&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Els béns immobles que s’indiquen en l’apartat de la resolució han sortit a subhasta pública, la qual ha quedat deserta atès que no s’ha presentat cap licitador. S’ha considerat, transcorregut un temps prudencial, tornar a treure’ls a subhasta pública, amb totes les garanties, descartant la venda directa, possibilitat prevista a la legislació de patrimoni.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. &amp;nbsp;Els immobles han estat taxats novament per a l’alienació en subhasta pública per la Direcció General del Medi Rural i Marí (sa Casa Nova, Son Ferriol) i per la Direcció General d’Arquitectura i Habitatge (local i garatge del carrer de Jeroni Pou, 2, de Palma de Mallorca).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. La convocatòria de subhasta pública dels béns immobles esmentats es regeix per la Llei 6/2001, d’11 d’abril, del patrimoni de la Comunitat Autònoma de les Illes Balears; el Decret 127/2005, de 16 de desembre, pel qual s’aprova el Reglament de desplegament de la Llei 6/2001, i pel Plec de condicions, que se sotmet a l’aprovació del conseller d’Hisenda i Pressuposts.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. &amp;nbsp;Els articles 53.1 a 55 i 87 &lt;em&gt;d&lt;/em&gt; de la Llei 6/2001, d’11 d’abril, del patrimoni de la Comunitat Autònoma de les Illes Balears (BOIB núm. 49, de 24 d’abril), i la resta de disposicions aplicables concordants.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. &amp;nbsp;Els articles 97.2 a 101, 107 i 110 i els concordants del Decret 127/2005, de 16 de desembre, pel qual s’aprova el Reglament de desplegament de la Llei 6/2001, d’11 d’abril, del patrimoni de la Comunitat Autònoma de les Illes Balears (BOIB núm.&amp;nbsp;192, de 24 de desembre).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. &amp;nbsp;La Llei 3/2003, de 26 de març, de règim jurídic de l’Administració de la Comunitat Autònoma de les Illes Balears (BOIB núm. 44, de 3 d’abril).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. &amp;nbsp;El Decret 5/2013, de 2 de maig, del president de les Illes Balears, pel qual es determina la composició del Govern i s’estableix l’estructura de l’Administració de la Comunitat Autònoma de les Illes Balears (BOIB núm. 60 ext., de 2 de maig).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;5. &amp;nbsp;El Decret 6/2013, de 2 de maig, del president de les Illes Balears, pel qual s’estableixen les competències i l’estructura orgànica bàsica de les conselleries de l’Administració de la Comunitat Autònoma de les Illes Balears (BOIB núm. 60 ext., de 2 de maig).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;6. &amp;nbsp;El Decret 7/2013, de 2 de maig, del president de les Illes Balears, pel qual es disposa el nomenament de membres del Govern de les Illes Balears (BOIB núm. 60 ext., de 2 de maig).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;7. &amp;nbsp;El Decret 15/2013, de 7 de juny, del president de les Illes Balears, pel qual es modifica el Decret 6/2013, de 2 de maig, del president de les Illes Baleares, pel qual s’estableixen les competències i l’estructura orgànica bàsica de les conselleries de l’Administració de la Comunitat Autònoma de les Illes Balears (BOIB núm. 81, de 8 de juny).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;8. El Decret 35/2013, de 21 de juny, &lt;span style="color: black"&gt;pel qual es nomena el director general del Tresor, Polít&lt;/span&gt;ica Financera i Patrimoni de la Conselleria &lt;span style="color: windowtext"&gt;d’Hisenda i Pressuposts&lt;/span&gt; de l’Administració de la Comunitat Autònoma de les Illes Balears (BOIB núm. 88/, de 22 de juny).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;9. &amp;nbsp;La Resolució del conseller d’Hisenda i Pressuposts de 24 de maig de 2013 de delegació de competències i de delegació de signatura en determinats òrgans de la Conselleria d’Hisenda i Pressuposts, d’altres conselleries de l’Administració de la Comunitat Autònoma de les Illes Balears, de l’Agència Tributària de les Illes Balears, i del Servei de Salut de les Illes Balears, i de suplència dels òrgans directius de la Conselleria d’Hisenda i Pressuposts (BOIB núm. 76, de 30 de maig).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El Conseller d’Hisenda i Pressuposts de la Comunitat Autònoma de les Illes Balears, a proposta del director general de Tresor, Política Financera i Patrimoni, va ordenar la iniciació del procediment, mitjançant una resolució de data 22 de Julio de 2013, d’alienació per subhasta dels immobles que es descriuen més endavant, propietat de l’Administració de la Comunitat Autònoma, atès que no eren necessaris per a l’ús general ni per al servei públic a què estaven destinats, ni n’era convenient l’explotació.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Per complir aquest resolució, atès el que preveuen la Llei 6/2001, d’11 d’abril, del patrimoni de la Comunitat Autònoma de les Illes Balears; el Decret 127/2005, de 16 de desembre, pel qual s’aprova el Reglament de desplegament d’aquesta Llei, i, subsidiàriament, la Llei&amp;nbsp;33/2003, de 3 de novembre, del patrimoni de les administracions públiques, i el seu Reglament general, aprovat pel Reial decret 1373/2009, de 28 d’agost, s’ha disposat la realització de la subhasta per mitjà del procediment de presentació d’ofertes en un sobre tancat, amb subjecció a les següents&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;CLÀUSULES&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Primera. Descripció dels béns immobles objecte de subhasta&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La valoració, el tipus de licitació en la primera convocatòria i el tipus mínim a l’alça són els que figuren en l’apartat 1 de la Resolució precedent.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La fiança és del 20 % del tipus mínim del valor a l’alça.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Segona. Publicitat&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La venda s’anunciarà en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;, en el tauler d’anuncis de les conselleries i a la seu electrònica de l’Administració de la Comunitat Autònoma de les Illes Balears (http://www.caib.es/).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Tercera. Requisits per participar en la subhasta&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Poden participar en la subhasta totes les persones que tenguin capacitat per contractar, d’acord amb les normes del Codi civil.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;No poden participar en la subhasta les persones que estiguin sotmeses a procediments de constrenyiment administratiu, les que hagin sol·licitat o estiguin declarades en concurs, les declarades insolvents en qualsevol procediment, les que estiguin subjectes a intervenció judicial o hagin estat inhabilitades d’acord amb la Llei&amp;nbsp;22/2003, de 9 de juliol, concursal, i, en general, les que es trobin en qualsevol causa d’incapacitat o de prohibició per contractar prevista en la legislació administrativa de contractes.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;De conformitat amb el que disposa l’article 104 del Reglament de desplegament de la Llei 6/2001, d’11 d’abril, del patrimoni de la Comunitat Autònoma de les Illes Balears, els participants han de constituir un dipòsit per un import del 20&amp;nbsp;% del tipus de licitació, en concepte de fiança, per cada lot al qual optin.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La presentació d’una oferta implica l’acceptació d’aquest plec de condicions.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Quarta. Presentació d’ofertes&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Forma&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;A. Les ofertes per a la subhasta s’han de presentar en dos sobres tancats, signats pel licitador, i s’han de presentar en el lloc indicat en l’anunci de licitació, dins el termini que es fixi. Un dels sobres, amb el títol “Oferta econòmica”, ha de contenir l’oferta econòmica que es faci. L’altre sobre, amb el títol “Documentació general”, ha de contenir els documents següents:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;a)&lt;/em&gt; Els que acreditin la personalitat del licitador i, si en té, del representant.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;b)&lt;/em&gt; El resguard del dipòsit previ del 20&amp;nbsp;% del tipus de subhasta, en concepte de fiança provisional, de conformitat amb la normativa específica aplicable.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;c)&lt;/em&gt; Els que acreditin la situació de no està sotmès a cap prohibició o incompatibilitat per contractar, d’acord amb el que disposa l’article 103 del Reglament de desplegament de la Llei 6/2001, d’11 d’abril, del patrimoni de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;d)&lt;/em&gt; Els que certifiquin que estan al corrent del compliment de les obligacions tributàries i les de la Seguretat Social imposades per les disposicions vigents.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;B. Les ofertes s’han d’ajustar al model establert en aquest Plec de condicions.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;C. No s’admetran ofertes en qualitat de cedir la rematada a un tercer.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;2. Lloc&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La documentació s’ha de presentar en el Servei de Patrimoni – Direcció General del Tresor, Política Financera i Patrimoni – Conselleria d’Hisenda i Pressuposts de la Comunitat Autònoma de les Illes Balears (plaça de la Drassana, núm. 4, 07012 de Palma de Mallorca).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;També es pot presentar en la forma prevista en la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú, i s’ha d’enviar, en la mateixa data de presentació, per fax al número 971 17 60 90, adreçat al Servei de Patrimoni de la Comunitat Autònoma de les Illes Balears, el full en què consti el segell del registre davant el qual s’ha presentat la documentació.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;3. Termini&amp;nbsp;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El termini de presentació d’ofertes és de vint dies naturals comptadors des de l’endemà de la publicació en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt; de l’anunci de realització de la subhasta. Un cop acabat aquest termini, el Registre ha d’expedir un certificat amb la relació de les proposicions rebudes, o, si s’escau, de l’absència de licitadors, que ha de ser tramès al secretari de la mesa de la subhasta.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;4. Admissió d’ofertes&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Cada interessat pot presentar una única oferta, que no pot ser millorada, llevat del que preveu la clàusula sisena.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;No s’admetran les ofertes presentades en qualitat de cessió a tercers, que no compleixin els requisits assenyalats en aquesta clàusula o que no s’ajustin als models descrits en els annexos que acompanyen aquest plec de condicions.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Cinquena. Constitució de la mesa&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La mesa està constituïda a l’empara de la primera convocatòria de subhasta pública, expedient 270/2013&lt;strong&gt;.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El dia hàbil següent al de la conclusió del termini d’admissió d’ofertes, es reunirà la mesa que ha d’autoritzar la subhasta, la qual ha d’estar integrada per les persones següents:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;a)&lt;/em&gt; Com a president, la persona titular de la Direcció General del Tresor, Política Financera i Patrimoni.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;b)&lt;/em&gt; Un vocal representant designat per la Intervenció General de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;c)&lt;/em&gt; Un vocal representant designat per la Direcció de l’Advocacia de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;d)&lt;/em&gt; Un representant de la Conselleria d’Agricultura, Medi Ambient i Territori.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;e)&lt;/em&gt; Un representant del Servei de Patrimoni, de la Direcció General de Patrimoni, Contractes i Obres Públiques, que ha d’actuar com a secretari amb veu i vot.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Sisena. Examen de la documentació&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Una vegada reunida la mesa, examinarà i qualificarà la documentació general esmentada en l’article 105 del Reglament. Si la mesa observa defectes en la documentació presentada, pot concedir, si ho considera oportú, un termini no superior a cinc dies, per rectificar errors.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La mesa no pot admetre en la subhasta els licitadors que no hagin presentat la documentació requerida o que no l’hagin corregida, d’acord amb el que disposa l’apartat anterior.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La no-admissió en subhasta s’ha de notificar a les persones interessades en l’acte públic de la subhasta previst en l’article 108 del Reglament, si hi són presents, o una vegada conclosa, perquè en el termini de cinc dies naturals formulin a la mesa les al·legacions oportunes, perquè les consideri en la resolució que posi fi al procediment, i per impugnar l’exclusió en el recurs administratiu que, si és procedent, s’interposi en contra.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Setena. Obertura d’ofertes&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Una vegada acabada la fase de qualificació de documents, el president ha de declarar oberta la subhasta en un acte públic i el secretari ha de llegir l’anunci publicat en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt; i la relació de licitadors que hagin presentat postures. A continuació, ha d’exposar el resultat de la qualificació prèvia de documents i dels licitadors admesos i exclosos de la subhasta, i finalment ha d’obrir el sobre que contengui la proposició econòmica, amb vista de la qual la mesa ha de declarar millor postor el licitador que hagi formulat la proposta més alta.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En el supòsit que es produeixi un empat entre els millors postors, s’ha d’obrir en el mateix acte, si els licitadors hi són presents, una licitació i s’ha d’adjudicar provisionalment la subhasta al licitador que hagi fet la proposició econòmica més alta. En el cas que els licitadors empatats no hi siguin, s’ha de resoldre l’empat per sorteig.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Del resultat de la subhasta, se n’ha d’estendre l’acta corresponent, en la qual s’ha d’incloure succintament, però fidelment, tota l’actuació i l’han de signar tots els components de la mesa i el millor postor.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Vuitena. Devolució de la garantia&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Immediatament després d’acabada la subhasta, el secretari de la mesa ha d’ordenar la devolució de les garanties constituïdes en concepte de fiança als que no resultin primers més-dients o adjudicataris provisionals.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Es pot acordar la retenció de la garantia del segon millor postor per cobrir el supòsit que el primer més-dient o adjudicatari provisional hi renunciï o no compleixi les seves obligacions.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Novena. Aprovació de la subhasta&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;L’aprovació de la subhasta ha de fer-la el conseller d’Hisenda i Pressuposts el qual ha de dictar la resolució corresponent, a proposta de la mesa, i adjudicar-la definitivament o declarar-la deserta.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Desena. Notificació de l’adjudicació&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;L’adjudicació definitiva de la subhasta s’ha de notificar a l’adjudicatari perquè en un termini de quinze dies efectuï el pagament del preu total de l’alienació, inclosos, si cal, els tributs repercutibles, i també les despeses dels anuncis de la subhasta. Així mateix, se l’ha d’advertir que si no ho fa, perd el dret i el dipòsit previ, sens perjudici de la recuperació de les possibles pèrdues que la inefectivitat de l’adjudicació produeixi a l’Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En ambdós casos, es pot procedir a l’adjudicació a la segona oferta més avantatjosa o bé a la declaració motivada de la subhasta com a deserta.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;De conformitat amb el que preveu l’article 113.3 de la Llei 30/1992, les alienacions dels béns immobles o drets sobre aquests s’han de formalitzar en una escriptura pública/certificat administratiu. L’adjudicatari, una vegada atorgada l’escriptura pública/certificat administratiu, ha d’inscriure-la en el Registre de la Propietat i canviar-ne la titularitat al Cadastre.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En aquesta escriptura/certificat es pot fer constar, si escau, que l’immoble s’aliena com a cos cert i en les condicions que es consignin, que s’han de donar per conegudes i acceptades per l’adquirent.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;De conformitat amb l’article 102 del Reglament de desplegament de la Llei 6/2001, d’11 d’abril, del patrimoni de la Comunitat Autònoma de les Illes Balears, aprovat pel Decret 127/2005, de 16 de desembre, es dóna publicitat a la convocatòria de la subhasta de tres béns immobles propietat de la Comunitat Autònoma de les Illes Balears, que es va establir mitjançant la Resolució precedent del Conseller d’Hisenda i Pressuposts, de 16 de setembre de 2013, serveixen la publicació de la Resolució i l’annex com a anunci de la subhasta, per evitar així reiteracions inútils.&lt;/span&gt;&lt;/p&gt;
