliar de la Policia Local, dirigits a l’Alcaldia i indicant les vostres dades personals, domicili, data, número de decret i matrícula del vehicle.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:10px;"><span style="font-size: 12px;">Tot això sens perjudici dels deutes que s’hagin generat amb la Hisenda
