    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El Ple del Consell de Mallorca, en sessió de dia 12 de desembre de 2013, va aprovar provisionalment la modificació de l’Ordenança fiscal reguladora de la taxa per serveis d’inspecció tècnica de vehicles, per a l’adaptació al nou concepte de taxa amb motiu de la modificació de la Llei General Tributària.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;L’expedient es va sotmetre a informació pública, mitjançant la inserció del anuncis corresponents en el tauler d’edictes des de dia 20 de desembre de 2013 a 10 de febrer de 2014, en el diari Ultima Hora de dia 31 de desembre de 2013, i en el BOIB núm. 178 de dia 26 de desembre de 2013, durant el termini de trenta dies, perquè totes les persones que hi estiguessin interessades el poguessin examinar i poguessin formular-hi les reclamacions i els suggeriments pertinents.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Durant aquest termini no s’hi va presentar cap al·legació, per la qual cosa i, d’acord amb el que va acordar el Ple, l’acord va esdevenir definitiu i es va ordenar que se’n publicàs íntegrament el text en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;, que s’incorpora com a annex.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra aquest acord, que exhaureix la via administrativa, podeu interposar el recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears, en el termini de dos mesos, comptadors a partir de l’endemà de publicar aquest acord. Tot això, de conformitat amb la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa. No obstant l’anterior, podeu exercitar, si escau, qualsevol altre recurs que considereu pertinent.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px; text-align: left"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Article 1r.- &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;FONAMENT, NATURALESA I ÀMBIT D’APLICACIÓ.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. En ús de les facultats concedides pels articles 133.2 i 142 de la Constitució i per l’article 106 de la Llei 7/1985, de 2 d’abril, reguladora de lles Bases del Règim Local i conformement amb el que disposen els articles 15 a 19 del Reial Decret Legislatiu 2/2004, de 5 de març, pel que s’aprova el text refós de la Llei Reguladora de les Hisendes Locals, aquest consell insular de Mallorca estableix la Taxa per inspecció tècnica de vehicles, que es regeix per la present Ordenança Fiscal, les normes de la qual s’atenen al que es preveu a l’article 132 del citat Reial Decret Legislatiu 2/2004.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. L’àmbit d’aplicació n’és l’illa de Mallorca.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Article 2n.- &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;FET IMPOSABLE.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Constitueix el fet imposable de la Taxa, la prestació, pel Consell Insular de Mallorca, dels serveis d’inspecció de vehicles relatius a les revisions periòdiques, a les prèvies a la matriculació, així com les autoritzacions de reformes, expedició de duplicats, certificats i altres actuacions relacionades amb el reconeixement dels vehicles.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Article 3r.- &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;SUBJECTE PASSIU.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Són subjectes passius contribuents, les persones físiques o jurídiques i les entitats que figuren a l’article 33 de la Llei General Tributària que els hagin sol·licitat o aquells als qui es presti qualsevol dels serveis que constitueixin el fet imposable de la Taxa.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Article 4rt.- &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;TARIFA.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La taxa s&amp;apos;exigirà d&amp;apos;acord amb les següents tarifes:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Suplement per a inspecció fora de l’horari de treball: el preu s’incrementarà en un 25% (sols es podran realitzar fora de l’horari de treball a petició de l’interessat).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Per a la segona inspecció de comprovació de la correcció dels defectes observats a la inspecció periòdica amb resultat desfavorable, s’abonarà una taxa del 30% de la primera, sempre que el termini de presentació del vehicle no sigui superior a dos mesos; en aquest cas es procedirà a realitzar una inspecció completa al vehicle, abonant el 100% de la taxa corresponent.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En el cas que el resultat de la inspecció sigui desfavorable, i que els defectes observats no obliguin a passar per la línia d’inspecció per comprovar la seva correcció, i no siguin més de 4 defectes greus, es concedirà un termini màxim de 7 dies hàbils per poder passar la segona inspecció sense abonar taxes.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;A les inspeccions periòdiques a tractors i remolcs agrícoles s’aplicarà la taxa de desplaçament [P = 53,71€ + (n-1) * 5,38€], quan sigui necessari, limitant el seu import a 7,79€ com a màxim per vehicle.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Les taxes caducaran a l’any de la data d’obertura dels expedients que les motiven.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Article 5è.- &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;EXEMPCIONS I BONIFICACIONS.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;No es concedeix cap exempció ni bonificació en l’exacció d’aquesta taxa.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Article 6è.- &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;MERITACIÓ.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Es merita la taxa i neix l’obligació de contribuir en el moment en que s’iniciï l’actuació administrativa que constitueix el fet imposable.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Article 7è.- &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;LIQUIDACIÓ I INGRÉS.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El procediment d’ingrés conformement amb el que preveu l’art.27 del Reial Decret Legislatiu 2/2004 serà el d’autoliquidació, havent d’autoliquidar el subjecte passiu la taxa, en el moment d’iniciar-se l’actuació administrativa de prestació del servei o la realització de l’activitat.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Article 8è.- &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;INFRACCIONS I SANCIONS&lt;/strong&gt;.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En totes les qüestions relatives a la qualificació d’infraccions tributàries i també a les sancions que hi corresponen en cada cas, s’aplicaran les disposicions contingudes en els articles 77 i següents de la Llei General Tributària.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;DISPOSICIÓ FINAL&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La present Ordenança, que va ser aprovada provisionalment pel Consell Insular de Mallorca, en sessió de dia 12 de desembre de 2013, entrarà en vigor l’endemà de la seva publicació íntegra al BOIB, i romandrà en vigor fins a la seva modificació o derogació expressa.&lt;/span&gt;&lt;/p&gt;
