    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Havent transcorri’t el termini de 30 dies comptats a partir del dia 31 d’octubre de 2013, data de publicació al BOIB numero 150 de l’aprovació inicial del Reglament d’Ajudes dels Serveis Socials&lt;span style="color: black"&gt; sense que se haguin presentades&lt;/span&gt; al·legacions ni suggeriments , el Reglament s’entén definitivament aprovat&amp;nbsp; un cop transcorregut el termini fixat a l’article 113&amp;nbsp; de la Llei 20/2006&amp;nbsp; de 15 de desembre, municipal y de régimen local de las Illes Balears&amp;nbsp; publicant el Reglament íntegrament al BOIB a l’efecte de la seva entrada en vigor&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Així mateix es comunicarà a la Delegació del Govern, Govern de les Illes Balears i Consell de Mallorca en compliment del que preveuen els articles 103 en relació al 113 de l’esmentada llei 20/2006&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;REGLAMENT REGULADOR DE PRESTACIONS ECONÒMIQUES DE SERVEIS SOCIALS DE L’AJUNTAMENT DE PUIGPUNYENT&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;EXPOSICIO DE MOTIUS &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Els Serveis Socials Municipals treballen amb l’objectiu de garantir l’atenció de les necessitats bàsiques del conjunt de la població, especialment dels col·lectius amb més dificultats d’inserció. Per això cal tenir en compte allò que estableix la Llei 4/2009, de 11 de juny, de Serveis Socials de les Illes Balears. En aquesta, s’estableixen els principis de responsabilitat pública, universalitat i igualtat, equitat territorial, descentralització i desconcentració, planificació, coordinació, prevenció, globalitat, normalització i integració, avaluació dels processos i els resultats, solidaritat, participació cívica, participació de la ciutadania en la programació, l’avaluació i el control en tots els nivells administratius de les Illes Balears, qualitat, intervenció comunitària, atenció personalitzada, foment de l’autonomia personal i respecte pels drets de la persona.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El sistema públic de serveis socials està integrat pel conjunt de recursos, prestacions, activitats, programes, projectes i equipaments destinats al benestar social de la població, de titularitat del Govern de les Illes Balears, dels consells insulars i de les entitats locals, com també aquells que l’administració contracti amb les entitats d’iniciativa social, mercantil o civil.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El sistema públic de serveis socials s’organitza en forma de xarxa per treballar en coordinació, en col·laboració i amb el diàleg entre tots els actors que intervenen en el procés d’atenció a les persones, i s’estructura en serveis socials comunitaris i en serveis socials especialitzats.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Els serveis socials comunitaris són el primer nivell del sistema públic de serveis socials. Constitueixen el punt d’accés immediat als serveis socials i la garantia de proximitat a les persones usuàries i als àmbits personal, familiar i social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Els serveis socials comunitaris bàsics tenen un caràcter universal, obert, polivalent, constitueixen el canal normal d’accés al sistema de serveis socials, i garanteixen la universalitat del sistema i la seva proximitat a les persones usuàries i als àmbits familiar i social. Els serveis socials bàsics es desenvolupen des de centres de serveis socials polivalents, mitjançant equips multidisciplinaris, integrats pel personal professional necessari per complir les seves funcions, amb l’estructura directiva i de suport tècnic i administratiu que s’estableixi per reglament.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;TÍTOL&lt;/span&gt;&lt;/strong&gt; &lt;strong&gt;&lt;span style="color: black"&gt;I.&lt;br /&gt; DISPOSICIONS GENERALS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ARTICLE 1.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Objecte I Règim Jurídic&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;1. OBJECTE:&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: black"&gt; Aquest Reglament té per objecte la regulació del procediment de concessió d’ajudes econòmiques&amp;nbsp; en el Municipi de Puigpunyent. Amb aquestes Ajudes econòmiques es pretén donar suport a aquelles persones i famílies que no tenen recursos econòmics per fer front a necessitats bàsiques en relació amb l’alimentació, allotjament, vestimenta, educació i formació, atenció sanitària no cobertes pels diferents sistemes públics, així com evitar les conseqüències físiques, psíquiques i socials que la manca de recursos econòmics suficients provoca i que afecten al normal desenvolupament de les persones en societat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;2. RÈGIM JURÍDIC:&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: black"&gt; La concessió de les ajudes econòmiques municipals per part dels serveis Socials, es regiran de conformitat amb allò que estableix la normativa i les disposicions que s’adoptin per a la seva aplicació i desplegament. En concret, aquest Reglament se desplega d’acord amb les facultats que confereix a aquest Ajuntament la normativa vigent, en particular l’article 25.2.k) i l’article 26.1.c) de la Llei 7/1985, de 2 d’abril, Reguladora de les Bases del Règim Local, exercitant la potestat normativa que regula l’article 84.1 de la Llei esmentada 7/1985. Així mateix, té en compte allò que estableix la Llei 4/2009, d’11 de juny, de Serveis Socials de les Illes Balears, la Llei 39/2006, de 14 de desembre, de Promoció de l’Autonomia Personal i Atenció a les persones en situació de dependència, aconseguint d’aquesta manera la implantació efectiva d’un sistema per a l’autonomia i atenció de la dependència, i la Llei 38/2003, de 17 de novembre, General de Subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ARTICLE 2&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Ambit d’aplicació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;1.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: black"&gt; L’àmbit territorial d’aplicació d’aquest Reglament és el Terme Municipal de Puigpunyent. L’àmbit funcional és l’atenció de situacions de necessitat bàsica de caràcter urgent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;2.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: black"&gt; Són titulars del dret a accedir al sistema de serveis socials i per tant del dret d’accedir a les ajudes d’urgència o emergència els espanyols, els nacionals de la resta d’Estats membres de la Unió Europea i els estrangers residents, sempre que estiguin empadronats en aquest municipi. La resta de persones que no tinguin la nacionalitat espanyola es regiran d’acord amb allò que estableix la legislació estatal sobre drets i llibertats dels estrangers a Espanya i la seva integració social, en els tractats internacionals i en els convenis que s’estableixin amb el país d’origen. En tot cas, les persones que estiguin en aquesta localitat en una situació d’urgència personal, familiar o social, poden accedir a aquelles prestacions del sistema de serveis socials que permetin atendre la situació esmentada. Els professionals municipals de serveis socials valoraran la situació en funció de la seva gravetat, precarietat i peremptorietat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;3.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: black"&gt; L’accés a les ajudes té com a requisit no disposar de recursos propis suficients per cobrir la necessitat objecte de l’ajuda sol·licitada, no tenir béns immobles o mobles d’importància, amb excepció de l’habitatge d’ús habitual, la valoració, possibilitat de venda o qualsevol altra forma d’explotació del qual, indiquin de manera notòria l’existència de mitjans materials suficients per atendre per si mateix la necessitat per a la qual sol·licita l’ajuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ARTICLE 3&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Definició&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;1.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: black"&gt; Es consideren ajudes d’urgència, als efectes d’aquest Reglament, aquelles prestacions econòmiques de pagament únic i caràcter extraordinari destinades a resoldre situacions puntuals d’emergència que afectin a persones o famílies a les quals sobrevinguin situacions de necessitat en què estiguin privades dels mitjans de vida primaris i imprescindibles, amb la finalitat de dispensar una atenció bàsica i urgent en el moment en què aquelles es produeixin.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;2.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: black"&gt; Les Ajudes d’Urgència o Emergència Social tenen el caràcter de subvencions directes, destinades a aquelles persones que estiguin en una situació d’urgència extrema o necessitat greu els recursos dels quals no els permetin fer front a les despeses més imprescindibles per a la seva pròpia subsistència o la de la seva família.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;3.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: black"&gt; Les Ajudes d’Urgència Social es caracteritzen per:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-El seu caràcter finalista, que s’han de destinar per satisfer la necessitat específicament assenyalada en l’acord de reconeixement de l’ajuda, fet que s’ha d’acreditar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-El seu caràcter subsidiari, respecte d’altres prestacions econòmiques reconegudes o recognoscibles segons la legislació vigent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-El seu caràcter personalíssim i intransferible.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-El seu caràcter transitori, i no periòdic.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ARTICLE 4&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Objectius&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;1.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: black"&gt; La concessió d’ajudes d’urgència té com a objectiu primordial satisfer necessitats puntuals i urgents, per, a partir de la solució d’aquesta situació, poder reconduir si és possible les necessitats de qui pateix les necessitats que es cobreixen puntualment.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;2.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: black"&gt; A partir de la concessió d’una ajuda d’urgència, s’obrirà un procés en què:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-S’analitzarà la realitat social individual per detectar les situacions de necessitat del subjecte i elaborar l’estratègia més adequada per tal d’afavorir d’ara endavant el benestar social i millorar la qualitat de vida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-S’adoptaran les mesures oportunes per promoure l’autonomia personal, familiar del beneficiari i família, mitjançant el desenvolupament de les seves capacitats.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Es contribuirà al desenvolupament humà tot assegurant el dret dels ciutadans a viure dignament durant totes les etapes de la seva vida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-S’afavorirà, si escau, la integració social de les persones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ARTICLE 5&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Modalitats de prestacions&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;1.-TIPUS D’AJUDA:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Les ajudes d’urgència social que aquí es regulen es destinaran a la satisfacció d’una necessitat primària i essencial per a la subsistència de la persona i de la seva unitat familiar&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Als efectes d’aquest reglament es consideraran situacions de necessitat extrema i urgent sussceptibles de ser ateses mitjançant una ajuda d’Urgència Social les següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Accés o manteniment de l’habitatge habitual i/o de les despeses derivades del mateix. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Lloguer endarrerits i lloguer habitual&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Reparacions o adaptació habitatge&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Pagament situacions llançaments i desnonaments&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Allotjament temporal, puntuals&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Adquisició d&amp;apos;equipament bàsic&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Facilitar l&amp;apos;accés a un habitatge&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Manteniment condicions mínimes d&amp;apos;higiene&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Garantir els subministraments bàsics&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Amb aquest casos es pagarà el 100% de l’ajuda prèvia justificació de serveis socials municipals.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Ajudes per l’escola de musica: Aquestes es concediran&amp;nbsp; sempre i quan sigui de gran ajuda&amp;nbsp; per l’usuari acudir a l&amp;apos;escola de musica i serà necessari un informe favorable d’un professional competent ( metge, psicòleg, psiquiatre, pedagog..... ) &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Ajudes per accedir a activitats esportives i instal·lacions municipals (piscina...)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;QUANTIES DE LES AJUDES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Cada tipologia d’ajut de l’article 5 i relacionades a l’annex II del present reglament tindrà una quantia que es concretarà en funció de la urgència i la necessitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Les prestacions econòmiques de quantia variable i orientades a donar cobertura&amp;nbsp; a la integritat de la necessitat són el conjunt de les regulades a l’article 5.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Accés o manteniment de l’habitatge habitual i/o de les despeses derivades del mateix.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;L’import de les prestacions econòmiques de quantia variable,&amp;nbsp; estarà determinat pel resultat de la suma de les puntuacions obtingudes al barem econòmic i a la valoració social. Annex I&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En el cas d’extrema i severa necessitat&amp;nbsp; el import serà íntegrament finançat per part de la Corporació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Al tractar-se d’un dret discrecional, i no revissable&amp;nbsp; per part del persona perceptora, l’Ajuntament podrà revisar l’augment o disminució de les quanties màximes dels ajuts en casos que així resti justificat per necessitats socials.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;No són susceptibles d’aquesta ajuda:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Les despeses derivades d’obligacions tributàries i deutes amb la Seguretat Social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Les despeses derivades de multes i altres sancions pecuniàries degudes al incompliment d’ordenances municipals.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Les despeses derivades del compliment d’una sentència judicial condemnatòria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ARTICLE 6.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Condicions Generals&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;1.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: black"&gt; Les ajudes econòmiques&amp;nbsp; es dirigeixen a aquelles persones i famílies que es troben en situació de necessitat social i no tenen cobertura d’altres sistemes de protecció social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;2.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: black"&gt; Les prestacions tenen un caràcter voluntari, temporal i extraordinari. Fet que suposa que les prestacions es concediran per un període de temps establert i que es poden renovar si es mantenen les condicions en què es van concedir i sempre que s’hagi complert el pla de treball.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;3.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: black"&gt; Els/Les titulars de les ajudes econòmiques i altres membres de la unitat familiar de convivència independent subscriuran amb els serveis socials&amp;nbsp; un pla d’inserció en què hi constin les intervencions o actuacions específiques en matèria d’inserció el contingut del qual serà negociat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;4.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: black"&gt; Les ajudes econòmiques concedides no es poden invocar com a precedent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;5.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: black"&gt; Aquestes prestacions seran intransferibles, i per tant, no es poden oferir en garantia d’obligacions, seran objecte de cessió total o parcial, compensació o descompte, llevat que sigui per al reintegrament de les prestacions indegudament percebudes, i/o retenció o embarg, llevat dels supòsits i amb els límits que preveu la legislació general de l’estat que sigui d’aplicació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;6.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: black"&gt; La concessió de les ajudes econòmiques s’ajustarà a la partida de despesa corresponent. Això no obstant, si es produeix un increment de la demanda que generi una despesa superior a la prevista, s’habilitarà la partida en la mesura que sigui possible i necessària, sempre que existeixin recursos financers suficients per cobrirà aquesta despesa d’acord a la legalitat vigent en matèria pressupostària.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;7.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: black"&gt; Les situacions d’excepcionalitat que es puguin produir en relació amb conceptes no contemplats o condicions per accedir a aquestes ajudes les recolliran els Serveis Socials, per al seu estudi.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;8.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: black"&gt; Els serveis socials comprovaran, pels mitjans oportuns, la situació econòmica, laboral i social dels/de les sol·licitants, la destinació de les prestacions a l’objecte previst i el compliment del pla de treball.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ARTICLE 7.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Destinataris i requisits&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;DESTINATARIS&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;1. &lt;/span&gt;&lt;/strong&gt;&lt;span style="color: black"&gt;Podran sol·licitar les ajudes econòmiques les persones físiques, per si mateixes o per la unitat familiar en situacions acreditades de greu necessitat i que reuneixen els requisits que s’estableixen en el present reglament.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;A tal efecte, s’entén com unitat familiar la constituïda per el/la sol·licitant i una o mes persones que convisquin en el mateix domicili, unides per la relació conjugal o anàloga, adoptiva.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;L’acolliment legal o de fet de un menor&amp;nbsp; o de una persona major per part de la unitat familiar, donarà lloc al còmput com un membre mes de la mateixa&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;REQUISITS:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Les persones sol·licitants de les prestacions han de complir els següents requisits:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Ser major de 18 anys o estar emancipades legalment o, en el seu defecte, haver iniciat el tràmit legal d’emancipació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Podran accedir&amp;nbsp; a les prestacions les persones i unitats familiars que no disposin d’ingressos (descontant les despeses de vivenda) superiors al següents percentatjes del IPREM per nombre de membres de la unitat familiar i de forma mensual.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Son obligacions dels/de les titulars i dels membres de la unitat econòmica de convivència independent:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Acceptar ofertes de treball tutelat i/o protegit formulades pels serveis públics d’ocupació o altres institucions competents, sempre que no s’acrediti impediment i a discreció de l’informe tècnic de referència dels Equips bàsics d’atenció social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Comunicar als serveis socials municipals les variacions o canvis existents en la situació social i econòmica de la persona o de la unitat convivència que pugin modificar les circumstàncies que van donar lloc a la sol·licitud i resolució.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Destinar la prestació a la finalitat que la va motivar (ajut al lloguer, medicaments, aliments, etc.).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Amb caràcter general l’atorgament de l’ajut resta condicionat a l’acceptació&amp;nbsp; de l’obligació de seguir un pla de treball individual i familiar per part de la persona usuària,( pla de feina ANNEX III)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Justificar l’ajuda mitjançant la presentació de factures acreditatives de la despesa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Comunicar als serveis socials de l’Ajuntament l’obtenció d’altres ajudes per a la mateixa finalitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Sotmetre’s a les actuacions de comprovació i control financer que efectuï l’Ajuntament de Puigpunyent i facilitar quanta informació i documentació li sigui requerida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Reintegrar els imports concedits quan no s’apliquin per a les finalitats per a les quals es van concedir.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Mantenir l’empadronament i la residència efectiva en el municipi de Puigpunyent durant el temps de percepció de l’ajuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Qualsevol altra obligació relacionada directament amb l’objecte de l’ajuda i que específicament s’estableixi en l’acord de concessió d’aquesta, i que serà proposada conforme al criteri professional dels serveis socials municipals.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ARTICLE 9.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Règim d’Incompatibilitats&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Cap persona podrà ser beneficiària simultàniament de més d’una prestació per a la mateixa finalitat, sigui quina sigui l’administració pública atorgant. Excepcionalment es podran concedir ajudes quan les prestacions econòmiques o serveis que es rebin d’altres administracions públiques no cobreixin la totalitat de l’import de la prestació per a la qual es va sol·licitar l’ajuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En general, serà compatible el gaudi pel mateix beneficiari de diverses prestacions econòmiques i la utilització gratuïta per part d’aquest dels serveis de les administracions públiques o d’entitats privades finançades amb fons públics, quan tinguin diferent naturalesa i responguin a diferents necessitats, dins dels límits i quanties econòmiques establertes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ARTICLE 10.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Seguiment de les Ajudes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Els Serveis Socials seran els encarregats de fer el seguiment de les situacions de necessitat protegida per a les ajudes d’urgència social, així com de la destinació donada a aquestes i podran requerir als beneficiaris la informació o documentació necessària per a l’exercici d’aquesta funció de forma adequada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La sol·licitud, es presentarà l`Ajuntament de Puigpunyent dirigit a Serveis&lt;/span&gt; &lt;span style="color: black"&gt;Socials de conformitat amb el model establert, sense perjudici d’allò que estableix l’article 38.4 de la llei 30/1992, de 26 de novembre, de regim jurídic de les administracions publiques i del procediment administratiu comú.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- Per las ajudes d’ulleres, ortopèdies, compra de mobiliari, electrodomèstics bàsics, condicionament sanitari i reparacions de l’habitatge&amp;nbsp; habitual: dos pressupostos i factures.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Ajuda destinada a millorar les condicions d’habitabilitat de l’habitatge habitual: aportar dos pressupostos d’obres i/o compres a realitzar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Per les ajudes de tractaments mèdics, pròtesis, ajudes tècniques complementaries o qualsevol altre tipus de prestació que cobreixi la Seguretat Social o altre entitat competent: Informe mèdic o prescripció facultativa de la Sanitat Pública que justifiqui la necessitat en cada cas, justificants de cites mèdiques i assistència al servei, dos pressupostos i sol·licitud de la prestació davant aquests organismes i resposta negativa a la mateixa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Atès el caràcter d’aquestes ajudes, excepcionalment s’admetran altres formes de justificació que els Serveis Socials d’atenció primària i la intervenció municipal valoraran.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;3.- PROTECCIÓ DE DADES.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Es garantirà la confidencialitat de les dades i el seu processament adequat, respectant en tot cas allò que estableix Llei Orgànica de Protecció de Dades. El sol·licitant ha de signar l’autorització expressa de tractament de dades de caràcter personal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ARTICLE 13.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Instrucció i Resolució de l’Expedient&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;EL PROCEDIMENT DE CONCESSIÓ&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;L’òrgan competent per resoldre sobre la concessió o denegació de les ajudes sol·licitades és l’Alcaldia-Presidència que podrà delegar aquesta facultat&amp;nbsp;&amp;nbsp; el/la regidor/ra de l’àrea de serveis socials de l’Ajuntament&amp;nbsp; de Puigpunyent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;PROCEDIMENT NORMALITZAT DE LES AJUDES:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Els ciutadans podran sol·licitar les ajudes al servei per pròpia iniciativa, o bé seran tramitades a proposta de la regidoria de benestar social o del professional de referència quant es tracti de persones amb les que ja s’està efectuant una&amp;nbsp; intervenció social o professional.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Les ajudes són tramitades pel Treballador/a Social dels Serveis Socials de l’Ajuntament de Puigpunyent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Una vegada rebuda la sol·licitud, en el cas que no s’hagi aportat tota la documentació necessària, és requerirà al sol·licitant que l’aporti en un termini de 15 dies hàbils, informant que l’incompliment del requeriment suposarà l’arxiu de l’expedient sense més tràmits.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-En el termini de quinze dies hàbils des de la recepció completa de la documentació necessària s’emetrà informe per part del treballador/a social, en el que es proposarà la concessió o no de l’ajuda sol·licitada, i, en el seu cas, de la quantia de l’ajuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-La resolució de la concessió d’ajuda serà del batle/batlessa&amp;nbsp; o del regidor/a delegat de l’Àrea de Serveis Socials, atorgant o denegant l’ajuda; ambdós participaran igualment del deure de mantenir en secret, al qual està obligat/a per ètica professional el treballador/a social. No es farà publicitat de les ajudes concedides, atès al que disposa l’article 18.3 de la Llei 38/2003 de 17 de novembre, general de subvencions, en relació amb l’article 7 del Decret legislatiu 2/2005, de 28 de desembre, pel que s’aprova el text refós de la Llei de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Una vegada resolt per l’autoritat resolutòria l’expedient, es comunicarà per escrit al sol·licitant, indicant-se la quantia i condicions de l’ajuda ( concepte, utilització de la prestació, duració i pla de treball, si n’és el cas), així com els recursos administratius i jurídics en el cas de desitjar la impugnació de l’acord.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Posteriorment es presentarà al departament d’intervenció la resolució de la regidoria de Serveis Socials perquè es pugui fer efectiu el pagament de la quantia concedida d’acord amb les condicions que s’estableixin.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-L’abonament de l’ajuda es pot realitzar directament al destinatari, o a l’entitat prestadora del servei o be motiu de subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-En casos de les ajudes periòdiques el tècnic valorarà la temporalització de l’ajuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ARTICLE 14.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Valoració de l’expedient&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Les peticions socials s’hauran de completar amb una valoració social per part del personal professional dels serveis socials bàsics municipals, mitjançant&amp;nbsp; annex I ( Model de barem per a la sol·licitud de ajudes econòmiques) &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Cada situació o problemàtica observada té una valoració en punts relacionades a l’annex 1 del present reglament. La suma de les diferents situacions correspondrà a la valoració social objectiva.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ARTICLE 15&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Justificació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-En la resolució de concessió s’expressarà l’obligació del/de la beneficiari/beneficiària de justificar l’aplicació de l’ajuda a la situació de necessitat a què s’orientava.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-La justificació de l’ajuda es realitzarà en el termini màxim de/d’ un mes &amp;nbsp;des de la seva concessió, mitjançant la presentació de factures, rebuts o justificants que acreditin de forma fefaent les despeses realitzades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Les factures i justificants presentats als efectes de la justificació han de ser originals i contenir, com a mínim, les dades del seu emissor i destinatari, on farà constar el seu número d’identificació fiscal, el bé o servei objecte de la contraprestació i l’import d’aquest, amb indicació de la part corresponent a l’IVA, i la data d’expedició d’aquesta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Atès el caràcter d’aquestes ajudes, excepcionalment s’admetran altres formes de justificació que els Serveis Socials de Base i la Intervenció Municipal valoraran.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Per a l’accés a determinades ajudes econòmiques serà necessari aportar, a més de la documentació general, la documentació específica que correspongui,segons l’article 12.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ARTICLE 16.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Denegació de la Prestació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La denegació de les sol·licituds, que ha de ser motivada, serà procedent&amp;nbsp; per&amp;nbsp; alguna de les causes següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-No complir els requisits exigits&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Negativa a subscriure i negociar un conveni d’inserció&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Poder satisfer adequadament les necessitats per si mateix i/o amb el suport&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; del&amp;nbsp;&amp;nbsp; seus familiars, representant legal o guardadors de fet.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Correspon l’atenció del sol.licitant a un altre administració publica a causa de&amp;nbsp; la naturalesa de la prestació o por raó de residència.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Per constar en el seu expedient personal no complir, amb les obligacions mínimes imposades en&amp;nbsp; l’acord i conveni de concessió, en altres ocasions en què&amp;nbsp; s’hagin concedit ajudes puntuals d’emergència.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Per qualsevol altra causa degudament motivada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ARTICLE 17&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Suspensió de la Prestació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La suspensió de la prestació pot ser motivada per la pèrdua temporal d’alguns dels requisits d’aquesta o per l’incompliment de les obligacions del destinatari/a que preveu l’article 8 d’aquesta Ordenança.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La suspensió es mantindrà mentre persisteixin les circumstàncies que l’hagin ocasionat durant un període continuat màxim de 3 mesos; transcorregut quest temps es procedirà a l’extinció del dret a la prestació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ARTICLE 18&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Modificació de la Prestació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La prestació es pot modificar per:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Modificació del nombre de membres de la unitat econòmica de convivència independent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Modificació dels recursos que s’hagin utilitzat de base per al càlcul de la prestació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ARTICLE 19&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Extinció de la Prestació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Es produirà l’extinció de la prestació pels motius següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Per mort, renúncia o trasllat del sol·licitant fora del municipi de Puigpunyent&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Per la desaparició de la situació de necessitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Per ocultament o falsedat en les dades que han s’han tingut en compte per concedir la prestació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Per la pèrdua d’alguns dels requisits o condicions exigides per ser beneficiari de la prestació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Por no destinar la prestació a l’objecte d’aquesta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Per manteniment d’una situació de suspensió per un període continuat superior a 3 mesos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ARTICLE 20&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Suspensió Cautelar de la Prestació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Independentment que s’hagi iniciat o no un procediment d’extinció, bé d’ofici o a instància de part es pot procedir a la suspensió cautelar del pagament de la prestació quan es detectin, en la unitat econòmica de convivència independent, indicis d’una situació que impliqui la pèrdua d’algun dels requisits exigits per al reconeixement o manteniment d’aquesta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;S’ha de resoldre sobre el manteniment, suspensió o extinció de la prestació en un termini màxim de tres mesos des de l’adopció de la suspensió cautelar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ARTICLE 21&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Desistiment i Renúncia&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La persona sol·licitant pot desistir de la seva sol·licitud o renunciar al seu dret, a la prestació reconeguda, mitjançant escrit dirigit a l’Ajuntament. Aquest dictarà resolució on s’expressi la circumstància en què concorre tot indicant els fets produïts i les normes aplicables.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ARTICLE 22&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Reintegrament&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Es reintegraran les quantitats obtingudes en concepte d’Ajuda d’Emergència Social, amb l’exigència de l’interès de demora establert legalment, en els casos següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Obtenir l’ajuda falsejant i ocultant dades que haguessin determinat la seva denegació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Destinar l’ajuda a altres fins diferents d’aquells que es van especificar en la resolució de concessió.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-No justificar l’aplicació de l’Ajuda , o justificar-la fora de termini.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-En la resta de supòsits que preveu la legislació reguladora de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ARTICLE 23&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Procediment d’Urgència&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En el cas d’urgència degudament justificada i valorada pels/per les professionals dels serveis socials municipals, es concedirà una part proporcional de l’ajuda precisa amb la major rapidesa possible sens perjudici de l’adopció de les mesures necessàries que garanteixin la seva finalitat i l’aprovació posterior de l’òrgan competent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;TÍTOL III.&lt;br /&gt; POTESTAT SANCIONADORA, INFRACCIONS I SANCIONS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ARTICLE 24&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Potestat Sancionadora&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La potestat sancionadora correspon a l’Alcalde, dins de l’àmbit de les seves competències, sens perjudici de comunicar si escau a les Autoritats Governatives i judicials, en el cas que puguin constituir un objecte constitutiu de delicte o manca de les conductes i infraccions la sanció i inspecció de les quals tinguin atribuïdes legalment o reglamentàriament, sempre amb incoació prèvia de l’expedient administratiu corresponent, de conformitat amb l’article 17 del Reial Decret 1398/1993, de 4 d’agost, pel qual s’aprova el Reglament de Procediment per a l’Exercici de la Potestat Sancionadora, els articles 80, 127 i següents de la Llei 30/1992, de 26 de novembre, de Règim Jurídic de les Administracions Públiques i del Procediment Administratiu Comú i els articles 100 i següents de la Llei 4/2009, d’11 de juny, de Serveis Socials de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ARTICLE 25&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Infraccions&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Constitueixen infracció administrativa les vulneracions dels deures i de les obligacions que el present Reglament fixa per als usuaris i usuàries de les prestacions de serveis socials.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Són faltes lleus les infraccions que no estan qualificades com a greus o molt greus.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-No facilitar informació sobre els canvis en la situació personal, familiar, econòmica i social&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-No complir els acords relacionats amb el servei concedit.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-No destinar la prestació a la finalitat per a la qual va ser concedida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-No comunicar als responsables del servei l’absència del domicili, sense una justificació vinculada a una incidència.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Són faltes greus:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-La comissió de dues faltes lleus en el període de sis mesos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-No comparèixer davant l’òrgan que li ha atorgat el servei.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-La manca de respecte al personal que presta el servei.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-No utilitzar amb responsabilitat i cura el material que li sigui subministrat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Són faltes molt greus:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-La comissió de dues faltes greus en el període de sis mesos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-L’agressió física o psicològica al personal que presta el servei.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-L’incompliment dolós dels compromisos acordats.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-La falsedat en la documentació presentada o la ocultació d’informació prioritària per a la prestació del servei.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ARTICLE 26&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Sancions&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;1.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: black"&gt;Les infraccions lleus es poden sancionar amb una amonestación o una multa per un import de fins a la meitat de l’indicador public de renda d’efectes múltiples( IPREM).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;2.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: black"&gt;Les infraccions greus es poden sancionar amb la suspensió de la condició de persona usuaria o beneficiaria de la prestación, o amb el tresllat a un altre centre, per un periode màxim de 12 mesos .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;3.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: black"&gt;Les infraccions molt greus es poden sancionar amb l’extinció de la prestación o del servei o amb el trasllat definitiu.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Per aplicar les sancions es té en compte allò que estableix l’article 61 i següents de la Llei 38/2003, de 17 de novembre, General de Subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;DISPOSICIÓ TRANSITÒRIA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ARTICLE 27&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Prescripció&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Les infraccions administratives molt greus tipificades en aquest Reglament prescriuen als quatre anys; les greus, als tres anys; i les lleus, a l’any. Aquest termini comença a comptar des de la data en què es produeix la infracció.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Les sancions imposades per infraccions molt greus prescriuen als quatre anys; les greus, als tres anys; i les lleus, a l’any. Aquest termini comença a comptar des del dia següent en què la resolució per la qual s’imposa la sanció sigui ferma.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Aquest Reglament, la redacció definitiva de la qual ha aprovat el Ple de l’Ajuntament en sessió celebrada en data 14 d’Octubre de 2013 entrarà en vigor als quinze dies de la seva publicació íntegra en el BOCAIB de conformitat amb els articles 65.2 i 70.2 de la Llei Reguladora de les Bases del Règim Local, i estarà en vigor fins a la seva modificació o derogació expressa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;DISPOSICIÓ FINAL&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;L’Alcaldia està facultada per dictar les disposicions internes que siguin necessàries per al desplegament i aplicació d’aquesta norma, sempre que no suposi la seva modificació; es comunicarà a la Comissió Informativa corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
