    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;Atès que no ha estat possible la notificació dels tràmits d’audiència a les persones físiques o jurídiques interessades&lt;strong&gt;,&lt;/strong&gt; d’acord amb el que disposa l’article 59.5 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú, mitjançant aquest anunci es notifica el següent:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;Realitzada la visita de comprovació per part del Servei d’Inspecció i Estratègia Turística d’aquesta conselleria, els establiments que s’indiquen a continuació no compleixen amb l’article 22 del decret 13/2011 de 25 de febrer, que obliga a comunicar qualsevol modificació de les dades corresponents a l’explotador, nom comercial, capacitat, o propietari dels establiments de restauració a la conselleria de Turisme i Esports, mitjançant la presentació d’una comunicació prèvia degudament formalitzada (model establert en l’annex 2 del Decret 13/2011), juntament amb el justificant de pagament de les taxes corresponents (model 046). &lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;D’acord amb el que preveu l’article 84 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú, disposau d’un termini de 15 dies de tràmit d’audiència des del dia següent al de la recepció d’aquest escrit, per a presentar el que us sol·licitem o per al·legar allò que considereu oportú.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;En cas contrari, i d’acord amb l’establert als articles 22 i 23 del Decret 13/2011, de 25 de febrer, s’haurà de suspendre l’activitat i es dictarà resolució de cancel·lació de la inscripció. La manca de comunicació a la Conselleria de Turisme, del canvi de titularitat en la propietat o en l’explotació de l’establiment, està tipificada en l’article 105 de la Llei 8/2012, de 19 de juliol, del turisme de les Illes Balears, com a falta greu, i podrà ser sancionada amb multa de 4.001 a 40.000 euros d’acord amb l’article 109 del mateix cos legal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
