    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La Junta Rectora del Consorci del Pavelló Esportiu Multifuncional en sessió extraordinària de dia 3 d’abril de 2013 va aprovar inicialment l’Ordenança reguladora del preu públic per a l’ús de les instal·lacions del Pavelló esportiu multifuncional de Menorca, la qual cosa s’exposa al públic juntament amb tot l’expedient mitjançant edicte inserit en el BOIB núm. 48 de 9 d’abril de 2013.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Atès que, dins el termini legal d’exposició al públic, no s’ha presentat cap al·legació ni suggeriment al respecte, de conformitat amb l’art.102 Llei 20/2006, de 15 de desembre, els articles 15 i següents del RDLEG 2/2005, Llei Reguladora de les Hisendes Locals, feim públic el text íntegre de l’Ordenança reguladora del preu públic per a l’ús de les instal·lacions del pavelló esportiu multifuncional de Menorca que, d’acord amb la seva disposició final, entrarà en vigor l’endemà d’haver-se publicat en el Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="font-weight: normal; text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;ORDENANÇA REGULADORA DEL PREU PÚBLIC PER A L’ÚS DE LES INSTAL·LACIONS DEL PAVELLÓ ESPORTIU MULTIFUNCIONAL DE MENORCA&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" style="font-weight: normal"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Article 1. CONCEPTE&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;De conformitat amb el que disposa l&amp;apos;article 127 del Text refós de la Llei reguladora de les Hisendes Locals aprovat per RDL 2/2004, de 5 de març, (TRLHL), en relació amb els articles 41 a 48 de la mateixa Llei, i d&amp;apos;acord amb el que preveuen els seus propis Estatuts, el Consorci del Pavelló Esportiu Multifuncional de Menorca estableix el preu públic per a l’ús de les instal·lacions del Pavelló Menorca, que es regirà per les disposicions legals i reglamentàries vigents, i per aquesta ordenança.&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Article 2. OBJECTE&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;L&amp;apos;objecte del preu públic és l’ús, per a activitats esportives i no esportives, de les instal·lacions del Pavelló Menorca, que comprenen la pista poliesportiva i les instal·lacions interiors complementàries (vestuaris, bars i sales), així com les instal·lacions exteriors annexes (bar exterior o &amp;quot;Time Out&amp;quot;, i aparcament), en les diferents modalitats que es recullen el en article 4 regulador de les tarifes.&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Article 3. OBLIGATS AL PAGAMENT&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Estan obligades al pagament les persones naturals o jurídiques que sol·licitin i utilitzin les instal·lacions esmentades en l&amp;apos;article anterior, de les quals és titular el Consorci.&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Article 4. TARIFES &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Els preus públics exigibles en cada cas, segons el tipus i característiques de l’activitat, segons la tipologia que s’indica, seran els que s’inclouen al quadre que s’adjunta com annex.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;A aquests imports se&amp;apos;ls afegirà l&amp;apos;import corresponent a l&amp;apos;Impost sobre el Valor Afegit (IVA) per obtenir el preu final a pagar, a excepció d&amp;apos;aquells casos en què l’activitat no estigui subjecte o estigui exempta de l&amp;apos;impost.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El preu exigible per a l’explotació del bar exterior o “Time Out” consistirà en el 10% de la recaptació que s’obtengui en l’explotació del mateix per a una activitat concreta. A la sol·licitud d’autorització de l’activitat, s’inclourà uns previsió d’ingresos i despeses de l’explotació d’aquesta instal·lació.&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Article 5. EXEMPCIONS I BONIFICACIONS&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Estaran exemptes del pagament del preu públic establert en aquesta ordenança les administracions públiques de qualsevol àmbit quan organitzin activitats en les que no es percebi un preu o entrada per participar o assistir-hi i tinguin un interès general.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Es podrà acordar una bonificació de fins al 90% del preu públic en l’ús del Pavelló per a activitats esportives, organitzades i realitzades per clubs, entitats i federacions esportives, sempre que no es percebi preu o entrada per participar o assistir-hi i tinguin un interès general .&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. Es podrà acordar una bonificació de fins al 90% del preu públic en l’ús del Pavelló per a activitats, esportives i no esportives, organitzades i realitzades per entitats sense ànim de lucre, sempre que no es percebi preu o entrada per participar o assistir a les mateixes i tinguin un interès general.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. Per poder gaudir de les bonificacions que preveu aquest article, les persones o entitats interessades les hauran de sol·licitar mitjançant escrit dirigit al Consorci, en el qual faran constar les circumstàncies específiques que motiven i avalen la sol·licitud. La Presidència del Consorci resoldrà fixant el percentatge de la bonificació i, si s&amp;apos;escau, les condicions per al seu gaudi.&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Article 6. NORMES DE GESTIÓ &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. L’ús de les instal·lacions del Pavelló Menorca es sol·licitarà amb un mínim de 30 dies d&amp;apos;antelació a la realització de l&amp;apos;activitat, mitjançant la presentació d&amp;apos;una sol·licitud per escrit dirigida al Consorci a la qual s&amp;apos;adjuntarà tota la informació i documentació relativa a l&amp;apos;activitat a realitzar. En el cas que es sol·liciti amb una antelació inferior als 30 dies, per causes justificades, la petició es tramitarà igualment, però subjecte a les limitacions de disponibilitat existents, i sempre que es compleixin la resta de requisits.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. La sol·licitud ha d&amp;apos;incloure, si escau, les mesures de seguretat i el compliment de les altres condicions que imposi la normativa vigent en la matèria per a l&amp;apos;activitat sol·licitada. En qualsevol cas s&amp;apos;haurà d&amp;apos;aportar, abans de la celebració de l&amp;apos;activitat, una assegurança de responsabilitat civil per cobrir els possibles danys a persones i qualsevol altra eventualitat.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. El Consorci, mitjançant resolució del president, autoritzarà, si s’escau, la realització de l&amp;apos;activitat, imposant les condicions que consideri necessàries per a la preservació i bon ús de la instal·lació, i el correcte desenvolupament de l&amp;apos;activitat, cessió que es formalitzarà mitjançant el corresponent contracte.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. En cap cas la persona o entitat autoritzada podrà cedir a tercers els drets inherents a l&amp;apos;autorització.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;5. Dins el termini de 5 dies naturals des de la data d&amp;apos;autorització de l’ús de la instal·lació, la persona o entitat sol·licitant realitzarà el pagament del 20% del preu públic corresponent, en concepte de reserva, mitjançant ingrés directe als comptes del Consorci. El 80% restant es pagarà en qualsevol cas abans d&amp;apos;iniciar l&amp;apos;activitat. Excepcionalment, i prèvia sol·licitud per part de la persona o entitat interessada, es podrà acordar l’ajornament del pagament del preu.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;6. En el cas de celebració d&amp;apos;esdeveniments no esportius amb aforament de més de 500 persones (tarifes A3 i B3), dins el termini de 10 dies naturals des de l&amp;apos;autorització de l’ús de la instal·lació, la persona o entitat sol·licitant haurà de presentar un aval per un import que es determinarà en la resolució d&amp;apos;autorització corresponent, que es destinarà a cobrir els desperfectes que es puguin produir. En els altres casos, tot i que no s&amp;apos;hagi de presentar aval, la persona o entitat sol·licitant es fa responsable dels desperfectes que puguin produir-se a les instal·lacions, i haurà d&amp;apos;abonar les reparacions corresponents segons la liquidació que presenti el Consorci a l&amp;apos;efecte.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;7. El Consorci no es fa responsable dels béns de qualsevol tipus que els usuaris o participants en l&amp;apos;activitat portin o introdueixin en les instal·lacions, ni dels actes que realitzin.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;8. Si l&amp;apos;activitat no es pot dur a terme per circumstàncies objectives sobrevingudes, o per decisió unilateral del sol·licitant, el Consorci no assumeix cap responsabilitat compensatòria.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;9. L’ús de la totalitat del Pavelló Menorca inclou les instal·lacions complementàries i annexes a aquest, esmentades en l&amp;apos;article 2, a excepció del bar exterior o &amp;quot;Time Out&amp;quot;, que s&amp;apos;ha de demanar, i si s&amp;apos;escau autoritzar, expressament, amb la tarifa que s&amp;apos;indica en l&amp;apos;article 4 d&amp;apos;aquesta ordenança.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;10. L&amp;apos;entitat o empresa sol·licitant haurà de presentar als responsables tècnics de la instal·lació aquella documentació que li sigui exigida i en especial la necessària per adherir-se a la llicència d&amp;apos;activitat de la instal·lació:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;a) Projecte d&amp;apos;activitat específic de l&amp;apos;esdeveniment signat per tècnic competent i certificat final d&amp;apos;instal·lació.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;b) Certificat d&amp;apos;estabilitat (visat i signat per tècnic competent) d&amp;apos;escenaris, grades o qualsevol estructura muntada per a la celebració de l&amp;apos;acte.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;c) Butlletí d&amp;apos;instal·lació elèctrica visat i signat per tècnic competent.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;d) Adhesió al Pla d&amp;apos;Autoprotecció del Pavelló o, en cas necessari, modificació del mateix, visat i signat per tècnic competent.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;11. En qualsevol cas, i amb caràcter general, la persona o entitat sol·licitant haurà de complir tota la normativa que sigui d&amp;apos;aplicació en atenció al tipus d&amp;apos;activitat, i haurà d’aportar tota la documentació que se li requereixi per part del Consorci.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;12. Aquestes normes de gestió seran completades i/o modificades per part del Consorci del Pavelló Esportiu Multifuncional en atenció a les característiques del acte.&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Article 7º.- DELEGACIÓ EN LA PRESIDÈNCIA DEL CONSORCI&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-right: 0.5cm; widows: 2; orphans: 2"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;D&amp;apos;acord amb les previsions estatutàries la Junta Rectora del Consorci Pavelló Multifuncional de Menorca delega en el president del Consorci tots els actes de gestió del preu públic que es recullen en aquesta ordenança.&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Disposició Final. ENTRADA EN VIGOR&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-right: 0.5cm; widows: 2; orphans: 2"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Aquesta ordenança entrarà en vigor l&amp;apos;endemà de la publicació del text íntegre de la mateixa en el Butlletí Oficial de les Illes Balears (BOIB), i continuarà vigent fins a la seva modificació o derogació.&lt;/span&gt;&lt;/p&gt;
