El dia 3 de juliol de 2013, la representació de l'empresa Aspro Ocio, SA i la del seu personal del centre de Marineland van subscriure el text del Conveni col·lectiu de treball.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. El dia 24 de juliol, el senyor Ramón Cabezas Serra, en representació de la Comissió Negociadora del Conveni col·lectiu, va sol·licitar el registre, el dipòsit i la publicació d’aquest Conveni col·lectiu.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Fonaments de dret</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. L'article 90.3 del Text refós de la Llei de l'Estatut dels treballadors, aprovat pel Reial decret legislatiu 1/1995, de 24 de març.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. El Reial decret 713/2010, de 28 de maig, sobre registre i dipòsit de convenis i acords col·lectius de treball.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. L'article 60 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú, modificada per la Llei 4/1999, de 13 de gener.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Per tot això, dict la següent</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Resolució</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Inscriure i dipositar el Conveni col·lectiu de l'empresa Aspro Ocio, SA per al centre de treball Marineland en el Registre de Convenis Col·lectius de les Illes Balears.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Publicar el Conveni en el <em>Butlletí Oficial de les Illes Balears</em>.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. Fer constar que la versió castellana del Conveni és l'original signada pels membres de la Comissió Negociadora i que la versió catalana n’és una traducció.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">4. No serà d'aplicació aquest Conveni a les persones contractades per ocupar càrrecs de direcció, caps i coordinadors de departament, ni superiors a aquests.</span></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 3</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Àmbit funcional</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">S'aplicarà a les activitats directament explotades per l'empresa en el centre de treball afectat.</span></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 4</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Àmbit territorial</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L'àmbit territorial d’aquest Conveni és el del centre de treball de l'empresa Marineland, situat al carrer de Garcilaso de la Vega, núm. 9, 07184 Costa d'en Blanes, Calvià, Mallorca (Illes Balears).</span></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 5</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Vigència i durada</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Aquest Conveni entrarà en vigor el dia 01/06/2013, qualsevol sigui la data de registre i publicació en&nbsp; el &nbsp;<em>Butlletí Oficial de les Illes Balears</em> (BOIB), sent la durada de dos anys, fins al dia 31/05/2015.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Es considerarà aquest Conveni automàticament prorrogat d'any en any, si cap de les parts no el denuncia el mes març de 2015, o qualsevol dels mesos de març de pròrroga següents, si s’escau.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les parts es comprometen a iniciar el procés de negociació tres mesos abans de l'acabament de la vigència d’aquest Conveni.</span></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 6</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Salaris</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els salaris que s'estableixen en aquest Conveni són els que figuren en la taula salarial de l'annex I, i es desglossen en els conceptes que s'hi expressen.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Increment salarial</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">A partir de la data d'entrada en vigor del Conveni, els salaris base i els plusos són els establerts en l'annex número 1 d’aquest Conveni.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Per a l'any, 2014</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Si l'EBITDA obtingut pel parc a l'exercici 2013 és superior a l'EBITDA obtingut pel parc a l'exercici 2012 les taules salarials s'incrementaran en el mateix import percentual que experimenti l'IPC real nacional interanual per a 2013.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Si l'EBITDA obtingut pel parc a l'exercici 2013 és inferior a l'EBITDA obtingut pel parc a l'exercici 2012 la retribució dels empleats quedarà congelada.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Si l'EBITDA obtingut pel parc a l'exercici 2013 és superior a l'EBITDA pressupostat per a l'exercici 2013, les taules salarials s'incrementaran en el mateix import percentual que experimenti l'IPC real nacional interanual 2013 més un 1 %.</span></p> <div style="page-break-after: always;"> <span style="display: none;">&nbsp;</span></div> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 7</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Paques extraordinàries</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els treballadors percebran tres pagues extraordinàries en les dates i amb les quanties següents:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">15 de juliol: 30 dies de salari base, complement no compensable i no absorbible i antiguitat, si s’escau.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">15 d'octubre: 30 dies de salari base, complement no compensable i no absorbible i antiguitat, si s’escau.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">20 de desembre: 30 dies de salari base, complement no compensable i no absorbible i antiguitat, si s’escau.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Així mateix s'abonarà en les pagues extraordinàries la millora voluntària a aquells treballadors amb qui així s'ha fet fins a la data i en aquells supòsits en què així es pacti expressament.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els treballadors eventuals que es contractin percebran les parts de les tres pagues que hagin meritat de forma prorratejada, és a dir, incloses dins de les seves mensualitats.</span></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 8</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Antiguitat</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En matèria de complement per antiguitat serà d'aplicació el règim següent:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Treballadors contractats amb efectes de l'1-1-2000. Aquests treballadors no meritaran el complement per antiguitat previst en el Conveni precedent, que queda suprimit amb el nou Conveni, sense perjudici dels drets adquirits que queden reconeguts en l'apartat següent.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Treballadors fixos i fixos discontinus anteriors a l’1-1-2000.&nbsp; Aquests treballadors seguiran meritat com a condició més beneficiosa a títol <em>ad personam</em> el complement per antiguitat previst en el Conveni precedent, això és, a raó de triennis de temps de servei en l'empresa, amb el límit de deu triennis (30 anys).</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Aquest complement per antiguitat serà el resultat d'aplicar un 6 per 100 per cada trienni sobre el salari base vigent l'any 1999. A aquest efecte es fixa una taula que s'uneix com annex II al Conveni en la qual es quantifiquen per a cada salari base de cada categoria professional el valor de cadascun dels deu triennis, amb el límit del 60 per 100 del salari base de 1999.</span></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 9</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Durada dels contractes</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El contracte de treball podrà concertar-se per temps indefinit o per una durada determinada.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Podran subscriure's contractes de durada determinada d'acord amb els supòsits previstos en la llei, amb les particularitats següents:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">a) Contracte per obra o servei determinat. S'identifiquen contractes com a treballs o tasques amb substantivitat pròpia dins de l'activitat normal del centre de treball, a més dels que preveu la llei, els següents:</span></p> <ul> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Posada en funcionament de les instal·lacions del centre de treball, fins i tot des d'abans de l'obertura, fins que aquestes estiguin a ple rendiment.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Reforç de plantilla per a caps de setmana, vigílies de festa i ponts, durant tot el temps que sigui necessària la realització del treball.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Treballs d'instal·lació, reparació i manteniment, fins que concloguin.</span></li> </ul> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">b) Contracte per acumulació de tasques. Quan les circumstàncies del mercat, l’acumulació de tasques o l’excés de comandes així ho exigissin, encara que es tracti de l'activitat normal de l'empresa.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les parts pacten que la durada màxima serà de sis mesos dins un període de dotze mesos.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En cas que el contracte s'hagués concertat per una durada inferior a la convencionalment establerta, podrà prorrogar-se mitjançant acord de les parts, per una única vegada, sense que la durada total del contracte pugui excedir de la durada màxima esmentada.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Contracte fix discontinu. Es concertarà per temps indefinit per realitzar treballs que tinguin el caràcter de fixos discontinus i no es repeteixin en dates certes, dins del volum normal d'activitat de l'empresa.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els treballadors fixos discontinus seran cridats per ordre d'antiguitat dins de la seva especialitat professional en el període que romangui el parc obert al públic.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Fora d'aquell període l'empresa podrà cridar aquells fixos discontinus que consideri oportú, per la seva idoneïtat i actitud, si en necessita els serveis.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les parts pacten que els treballadors eventuals es transformaran, en la tercera crida, en fixos discontinus quan l'empresa hagi realitzat dues crides consecutives sempre que en cadascuna la crida tingui una durada mínima de sis mesos.</span></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 10</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Cessament</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els treballadors que desitgin cessar voluntàriament, estaran obligats a assabentar-ne l'empresa, per escrit, complint un preavís de 15 dies.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L'incompliment pel treballador de l'obligació de preavisar amb l'antelació indicada, donarà dret a l'empresa a descomptar de la liquidació salarial l'import equivalent a un dia de salari per cada dia de retard en l'avís.</span></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 11</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Jornada laboral</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La jornada de treball representarà un màxim de 40 hores per setmana de treball efectiu, amb la distribució en general de 5 dies de treball consecutius i 2 dies de descans per a tot el personal, sigui com vulgui la modalitat de contractació.</span></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 12</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Vacances</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els treballadors tindran dret al gaudi de trenta dies naturals de vacances a l'any, als quals se sumarà un dia per cada dos anys d'antiguitat, fins a arribar a un màxim de cinc dies per aquest concepte.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les esmentades vacances s’agafaran de mutu acord entre el treballador i l'empresa, subjectes a un màxim de quinze dies agafats durant el període de temporada mitjana (març, abril, maig, juny o octubre) per als departaments que funcionin de cara al públic.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Si per haver esgotat les seves vacances és necessari que algun treballador hagi de prestar els seus serveis en períodes de tancament del parc, aquest es compromet a efectuar treballs de manteniment i/o neteja dins de la seva pròpia secció.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Per als treballadors que agafin vacances en el període hivernal, se sumarà un dia per cada sis d’agafats, fins a un màxim de cinc dies extres.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Cada cap de departament analitzarà amb els seus empleats el calendari de vacances per a la seva secció, per arribar així a un mutu acord amb l'empresa.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Es publicarà un calendari dels acords esmentats cada any amb la suficient antelació per facilitar la planificació de les vacances de cada treballador.</span></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 13</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Permisos i llicències</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els treballadors, avisant amb la possible antelació i justificant-ho adequadament, podran faltar o absentar-se del treball, amb dret a remuneració, pels motius assenyalats en l'Estatut dels treballadors, sent els temps d'absència o llicència els que s’hi assenyalen, que s’amplien en els casos següents:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">a) En cas de naixement de fills, malaltia greu o mort del cònjuge, fill, pare, mare, néts, avis o germans d'un o un altre cònjuge, 3 dies ampliables a 6 si el treballador ha de desplaçar-se fora de l'illa. És necessari presentar un justificant de l'hospitalització, de la intervenció amb anestèsia general o de la mort.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">b) Un dia per casament de fills.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">c) Un dia per descans en el cas de casament de germans, sense retribució. Si per qualsevol motiu el treballador volgués incrementar els permisos, aquests excessos serien descomptats de les seves vacances i sempre de comú acord amb l'empresa.</span></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 14</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Consultes mèdiques</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L'empresa abonarà com a temps efectiu de treball les hores d'absència per motiu de consulta mèdica oficial incloent-hi l’oftalmologia i l’odontologia privades, havent-ho de sol·licitar el treballador prèviament i havent de presentar posteriorment un justificant de la seva visita a la consulta.</span></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 15</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Festius</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En els dies festius, dels 14 anuals, que coincideixin amb el període d'obertura del parc, l'empresa tractarà que el nombre d'empleats que hagin de treballar sigui el mínim.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Si un treballador per motius personals no desitja treballar un d'aquells dies festius que sí li correspondria acudir al treball, ho sol·licitarà amb 7 dies naturals d'antelació i l'empresa l’alliberarà d'assistir al treball si les necessitats ho permeten.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els dies festius, dels 14 anuals, que un treballador hagi d'assistir al treball li seran compensats amb dos dies de lliurança, que seran gaudits al final del període d'obertura del parc o acumulats al costat de les seves vacances, si el seu contracte fos fix.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Si un dels dies lliures programats coincidís amb un dels 14 dies festius anuals, l'empleat gaudirà d'un altre dia lliure.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Aquest dia lliure podrà ser compensat pel seu abonament en efectiu al preu d'un dia de salari normal si l'empleat ho sol·licita i l'empresa ho accepta.</span></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 16</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Hores extraordinàries</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Si per necessitats del servei l'empresa demana als treballadors la realització d'hores extraordinàries aquests adquireixen l'obligació de realitzar-les, dins dels límits legals. Les esmentades hores extres han de tenir l'autorització expressa del director del parc per tenir aquesta consideració.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El treballador podrà optar per la compensació amb un temps equivalent per cada hora extraordinària a un descans d'hora i mitja o per l’abonament d’aquesta amb un recàrrec del 130 per 100 sobre el salari hora ordinària.</span></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 17</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Treball durant els diumenges</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El treball dels diumenges s'efectuarà segons torn rotatiu del personal de les seccions que hagin de romandre obertes durant aquest dia.</span></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 18</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Vigilància de salut</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L'empresari garantirà als treballadors un servei de la vigilància del seu estat de salut en funció dels riscos inherents al treball, com estableix la Llei de prevenció de riscos laborals en l’article 22.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Aquesta vigilància de la salut només es podrà dur a terme quan el treballador presti el seu consentiment. Les mesures de vigilància i control de la salut dels treballadors es duran a terme respectant sempre el dret a la intimitat i dignitat del treballador i la confidencialitat de tota la informació relacionada amb el seu estat de salut.</span></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 19</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Baixes per malaltia</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Tot treballador en situació d'incapacitat temporal, derivada de malaltia o accident de treball tindrà dret a percebre, mentre duri la relació laboral, amb càrrec a l'empresa, la diferència entre la prestació legal que percebi per aquest concepte i el seu salari real, durant el termini màxim d'un any, prèvia aprovació del metge designat per l'empresa.</span></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 20</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Uniformitat</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L'empresa proporcionarà als treballadors i a treballadores els uniformes i la roba de treball que exigeixi i que no sigui d'ús comú en la vida ordinària.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La cura i conservació de l'uniforme és responsabilitat de la treballadora o treballador.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L'empresa determinarà el nombre (com a mínim dos), la composició i la durada de l'uniforme.</span></p> <div style="page-break-after: always;"> <span style="display: none;">&nbsp;</span></div> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 21</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Dinars</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Dins les contraprestacions de l'empresa, s'inclou el dinar del migdia com a producte en espècie concedit voluntàriament per aquesta. Dins d'aquesta concessió se servirà aigua o un refresc a càrrec de l'empresa, que no serà substituïble amb cap altra beguda. L'empresa elaborarà un menú per als treballadors, el qual es complirà puntualment, tret que existeixin raons inexcusables que així ho impedeixin. Es fixarà com a única excepció un preu diari per a aquells treballadors que, per recomanació mèdica escrita, estiguin obligats a seguir un règim especial diferent del menú ordinari.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Aquest preu serà igual al fixat per a terceres persones que utilitzin el menjador de personal.</span></p> <p style="margin:0px;"> que puguin originar-se amb motiu de la interpretació d’aquest Conveni, es designa una Comissió Paritària composta per una representació de l'empresa (tres membres) i pel Comitè d'Empresa del centre de treball (tres membres), el domicili de la qual a l’efecte de notificacions serà el del domicili del centre de treball Marineland.</span></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 25</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Sistema d’agrupació professional</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les treballadores i els treballadors inclosos en l'àmbit d’aquet Conveni seran inclosos en els grups professionals tenint en compte els seus coneixements, experiència, grau d'autonomia, responsabilitat i iniciativa, d'acord amb el contingut de la prestació laboral objecte del contracte de treball i amb les definicions que s'especifiquen en aquest sistema de classificació i qualificació professional.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L'agrupació es farà en grups professionals i per les tasques i funcions bàsiques més representatives, prevalents, i de major importància segons el parer de l'empresa, que desenvolupin les treballadores i els treballadors.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Així mateix, en el cas que habitualment la treballadora o el treballador exerceixi dos o més funcions en un mateix lloc de treball de tasques corresponents a diferents grups professionals, la classificació es farà en virtut de les funcions que resultin prevalents, de major importància segons el parer de l'empresa.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La classificació i nomenclatura contingudes en aquest capítol són merament enunciatives, per tant, es possible modificar-les, ampliar-les i determinar-les i això no suposa que l'empresa hagi de tenir coberts tots els grups si les necessitats organitzatives i productives així no ho exigeixen.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Factors per a la classificació i enquadrament professional</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els factors que influeixen en la classificació professional de les treballadores i els treballadors inclosos en l'àmbit personal d'aquest Conveni i que, per tant, indiquen la pertinença de cadascun a un determinat grup professional, són els següents:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">a) CONEIXEMENTS: per a valorar-los es tindrà en compte, a més de la formació bàsica necessària per poder complir correctament la comesa, el grau de coneixement i experiència adquirits, així com la dificultat en adquirir-los.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">b) INICIATIVA: es tindrà en compte el grau d'innovació i d'aportació personal aplicats en executar les tasques o funcions.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">c) AUTONOMIA: factor per a la valoració del qual s’ha de tenir en compte el grau de dependència jeràrquica en l'acompliment de les tasques i funcions que es desenvolupin.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">d) RESPONSABILITAT: referent al grau d'autonomia d'acció de la o el titular de la funció, el nivell d'influència sobre els resultats i la importància de les conseqüències de la gestió, sobre les persones, els productes o les eines i les instal·lacions.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">e) COMANDAMENT: es tindrà en compte el grau de supervisió i ordenació de les funcions i tasques, la manera de coordinar-les, com també les característiques i el nombre de persones sobre qui s'exerceix el comandament. A l'hora de valorar-ho s'atendrà la dificultat que suposa la realització d'una sèrie de funcions.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">GRUP PROFESIONAL I: CAPS DE DEPARTAMENT / ENCARREGAT/ADA DE DEPARTAMENT</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">CRITERIS GENERALS: estan inclosos en aquest grup els treballadors que exerceixen funcions que suposen la responsabilitat completa de la gestió d'una o diverses àrees funcionals de l'empresa, a partir de les directrius generals directament emanades de la mateixa Direcció de l'empresa. Coordinen, supervisen i integren l'execució de tasques heterogènies i ordenen el treball d'un conjunt de col·laboradors. Duen a terme, a més, funcions que suposen la realització de tasques complexes que exigeixen una preparació específica, com també d’altres que consisteixen a establir o desenvolupar programes o a aplicar tècniques especials de funcionament del personal al seu càrrec i d'un pressupost assignat a gestionar.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">També poden exercir tasques de representació i ocasionalment de comandament en el conjunt de les àrees de l'empresa.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">FORMACIÓ: teòrica o adquirida amb la pràctica, equivalent a titulat de grau superior, mitjà o titulació específica del lloc de treball, o bé un període de pràctiques o experiència dilatada que hagin adquirit en treball anàleg al sector o que així siguin valorades per l'empresa.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">GRUP PROFESSIONAL II: TÈCNICS /TÈCNIQUES</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">CRITERIS GENERALS: estan inclosos en aquest grup professional els treballadors que exerceixen funcions d'execució autònoma que exigeixen, habitualment, iniciativa i decisió al treballador encarregat d'executar-les. Així mateix integren, coordinen i supervisen tasques de contingut homogeni realitzades per un grup de col·laboradors.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">FORMACIÓ: la formació requerida equival a titulació acadèmica de grau superior o mitjà, formació professional de primer o segon grau, o titulació específica de les tasques que exerceixi, o s'acreditin mitjançant una dilatada experiència adquirida al sector, o una formació específica acreditada per al lloc de treball, o que així sigui valorada per l'empresa.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">GRUP PROFESSIONAL III: TÈCNICS/TÈCNIQUES AUXILIARS</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">CRITERIS GENERALS: estan inclosos en aquest grup professional els treballadors que exerceixen funcions d'execució autònoma que, fins i tot exigint iniciativa al treballador, són supervisades i encomanades pels empleats del grup superior, de qui depenen jeràrquicament a l’àmbit funcional i a l’àmbit de realització de les tasques que se li encomanen, que exigeixen, habitualment, iniciativa i decisió al treballador encarregat d'executar-les. Així mateix integren, coordinen i supervisen tasques de contingut homogeni realitzades per un grup de col·laboradors.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">FORMACIÓ: la formació requerida equival a titulació acadèmica de grau mitjà, de formació professional de primer grau, o titulació específica de les tasques que exerceixi o s'acreditin mitjançant una determinada experiència adquirida al sector, o una formació concreta acreditada per al lloc de treball, o que així sigui valorada per l'empresa.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">GRUP PROFESSIONAL IV: PERSONAL D'OPERACIONS (EMPLEATS DE SUPORT)</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">CRITERIS GENERALS: estan inclosos en aquest grup els treballadors que exerceixen tasques consistents en l'execució d'operacions que, encara que es realitzin sota instruccions precises, requereixen coneixements professionals o aptituds pràctiques. Realitzen treballs consistents en l'execució de tasques concretes dins d'una activitat més àmplia. Exerceix certa autonomia en decidir sobre l'aplicació concreta dels mètodes per assolir els objectius.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les tasques dutes a terme són les mateixes que les realitzades pel grup de personal d'ingrés, però la seva realització es desenvolupa amb un major marge d'autonomia sobre la base de l'experiència global adquirida en el lloc de treball després del pas del temps executant les seves tasques.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">FORMACIÓ: la formació bàsica requerida serà l'equivalent a formació professional de primer grau, graduat escolar o la titulació específica a la tasca que exerceixi, encara que si no en té, podria suplir-la amb un període d'experiència acreditada en un lloc de treball de característiques similars, o que així siguin valorades per l'empresa.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">GRUP PROFESSIONAL V: PERSONAL BASE (PERSONAL SUBALTERN)</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">CRITERIS GENERALS: estan inclosos en aquest grup els treballadors que exerceixen tasques que s'executen segons instruccions concretes, preestablertes, que normalment exigeixen coneixements no professionals de caràcter elemental i un període breu d'adaptació.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">FORMACIÓ: la formació requerida equival a graduat escolar, que pot suplir-se amb experiència, o que així siguin valorades per l'empresa.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Efectes sobre la retribució de la transformació del sistema de classificació professional de categories en els grups professionals:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els empleats s'han reclassificat en els grups professionals acordats.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La diferència entre la retribució que percebien per aplicació del sistema de categories actualitzat per a 2013 amb l'increment acordat per a aquell any, serà la mateixa que percebran després de la transformació en grups professionals el 2013.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Si algun empleat tingués un salari base inferior al que anteriorment percebia, per l'aplicació del sistema de grups, la diferència fins a la retribució real 2013 més amunt assenyalada serà abonada mitjançant un "complement personal no compensable ni absorbible".</span></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 26</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Règim disciplinari</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La Comissió Paritària elaborarà el text de faltes i sancions laborals del Conveni, segons els criteris de l'Acord sobre cobertura de buits, publicat en el BOE núm. 137, de 9 de juny de 1997, per Resolució de la Direcció General de Treball de 13 de maig de 1997. Mentrestant serà d'aplicació el capítol IV de l'Acord esmentat.</span></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 27</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Garantia d’ocupació</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L'empresa no pot garantir un període mínim d'ocupació als empleats fixos discontinus.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Si durant el període d'activitat fos necessari subscriure contractes eventuals, aquests s'aniran extingint a mesura que vagi disminuint l'activitat, de manera que fins a la data de tancament del parc estigui atesa amb treballadors fixos discontinus, que tindran preferència en la permanència fins a l'acabament de l'activitat.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Mentre existeixi un contracte de treball eventual en actiu, no s'extingirà el d'un fix discontinu de funcions similars.</span></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 28</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Tribunal d’Arbitratge i Mediació de les Illes Balears (TAMIB)</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les parts acorden adherir-se als procediments de solució de conflictes del TAMIB.</span></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 29</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Comissió mixta</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Ambdues parts acorden establir una Comissió Mixta, com a òrgan d'interpretació, conciliació i vigilància del compliment col·lectiu d'aquest Conveni.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Composició: la Comissió Mixta estarà composta per 6 membres, 3 per cada una de les parts signants, i seran designats per les representacions respectives. Els membres representants dels treballadors seran elegits per la mateixa representació dels treballadors en la Comissió Negociadora i d'entre ells mateixos, i podran ser revocats pel Comitè, que també n’elegirà els substituts. Els membres representants de la Direcció seran designats i revocats per aquesta. No obstant això, una vegada plantejada per qualsevol de les parts una qüestió pròpia de la seva competència a la Comissió Mixta, els membres titulars en aquell moment no podran ser revocats fins a la seva resolució.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Reunions: la Comissió Mixta es reunirà quan una de les parts ho sol·liciti per tractar un tema de la seva competència. La part promotora de la reunió traslladarà a l'altra un informe en què quedin exposats els antecedents, els fets i les divergències interpretatives de l'articulat, i la part receptora de la comunicació disposarà d'un termini de quinze dies hàbils per a l'estudi pertinent. Les reunions tindran lloc al domicili social de l'empresa. La Comissió Mixta es reunirà i emetrà la seva resolució en el termini màxim d'un mes des que li sigui plantejada qualsevol qüestió.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Acords: els acords que adopti la Comissió Mixta tindran caràcter vinculant per a ambdues parts, sent necessari per a adoptar-los el vot de 2 dels 3 components de cada part, i se n'estendrà acta.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En el cas que no s'aconseguís un acord en la interpretació per la Comissió Mixta, ambdues parts se sotmetran a la mediació del TAMIB.</span></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Article 30</span></strong></p> <p style="margin:0px;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Procediment per a resoldre de manera efectiva les discrepàncies que puguin sorgir per la inaplicació de les condicions de treball</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Quan es presentin causes econòmiques, tècniques, organitzatives o de producció, per acord entre l'empresa i els representants dels treballadors legitimats per negociar el conveni col·lectiu, es podrà procedir, previ desenvolupament d'un període de consultes en els termes de l'<span style="color: windowtext;">article 41.4</span> del Reial decret legislatiu 1/95, a inaplicar en l'empresa les condicions de treball previstes en el conveni col·lectiu aplicable, sigui aquest de sector o d'empresa, que afectin les matèries següents:</span></p> <ul> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Jornada de treball.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Horari i distribució del temps de treball.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Règim de treball a torns.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Sistema de remuneració i quantia salarial.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Sistema de treball i rendiment.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Funcions, quan excedeixin dels límits que per a la mobilitat funcional preveu l'article 39 d'aquesta Llei.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Millores voluntàries de l'acció protectora de la Seguretat Social.</span></li> </ul> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">S'entén que es presenten causes econòmiques quan dels resultats de l'empresa es desprengui una situació econòmica negativa, en casos com ara l'existència de pèrdues actuals o previstes, o la disminució persistent del seu nivell d'ingressos ordinaris o de vendes. En tot cas, s'entendrà que la disminució és persistent si durant dos trimestres consecutius el nivell d'ingressos ordinaris o de vendes de cada trimestre és inferior al registrat en el mateix trimestre de l'any anterior.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">S'entén que es presenten causes tècniques quan es produeixin canvis, entre d'altres, en l'àmbit dels mitjans o instruments de producció; causes organitzatives, quan es produeixin canvis, entre d'altres, en l'àmbit dels sistemes i mètodes de treball del personal o en la manera d'organitzar la producció, i causes productives, quan es produeixin canvis, entre d'altres, en la demanda dels productes o serveis que l'empresa pretén col·locar al mercat.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Quan el període de consultes finalitzi amb un acord es presumirà que es presenten les causes justificatives a què al·ludeix el paràgraf segon, i només podrà ser impugnat davant la jurisdicció social per l'existència de frau, dol, coacció o abús de dret en la seva conclusió. L'acord haurà de determinar amb exactitud les noves condicions de treball aplicables en l'empresa i la seva durada, que no podrà perllongar-se més enllà del moment en què resulti aplicable un nou conveni en l'empresa. L'acord d'inaplicació no podrà donar lloc a l'incompliment de les obligacions establertes en conveni relatives a l'eliminació de les discriminacions per raons de gènere o de les que estiguessin previstes, si s'escau, en el Pla d'Igualtat aplicable a l'empresa. Així mateix, l'acord haurà de ser notificat a la Comissió Paritària del Conveni col·lectiu.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En cas de desacord durant el període de consultes qualsevol de les parts podrà sotmetre la discrepància a la Comissió del Conveni, que disposarà d'un termini màxim de set dies per pronunciar-s'hi, a comptar des que la discrepància li fos plantejada. Quan no s'hagués sol·licitat la intervenció de la Comissió o aquesta no hagués assolit un acord, les parts hauran de recórrer als procediments que s'hagin establert en els acords interprofessionals del sector d'hoteleria d'àmbit autonòmic o estatal, previstos en l'<span style="color: windowtext;">article 83 del Reial decret legislatiu 1/95</span>, per resoldre de manera efectiva les discrepàncies sorgides en la negociació dels acords als quals es refereix aquest apartat, inclòs el compromís previ de sotmetre les discrepàncies a un arbitratge vinculant; cas en què el laude arbitral tindrà la mateixa eficàcia que els acords en període de consultes i només serà recurrible d'acord amb el procediment i partint dels motius establerts en l'<span style="color: windowtext;">article 91</span> del Reial decret legislatiu 1/95.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Quan el període de consultes finalitzi sense acord i no siguin aplicables els procediments a què es refereix el paràgraf anterior o aquests no hagin solucionat la discrepància, qualsevol de les parts en podrà sotmetre la solució a la Comissió Consultiva de Convenis Col·lectius de la Comunitat Autònoma. La decisió d'aquest òrgan, que podrà ser adoptada al seu propi si o per un àrbitre designat a l'efecte per ells mateixos amb les garanties escaients per assegurar la seva imparcialitat, haurà de dictar-se en un termini no superior a vint-i-cinc dies a comptar des de la data de la submissió del conflicte davant dels òrgans esmentats. Tal decisió tindrà l'eficàcia dels acords assolits en període de consultes i només serà recurrible d'acord amb el procediment i partint dels motius establerts en l'<span style="color: windowtext;">article 91</span> del Reial decret legislatiu 1/95.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El resultat dels procediments a què es refereixen
