	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;Antecedents&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;1. La Central Corporativa de Compres i Logística (C3L) es configura com un nou projecte de centralització dels serveis amb el qual es pretén aconseguir millores importants en la gestió de les compres i en la logística.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;2. El projecte centralitza i unifica la totalitat dels recursos materials i humans en matèria de compres —que fins a l’actualitat han estat en mans de les diferents gerències territorials del Servei de Salut de les Illes Balears— amb la finalitat d’unificar totes les unitats o departaments en el nou servei centralitzat, adscrit als Serveis Centrals del Servei de Salut. &lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;3. Per poder fer efectiu el funcionament normal de la C3L, cal dotar-la del personal necessari per acomplir les funcions assignades. Amb aquesta finalitat, el 16 de gener de 2015 el Consell de Govern va adoptar un acord pel qual s’aprova el “Pla d’ordenació dels recursos humans pel qual el personal de compres de les gerències s’integra en la Central Corporativa de Compres i Logística del Servei de Salut de les Illes Balears i es regula el procediment de mobilitat per raó del servei que se’n deriva i es reordena el personal”. L’Acord es va publicar íntegrament en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt; el 17 de gener de 2015.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;4. El Pla disposa que cal implementar diverses mesures d’identificació, mobilitat i reordenació de personal, i de modificacions de plantilles. Així doncs, cal dur a terme les actuacions següents després d’haver identifica el personal afectat: &lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;· Per una banda, cal dur a terme un procés de mobilitat per raó del servei per tal de destinar als Serveis Centrals el personal fix que presta servei als departaments de compres adscrits a les gerències territorials del Servei de Salut, i integrar-lo en la plantilla corresponent. La mobilitat suposa un canvi d’adscripció, de manera que les persones afectades passaran a integrar la plantilla orgànica dels Serveis Centrals.&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;· Pel que fa al personal que estigui en les situacions de comissió de serveis o de promoció interna temporal, o que ocupi un lloc de comandament intermedi, cal actuar de la manera establida en el Pla.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;5. Una vegada identificades les persones afectades per les mesures previstes en el Pla, cal implementar el procés de mobilitat oportú, de conformitat amb les indicacions aprovades pel Consell de Govern.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;Consideracions jurídiques&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;1. La C3L és el resultat d’un projecte que centralitza i unifica la gestió i la totalitat dels recursos materials i humans en matèria de compres. Amb aquesta finalitat, cal reordenar el personal afectat perquè passi a dependre dels Serveis Centrals del Servei de Salut. Per això era necessari dissenyar un pla d’ordenació dels recursos humans (PORH) que establís diverses mesures de gestió de conformitat amb la Llei 55/2003, de 16 de desembre, de l’estatut marc del personal estatutari dels serveis de salut.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;2. Segons l’article 13 de la Llei 55/2003, els PORH són l’instrument bàsic de planificació global dels recursos humans en un servei de salut i han d’especificar els objectius en matèria de personal i els efectius i l’estructura dels recursos humans que es considerin adequats per assolir aquests objectius. &lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;3. De conformitat amb l’article 80 de la Llei 55/2003, relatiu a pactes i acords que s’adopten en el si de les meses de negociació, els PORH s’estableixen com a matèria que ha de ser necessà­riament objecte de negociació.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;4. Per una altra banda, segons l’article 5.2.&lt;em&gt;f&lt;/em&gt; de la Llei 3/2007, de 27 de març, de la funció pública de la Comunitat Autònoma de les Illes Balears, correspon al Consell de Govern aprovar els PORH i els programes específics per optimitzar els recursos humans.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;5. En virtut de les consideracions anteriors, es va dissenyar un PORH relatiu al personal de compres de les gerències, en virtut del qual aquest s’integra en la C3L, entre d’altres mesures de reordenació. Aquest PORH va ser negociat amb les organitzacions sindicals representades en la Mesa Sectorial de Sanitat en la sessió del 22 de desembre de 2014.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;6. En conseqüència, el 17 de gener de 2015 es va publicar en el &lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;l’Acord del Consell de Govern de 16 de gener de 2015 pel qual s’aprova el “Pla d’ordenació dels recursos humans pel qual el personal de compres de les gerències s’integra en la Central Corporativa de Compres i Logística del Servei de Salut de les Illes Balears i es regula el procediment de mobilitat per raó del servei que se’n deriva i es reordena el personal”.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;7. El punt 7 del Pla detalla el procediment que cal seguir per dotar la C3L dels recursos humans adients per acomplir les tasques que té encomanades. El procediment consta de dues fases principals: la primera consisteix en la identificació, la mobilitat i la reordenació del personal; la segona estableix&amp;nbsp; la modificació de plantilles i l’ordenació i la reestructuració internes. Concretament, disposa el següent: &lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;b)&lt;/em&gt;&amp;nbsp; Pel que fa al procés de mobilitat, amb relació al personal estatutari fix que presta servei en els departaments de compres adscrits a les gerències territorials del Servei de Salut, s’ha d’executar el procés per mitjà d’una resolució del director general per la qual —de conformitat amb l’article 36 de la Llei 55/2003— s’acordi destinar als Serveis Centrals les persones que s’hi indiqui i integrar-les en la plantilla corresponent. La mobilitat suposarà el canvi d’adscripció, i per això les persones afectades passaran a integrar la plantilla orgànica dels Serveis Centrals, amb tots els efectes inherents que se’n desprenguin. La resolució, que ha d’indicar la data efectiva de la mobilitat, s’ha de publicar en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;. Contra aquesta resolució s’hi podran interposar els recursos pertinents. A més, la publicació en el BOIB servirà com a notificació a les persones interessades i en substituirà la notificació individualitzada.&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Simultàniament, caldrà dur a terme les actuacions oportunes per adaptar les plantilles orgàniques de les gerències afectades [...].&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;La resolució per la qual s’efectuï el canvi d’adscripció del personal s’ha d’adjuntar a cada un dels expedients personals de les persones interessades, però no caldrà fer-los un nou nomenament, sense perjudici de les adaptacions necessàries i preceptives de les plantilles.&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;El personal afectat pel procediment de mobilitat s’integrarà —a tots els efectes— en els Serveis Centrals, en la mateixa categoria professional de procedència.&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Aquest procés no afectarà els professionals que ja estiguin adscrits als Serveis Centrals, tot i que formaran part de la C3L i s’hi consideraran incorporats directament.&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;c)&lt;/em&gt;&amp;nbsp; Pel que fa a la resta del personal de compres i la resta de situacions que exigeixen reordenar els recursos, caldrà fer els tràmits oportuns perquè tot el personal dels departaments de compres quedi adscrit als Serveis Centrals, de conformitat amb el que estableix aquest PORH. Es duran a terme els tràmits que es descriuen a continuació per a cada circumstància o col·lectiu següents:&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;1) Personal estatutari temporal interí:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;[...] les corresponents places interines a les gerències d’origen, s’amortitzaran i paral·lelament es crearan en la plantilla orgànica dels Serveis Centrals, tot expedint a les persones afectades un nou nomenament de personal temporal interí amb adscripció als Serveis Centrals.&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;2) Comissions de servei: &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;En els casos en què hi pertoqui, s’amortitzaran aquestes places a les gerències d’origen —amb la qual cosa es cancel·larà la comissió de serveis— i paral·lelament es crearan en la plantilla orgànica dels Serveis Centrals i seran assignades a les persones que les ocupaven. El canvi de gerència s’efectuarà per mitjà d’una resolució de mobilitat per raó del servei [...].&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;3) Promocions internes temporals (PIT):&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Si alguna de les persones afectades ocupava una plaça per la via de la promoció interna temporal, se li atorgarà una nova plaça en promoció interna temporal en la plantilla autoritzada dels Serveis Centrals, per part del director general, amb l’avocació prèvia de la competència, si hi escau. Així doncs, la plaça d’origen a la que pertanyia i la plaça ocupada en PIT a la gerència d’origen seran amortitzades i creades a la plantilla orgànica dels Serveis Centrals. A més, la plaça creada i ocupada en PIT serà assignada a la persona que l’ocupava.&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;4) Llocs de comandament intermedi:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Si alguna de les persones afectades ocupa un lloc de comandament intermedi, el traspàs es farà de manera que es mantengui, sense perjudici d’expedir —si hi escau— un nou nomenament en relació amb la nova destinació i les funcions adquirides. S’amortitzaran els llocs de comandament intermedi d’origen i es crearan en la plantilla orgànica autoritzada dels Serveis Centrals i s’assignaran a les persones que els ocupaven. […]&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;8. El punt 7.2.1 del Pla disposa que, una vegada identificats els professionals afectats, s’ha d’implementar un procés de mobilitat per raó del servei, en virtut de l’article 36 de la Llei 55/2003, segons el qual el personal estatutari pot ser destinat a centres o unitats ubicats fora de l’àmbit previst en el seu nomenament, de conformitat amb el que estableixin les normes o els PORH que hagin estat negociats prèviament en les meses corresponents.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;9. D’acord amb la delegació de competències prevista en el punt 2.&lt;em&gt;b &lt;/em&gt;de la Resolució de la consellera d’Interior de 31 de març de 2008 de delegació de competències en matèria de personal estatutari en el conseller de Salut i Consum i en el director general del Servei de Salut de les Illes Balears (BOIB núm. 60/2008, de 3 de maig), el director general del Servei de Salut és l’òrgan competent per resoldre els procediments de mobilitat per raó del servei, de conformitat amb les prescripcions de la normativa vigent. A més, en el punt 2.&lt;em&gt;z&lt;/em&gt; se li assignen totes les competències que no estiguin atribuïdes expressament a altres òrgans.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Per tot el que s’ha exposat, dict la següent&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: center;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;1. Acordar la mobilitat per raó del servei del personal que figura en l’annex d’aquesta resolució, de conformitat amb l’article 36 de la Llei 55/2003, i adscriure’l a la plantilla dels Serveis Centrals del Servei de Salut de les Illes Balears aplicant l’Acord del Consell de Govern de 16 de gener de 2015 pel qual s’aprova el “Pla d’ordenació dels recursos humans pel qual el personal de compres de les gerències s’integra en la Central Corporativa de Compres i Logística del Servei de Salut de les Illes Balears i es regula el procediment de mobilitat per raó del servei que se’n deriva i es reordena el personal”.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;2. Establir que s’adjudiquen les places del personal esmentat provinent de diverses gerències territorials a la nova destinació, en la categoria i amb les circumstàncies que s’expressen en l’annex. L’adjudicació implica l’adscripció directa a la plantilla orgànica dels Serveis Centrals, havent modificat prèviament les plantilles corresponents, tal com preveu el Pla.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;3. Determinar que el canvi d’adscripció de les places i la resta de mesures tenen efecte a partir del 9 de febrer de 2015.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;4. Establir que, com a conseqüència del procés de mobilitat, s’han de cancel·lar les comissions de servei, de conformitat amb el que el Pla estableix.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;5. Disposar que la senyora Francisca Araceli Carbonell Alòs (amb DNI 43044924X), personal estatutari fix del grup C2, provinent de la Comunitat Valenciana i que ocupa una plaça en comissió de serveis a la Gerència del Sector Sanitari de Ponent, ha de ser objecte d’una modificació perquè la comissió de serveis tengui destinació als Serveis Centrals del Servei de Salut. &lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;6. Establir que les persones que s’indiquen a continuació han de ser objecte d’un nou nomenament com a personal interí amb adscripció als Serveis Centrals del Servei de Salut:&lt;/span&gt;&lt;/p&gt;
