M. de Sencelles i d&amp;apos;acord amb el projecte redactat per l&amp;apos;Arquitecte Sr. Josep Antoni Aguiló Oliver, una vegada superat el periode d&amp;apos;exposició pública sense que se n&amp;apos;haguessin presentat ni al.legacions ni suggeriments.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Dins el sòl urbà d’aquestes Normes Subsidiàries, es va preveure la Unitat d’Actuació UAC-2- del nucli urbà de Sencelles, incloent un àmbit de superfície total d’actuació de 4.074m2 i amb la fitxa de desenvolupament següent:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;UAC-2-.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La unitat d’actuació té com a finalitat principal la dotació del vial públic de 700m2 que perllongaria l’actual carrer des Gall fins a la perpendicular del carrer des Molins, millorant així, la funcionalitat interna del nucli.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;2.- MEMÒRIA JUSTIFICATIVA&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;D’ençà de l’aprovació de les NNSS fins al moment actual, l’Ajuntament ha pogut constatar la dificultat de gestió que suposa dur a terme aquesta unitat amb la delimitació actual i pel sistema previst – compensació -, per la falta d’acord entre els propietaris del sòl.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En aquest sentit, i donat que l’únic objectiu de la unitat és que els propietaris afectats cedeixin i executin la part del vial corresponent amb la façana de les seves parcel·les resultants, urbanes i lucratives, l’Ajuntament opta per dividir en dos àmbits de gestió la unitat actual (UAC-2-), de manera que, de manera independent, els propietaris que així ho desitgin, puguin dur endavant el desenvolupament de la part del vial que els afecta, aconseguint així els objectius municipals, d’acord al sistema establert, d’una manera més àgil, i sense tenir que arribar a demanar l’acord entre les distintes propietats.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;3.- MEMÒRIA DESCRIPTIVA. PROPOSTA.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Es proposa, doncs, la modificació de l’àmbit de la UAC-2-de les NNSS de Sencelles, de manera que l’àmbit inicial quedi subdividit en dos àmbits UAC-2.a- i UAC-2.b- que mantinguin totes les característiques urbanístiques de la unitat d’actuació original amb la diferència de ser dividida en dues fases de gestió per compensació, com així preveu la norma urbanística municipal.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Es reajusten tots els límits d’acord a la nova i més detallada topografia i amb la intenció d’ajustar els límits de les noves unitats a les parcel·les o/o propietats de manera que es faci més simplificada la gestió dels àmbits. A la vegada que s’exclou una edificació existent ja urbana, s’inclou més clarament la servitud de pas a la UAC-2.b-, part de darrera del vial central- que ajuda a resoldre tota la funcionalitat de l’àmbit i millora els accessos de la unitat.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Manteniment de les característiques de la UA.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Es mantenen totes les característiques de la unitat d’actuació original, segon el següent:&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;No existeix necessitat d’equidistribució. A la present unitat no es tracta que hi hagi una justa distribució dels beneficis i càrregues, simplement es tracta que cada propietari cedeixi i executi la part del vial corresponent amb la façana de la seva parcel·la urbana lucrativa, de manera que es pretén aconseguir dotar d’accés rodat les parcel·les urbanes.&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;No existeix cap equipament o espai lliure que s’hagi de cedir. Només es tracta de l’obertura d’un vial públic.&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Ateses les dues consideracions anteriors, resulta que l’execució conjunta de la unitat no té cap element que la faci imprescindible, ni origina cap perjudici als propietaris afectats i integrats dins la unitat.&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Canvis que es produiran.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Únicament, divisió en dos àmbits de la UAC-2- original, fixant dues fases o noves unitats en l’execució de la unitat.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Els nous àmbits de la UAC-2.a- i UAC-2.b-, es grafien als plànols de proposta d’aquest document.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Procediment per a la modificació de la UA i divisió en dues.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El procediment per a la tramitació d’aquesta modificació, s’entén que entra dins les possibilitats previstes en l’article 14 del &lt;em&gt;Decret llei 2/2012 de 17 de febrer, de mesures urgents per a l’ordenació urbanística sostenible&lt;/em&gt;, titulat &lt;em&gt;Delimitació de polígons i unitats d’actuació i fixació del sistema de gestió urbanística&lt;/em&gt;, i en el que es preveu que l’organisme municipal pot modificar i fer-ne la primera delimitació d’àmbits d’unitats d’actuació com la de referència, d’acord al tràmit reduït que estableix el referit article.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Memòria econòmica.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En tant que es manté el sistema de compensació i que no es modifiquen les càrregues i beneficis globals de la unitat, s’entén que no es necessari la modificació o revisió de l’estudi econòmic i financer previst, tot i afegint que, amés, totes les càrregues són per a la promoció privada.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Cal reflectir que, de l’estudi detallat de l’àmbit original de la UA, resulten unes superfícies distintes de les superfícies previstes en les NS de Sencelles, però que són les reals, estudiades i delimitades a través de topografia real i que, en cap cas, minven ni modifiquen les previsions urbanístiques de les normes, principalment en el que es refereix a les dotacions públiques que suposa el vial de cessió, ja que aquest manté les mateixes alineacions i ample de les NS vigents, és a dir, manté el mateix dibuix i cotes mínimes de la cessió obligatòria de vials.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Així doncs, l’estat actual real de les NS vigents, s’han d’entendre, com així es pot comprovar a la documentació gràfica d’aquest document, el següent:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;5.- NO SUBJECCIÓ A TRAMITACIÓ AMBIENTAL.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;D’acord a l’excepció i) del punt 4), del grup 1 de l’Anex III de la Llei 11/2006, de 14 de setembre, d’avaluacions de impacte ambiental i avaluacions estratègiques de les Illes Baleares, afegit en la modificació de dita Llei pel Decret Llei 3/2009 de 29 de maig de mesures ambientals per a impulsar les inversions i l’activitat econòmica a les Illes Balears, que diu que “...es considera que no tenen efectes significatius en el medi ambient i, per tant, no es subjecten als procediments d’avaluació ambiental estratègiques... i) Modificació de delimitació de l’àmbit de polígons o unitats d’actuació i canvi de sistema de actuació”, &lt;strong&gt;s’entén&lt;/strong&gt; que la modificació proposada no està subjecte al procediment ambiental.&lt;/span&gt;&lt;/p&gt;
