font-size: 12px">Havent-se procedit a la pràctica notificació personal, i resultada infructuosa, es va procedir al tràmit de la notificació per edictes mitjançant exposició en el Tauler d’Anuncis d’aquest Ajuntament i publicació en el BOIB, de conformitat amb allò disposat a l’article 59.5 de la Llei 30/1922, a l’objecte que per aquest i en el termini de 15 dies i en compliment d’allò disposat en els articles 35.e, 79.1 i 84 de la vigent Llei 30/92, de 26 de novembre, pugui(n) al·legar i presentar els documents i justificacions que consideri(n) pertinents per acreditar que la seva residència habitual és aquella que figura com a domicili en el Padró Municipal d’Habitants.</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">VIST que en l’esmentat termini, l’interessat(s) no ha(n) presentat al·legacions.</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">VIST que de conformitat amb allò disposat a l’article 17 de la Llei 7/1985, de 2 d’abril, reguladora de les Bases de Règim Local, en la seva redacció donada per la Llei 4/1996, de 10 de gener, així com els articles 54, 72, 85.e), 91 i 92 del vigent Reglament de Població i Demarcació Territorial de les Entitats Locals, en la seva redacció donada pel Reial Decret 2612/1996, de 20 de Desembre, fou remesa a la Secció Provincial de les Illes Balears del Consell d’Empadronament, còpia compulsada d’aquest expedient per a que s’informés, amb caràcter preceptiu i vinculant, sobre la procedència de cancel·lar en el fitxer informàtic del Padró Municipal la inscripció de la(es) persona(es) inclosa(es) en aquest expedient de regularització patronal.</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">Vist que en data&nbsp; la Secció Provincial del Consell d’Empadronament, acordà entre d’altres assumptes emetre informe favorable a la procedència de cancel·lar en el fitxer informàtic del Padró Municipal la inscripció de la(es) persona(es) inclosa(es) en aquest expedient de regularització padronal, als efectes d’allò disposat a l’Annex, apartat II “Gestió de Padró Municipal”, punt 2c de la Resolució de 9 d’abril de 1997 del Ministeri de la Presidència.</span></p> <p> <strong><span style="font-family: times new roman, times, serif; font-size: 12px">Contra aquesta Resolució, que posa fi a la via administrativa, es pot interposar, amb caràcter potestatiu, recurs de reposició davant el mateix òrgan que l’ha dictada, d’acord amb allò disposat a l’article 116 de la Llei 30/92, de 26 de novembre, de Règim Jurídic de les Administracions Públiques i del Procediment Administratiu Comú, segons la redacció donada al mateix per la Llei 4/99, de 13 de gener, el termini per interposar-lo és d’un mes a comptar des del dia següent al de la recepció de la present notificació, no podent en aquest cas, interposar recurs contenciós administratiu fins que s’hagi resolt el de reposició.</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">El recurs de reposició potestatiu haurà de presentar-se en el Registre d’aquest Ajuntament o a les dependències a què es refereix l’article 38.4 de la Llei 30/92, de 26 de novembre, abans esmentada, i s’entendrà desestimat quan no s’hagi resolt i notificada la resolució, en el termini d’un mes, a comptar des del dia següent al de la seva interposició, quedant en aquest cas expedita la via contenciosa administrativa.</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">Si no s’utilitza el recurs potestatiu de reposició, es pot interposar directament recurs contenciós administratiu, de conformitat amb l’article abans indicat i els articles 10, 45 i següents de la Llei 29/98, de 13 de juliol, Reguladora de la Jurisdicció Contenciosa Administrativa, davant la Sala del Contenciós Administratiu del Tribunal Superior de Justícia de les Illes Balears, en el termini de dos mesos a comptar des del dia següent al de la recepció de la present notificació, tot això sense perjudici de qualsevol altre recurs o acció que consideri convenient. </span></p> <p> &nbsp;</p> <p style="margin: 0px;
