CAIB ca 2014-08-14 CAIB CAIB 37541 text/html 60 37551 547484 2014-08-14 ![CDATA[<p> <span style="font-family:times new roman,times,serif;font-size:12px;">En sessió plenària celebrada el dia 30 d’abril de 2014, s’aprovà la Relació de llocs de treball de l’Ajuntament de Santa Eugènia (RLT). </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En aplicació del que determina l’article 74 de la Llei 7/2007, de 12 d’abril, de l’Estatut Basic de l’empleat públic, es publica un extracte del text aprovat de la Relació dels llocs de treball. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En concret, no s’inclouen els apartats 1 “Descripció de l’Ajuntament”, 3 “La plantilla de personal del pressupost”, i 4 “L’oferta d’ocupació pública per a l’exercici 2014”, perquè el seu contingut només és introductori respecte del contingut normatiu de la RLT. Tampoc s’inclouen les fitxes concretes de descripció i valoració dels llocs, sinó un llistat amb les característiques essencials de cada un dels llocs de la RLT. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">No obstant, hi ha un ejemplar complet de la RLT a la secció Documentació municipal de la pàgina web de l’Ajuntament de Santa Eugènia <a href="http://www.ajsantaeugenia.net/">www.ajsantaeugenia.net</a> </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">EXTRACTE DEL TEXT APROVAT DE LA RELACIÓ DE LLOCS DE TREBALL DE L’AJUNTAMENT DE SANTA EUGÈNIA.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">[…]</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Justificació de la Relació de llocs de treball</span></p> <p> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">És molt important definir i estructurar amb claredat els recursos humans d’una organització tan complexa com la descrita, on conviuen treballadors amb dos règims jurídics diferents (funcionaris i laborals), amb categories distintes (algunes d’elles amb diferents condicions horàries), i sistemes de retribució divergents, tant en estructura com en quantitat salarial.</span></strong></p> <p> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Aquesta complexitat exigeix reflexió, clarificació, debat i consens, que són vitals donada la peculiaritat de “l’empresa” municipal, on el nivell polític representa alhora la “propietat” – els habitants del municipi- , i la direcció empresarial. </span></strong></p> <p> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">A més, no es pot oblidar que la major part del personal és “propietària” de l’Ajuntament –en&nbsp; tant que ciutadans del municipi- confluint uns i altres en la recerca de l’objectiu fundacional de “l’empresa”: Millorar el benestar diari dels habitants de Santa Eugènia.</span></strong></p> <p> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Seguint les idees de la Nova Gestió Pública s’ha de contemplar l’administració des d’un punt de vista empresarial, però sense oblidar que l’objectiu no és obtenir rendiments econòmics, sinó rendiments socials. És impensable que una empresa –privada o pública- amb un desig de permanència i rendibilitat pugui subsistir sense disposar d’un programa d’utilització sostenible dels seus recursos humans. </span></strong></p> <p> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">D’aquí neix la necessitat de treballar i consensuar entre la direcció política i els representants del personal municipal, una RLT que defineixi clarament l’estructura i funcionalitat de cada membre de la plantilla, i la millor utilització dels recursos disponibles.</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Per altra banda, des de l’aprovació de la llei 30/1984, de&nbsp; reforma de la funció pública - antecedent del vigent Estatut bàsic de l’empleat públic de 2007-, és una obligació que totes les administracions públiques disposin de la seva RLT.</span></p> <p> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">A més, hi ha altre personal treballador a l’Ajuntament que no s’inclou a l present catàleg per alguna de les següents raons:</span></strong></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">- La secretaria-intervenció, en tant que com està agrupada amb l’Ajuntament de Búger, les condicions de treball i salarials s’han d’establir per consens de l’òrgan directiu de l’Agrupació.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">- Personal de la Mancomunitat del Pla, que realitza les seves tasques parcialment al municipi de Santa Eugènia.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">- Personal temporal per conveni SOIB - Corporacions Locals de col·laboració social.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">- Personal temporal contractat en funció de la demanda de serveis puntuals de caràcter no permanent, com les educadores i auxiliars de l’escola infantil municipal. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En el darrer cas, a més, es dóna la particularitat que les escoles infantils municipals han esdevingut una competència autonòmica, d’acord a la disposició addicional quinzena de la Llei 27/2013, de 27 de desembre, de racionalització i sostenibilitat de l’administració local. No obstant, mentre no es puguin conèixer amb detall les condicions del traspàs del servei a la comunitat autònoma, es mantenen les condicions laborals i salarials del personal de l’escola infantil municipal.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En aquest darrer cas, d’acord a la Llei 27/2013, de 27 de desembre, de racionalització i sostenibilitat de les administracions locals, cal recordar que les competències educatives s’han de transferir obligatòriament a la comunitat autònoma, en un termini encara indefinit perquè dependrà del sistema de finançament autonòmic i local, actualment en procés de negociació. Per aquest motiu no es poden incloure a una RLT que té vocació de permanència en el temps. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Tampoc poden formar part de la RLT els professionals liberals contractats per l’Ajuntament en règim d’assessorament extern (arquitecte tècnic, misser),&nbsp; atès que el règim de prestació de serveis no permet incloure’ls dins la plantilla de personal de l’Ajuntament. La regulació de les seves funcions i condicions de treball, així com la seva selecció, estan subjectes a la normativa de contractació administrativa.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">[…]</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">5. Descripció de la relació de&nbsp; llocs de treball</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’article 74 de l’EBEP obliga les administracions públiques a estructurar la seva organització “<em><span style="color: rgb(51, 51, 51);">a través de relaciones de puestos de trabajo u otros instrumentos organizativos similares que comprenderán, al menos, la denominación de los puestos, los grupos de clasificación profesional, los cuerpos o escalas, en su caso, a que estén adscritos, los sistemas de provisión y las retribuciones complementarias. Dichos instrumentos serán públicos.”</span></em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">A més, cal tenir en compte que la DT. 2a del RD 861/1986, de 25 d’abril, de retribucions del personal de l’administració local, diu que: <em>“Hasta tanto se dicten por la Administración del Estado las normas con arreglo a las cuales haya de confeccionarse las relaciones de puestos de trabajo tipo y las condiciones requeridas para su creación, los Plenos de las Corporaciones Locales deberán aprobar un catálogo de puestos a efectos de complemento específico”.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Fins ara l’Estat no ha dictat normes concretes per a l’Administració Local sobre la definició de relacions de llocs de treball, però l’OM de 2/12/1988 i OM,&nbsp; de 6/2/89, contenen les previsions oportunes per a l’Administració de l’Estat, que es poden considerar com a normativa supletòria..</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Així, per a la confecció de la present Relació de Llocs de Treball (RLLT), s’han seguit els criteris de contingut establerts per l’OM de 2 de desembre de 1.988 sobre relacions de llocs de treball de l’Administració de l’Estat: <em>“En dichas relaciones se indicará la denominación y características esenciales de los puestos de trabajo, los requisitos exigidos para su desempeño, el nivel de complemento de destino y, en su caso, el complemento específico, cuando hayan de ser desempeñados por personal funcionario, o la categoría profesional y régimen jurídico aplicable cuando sean desempeñados por personal laboral.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">&nbsp;&nbsp;&nbsp; <em>Entre las características esenciales de los puestos de trabajo y los requisitos exigidos para su desempeño deberán figurar necesariamente el tipo de puesto, el sistema de provisión y los Grupos, Cuerpos y escalas a que deban adscribirse y, en su caso, la titulación académica y formación específica necesarias para el correcto desempeño del puesto de trabajo. Igualmente podrán especificarse aquellas condiciones particulares que se consideren relevantes en el contenido del puesto o en su desempeño”.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Per a la seva elaboració s’ha seguit una metodologia basada en la jerarquització dels llocs prenent en consideració la globalitat del contingut de les tasques dels llocs. Aquest sistema consisteix en la distribució ordenada dels llocs d’acord al seu grau de complexitat i dificultat, sense descompondre les tasques en factors, sinó considerant globalment els continguts i comparant-los entre si per establir la seva situació relativa.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Malgrat tot, convé subratllar el caràcter instrumental de les tècniques d’avaluació. La valoració econòmica de cada lloc depèn de la política retributiva de cada organització, i de com aquesta organització distribueix la retribució total del personal en funció del nivell del lloc o d’altres factors, com la categoria personal, l'antiguitat, el rendiment en el lloc, certes condicions de treball o les qualitats personals.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En aquest sentit, s’ha realitzat una valoració objectiva de les condicions de cada lloc de treball en base als següents paràmetres:</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Les funcions realitzades són una descripció genèrica i no exhaustiva de les tasques assignades a un lloc de treball concret en el moment de l’aprovació de la RLT. La seva variació temporal o permanent –i el valor econòmic de la variació- serà negociada puntualment entre la direcció, el personal afectat i la representació del personal, sense que impliqui una revisió de la RLT.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Les condicions de complexitat tècnica i responsabilitat d’execució de les funcions del lloc són la base per determinar el nivell corresponent al complement de destí.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">3. La descripció de condicionants com la penositat o perillositat serveixen per a la valoració del complement específic.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Un dels objectius fonamentals de la política d’organització dels recursos humans és la unificació de totes les places permanents en el règim funcionarial, mitjançant processos de funcionarització del personal laboral indefinit fix. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Amb aquest objectiu s’ha calculat la valoració econòmica aplicant l’estructura de grups, nivells i complements propis del personal funcionari, assimilant el personal laboral d’acord amb la titulació exigida en l’accés al lloc de treball. Per això, s’han creat els complements de destí i específic allà on no existien. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Finalment, el procediment d’aprovació de la Relació, d’acord a la normativa, serà el següent:</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Redacció d’una proposta inicial amb la definició del règim jurídic, funcions, característiques&nbsp; i valoració econòmica de cada lloc de treball.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Presentació de la proposta als representants sindicals del personal laboral i funcionari, de forma que la puguin conèixer amb detall, per a la seva anàlisi. </span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">3. Debat i aprovació de la proposta en les Comissions Paritàries de Seguiment dels respectius conveni laboral i pacte de funcionaris, com a representació plural del personal municipal.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">4. Aprovació de la redacció definitiva de la Relació de llocs de treball al Ple municipal.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">6. La valoració econòmica dels llocs de treball</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Una part fonamental de la RLT és la valoració en termes salarials de les condicions de desenvolupament de cada lloc de treball de l’Ajuntament, el que suposa uns nivells retributius que s’han de calcular amb criteris homogenis, amb l’objectiu de respondre a la desigualtat existent.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La RLT, però, no inclou la valoració de triennis, ajudes socials, o productivitat, ja que aquests complements no són inherents al lloc de treball, sinó propis de la persona que l’ocupa. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La valoració econòmica s’ha calculat d’acord als següents criteris de racionalització:</span></p> <ol> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Adaptar a tot el personal de la plantilla l’estructura salarial del funcionariat, en base als Pressuposts Generals de l’Estat per a 2014.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Mantenir el poder adquisitiu&nbsp; actual de totes les persones actualment en plantilla. En el cas que a la valoració s’obtenguin imports salarials inferiors als actuals, s’aplicarà un complement personal transitori absorbible, que anirà reduint-se en funció de futurs increments de les quanties estipulades als Pressuposts generals de l’estat, fins a assolir els imports de la RLT. </span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Aplicar el principi “Igual feina, igual salari”, valorant amb criteris equivalents les places d’un mateix grup, tret de les particularitats que porten a la seva singularització.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Limitar les retribucions de cada lloc de treball –i del conjunt del personal descrit- als imports establerts per a 2014, en aplicació de la normativa de sostenibilitat econòmica. En el cas que de la valoració s’obtenguin imports salarials superiors als actuals,&nbsp; s’aplicaran proporcionalment en funció de futurs increments de les quanties estipulades als Pressuposts generals de l’estat, fins a assolir els imports de la RLT. </span></li> </ol> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">7. Descripció de les fitxes de lloc de treball</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Com hem vist, la RLT pretén informar de forma esquemàtica i sintètica sobre els aspectes fonamentals dels recursos humans dels que disposa una corporació, pública o privada, responent a les preguntes fonamentals de la gestió de personal:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">- Què fa?</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">- Quina normativa s’aplica?</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">- Quins requisits formatius exigeix?</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">- Quin cost té? </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les fitxes de lloc de treball pretenen donar resposta detallada a aquestes qüestions, mitjançant la següent estructura:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><u>Descripció del lloc</u></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Denominació:</strong> nom identificatiu del lloc de treball.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Núm. RLLT: identificació numèrica del lloc de treball dins la Relació.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Tipus: qualificació del lloc segons que hi hagi places funcionalment similars a altres administracions –normalitzat-, o be que té unes característiques específiques que impedeixen l’equiparació funcional amb altres administracions –singularitzat-.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Llocs homogenis: nombre de places descrites per la fitxa.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Jornada habitual: nombre d’hores setmanals de treball.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">% jornada completa: proporció de la jornada habitual del lloc de treball respecte d ela jornada laboral completa establerta per la normativa (37,5 h/setm).</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><u>Règim jurídic</u></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Tipus: descripció del règim jurídic aplicable: funcionarial, laboral, o eventual.¹</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Forma de provisió: sistema d’accés bé per concurs de mèrits i capacitat, bé per lliure designació de la prefectura de personal.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Compatibilitat: regulació dels límits a la capacitat de desenvolupar altres activitats públiques o privades a part de les pròpies del lloc de treball, així com l’existència de restriccions imposades pel propi Ajuntament.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>__________________________________________________________________________________________________________</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:10px;">1 Nota: atès l’objectiu de funcionarització de tot el personal laboral indefinit fix, tots els llocs de treball s’han descrit com a subjectes al règim funcionarial. A la RLT no es preveu cap lloc de treball en règim eventual.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><u>Classificació</u></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Escala:</strong> regulades per al personal de l’Administració local pel Reial decret legislatiu 781/1986, de 18 d’abril, segons el grup d’accés descrit a l’art. 76 EBEP, determinat per la titulació acadèmica requerida en l’accés.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Grup d’accés: grup d’accés definit a l’article 76 de l’EBEP, en base a la següent classificació:</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">A1 i A2. Exigeix el títol universitari de Grau o equivalent. Els dos subgrups es defineixen en funció del nivell de responsabilitat de les tasques a desenvolupar i de les característiques de les proves d’accés. Correspon als antics grups A i B de la Llei 30/1984.</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">B. Exigeix el títol de Tècnic superior.</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">C1. Exigeix el títol de Batxiller o Tècnic. Correspon a l’antic grup C de la Llei 30/1984.</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">C2. Exigeix el títol de graduat en Ensenyament secundari obligatori. Correspon a l’antic grup D de la Llei 30/1984</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">AP. Agrupacions professionals definides a la normativa de funció pública autonòmica o sectorial. Definida a la disposició addicional setena de l’EBEP. Correspon a l’antic grup E de la Llei 30/1984 </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Subescala: subescala i classe, regulades al Rdl 781/1986.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><u>Titulació</u></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Acadèmica: nivell acadèmic exigit per accedir a l’escala del lloc de treball.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Específica: altra titulació diferent de l’acadèmica, o complementària d’aquesta que sigui necessària per al desenvolupament de les funcions pròpies del lloc de treball.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Nivell de català: nivell de coneixements de la llengua catalana mínims i obligatoris per a ocupar el lloc de treball definit per l’Ajuntament, en aplicació de la disposició addicional dotzena de la Llei 3/2007, de 27 de març, de la funció pública de la Comunitat autònoma de les Illes Balears. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><u>Funcions</u></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Descripció sintètica de les funcions principals del lloc de treball. Aquestes funcions tenen caràcter genèric i no exhaustiu. En el cas que hagi produir-se una variació substancial, es negociarà a la Comissió Paritària de Seguiment de l’acord del personal funcionari² definint clarament la justificació del canvi, les tasques afectades i la repercussió en l’estructura salarial.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><u>Condicions particulars</u></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Altres característiques no exposades anteriorment i que són d’interès en la definició del lloc de treball i la seva valoració econòmica.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><u>Complement de destí</u></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La quantia del complement de destí s’estableix anualment als Pressuposts Generals de l’Estat, d’aplicació per a totes les administracions públiques, en base als nivells propis de cada lloc de treball. competència i complexitat s’han triat les següents:</span></p> <ul> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Comandament: relació amb subordinats jeràrquics o orgànics.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Qualificació tècnica: exigència de coneixements tècnics específics del lloc de treball</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Actualització permanent: exigència de formació constant en les tasques del lloc de treball.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Responsabilitat penal: grau d’imputació penal en l’exercici de les seves activitats.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Conducció de vehicles: feina habitual que impliqui l’ús de vehicles propis o municipals.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Maneig doblers: responsabilitat per gestió directa de doblers en quantitat significativa, tant en metàl·lic com en format telemàtic.</span></li> <li> <span pròpia feina</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Feina en equip: necessitat de coordinació i sincronia amb altres llocs de treball</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Ordre públic i armes: Feina habitual que impliqui l’ús d’armes o de defensa personal.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Incompatibilitat: restricció jurídica de realització de tasques semblants fora de l’horari laboral.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Disponibilitat horària: possibilitat de realitzar tasques extraordinàries obligatòries fora de l’horari laboral.</span></li> </ul> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les condicions s’han valorat segons tres graus d’intensitat (0 – no aplicable, 1- intensitat mitjana, i 2- intensitat alta). </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La suma total de punts obtinguts de multiplicar la intensitat de cada una de les condicions –amb un màxim possible de 22 punts- determina el nivell de complement de destí aplicable al lloc de treball, assignant un nivell superior al mínim del grup per cada 2 punts (o fracció), sense que es pugui superar el nivell destí tenen assignat un valor monetari determinat en els Pressuposts Generals de l’Estat. Per tant, el lloc de treball de l’exemple anterior té un complement de destí mensual valorat en&nbsp; 237,62 €.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La valoració del nivell de complement de destí també repercuteix en el càlcul de les dues pagues extres aplicables, ja que els Pressuposts Generals de l’Estat determinen anualment que consisteixen, cada una, d’una quantia aplicable segons el grup, una mensualitat del complement de destí i del complement específic, a més dels triennis aplicables, que no són objecte de la Relació de llocs de treball.&nbsp; </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><u>Complement específic:</u></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Retribució complementària destinada a valorar les condicions particulars d’alguns llocs de treball en atenció a la seva especial dificultat tècnica, dedicació, incompatibilitat, responsabilitat, perillositat o penositat. (art. 4.1 del Reial Decret 861/1986, de retribucions de funcionaris de l’administració local). </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Vist que els Pressuposts Generals de l’Estat no ho determinen, s’ha utilitzat com a base la valoració per a 2014 del III Conveni únic del personal laboral de l’Administració general de l’estat, agafant els complements singular de lloc i altres que són d’aplicació a l’Ajuntament, i que s’apliquen en funció del grup d’accés. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">D’aquesta manera, s’han valorat els següents conceptes, distribuïdes en 14 pagues:</span></p> <ul> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">(A/) Idiomes cooficials: ús obligatori de vàries llengües oficials en l’atenció al públic o la tramitació d’expedients.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">(AR) Dificultat tècnica: tasques habituals que exigeixen concentració, esforç físic o psicològic.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">(B) Atenció al públic: feina habitual d’accés directe al públic</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">(C) Maneig de fons públics: feina habitual amb cabals públics, en metàl·lic o de forma electrònica.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">(D6) Toxicitat: Feina habitual amb productes tòxics, àcids, inflamables o corrosius.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">(001 C) Nocturnitat: possibilitat de realitzar treball nocturn, entès des de les 22.00 a les 06.00 hores.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">(001 C1) Nocturnitat i festius: possibilitat de realitzar treball nocturn, incloent festius i diumenges.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">(002 C) Turnicitat: distribució de l’horari habitual de feina en torns.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">(002 C1) Turnicitat i festius: distribució de l’horari laboral en torns, incloent festius i diumenges. </span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">(004 A) Jornada partida: Distribució de l’horari habitual de feina que inclogui almenys una horabaixa setmanal.</span></li> </ul> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">A més, s’ha incorporat el criteri addicional variable <em>Especial responsabilitat</em> per a valorar el fet que determinades places inclouen una major repercussió de la bona execució de les seves tasques que no es troba definida en altres criteris del complement específic o de destí. Aquest criteri s’ha valorat en 55,00 € mensuals a personal de l’administració general, 30,00 € en personal de biblioteca, i 20,00 € en personal de brigada i neteja.</span></p> <table border="1"
