    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En relació amb l’assumpte de referència, i d’acord amb la Llei 16/2002, d’1 de juliol, de prevenció i control integrats de la contaminació, us comuniquem que el Ple de la CMAIB, en sessió de 03 d’abril de 2013&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ATÈS&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Que Ladrilleras Ibicencas SA ha sol·licitat una modificació de l’AAI consistent en la utilització de pellets i olis vegetals usats com a nous combustibles.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Que la documentació aportada justifica que es tracta d’una modificació no substancial, en compliment de l’art. 10.2 de la Llei 16/2002, d’1 de juliol.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. Que els informes emesos pels diferents departaments són favorables, consideren la modificació com a no substancial i proposen una sèrie de condicionants.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ACORDA&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;atorgar la modificació no substancial de l’Autorització Ambiental Integrada de la fàbrica de blocs, teules i altres productes ceràmics a Sta. Eulària des Riu, consistent en la utilització de pellets i olis vegetals usats com a nous combustibles, amb les condicions d’explotació, capacitat i processos indicats a la documentació tècnica que acompanya la sol·licitud i amb subjecció a les següents condicions:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1.Es modifica el condicionant 5 Consums per afegir els pellets i els olis vegetals usats com a matèries primeres:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;em&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;“5. Consums&lt;/span&gt;&lt;/em&gt;&lt;/p&gt; 
&lt;p&gt; &lt;em&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;S’estima que els consums màxims de matèries primeres, auxiliars i matèries d’addició seran els següents:&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt; &lt;em&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;(1) Dades extretes de la relació entre consum-producció real i capacitat màxima de producció.&lt;/span&gt;&lt;/em&gt;&lt;/p&gt; 
&lt;p&gt; &lt;em&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;(2) Dades considerant una substitució del 50% del fuel-oil a la capacitat màxima de producció.&lt;/span&gt;&lt;/em&gt;&lt;/p&gt; 
&lt;p&gt; &lt;em&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;(3) Dades considerant una substitució de fins a un 30% del fuel mitjançant oli vegetal usat. S’ha de tenir en compte que la quantitat màxima anual disponible d’oli vegetal usat a l’illa d’Eivissa és, segons les consultes realitzades pel promotor als gestors de residus, de 120 t però una millora en la seva gestió podria veure incrementada aquesta quantitat”.&lt;/span&gt;&lt;/em&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El present acord s’entén sense el perjudici de l’obtenció de les altres autoritzacions, llicències o permisos que, en el seu cas, siguin exigibles, així com de l’actualització del Pla d’Autoprotecció a la D.G. d’Interior, Emergències i Justícia.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Interposició de recursos&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra aquest acord, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el Ple de la Comissió de Medi Ambient de les Illes Balears en el termini d’un mes comptador des de l’endemà d’haver-ne rebut&amp;nbsp; la notificació, d’acord amb l’article 117 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques&amp;nbsp; i del procediment administratiu comú, i l’article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l’Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l’endemà d’haver rebut la notificació de l’acord, d’acord amb l’article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa. &lt;/span&gt;&lt;/p&gt;
