    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En sessió plenària de data 16/10/13 es va aprovar inicialment la modificació de l´ordenança fiscal reguladora de la&lt;strong&gt; TAXA PER LA PRESTACIÓ DE SERVEIS&amp;nbsp; DEL CENTRE DE DIA&lt;/strong&gt;,&amp;nbsp; que te per objecte la modificació dels següents articles i/o annexes.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Fonament i naturalesa&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ARTICLE 1&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Fent ús de les facultats conferides pels articles 133.2 i 142 de la Constitució i per l’article 100 de la Llei 7/1985, de 2 d’abril, reguladora de les bases de règim local, i conforme al que disposen els articles del 15 a 19 de la Reial Decret Legislatiu 2/2004, pel qual s’aprova el Text Refós de la Llei reguladora de les hisendes locals, aquest Ajuntament estableix la taxa per la prestació de serveis al Centre de Dia, que es regirà per la present Ordenança fiscal, les normes de la qual s&amp;apos;avenen amb el que disposa&amp;nbsp; l&amp;apos;article 58 del Reial Decret legislatiu 2/2004.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Fet imposable&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;ARTICLE 2&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Constitueix el fet imposable d’aquesta taxa la prestació dels serveis del Centre de Dia.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Subjecte passiu&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;ARTICLE 3&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Són subjectes passius contribuents de la taxa les persones beneficiaris dels serveis regulats en aquesta Ordenança.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Quota Tributària&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;ARTICLE 4&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La quota tributària de la taxa regulada en aquesta Ordenança serà la fixada a les Tarifes contingudes a l&amp;apos;annex de l’ordenança.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Meritació&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;ARTICLE 5&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La taxa es meritarà en el moment en què s’iniciï la prestació del servei.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Declaració i ingrés&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;ARTICLE 6&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. El pagament de la taxa del servei regular es realitzarà dins els quinze primers dies de cada mes d’utilització del servei.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Els usuaris del serveis ocasionals abonaran el preu de la taxa corresponent el primer dia que comencin a utilitzar el servei.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Exempcions i Bonificacions&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;ARTICLE 7&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. L’Ajuntament podrà fixar algun tipus de bonificació o benefici per raons socioeconòmiques, i sempre amb un informe previ de la comissió corresponent.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. En cap cas podran acollir-se a les places gratuïtes o ajudes les persones que tenguin patrimoni o tenguin ingressos superiors als barems establerts, així com els que tinguin parents en primer grau amb capacitat econòmica suficient per fer front als costos de la quota mensual.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. En el cas de persones dependents que ocupin una de les places compreses en el conveni, la tarifa a pagar pels dissabtes gaudirà d&amp;apos;una bonificació del 30% per a depenents de grau 1, 40% per a depenents de grau 2 i 50% per a depenents de grau 3. Aquesta bonificació s’aplicarà al preu corresponent a la tarifa ocasional que correspongui.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. En el cas d&amp;apos;ingrés hospitalari o malaltia greu justificada de l´usuari, que impliqui la no -assistència al centre per un temps igual o superior a quinze dies, es podrà aplicar una reducció del 50% de la quota a pagar. Les manques d´assistència d´entre 7 i 14 dies del mateix mes tindran una bonificació del 25% de la taxa.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Infraccions i Sancions&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;ARTICLE 9&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En tot quant fa referència a la qualificació d&amp;apos;infraccions tributàries, i també a les sancions que els correspongui en cada cas, hom s’avindrà amb el que disposen els articles 178 i següents de la Llei general tributària.&lt;/span&gt;&lt;/p&gt;
