Notificació vehicles dipòsit Toe 5-14]] ca 2014-04-10 CAIB 2180 537448 15449 text/html 15448 CAIB ca 6257 2014-04-10 ![CDATA[<p> <span style="font-family:times new roman,times,serif;font-size:12px;">Atès que no han pogut tenir efecte les notificacions d’abandonament de vehicle, d’acord amb l’article 59.4 i 61 de la llei 30/1992 de Règim Jurídic de les Administracions Públiques i del Procediment Administratiu Comú, amb el present anunci se comunica a les persones relacionades el seu contingut (TOE&nbsp; 5-14)</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El Regidor de l’Àrea delegada de Seguretat Ciutadana, en ús de les facultats que li confereix el Decreto de Alcaldía&nbsp; nº&nbsp; 954 de día 27-01-14, d’organització dels serveis administratius de l’Ajuntament de Palma publicat al BOIB núm. 21 de dia 11-02-14, ha dictat la següent resolució, d’acord amb Decreto nº 4618, de fecha 18 de març de 2014 “Havent ingressat el vehicle al dipòsit municipal i d’acord amb el que estableix l’article 86 de la Llei sobre trànsit, circulació de vehicles de motor i seguretat viària (RDL 339/1990), si transcorregués més de dos mesos sense que la persona titular el retiri, se’n presumirà racionalment l’abandonament. Arribat a aquest cas, la persona titular disposarà d’un termini d’un mes per retirar el vehicle del dipòsit municipal. En cas contrari el vehicle s’entregarà a un centre autoritzat per reciclar-lo i descontaminar-lo (CARD) o se li donarà la finalitat establerta a l’article 86.3 del Reial decret legislatiu 339/1990.”</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Per això, i atès l’anterior Decret, se us concedeix el termini indicat perquè el retireu del dipòsit Municipal indicat a d’alt i se us adverteix que si no ho feis s’entregarà a un centre autoritzat per reciclar-lo i descontaminar-lo i es generaran les corresponents taxes que poden arribar a la quantitat de 1.561’52 euros (128’75 per la retirada, 1.141’24 per la custòdia i 291’53&nbsp; per la declaració d’abandonament, descontaminació, desballestament i gestió de la baixa administrativa)</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En aquest moment ja s’han generat la taxa de retirada del vehicle (128’75 euros) i la taxa pels dies de custòdia, però podeu evitar que es generin la resta de taxes si en el termini establert renuncieu voluntàriament al vehicle emplenant l’imprès de renúncia que us facilitaran al mateix dipòsit, o a qualsevol de les UIAP de l’ajuntament o a qualsevol oficina de la Policia Local. En aquest cas la taxa per custòdia es limitarà als primers 15 dies (152’44 euros) i se us condonaran la resta de dies i s’entregarà el vehicle a un CARD i se n’anotarà la baixa definitiva, o se li donarà la finalitat establerta a l’article 86.3 del Reial decret legislatiu 339/1990, de 2 de març, sense més cost per a vós.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Contra aquesta resolució, que exhaureix la via administrativa, es pot interposar RECURS DE REPOSICIÓ davant el mateix òrgan que l’ha dictada, conformement al que disposa l’article 116 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú, segons la redacció de la Llei 4/1999, de 13 de gener. El termini per interposar-lo és d’un mes comptat des de l’endemà de rebre la notificació. En aquest cas no es pot interposar recurs contenciós administratiu fins que no s’ha resolt el de reposició. El recurs de reposició potestatiu s’ha de presentar al Registre General d’aquest Ajuntament o a les dependències a què es refereix l’article 38.4 de l’esmentada Llei 30/1992 i es considera desestimat quan no s’ha resolt i s’ha notificat la resolució en el termini d’un mes comptat des de l’endemà d’interposar-lo. En aquest cas queda expedita la via contenciosa administrativa.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Si no s’utilitza el recurs potestatiu de reposició es pot interposar directament recurs contenciós administratiu, d’acord amb l’article esmentat anteriorment i els 45 i següents de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa, davant el Jutjat Contenciós Administratiu, en el termini de dos mesos comptats des de l’endemà de rebre la notificació de la resolució.
