    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Mitjançant resolució de data 14 de juny de 2013 es va aprovar la convocatòria, les bases, el barem de mèrits i la designació de la Comissió de Valoració del concurs de provisió de llocs de feina d&amp;apos;aquest Ajuntament de Calvià (BOIB núm. 95 de 6/7/2013).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;A la vista que la Comissió de Valoració de la Convocatòria ha formulat la proposta definitiva d&amp;apos;adjudicació dels llocs de feina determinats en l&amp;apos;annex 5 de la resolució citada en l&amp;apos;apartat anterior i de l&amp;apos;establert en la base 12.7 de la convocatòria, respecte d&amp;apos;aquells funcionaris i funcionàries que trobant-se en la situació d&amp;apos;adscripció provisional no han obtingut cap lloc de feina, aquesta Tinença de Batlia, d&amp;apos;acord a la facultat que li confereix l&amp;apos;art. 21.1.h) de la Llei 7/85 de 2 d&amp;apos;abril, reguladora de les bases de règim local, dicta la següent&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Primer.&lt;/strong&gt; Adjudicar, segons la proposta definitiva efectuada per la Comissió de Valoració, els llocs de feina de l&amp;apos;Ajuntament de Calvià objecte del procediment de provisió convocat per Resolució de la Tinença de Batlia de data 14/6/2013 (BOIB núm. 95 de 6/7/2013), d&amp;apos;acord el següent:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Tercer. &lt;/strong&gt;Ordenar la publicació d&amp;apos;aquesta resolució en el tauler d&amp;apos;anuncis de l&amp;apos;Ajuntament, en el web municipal i en el Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Quart.&lt;/strong&gt; El termini per prendre possessió del nou lloc de feina adjudicat és de tres dies. En els casos en què la persona adjudicatària ho sol·liciti i ho justifiqui degudament, es pot concedir una pròrroga del citat termini, tal com determina la base 13.5 de la convocatòria.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Cinquè&lt;/strong&gt;. El termini de presa de possessió comença a comptar l&amp;apos;endemà del cessament del lloc de feina, el qual s&amp;apos;ha d&amp;apos;efectuar dins els tres dies hàbils següents a la publicació de la resolució del concurs en el BOIB.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La persona titular del servei on presti serveis el funcionari o funcionària que hagi de cessar en el lloc de feina pot proposar a la Tinença de Batlia , per necessitats del servei, que s&amp;apos;ajorni el cessament per termini màxim de 20 dies hàbils.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra aquesta resolució, que posa fi a la via administrativa, cal interposar, amb caràcter potestatiu, recurs de reposició davant el mateix òrgan que l&amp;apos;ha dictada, d&amp;apos;acord amb el que disposa l&amp;apos;art. 116 de la Llei 30/92, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú, segons la redacció que en fa la Llei 4/99, de 13 de gener. El termini per interposar-lo és d&amp;apos;un mes a comptar de l&amp;apos;endemà al de la publicació d&amp;apos;aquesta resolució i no es pot, en aquest cas, interposar recurs contenciós administratiu fins que s&amp;apos;hagi resolt el de reposició.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El recurs de reposició potestatiu s&amp;apos;ha de presentar en el Registre General d&amp;apos;aquest Ajuntament o en les dependències a què es refereix l&amp;apos;art. 38.4 de la Llei 30/92, de 26 de novembre, abans citada, i s&amp;apos;ha d&amp;apos;entendre desestimat quan no s&amp;apos;hagi resolt i notificat la resolució en el termini d&amp;apos;un mes a comptar de l&amp;apos;endemà d&amp;apos;haver-se interposat, cas en què queda expedita la via contenciosa administrativa.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Si no s&amp;apos;utilitza el recurs potestatiu de reposició, cal interposar directament recurs contenciós administratiu, conforme al que estableix l&amp;apos;article anteriorment citat, i els articles 45 i següents de la Llei 29/98, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa, davant el Jutjat Contenciós Administratiu, en el termini de dos mesos a comptar de l&amp;apos;endemà al de la publicació d&amp;apos;aquesta notificació.&lt;/span&gt;&lt;/p&gt;
