2015-03-31 ![CDATA[Resolució d'atorgament de les ajudes econòmiques de l’Institut Mallorquí d’Afers Socials per al finançament del transport escolar especial per a persones amb discapacitat per a l’any 2014]] 2015-03-27 CAIB 5591 ![CDATA[<p> <span style="font-family:times new roman,times,serif;font-size:12px;">El dia 26 de març de 2015, la presidenta de l’Institut Mallorquí d’ Afers Socials ha dictat la següent resolució:&nbsp;</span></p> <p class="western" lang="ca-ES"> <span style="font-family:times new roman,times,serif;font-size:12px;"><b>«Resolució d'atorgament de les ajudes econòmiques de l’Institut Mallorquí d’Afers Socials per al finançament del transport escolar especial per a persones amb discapacitat per a l’any 2014</b></span></p> <p class="western" lang="ca-ES"> <span style="font-family:times new roman,times,serif;font-size:12px;">&nbsp;<b>Antecedents:</b></span></p> <p class="western" lang="ca-ES" style="font-weight: normal"> <span style="font-family:times new roman,times,serif;font-size:12px;">1. El 2 de març de 2015, la presidenta de l’Institut Mallorquí d’Afers Socials (IMAS) va aprovar l’expedient de convocatòria pública d’ajudes econòmiques <span style="font-weight: normal;">de l’Institut Mallorquí d’Afers Socials per al finançament del transport escolar especial per a persones amb discapacitat per a l’any 2014 </span>i va autoritzar la despesa dimanant d’aquest expedient amb càrrec a la partida pressupostària <font color="#000000">40.23128.48981 de</font>l pressupost de despeses de l’IMAS per a l’any 2015 per un import de dos-cents vint-i-set mil tres-cents seixanta-cinc euros amb trenta-nou cèntims (227.365,39<font color="#ff0000"> </font>€).&nbsp;</span></p> <p class="western" lang="ca-ES" style="font-weight: normal"> <span style="font-family:times new roman,times,serif;font-size:12px;">2. La convocatòria es va publicar en el BOIB núm.<font color="#000000"> 32, de 5 de març de 2015.</font>&nbsp;</span></p> <p class="western" lang="ca-ES" style="font-weight: normal"> <span style="font-family:times new roman,times,serif;font-size:12px;">3. Una vegada revisades les sol·licituds admeses i esmenades, si era possible, les deficiències que presentaven, la Comissió Avaluadora es va reunir el 20 de març de 2015. Aplicats els criteris de valoració establerts a les bases i a la convocatòria, va formular la corresponent proposta de resolució.</span></p> <p class="western" lang="ca-ES" style="font-weight: normal"> <span style="font-family:times new roman,times,serif;font-size:12px;"><b>Consideracions jurídiques:</b>&nbsp;</span></p> <p class="western" lang="ca-ES" style="font-weight: normal"> <span style="font-family:times new roman,times,serif;font-size:12px;">1. El Ple del Consell de Mallorca, en data 5 de maig de 2005, aprovà les bases reguladores de les ajudes econòmiques individuals de la Direcció de l’Àrea de Serveis Socials de l’Institut (BOIB núm. 99 de dia 30 de juny), d’acord amb què preveu la Llei 38/2003, de 17 de novembre, general de subvencions, aplicable en els termes previstos a la disposició final primera, i el Decret legislatiu 2/2005, de 28 de desembre, pel qual s’aprova el Text refós de la Llei de subvencions.&nbsp;</span></p> <p class="western" lang="ca-ES" style="font-weight: normal"> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Assenyala la DA segona del Decret legislatiu 2/2005, de 28 de desembre, pel qual s’aprova el Text refós de la Llei de subvencions, que els consells insulars han d’adequar la concessió de subvencions al que disposa aquesta llei quan aquella es desenvolupi en matèries en les quals la comunitat autònoma els hagi atribuït competències.&nbsp;</span></p> <p class="western" lang="ca-ES" style="font-weight: normal"> <span style="font-family:times new roman,times,serif;font-size:12px;">3. D'acord amb l'article 3 dels Estatuts de l'IMAS, aquest organisme té personalitat jurídica pròpia i la capacitat d'obrar necessària per complir els seus fins. Entre les seves facultats, es troba la d’atorgar subvencions.&nbsp;</span></p> <p lang="ca-ES" style="font-weight: normal"> <span style="font-family:times new roman,times,serif;font-size:12px;">4. L’article 7.2 g dels Estatuts de l'IMAS estableix que correspon a la Presidència aprovar i resoldre els procediments d’ajudes i subvencions.&nbsp;&nbsp;</span></p> <p class="western" lang="ca-ES"> <span style="font-family:times new roman,times,serif;font-size:12px;"><span style="font-weight: normal;">5.<span style="font-weight: normal;"> </span>D’</span><span style="font-weight: normal;">acord<span style="font-weight: normal;"> </span>amb l'article 17 del Decret legislatiu 2/2005 pel qual s'aprova el text refós de la Llei de subvencions, el concurs constitueix la via ordinària de selecció dels beneficiaris.
