![CDATA[Consell Executiu. Aprovació de la concessió de subvencions a entitats privades sense ànim de lucre per a programes dins l'àmbit social - 2012]] 2013-07-18 13698 ![CDATA[<p> <span style="font-family: times new roman, times, serif; font-size: 12px">Es fa públic que el Consell Executiu del Consell Insular de Menorca en sessió ordinària de dia 1 de juliol de 2013, va adoptar el següent acord en relació a l’assumpte:</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">Ateses la convocatòria i les bases que regeixen la concessió dels ajuts del Consell Insular de Menorca a les entitats privades sense ànim de lucre per al desenvolupament de programes d’atenció a persones en l’àmbit social per a l’any 2012 (BOIB núm. 5 de 10 de gener de 2013), aprovades pel Consell Executiu de dia 2 de desembre de 2012;</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">Ateses les sol·licituds presentades dins el termini establert en la convocatòria i la documentació annexa que les acompanya;</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">Atès l’informe de la instructora de l’expedient, de 30 de maig de 2013, on es fa constar que, un cop revisats els expedients, es comproven determinades deficiències en alguna documentació incorrecta o incompleta;</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">Atès que l’esmentat informe determina que totes les entitats a les quals s&apos;ha remès el requeriment s’han esmenat en temps i forma la documentació;</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">Atès l’informe de la Comissió Avaluadora de 14 de juny de 2013, pel qual s’emet informe favorable sobre la concessió dels ajuts del Consell Insular de Menorca a les entitats sense ànim de lucre que figuren en l’acord primer d’aquesta proposta per al desenvolupament de programes d’atenció a persones en l’àmbit social per a l’any 2013, d’acord amb la distribució que en ell es detalla, com a resultat de la valoració de cadascun dels projectes, i que es detalla en les fitxes annexes que l’acompanyen;</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">Atès que la Comissió Avaluadora emeté informe desfavorable a la concessió dels ajuts del Consell Insular de Menorca, per al desenvolupament de programes d’atenció a persones en l’àmbit social per a l’any 2012, a les entitats Vida Creixent i Alcer Menorca, que van presentar les corresponents sol·licituds fora de termini, i a la Fundació Joves Navegants de Balears, per no disposar en data 31 de desembre de 2012 de l’autorització administrativa corresponent per al desenvolupament dels programes pels quals sol·licitava l’ajut, d’acord amb el que estableix el punt 9 d) de les corresponents bases;</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">Atès que la convocatòria fixa un import màxim global de 130.000 € (cent trenta mil euros), que serà atès amb càrrec a la partida 2301 4890012 del pressupost vigent del Consell Insular de Menorca;</span></p> <p class="western"> <span style="font-family: times new roman, times, serif; font-size: 12px">Atesa la proposta de la consellera executiva del Departament de Benestar Social i Joventut;</span></p> <p class="western"> <span style="font-family: times new roman, times, serif; font-size: 12px">El Consell Executiu, per unanimitat i en votació ordinària, adopta el següent <b>acord:</b></span></p> <p> <span style="font-family: times new roman, times, serif; Si no es produeix una renúncia expressa en el termini de 15 dies des que s’hagi notificat la resolució, s’entendrà que ha estat acceptada.</span></p> <p style="margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px">b) Realitzar el projecte que fonamenta la concessió de l’ajuda en el termini previst.</span></p> <p style="margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px">c) Justificar la realització del projecte pel qual es concedeix l’ajuda i també complir els requisits i les condicions establertes en les bases de la convocatòria i en la resolució de la concessió dels ajuts.</span></p> <p style="margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px">d)Acreditar, si escau, abans del 31 de desembre de 2012, haver obtingut l’autorització administrativa de conformitat amb el que estableixen els articles 19 i següents del Decret 66/1999, de 4 de juny, pel qual s’aprova el Reglament regulador del Sistema Balear de Serveis Socials.</span></p> <p style="margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px">e) Proporcionar la informació sobre l’execució del projecte subvencionat que li requereixi el Consell Insular de Menorca.</span></p> <p style="margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px">f) Sotmetre’s a les actuacions de comprovació que efectuïn el Consell Insular de Menorca i la resta d’organismes competents per a la fiscalització dels comptes públics.</span></p> <p style="margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px">g) Comunicar al Consell Insular de Menorca la sol·licitud i l’obtenció de subvencions o ajudes per a la mateixa finalitat, procedents de qualsevol ens públic o privat, nacional o internacional. La comunicació es farà mitjançant la presentació d’una còpia de la resolució de concessió de l’ajut.</span></p> <p style="margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px">h) Estar, abans que es pagui la subvenció, al corrent de les obligacions amb la hisenda estatal i de la comunitat autònoma, així com de les obligacions amb la Seguretat Social.</span></p> <p style="margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px">i) Fer constar, de manera expressa, el suport del Departament de Benestar Social i Joventut del Consell Insular de Menorca a la realització de les activitats subvencionades i posar a la seva disposició els materials gràfics i audiovisuals relatius a l’activitat.</span></p> <p style="margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px">j) Deixar constància de la percepció i l’aplicació de la subvenció en la comptabilitat o en els llibres de registre.</span></p> <p style="margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px">k) Reflectir, en un lloc destacat de tots els elements publicitaris de la inversió subvencionada, la col·laboració del Consell Insular de Menorca.</span></p> <p style="margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px">l) Comunicar immediatament al Consell Insular de Menorca qualsevol eventualitat que alteri les condicions tingudes en compte per concedir la subvenció, així com qualsevol eventualitat que dificulti greument el desenvolupament del projecte subvencionat, en particular si se’n poden derivar retards en l’execució o si poden afectar el cost total, i sol·licitar l’autorització prèvia i expressa del Consell Insular de Menorca per fer qualsevol modificació substancial del projecte objecte de l’ajuda. Les sol·licituds de modificació substancial han de ser motivades, s’han de formular immediatament després de l’aparició de les circumstàncies que les justifiquin i han d’especificar les repercussions pressupostàries que impliquin.</span></p> <p style="margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px">m) Presentar, en el termini establert en les bases, la justificació de la despesa per l’import de la subvenció.</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><b>Quart.- </b>Informar a les entitats beneficiàries dels ajuts que, d’acord amb el que s’estableix en les bases i el que disposa l’article 43 del Decret legislatiu 2/2005, de 28 de desembre, pel qual s’aprova el text refós de la Llei de subvencions de la Comunitat Autònoma de les Illes Balears, es revocarà la subvenció quan, posteriorment a la resolució de la concessió, l’entitat beneficiària incompleixi totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l’eficàcia de l’acte de concessió de la subvenció.</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">Com a conseqüència de la revocació de la subvenció, quedarà sense efecte, totalment o parcialment, l’acte de concessió i pertocarà el reintegrament de les quantitats percebudes indegudament.</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">Així mateix, les entitats beneficiàries hauran de reintegrar totalment o parcialment les quantitats rebudes i, si escau, l’interès de demora, ens els supòsits recollits en els articles 37 i 38 de la Llei 38/2003, de 17 de novembre, general de subvencions i l’article 44 de l’esmentat Decret Legislatiu 2/2005, de 28 de desembre.</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><b>Cinquè.- </b>Notificar els acords anteriors a les entitats beneficiàries i sol·licitar-los que comuniquin al Consell Insular de Menorca l’acceptació de la subvenció, en el benentès que si no es produeix una renúncia expressa en el termini de 15 dies des que s’hagi notificat la resolució de concessió, s’entendrà que l&apos;accepten.</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><b>Sisè.- </b>Publicar els acords anteriors en el BOIB.</span></p> <p> &nbsp;</p> <p style="margin: 0px; text-align: center"> <span style="font-family: times new roman, times, serif; font-size: 12px">Maó, 10 de juliol de 2013</span></p> <p style="margin: 0px; text-align: center"> &nbsp;</p> <p style="margin: 0px; text-align: center"> <strong><span style="font-family: times new roman, times, serif; font-size: 12px">El secretari del Consell Executiu</span></strong></p> <p style="margin: 0px; text-align: center"> <span style="font-family: times new roman, times, serif; font-size: 12px">Octavi Pons Castejón</span></p>]] 520677 ca 34567 2013-07-18 CAIB ca CAIB 34565 CAIB text/html 360 2013-07-16
