    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En sessió plenària de data 16/10/13 es va aprovar inicialment la modificació de l´ordenança fiscal reguladora del&lt;strong&gt; PREU PÚBLIC PER A LA&amp;nbsp; REALITZACIÓ D’ACTIVITATS DEL CENTRE D’INFORMACIÓ JOVE (CIJ) DE L’AJUNTAMENT DE CAPDEPERA&lt;/strong&gt;,&amp;nbsp; que te per objecte la modificació dels següents articles i/o annexes.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ARTICLE 1. NATURALESA&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La contraprestació econòmica per a la realització d’activitats organitzades pel CIJ té caràcter de preu públic, atès que és objecte de la competència d’aquesta entitat i no hi concorre cap de les circumstàncies especificades a la lletra B de l’article 20.1 del Text Refós de la Llei reguladora de les hisendes locales, aprovat per Reial Decret Legislatiu 2/2004, de 5 de març (LA LLEI 362/2004).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ARTICLE 2. OBLIGATS AL PAGAMENT&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Estan obligats al pagament del preu públic regulat en aquesta ordenança les persones físiques o jurídiques que realitzin activitats prestades, directament o indirectament, pel CIJ, fora o dintre d’un recinte municipal.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ARTICLE 3. QUANTIA&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. La quantia del preu públic serà la fixada en les tarifes contingudes en l’annex per a cada una de les activitats programades pel CIJ.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Els no empadronats tindran un recàrrec del 50% sobre les tarifes corresponents, sempre i quan no consti una tarifa específica per a aquest col·lectiu.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ARTICLE 4. OBLIGACIÓ DE PAGAMENT&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Amb caràcter general l’obligació del pagament del preu públic regulat en aquesta ordenança neix des que es presta o es realitza qualsevol dels serveis especificats a l’annex.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. En particular, l&amp;apos;obligació de pagament sorgeix amb la formalització de la matrícula i/o inscripció a alguna activitat, amb la qual s&amp;apos;adquireix la condició d’abonat, en el cas de preus públics per a la realització d’activitats organitzades pel CIJ.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ARTICLE 5. PAGAMENT DEL PREU PÚBLIC&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El pagament del preu públic s’efectuarà amb antelació a la prestació del servei.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ARTICLE 6. NORMES DE PAGAMENT&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El preu públic s’abonarà per avançat, mitjançant:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;a) Ingrés directe al compte corrent del CIJ, Ajuntament o de l’empresa que gestioni el servei, segons s’acordi prèviament.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;b) Transferència bancària.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;c) Pagament «en línia».&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;d) Pagament amb targeta bancària.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;e) Domiciliació bancària. En el cas que es produeixi una devolució d’un rebut es cobrarà una penalització de 3,01 € per fer front a les diferents comissions bancàries.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;f) Pagament en metàl·lic en el CIJ (només en els casos que així es determini).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ARTICLE 7. PERIODICITAT DELS PAGAMENTS&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Els períodes de pagament dels preus públics podran ser mensuals, trimestrals o anuals, segons determini el CIJ en cada cas.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Per a aquelles activitats de duració inferior a un mes el pagament s’efectuarà en el moment de la inscripció (tallers puntuals, sortides, nits temàtiques...).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ARTICLE 8. TRAMITACIÓ DE LES SOL·LICITUDS DE BONIFICACIÓ&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Les sol·licituds de bonificació les podran presentar persones físiques o jurídiques, amb capacitat d’obrar, espanyoles o estrangeres, que estiguin degudament identificades, personalment o mitjançat representació, sempre que es refereixin a procediments administratius de naturalesa tributària relacionats amb el preu públic per a la realització d’activitats.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Als impresos de sol·licitud s’hauran d’adjuntar els diversos documents acreditatius de la condició de beneficiari, segons el cas:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;-&amp;nbsp; Original i còpia del llibre de família, CIF, passaport o targeta de residència.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;-&amp;nbsp; Original i còpia del certificat de minusvalidesa.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;-&amp;nbsp; Document acreditatiu que demostri la realització d’una segona activitat.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Qualsevol altre document que fonamenti l&amp;apos;al·legació del sol·licitant.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Les sol·licituds s&amp;apos;han de presentar al registre general d’entrada de l’Ajuntament de Capdepera, en qualsevol moment de l’any i amb caràcter general abans de la data d’obligat pagament de la tarifa.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ARTICLE 9. PROCEDIMENT DE SOL·LICITUD DE LA BONIFICACIÓ&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Emplenar i signar el corresponent registre d’entrada, adjuntant els documents justificatius anteriorment esmentats, si és el cas.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Presentar la sol·licitud en el registre general d’entrada de dilluns a divendres en horari de 09.00 a 14.00 hores.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. El registre les remetrà al CIJ, que les tramitarà, en realitzarà els informes tècnics corresponents, els sotmetrà posteriorment a la resolució de l’òrgan competent i notificarà a la persona interessada la resolució adoptada.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. Així mateix, els usuaris podran presentar en el registre un recurs contra la resolució adoptada en un termini màxim d’un mes, comptador a partir de l&amp;apos;endemà d&amp;apos;haver rebut&amp;nbsp; la notificació. Aquest recurs serà remès novament al CIJ.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ARTICLE 10. IMPAGAMENTS&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;L’impagament de la quota suposarà la pèrdua de la condició d’usuari o, en el seu cas, d’abonat al curs corresponent.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;No podran realitzar activitats organitzades pel CIJ les persones que no estiguin al corrent de pagament de les tarifes relacionades en activitats anteriors.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Els deutes per impagament dels preus públics prevists en la present normativa s’exigiran d’acord amb el que disposa l’article 46.3 del Text Refós de la Llei reguladora de les hisendes locals, aprovat pel Reial Decret Legislatiu 2/2004, de 5 de març (LA LLEI 362/2004).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ARTICLE 11. DEVOLUCIÓ DE PREUS PÚBLICS&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Serà procedent la devolució dels preus públics regulats en aquesta ordenança, amb un informe tècnic previ i una autorització de l’òrgan corresponent, en els casos i quanties següents:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Es farà devolució del 100% del preu públic corresponent quan la suspensió de l’activitat es produeixi per causes imputables al CIJ.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. No serà procedent la devolució del preu públic, prèviament abonat, una vegada iniciada l’activitat, ja sigui puntualment o en règim de continuïtat, si les causes no són imputables al CIJ.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. Amb caràcter general no es té dret a la devolució dels preus públics en cas de renúncia per part dels interessats, amb les següents excepcions:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;a) Si se sol·licita la devolució amb una antelació igual o superior a 10 dies naturals al començament de l’activitat.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;b) Serà procedent la devolució del 100% del preu públic satisfet, amb una sol·licitud prèvia de l’interessat, si es produeix una malaltia documentalment acreditada que impossibiliti poder participar en l’activitat.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;c)En les activitats desenvolupades a l’aire lliure amb continuïtat no serà procedent la devolució del preu públic a causa d’inclemències meteorològiques.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Les sol·licituds de tramitació de devolució hauran de ser presentades per escrit en el registre general de l’Ajuntament de Capdepera.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ARTICLE 12. TRAMITACIÓ DE LES SOL·LICITUDS DE DEVOLUCIÓ&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Les sol·licituds de devolució les podran presentar persones físiques o jurídiques, amb capacitat d’obrar, espanyoles o estrangeres, que estiguin degudament identificades, personalment o mitjançat representació, sempre que es refereixin a procediments administratius de naturalesa tributària relacionats amb el preu públic per a l’ús d’instal·lacions esportives o realització d’activitats esportives.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Als registres d’entrada s’hauran d’adjuntar els següents documents:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;-&amp;nbsp; Original i còpia dels documents acreditatius del pagament realitzat.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;-&amp;nbsp; Document justificatiu del compte corrent on realitzar l’ingrés.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;-&amp;nbsp; Qualsevol altra documentació que fonamenti les al·legacions del reclamant.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Les sol·licituds de devolució s’hauran de presentar en un termini màxim d’un mes, comptador a partir del moment en què s’hagin produït els fets que motivin la devolució.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ARTICLE 13. PROCEDIMENT PER SOL·LICITAR LA DEVOLUCIÓ&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Emplenar i signar la corresponent sol·licitud de registre d’entrada, a la qual s&amp;apos;hauran d&amp;apos;adjuntar els documents justificatius anteriorment esmentats, si fos el cas.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Presentar la sol·licitud en el registre general d’entrada de dilluns a divendres en horari de 09.00 a 14.00 hores.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. El registre les remetrà al CIJ, que les tramitarà, en realitzarà els informes tècnics corresponents, que seran sotmetesos posteriorment a la resolució de l’òrgan competent, i es notificarà a la persona interessada la resolució adoptada.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. Així mateix, els usuaris podran presentar en el registre un recurs contra la resolució adoptada en un termini màxim d’un mes, comptador a partir de l&amp;apos;endemà d&amp;apos;haver rebut&amp;nbsp; la notificació.&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ARTICLE 14. NOVES INSTAL·LACIONS I SERVEIS ESPORTIUS&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Per a aquells serveis o activitats, de gestió directa o indirecta, no relacionats en el present document que s&amp;apos;hi poguessin incorporar mentre aquest sigui vigent, el preu públic s’haurà d’establir prèvia tramitació de l’expedient administratiu, conforme a la normativa legal vigent.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El preu públic per a la realització d’activitats que es gestionin en règim de concessió administrativa serà fixat pel plenari. A l’efecte les sol·licituds de revisió de tarifes o preus i/o modificació de tarifes o preus es tramitaran pel CIJ, amb una proposta prèvia del concessionari.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ARTICLE 15. NORMES DE GESTIÓ GENERALS SOBRE LA PARTICIPACIÓ EN ACTIVITATS&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. A les instal·lacions del CIJ s’hi accedeix bé com a usuari individual o com a grup organitzat, sempre segons les indicacions dels horaris elaborats pels responsables del propi CIJ.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. El deteriorament que es produeixi a les instal·lacions i/o en el material utilitzat, per fer-ne un ús incorrecte, i amb un informe previ del CIJ, comportarà el reemborsament de l’import dels desperfectes, amb càrrec a la persona o entitat responsable, segons els preus de mercat.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. Els usuaris de les activitats estaran obligats a conèixer la present normativa, així com a seguir les indicacions que dicti el CIJ en cada una de les activitats, i la contractació de les activitats implica que aquestes són acceptades.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. Per a allò no previst en les presents normes s’aplicaran les condicions aprovades juntament amb els programes.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ARTICLE 16. NORMES DE GESTIÓ PARTICULARS PER PARTICIPAR EN ACTIVITATS&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. La condició d’abonat per a qualsevol activitat organitzada pel CIJ es perdrà quan s’incompleixi l’obligació de pagament d&amp;apos;aquesta, d’acord amb la normativa que s’estableixi per a cada activitat.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Les persones que realitzin dues activitats del CIJ durant el mateix període de temps tindran un descompte del 25% sobre l’activitat amb la quota més baixa. En cas de fraccionar la quota, el descompte s’aplicarà en la mateixa modalitat i proporció.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. El CIJ podrà cancel·lar aquells grups o activitats en els quals no s’hagin matriculat un nombre mínim, generalment 10. En aquest cas es retornarà als afectats l’import abonat.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. Per motius d’organització les dates i els horaris de les diferents activitats podran ser modificats.&lt;/span&gt;&lt;/p&gt;
