    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="font-weight: normal"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Per acord de ple de data 6 d&amp;apos;agost de 2013 es va aprovar inicialment&lt;/span&gt;&lt;/span&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt; &lt;/span&gt;&lt;/b&gt;l’ordenança municipal reguladora &lt;span style="font-weight: normal"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;dels horaris d&amp;apos;establiments i espectacles públics i activitats recreatives&lt;/span&gt;&lt;/span&gt;&lt;span style="font-weight: normal"&gt;.&lt;/span&gt; Finalitzat el període d’exposició pública, i atès que no s’ha presentat cap reclamació, objecció u observació, s’entén definitivament aprovat l’acord provisional.&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;De conformitat amb el que disposa l’article 70.2 de la LBRL i l’article 103 de la Llei 20/2006, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa, es publica a continuació el seu text íntegre:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;ORDENANÇA REGULADORA DELS HORARIS D&amp;apos;ESTABLIMENTS I ESPECTACLES PÚBLICS I ACTIVITATS RECREATIVES.&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;La regulació dels horaris dels establiments i espectacles públics i de les activitats recreatives constitueix un element fonamental per assegurar la tranquil·litat i la convivència entre els veïnats i visitants de qualsevol municipi. La seva ordenació i el control corresponent incideix directament en les molèsties que es puguin produir per renous molests, i és evident també la seva relació directa amb aspectes relacionats amb la seguretat ciutadana, l&amp;apos;ordre públic, la neteja viària, etc.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;El fet que la vida quotidiana sigui en determinats horaris obliga a l&amp;apos;adaptació d&amp;apos;aquests amb la finalitat de salvaguardar drets constitucionals com la qualitat de vida, el dret a la salut i el dret a un medi ambient adequat per a les persones, al mateix temps que es facilita l&amp;apos;adequada utilització de l&amp;apos;oci.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;L&amp;apos;Ajuntament entén que és possible compaginar aqueix interès amb l&amp;apos;oferiment al resident de la tranquil·litat necessària.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;L&amp;apos;Art. 19 de la Llei 9/1997, de 22 de desembre, de diverses mesures tributàries i administratives, estableix que l&amp;apos;horari general dels espectacles i de les activitats recreatives serà determinat reglamentàriament pel Govern de la Comunitat Autònoma de les Illes Balears. No obstant, mentre aquesta administració no reguli aquest tema, correspondrà als plens dels Ajuntaments aprovar mitjançant reglament ampliacions o reduccions dels horaris en matèria d&amp;apos;espectacles públics i d&amp;apos;activitats recreatives.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Fent ús d&amp;apos;aquesta facultat prevista en el paràgraf anterior, es procedeix a la fixació dels horaris d&amp;apos;obertura i tancament dels establiments i espectacles públics i de les activitats recreatives en el Municipi de Sóller.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Article 1. Horari d&amp;apos;obertura i tancament.&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1.1.-Als efectes d&amp;apos;aquesta ordenança es consideren els següents grups de locals o activitats.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;I : Restaurants, Bars, Cafès, Cafeteries i anàlegs.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;II : Bars Musicals ( bar amb llicència de música tipus III segons ordenança de renous local) i anàlegs.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;III : Bingos, Salons de Joc, Cines, Teatres, Cafès-Teatre i anàlegs.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;IV : Discoteques, Sales Festa i de Ball, Cafès concerts i anàlegs&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;V : Salons Recreatius.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1.2.- L&amp;apos;horari d&amp;apos;obertura i tancament dels establiments públics i activitats recreatives serà el que es reflecteixi en la següent taula:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;En els períodes compresos entre el 16 d&amp;apos;abril al 30 de setembre (període considerat estiu) :&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1.3.- En els períodes compresos entre el dia 1 d&amp;apos;octubre al dia 15 d&amp;apos;abril (període considerat hivern) l&amp;apos;horari de tancament es reduirà en mitja hora, excepte els divendres, dissabtes i vesprades de festes que es regiran per l&amp;apos;horari establert en l&amp;apos;apartat 1.2.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;L&amp;apos;obertura es refereix l&amp;apos;horari a partir del qual està permès obrir i iniciar l&amp;apos;activitat. El tancament es refereix a l&amp;apos;horari a partir del qual l&amp;apos;activitat de l&amp;apos;establiment ha d&amp;apos;haver cessat completament. A partir de l&amp;apos;hora de tancament establerta, cessarà tota amenitzada musical, joc o actuació en el local i no es serviran més consumicions. Tampoc es permetrà l&amp;apos;entrada de més persones s&amp;apos;encendran tots els llums del local per a facilitar el seu desallotjament.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1.4.- Quan en els establiments concorrin més d&amp;apos;una activitat de les descrites anteriorment que no puguin separar-se físicament entre sí, cada una d&amp;apos;elles se considerarà com a independent i se regirà pel seu propi horari, conforme a l&amp;apos;establert en els articles anteriors.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Article 2. Excepcions.&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;2.1.- Per als locals del Grup I i excepcionalment per aquells establiments que habitualment serveixin berenars, es permet l&amp;apos;avançament de 2 hores de l&amp;apos;horari d&amp;apos;obertura, prèvia sol·licitud dels titulars de dits establiments a l&amp;apos;Ajuntament, havent de realitzar aquest servei sense cap tipus d&amp;apos;amenitzada musical.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;2.2.- En els locals del Grup IV, en el cas d&amp;apos;organització de gales juvenils, es permetrà la realització de l&amp;apos;activitat fins a les 24:00 hores en festius vesprades de festius, amb les limitacions d&amp;apos;admissió, consum i servei de begudes establerts per a menors. En aquests casos hauran de transcórrer al manco 1 hora des de la conclusió de la gala juvenil a l&amp;apos;inici normal de l&amp;apos;activitat, dins de l&amp;apos;horari permès.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Article 3. Terrasses.&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Els locals que comptin amb terrassa pública o privada (qualsevol que sigui el Grup de local o activitat) hauran de cessar qualsevol amenitzada musical a les 00:00 hores, paralitzant-se per complet l&amp;apos;activitat en dita terrassa a les 01:00 hores, sense que pugui sobrepassar l&amp;apos;horari establert en la taula contemplada en l&amp;apos;article 1.2.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Article 4. Execució del tancament.&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;L&amp;apos;establiment haurà de quedar totalment buit de públic com a màxim mitja hora després de l&amp;apos;horari de tancament autoritzat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Article 5. Altres horaris.&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;L&amp;apos;horari d&amp;apos;obertura i de tancament o finalització de la resta d&amp;apos;establiments, espectacles públics i activitats recreatives que, segons la normativa vigent, requereixin autorització administrativa, i no estiguin contemplats en la presente ordenança, requerirà d&amp;apos;autorització expressa i específica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Article 6. Restriccions.&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;L&amp;apos;Ajuntament podrà avançar l&amp;apos;horari de tancament o retardar l&amp;apos;horari d&amp;apos;obertura, d&amp;apos;aquells locals als que, per infracció a la normativa d&amp;apos;activitats o a l&amp;apos;ordenança municipal de renous, se&amp;apos;ls hagi indicat l&amp;apos;obligació d&amp;apos;adoptar mesures correctores. Dita restricció d&amp;apos;horaris, de funcionament es prolongarà fins que s&amp;apos;hagin adaptat dites mesures i obtingut informe favorable de l&amp;apos;òrgan competent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Article 7. Festes populars.&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Sense perjudici del que disposa l&amp;apos;article 1, el batle podrà autoritzar horaris especials durant la celebració de festes populars i en les de Nadal i Setmana Santa, amb les limitacions que s&amp;apos;estableixin en la resolució administrativa corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Article 8. Infraccions&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm; font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1.- Constitueixen infraccions administratives les accions u omissions que contravenguin les disposicions de la presente Ordenança, sense perjudici de les responsabilitats civils, penals o d&amp;apos;altra ordre que se&amp;apos;n poguessin derivar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm; font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;2.- En els procediments sancionadors que s&amp;apos;instrueixin en aplicació de la presente Ordenança, els fets constatats per agents de l&amp;apos;autoritat tenen valor probatori, d&amp;apos;acord amb la normativa aplicable a l&amp;apos;efecte, sense perjudici d&amp;apos;altres proves que puguin aportar les persones interessades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="ca-ES"&gt;&lt;span style="font-weight: normal"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;3.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span lang="ca-ES"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Als expedients sancionadors que &lt;/span&gt;&lt;/span&gt;&lt;span lang="ca-ES"&gt;&lt;span style="font-weight: normal"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;s&amp;apos;instrueixin&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span lang="ca-ES"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;, i amb els requisits que corresponguin d&amp;apos;acord amb la legislació vigent, es podran incorporar imatges dels fets denunciats, ja sigui en fotografia, filmació digital o altres mitjans en la denúncia formulada d&amp;apos;acord amb la normativa aplicable. En tot cas, la utilització de vídeo càmeres requerirà, si s&amp;apos;escau, les autoritzacions previstes en la legislació aplicable, així com o el seu ús segons el principi de proporcionalitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;4.-Les infraccions administratives es classifiquen en&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1. Lleus&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;a) El retard en el començament o finalització dels espectacles, en un excés de temps de fins 30 minuts.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;b) &lt;span style="font-weight: normal"&gt;L&amp;apos;avançament&lt;/span&gt;&lt;span style="font-weight: normal"&gt; e&lt;/span&gt;n l&amp;apos;obertura o el retard en el tancament dels establiments públics, en un excés de temps de fins 30 minuts.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;c) Qualsevol infracció a les normes de la presente Ordenança no qualificada com a falta greu o molt greu.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;2. Greus&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;a) El retard en el començament o finalització dels espectacles, en un excés de temps de fins 30 minuts i fins a una hora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;b) &lt;span style="font-weight: normal"&gt;L&amp;apos;avançament&lt;/span&gt;&lt;span style="font-weight: normal"&gt; e&lt;/span&gt;n l&amp;apos;obertura o el retard en el tancament dels establiments públics, en un excés de temps de fins 30 minuts i fins a una hora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;c) Les infraccions lleus quan, dotze mesos abans de cometre-les, el seu responsable hagi estat objecte de sanció mitjançant resolució definitiva, per infracció tipificada com lleu.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;3. Molt greus&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;a) El retard en el començament o finalització dels espectacles, en un excés de temps de més d&amp;apos;una hora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;b) &lt;span style="font-weight: normal"&gt;L&amp;apos;avançament&lt;/span&gt;&lt;span style="font-weight: normal"&gt; e&lt;/span&gt;n l&amp;apos;obertura o el retard en el tancament dels establiments públics, en un excés de temps de més d&amp;apos;una hora. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;c)Les infraccions lleus quan, dotze mesos abans de cometre-les, el seu responsable hagi estat objecte de sanció mitjançant resolució definitiva, per infracció tipificada com greu.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;5.- Les infraccions tipificades en la presente Ordenança com a lleus prescriuran en el termini de 6 mesos, les tipificades com a greus en el de 2 anys i les tipificades com a molt greus en el de 3 anys. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;6.- Interromprà la prescripció, la iniciació, amb coneixement de la persona interessada, del procediment sancionador, reprenent-se el termini de prescripció si l&amp;apos;expedient sancionador estigués paralitzat durant més d&amp;apos;un mes per causa no imputable al presumpte responsable.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;7.- El procediment sancionador ordinari haurà de ser resolt i notificar-se la resolució que procedeixi a la persona interessada, en el termini màxim d&amp;apos;un any, des de la seva iniciació, produint-se la seva caducitat en la forma i manera previstes en la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú. No obstant l&amp;apos;anterior, l&amp;apos;instructor de l&amp;apos;expedient podrà acordar la suspensió del termini màxim per resoldre quan concorri alguna de les circumstàncies previstes i exigides per a tal motiu en l&amp;apos;article 42.5 de la citada llei, d&amp;apos;acord amb la redacció establerta per la Llei 4/1999, de 13 de gener.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Article 9. Sancions&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1. Les infraccions podran ser sancionades per via administrativa, de conformitat amb les següents quanties:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;a) Infraccions lleus, amb multa de fins 750 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;b) Infraccions greus, amb multa de fins 1.500 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;c) Infraccions molt greus, amb multa de fins 3.000 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;2. Per a la imposició de sancions previstes en la presente Ordenança es tendran en compte, en tot cas, els criteris de graduació següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;a) La gravetat de la infracció.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;b) L&amp;apos;existència d&amp;apos;intencionalitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;c) La naturalesa dels perjudicis causats.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;d) La reiteració. S&amp;apos;entén que hi ha reiteració quan, en el moment de la comissió dels fets tipificats com a infracció en la presente Ordenança, el presumpte responsable estigui imputat en la instrucció d&amp;apos;altres procediments sancionadors per infraccions a la present Ordenança.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;3. En la fixació de les sancions de multa es tendrà en compte que, en tot cas, el compliment de la sanció no resulti més beneficiosa per a la persona infractora que el compliment de les normes infringides.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;4. La desobediència o la resistència a l&amp;apos;autoritat en els termes dels articles 556 i 634 de la Llei Orgànica 10/1995 de 23 de Novembre, del Codi Penal donarà lloc al fet que, per l&amp;apos;òrgan actuant, es passi el tant de culpa al Jutjat d&amp;apos;Instrucció per a la determinació de les responsabilitats penals en les que s&amp;apos;hagués pogut incórrer.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;5. Prescriuran als sis mesos les sancions imposades per infraccions lleus en la present Ordenança; als dos anys les imposades per infraccions greus i als tres anys les imposades per infraccions molt greus. El termini de prescripció de les sancions començarà a comptar-se des del dia següent a aquell en què s&amp;apos;hagi esgotat la via administrativa de la resolució per la que s&amp;apos;imposa la sanció. Interromprà la prescripció la iniciació, amb coneixement de la persona interessada, del procediment d&amp;apos;execució.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Article 10. Reconeixement de la responsabilitat&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Les persones denunciades poden assumir la seva culpabilitat i conformitat mitjançant el pagament de les sancions de multa, amb una reducció del 30% de l&amp;apos;import màxim de la sanció si el pagament es fa efectiu abans de l&amp;apos;inici del procediment sancionador, o amb una reducció del 20% de l&amp;apos;import de la sanció que consti en la resolució d&amp;apos;inici o en la proposta de resolució si el pagament es fa efectiu abans de la resolució final.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;En tot cas, la quantia resultant d&amp;apos;aplicar dites reduccions no podrà superar el límit inferior de les quanties assenyalades en l&amp;apos;article 9.1 de la presente Ordenança.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Disposició Final.&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;La presente Ordenança entrarà en vigor als quinze dies hàbils de la seva publicació íntegra en el Butlletí Oficial de les Illes Balears de conformitat amb l&amp;apos;establert en l&amp;apos;Art. 70.2 de la Llei 7/1985 de 2 abril, Reguladora de Bases de Règim Local.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &amp;nbsp;&lt;/p&gt;
