    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p style="margin-left: 2.25pt"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Mitjançant el present edicte es notifica als beneficiaris que a continuació es relacionen que una vegada analitzada la al·legació presentada i la documentació aportada en el seu cas, s’ha resolt estimatoriament ja que es considera que &lt;/span&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;s&amp;apos;ha complert amb l&amp;apos;obligació de comunicar&lt;/span&gt; immediatament qualsevol modificació de les condicions que van motivar el reconeixement perquè es resolgui el que sigui procedent,&lt;span style="color: rgb(51, 51, 51)"&gt;complit amb l’obligació prevista a l&amp;apos;article&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;3.4 del&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;Reial&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;decret 1472&lt;/span&gt;/2007, &lt;span style="color: rgb(51, 51, 51)"&gt;de 2 de novembre&lt;/span&gt;, &lt;span style="color: rgb(51, 51, 51)"&gt;modificat&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;pel&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;Reial&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;Decret 366&lt;/span&gt;/2009, &lt;span style="color: rgb(51, 51, 51)"&gt;de 20 de març&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;i&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;pel&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;Reial&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;Decret 1260&lt;/span&gt;/2010, &lt;span style="color: rgb(51, 51, 51)"&gt;de 8 d&amp;apos;octubre, per la qual cosa s’ha informat favorablement &amp;nbsp;l’aixecament de la suspensió cautelar&lt;/span&gt; i la remissió al Ministeri de Foment per a la tramitació del reintegrament dels pagaments indeguts, sense responsabilitat del beneficiari.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;span style="color: rgb(51, 51, 51)"&gt;Si hi&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;ajudes&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;indegudament&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;percebudes&lt;/span&gt;, &lt;span style="color: rgb(51, 51, 51)"&gt;es&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;tramitarà&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;un expedient&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;de reintegrament&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;amb&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;les&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;garanties&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;de procediment&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;establertes a la&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;Llei 38&lt;/span&gt;/2003, &lt;span style="color: rgb(51, 51, 51)"&gt;de 17 de novembre&lt;/span&gt;, &lt;span style="color: rgb(51, 51, 51)"&gt;general de subvencions&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;(&lt;/span&gt;BOE &lt;span style="color: rgb(51, 51, 51)"&gt;N º&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;276,&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;de 18 de novembre&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;de 2003)&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;que&lt;/span&gt;, &lt;span style="color: rgb(51, 51, 51)"&gt;en&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;és el cas&lt;/span&gt;, &lt;span style="color: rgb(51, 51, 51)"&gt;serà&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;notificat&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;amb&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;la proposta&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;de liquidació&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;a efectes&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;del seu ingrés&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;o&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;la presentació&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;de documents&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;i al · legacions&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;que l&amp;apos;interessat&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;consideri&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;oportú&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;abans&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;de dictar&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;la resolució&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;amb&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;la liquidació&lt;/span&gt; &lt;span style="color: rgb(51, 51, 51)"&gt;definitiva. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;span style="color: rgb(51, 51, 51)"&gt;Contra aquesta resolució que posa&lt;/span&gt; fi a la via administrativa, es pot interposar recurs de reposició potestatiu davant l&amp;apos;òrgan que subscriu, en el termini d&amp;apos;un mes a comptar de l&amp;apos;endemà de la notificació d&amp;apos;aquesta Resolució, segons disposen els articles 116 i 117 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú (BOE N º 311, de 28/12/92), modificada per la Llei 4/1999, de 13 de gener (BOE N º 12, de 14/01/99), o recurs contenciós-administratiu davant el Jutjat en la circumscripció tingués el demandant el domicili, en el termini de dos mesos comptats des del dia següent a la data de la notificació, de conformitat amb el que preveu l&amp;apos;article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa (BOE N º 167, de 14/07/98).&lt;/span&gt;&lt;/p&gt;
