    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Acordat per aquest Ajuntament en Ple, en sessió ordinària celebrada el dia 1 de juliol de 2013, s’aprova la modificació de ORDENANÇA FISCAL REGULADORA DE LA TAXA PER A LA PRESTACIÓ DE SERVEIS I UTILITZACIÓ DE LES INSTAL·LACIONS ESPORTIVES MUNICIPALS. I feta la legal exposició al públic sense haver-ne presentat durant el temps d’exposició cap reclamació, suggeriments, de conformitat amb el disposat a l’article 17-3 del Real Decret 2/2004 de 5 de març del Text Refós de la Llei&amp;nbsp; Reguladora de les Hisendes Locals, es considera definitivament aprovat, transcrivint-ne a continuació el text complet de l’ordenança.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra el present acord definitiu de modificació de la referida ordenança fiscal, els interessats podran interposar recurs contenciós administratiu davant la Sala de lo Contenciós Administratiu del Tribunal Superior de Justícia de les Illes Balears, en el termini de dos mesos comptats a partir del dia següent al de la publicació del present acord en el B.O.I.B.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;TEXTE DE L’ORDENANÇA&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;ORDENANÇA FISCAL REGULADORA DE LA TAXA PER A LA PRESTACIÓ DE SERVEIS I UTILITZACIÓ DE LES INSTAL·LACIONS ESPORTIVES MUNICIPALS&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Article 1r. Fondament i naturalesa&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;D’acord amb el previst als articles&amp;nbsp; 20.4- o) del Real Decret Legislatiu 2/2004 de 5 de març del Text Refos de la Llei Reguladora de les Hisendes Locals, de conformitat amb el que disposen els articles 15 a 19 de dit text legal, aquest Ajuntament estableix la taxa per la prestació de serveis a les instal·lacions esportives &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Article 2n. Fet imposable&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El fet imposable està determinat per la utilització de les distintes instal·lacions o serveis existents als recintes esportius de propietat municipal&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Article 3r. Obligació de contribuir&lt;/strong&gt;&lt;strong&gt;.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;L&amp;apos;obligació de contribuir neix com a conseqüència de l&amp;apos;entrada dels usuaris a les instal·lacions esportives de propietat municipal, així com per la utilització dels seus diferents serveis.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Article 4rt. Subjecte passiu&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Estan obligats al pagament d&amp;apos;aquesta taxa, les persones naturals usuàries dels distints serveis, o que sol·licitin l&amp;apos;entrada al recinte esportiu municipal.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Article 5è. Responsables.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Seran responsables, solidaris o subsidiaris, de les obligacions tributaries del subjecte passiu, les persones físiques i jurídiques a que es refereix els articles 38.1, 39 i 40 de la Llei General Tributaria&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Article 6è. Quantia&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La quantia de la taxa regulada en aquesta Ordenança serà la fixada en la tarifa continguda al següent apartat.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La tarifa d’aquesta taxa serà la següent:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El Regidor Delegats d&amp;apos;Esports, resta facultat per expedir carnets d&amp;apos;abonat per a l&amp;apos;ús de les instal·lacions, les quals podran tenir caràcter, individual i/o juvenil. L&amp;apos;expedició dels esmentats documents importarà les següents quotes anuals:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;Tenir l’esmentat carnet donarà dret al seu titular per entrar lliurament a totes les instal·lacions, i a l’ús dels serveis que no estiguin expressament ocupats. Els uniesportius donaran dret a realitzar l’esport pel que s’hagi abonat. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El carnet d’abonament serà personal i intransferible. A tal efecte el carnet contindrà, com a dades personals mínimes el nom i llinatges i una fotografia recent de l’abonat.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Per activitats extraordinàries, (com ús no esportiu de les instal·lacions) la Batlia resoldrà en cada cas, tenint en compte les seves especials característiques.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;A les tarifes de la present ordenança, s’entén l’IVA inclòs quan legalment procedeixi la seva aplicació.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Les liquidacions de la Taxa en les sol·licituds d’ús col·lectiu, formulades per aquests o pels seus representants podran ser objecte de liquidació mitjançant concert. Atenent per la determinació de les tarifes, als terminis de temps i el període de l’any, al qual s’interessin per a l’ús de les instal·lacions&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Article 7è. Exempcions&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Resten exempts, excepte els dissabtes i els diumenges que abonaran el 50% de les tarifes. El Ajuntament es reserva el dret de decidir en el supòsit de torneigs:&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;l’Associació de Tenistas de Valldemossa, previ acord amb la Regidoria d’Esports.&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La resta d’associacions esportives inscrites a Valldemossa, previ acord amb la Regidoria d’Esports&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Resten exempts els disminuïts físics i/o psíquics, previ informe del Servei d&amp;apos;Acció Social, així com les persones recomanades per dit Servei.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Article 8è. Cobrament de les tarifes&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El cobrament s&amp;apos;efectuarà mitjançant talonaris numerats que seran entregats per la Tresoreria, mitjançant el càrrec pertinent a les persones encarregades de la vigilància i custòdia de les instal·lacions. Dites persones hauran d&amp;apos;efectuar l&amp;apos;ingrés de les quotes recaptades quinzenalment o en un termini de temps inferior, si així ho exigeix la Tresoreria. L&amp;apos;import de l&amp;apos;abonament es farà efectiu mitjançant l&amp;apos;ingrés a la Tresoreria d&amp;apos;aquest Ajuntament, i amb el resguard de dit ingrés s&amp;apos;expedirà el carnet d&amp;apos;abonat.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Article 9è.&amp;nbsp; Infraccions i sancions&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Les infraccions i sancions en matèria tributària es regiran per el disposat en la Llei General Tributària,&amp;nbsp; la seva normativa de desenvolupament i l’Ordenança General de Gestió.”&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Disposició final&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La present ordenança entrarà en vigor el dia de la seva publicació en el Butlletí Oficial de la Comunitat Autònoma de les Illes Balears, estant en vigor fins a la seva modificació o derogació expressa.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt;
