    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;“El vicepresident de Cultura, Patrimoni i Esports ha dictat, el 31 d’octubre de 2013, la resolució&amp;nbsp; que transcric, literalment, a continuació:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;“&lt;/strong&gt;Antecedents. 1.La Vicepresidència de Cultura, Patrimoni i Esports del Consell de Mallorca va aprovar, el 3 de juny de 2013, la convocatòria de subvencions en espècie any 2013 per a la dotació dels equipaments de les biblioteques de les entitats d’administració local o dels organismes&amp;nbsp; públics que en depenen&lt;span style="color: black"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. La Comissió Avaluadora, atès el nombre d’ordinadors que es podrien adquirir, en&amp;nbsp; virtut del crèdit pressupostari de la convocatòria (30.000,00 €) i del preu unitari de l’equipament proposat pel Servei d’Informàtica, ha emès l’informe pertinent on es proposen les entitats beneficiàries i el nombre d’equipaments que els correspon&lt;span style="color: black"&gt;.&lt;/span&gt; &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. L’òrgan instructor ha emès informe relatiu al compliment dels requisits de la bases de la convocatòria esmentada per part dels beneficiaris recollits a l’informe de la comissió avaluadora esmentada.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. El Servei Jurídic del Departament de la Vicepresidència de Cultura, Patrimoni i Esports ha emès informe favorable sobre els aspectes jurídics de la proposta dictada per l’òrgan instructor. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;5. L’existència de crèdit pressupostari adequat i suficient a la partida pressupostària 20.33200.76200 per atendre a la concessió de les subvencions en espècie proposades resta acreditada en virtud de la RC amb el núm. de referència 22013/5324 per un import de 30.000,00 €.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;6. El secretari tècnic, òrgan instructor de la convocatoria assenyalada, va proposar la resolució de la convocatoria en els termes recollits en aquesta resolució.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;7. La Intervenció General ha fiscalitzat de conformitat la proposta esmentada del secretari tècnic.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Fonaments&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. La base catorzena estableix que la Comissió Avaluadora és l’encarregada d’estudiar i avaluar les sol·licituds així com de fixar-ne l’import de les subvencions.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. El tercer paràgraf de la base vuitena recull el següent:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;“No obstant això, no cal establir un ordre de prelació entre les sol·licituds presentades que reuneixen els requisits de la convocatòria, mitjançant l&amp;apos;aplicació dels criteris de la base tretzena, quan el crèdit pressupostari sigui suficient per satisfer-les.”&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. El quart paràgraf de la base vuitena esmentada estableix que és l’òrgan instructor l’encarregat de dictar la proposta de resolució de la convocatoria i, el vicepresident de Cultura, Patrimoni i Esport l’encarregat de resoldre la convocatoria.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En virtut de tot el que s’ha exposat i, d’acord amb l’apartat g) de l’article 2 del Decret d&amp;apos;organització del Consell de Mallorca, RESOLC:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1&lt;strong&gt;. &lt;/strong&gt;Concedir a les entitats que s’indiquen a l’annex 1 una subvenció total en espècie de 29.656,59 €, corresponent a l’import total dels equipaments informàtics (base segona: monitor i ordinador) de la convocatòria de subvencions en espècie any 2013 per a la dotació dels equipaments de les biblioteques de les entitats d’administració local o dels organismes&amp;nbsp; públics que en depenen, tot allò d’acord amb l’establert a les bases de la convocatòria esmentada.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Ordenar-ne la publicació en el BOIB.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra aquesta resolució, que no posa fi a la via administrativa, es pot interposar el recurs d’alçada davant la Presidència del Consell de Mallorca, dins el termini d’un mes, comptador a partir de l’endemà de la publicicació d’aquesta resolució.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra la desestimació expressa del recurs d’alçada, hom pot interposar el recurs contenciós administratiu davant del Jutjat Contenciós Administratiu, en el termini de dos mesos, comptadors a partir de l’endemà de la notificació de la desestimació del recurs d’alçada.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra la desestimació per silenci del recurs d&amp;apos;alçada podrà interposar-se el recurs contenciós administratiu, en el termini de sis mesos, comptadors a partir del dia següent a la desestimació presumpta (tres mesos des de la interposició del recurs sense que s&amp;apos;hagi notificat la resolució).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;No obstant això, s’hi pot presentar qualsevol altre recurs que hi sigui pertinent. Tot, d’acord amb la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa, i de la Llei 4/1999, de 13 de gener, que modifica la Llei 30/1992, de 26 de novembre, del règim jurídic de les administracions públiques i del procediment administratiu comú.”&lt;/span&gt;&lt;/p&gt;
