&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1. Les entitats que figuren en l’annex 1 d’aquesta Resolució han presentat a la Direcció General de Comerç i Empresa una sol·licitud d&amp;apos;ajuda per a la incorporació de socis treballadors.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2. Els serveis tècnics de la Direcció General de Comerç i Empresa, abans de traslladar-les a la Comissió Avaluadora, han examinat les sol·licituds i han comprovat que:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Les entitats sol·licitants, per la seva naturalesa, poden ser beneficiàries de la subvenció objecte de convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Les persones sol·licitants han presentat les sol·licituds dins el termini previst. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Les persones sol·licitants estan al corrent de les obligacions amb la seguretat social i amb l&amp;apos;Administració tributària, tant l&amp;apos;estatal com l&amp;apos;autonòmica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3. Les sol·licituds s&amp;apos;han traslladat a la Comissió Avaluadora, que s&amp;apos;ha reunit el dia 29 de novembre de 2013 i ha elaborat l&amp;apos;informe corresponent en què estableix la llista d&amp;apos;expedients classificats per ordre decreixent de la puntuació obtinguda, d&amp;apos;acord amb els criteris de valoració que fixa l&amp;apos;apartat setè de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. En data 2 de desembre de 2013, s’han publicat a la pàgina web de la Direcció General de Comerç i Empresa l’Informe de la Comissió Avaluadora i la Proposta de resolució, condicionada a l’aportació de la documentació establerta en l’apartat 5.3 de la convocatòria dins el termini de quinze dies.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;5. Abans de finalitzar el termini previst a l’apartat anterior, les entitats sol·licitants han presentat la documentació establerta en l’apartat 5.3 de la convocatòria per a cada nou soci incorporat, per la qual cosa l’import inicial previst per a cada una de les entitats no ha sofert cap modificació.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;6. La subvenció proposada es distribueix en les quantitats especificades en l’annex 1, per beneficiari, al qual se li ha aplicat l&amp;apos;import previst a la convocatòria en funció del col·lectiu al qual pertany el soci/sòcia incorporat i el tipus de jornada completa o parcial segons pertoqui, i hi ha crèdit adequat i suficient a la partida pressupostària 14701 315C01 47000/FF19202 dels pressuposts vigents de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;7. S&amp;apos;ha aplicat als beneficiaris d&amp;apos;aquesta convocatòria la norma de minimis, la qual determina que l&amp;apos;ajuda de minimis no pot ser superior a 200.000 euros durant un període de tres exercicis fiscals.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;8. Amb data 10 de desembre de 2013, la directora general de Comerç i Empresa ha dictat proposta de resolució per a tots els beneficiaris que figuren a l’annex 1.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;9. En data 12 de desembre de 2013 s’ha fiscalitzat de conformitat l’expedient núm. 2/2013 (SUBCC 2013 6937) corresponent a l’entitat S. COOP. D’ENSENYAMENT ES LLEDONER amb CIF núm. F07746423.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;8. La Resolució del conseller d’Economia i Competitivitat de 7 de novembre de &amp;nbsp;2013 per la qual es convoquen ajuts destinats a fomentar l&amp;apos;ocupació i la millora de la competitivitat en les cooperatives i societats laborals (BOIB núm. 155 , de 12 de novembre).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Resolució&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1. Aprovar la concessió d’una subvenció destinada a fomentar l&amp;apos;ocupació i la millora de la competitivitat en les cooperatives i societats laborals, a les cinc entitats beneficiàries que figuren en l’annex 1 de – S. COOP. D’ENSENYAMENT ES LLEDONER a GORG BLAU S. COOP. LTDA. -, per l’import individual indicat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2. Autoritzar i disposar la despesa, reconèixer l’obligació i proposar-ne el pagament a favor de tots ells per l&amp;apos;import individual indicat en l&amp;apos;annex 1, per un import total de 64.481,20 euros, amb càrrec a la partida 14701 315C01 47000/FF19202 dels pressuposts vigents de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3. Els beneficiaris queden obligats a:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;a) Presentar abans del 30 de juny, durant tres anys consecutius, la documentació següent respecte del soci incorporat:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;— Informe de vida laboral emès per la Tresoreria General de la Seguretat Social.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;— Certificat expedit per la persona titular de l’òrgan competent de la cooperativa o societat laboral que acrediti la permanència com a soci.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;b) Mantenir la persona o persones incorporades com a soci treballador o de treball almenys durant tres anys. En cas que siguin baixa, els hauran de substituir per una altra persona pel període que falti fins a completar els tres anys. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Si l’ajut s’ha concedit per a la incorporació d’una persona que pertany a un col·lectiu determinat, la substitució s’haurà de fer per una altra persona que pertanyi a algun dels col·lectius que puguin ser beneficiaris d’aquestes subvencions per un import igual o superior al de qui ha estat baixa.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;L’entitat té l’obligació de comunicar la baixa a la Direcció General de Comerç i Empresa en el termini d’un mes comptador des que s’ha produït, i la substitució s’ha de fer en el termini màxim de sis mesos des de la data en què va ser baixa.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En el cas que no es mantingui l’activitat durant el període de tres anys, hauran de reintegrar les quantitats percebudes pel període que falti amb els interessos de demora corresponents.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;c) Mantenir durant un període de cinc anys, almenys, una forma jurídica entre les exigibles per ser beneficiària de la subvenció obtinguda. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;d) Sotmetre’s a les actuacions de comprovació que faci la Direcció General de Comerç i Empresa, i a les actuacions de control financer de la Intervenció General de la Comunitat Autònoma de les Illes Balears i de la Sindicatura de Comptes.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;e) Comunicar l’obtenció d’altres subvencions o ajudes per a la mateixa finalitat procedents de qualsevol administració o entitat pública o privada, nacional o internacional.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;f) Conservar els documents justificatius de l’aplicació dels fons percebuts, mentre puguin ser objecte d’actuacions de comprovació i control.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;g).&lt;span style="color: black"&gt;Reintegrar els fons percebuts en els supòsits prevists en l’article 44 del Decret legislatiu 2/2005.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Interposició de recursos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Contra aquesta resolució —que exhaureix la via administrativa— es pot interposar un recurs potestatiu de reposició davant el conseller d’Economia i Competitivitat, en el termini d’un mes comptador des de l’endemà d’haver-ne rebut la notificació, d’acord amb l’article 117 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú, i l’article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l’Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l’endemà d’haver rebut la notificació de la Resolució, d’acord amb l’article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
