    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p class="MsoNormal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="letter-spacing: -0.15pt"&gt;La regidora titular de l´Àrea de Funció Pública i Govern Interior&lt;/span&gt;&lt;span lang="FR"&gt; i el regidor titular de l’Àrea Delegada de Seguretat Ciutadana, d’acord amb les competències atribuïdes pel&lt;/span&gt;&lt;span style="letter-spacing: -0.15pt"&gt;&lt;span&gt;&amp;nbsp; &lt;/span&gt;Decret de batlia núm. 5309, de 26.03.2012 (BOIB núm. 52, de 12/04/2012),&lt;/span&gt;&lt;span lang="CA"&gt; han dictat els acords de resolució dels expedients sancionadors que figuren a l&amp;apos;annex d’aquest edicte.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p class="MsoNormal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="CA"&gt;&amp;nbsp;S’ha intentat&lt;span&gt;&amp;nbsp; &lt;/span&gt;la seva notificació i&lt;span&gt;&amp;nbsp; &lt;/span&gt;no s’ha pogut dur a terme. En conseqüència es publica aquest&lt;span&gt;&amp;nbsp; &lt;/span&gt;edicte,&lt;span&gt;&amp;nbsp; &lt;/span&gt;d&amp;apos;acord amb el que preveuen els articles&lt;span&gt;&amp;nbsp; &lt;/span&gt;59.5&lt;span&gt;&amp;nbsp; &lt;/span&gt;i&lt;span&gt;&amp;nbsp; &lt;/span&gt;61&lt;span&gt;&amp;nbsp; &lt;/span&gt;de la Llei 30/92, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú (BOE núm. 285, de&lt;span&gt;&amp;nbsp; &lt;/span&gt;27/11/1992) ,&lt;span&gt;&amp;nbsp; &lt;/span&gt;modificada per la Llei 4/1999, de 13 de gener (BOE núm. 12, de 14/1/1999).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p class="MsoNormal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="CA"&gt;&amp;nbsp;Els interessats poden abonar l’import de la multa a la Recaptació Municipal, plaça de Santa Eulàlia&lt;span&gt;&amp;nbsp; &lt;/span&gt;núm. 8, de 9 a 13.30 hores, de dilluns a divendres, comptats des de l’endemà de la publicació d’aquest edicte.&lt;span&gt;&amp;nbsp; &lt;/span&gt;Si una vegada transcorregut aquest termini no l’han abonat, es cobrarà per via de constrenyiment, amb els recàrrecs corresponents.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p class="MsoNormal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="CA"&gt;&amp;nbsp;Contra l’acord de resolució de l’expedient sancionador, que exhaureix la via administrativa, es pot interposar recurs de reposició davant el mateix òrgan que l&amp;apos;ha dictada, d’acord amb allò que disposa l’article 108 de la Llei 7/85, de règim local, modificat per l’article 1.1 de la Llei 57/2003 de 16 de desembre, (BOE núm. 301, de 17/12/2003). El termini per interposar-lo és d&amp;apos;un mes comptat des de l&amp;apos;endemà de la publicació de la present notificació. En aquest cas no es podrà interposar recurs contenciós administratiu fins que s&amp;apos;hagi resolt el de reposició.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p class="MsoNormal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="CA"&gt;&amp;nbsp;El recurs de reposició potestatiu s&amp;apos;ha de presentar al Registre General d&amp;apos;aquest Ajuntament o a les dependències a què es refereix l&amp;apos;article 38, 4t de la Llei 30/92, de 26 de novembre, abans esmentada, i es considerarà desestimat quan no s&amp;apos;hagi resolt i notificat la resolució en el termini d&amp;apos;un mes comptat des de l&amp;apos;endemà de la seva interposició. En aquest cas queda expedita la via contenciosa administrativa. Si no s&amp;apos;utilitza el recurs potestatiu de reposició, es pot interposar directament recurs contenciós administratiu, conformement al que estableix l&amp;apos;article esmentat anteriorment, i als articles 45 i següents de la Llei 29/98, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa, davant el jutjat contenciós administratiu, en el termini de dos mesos comptat des de &lt;/span&gt;comptat des de l&amp;apos;endemà de de la publicació d’aquest edicte&lt;span lang="CA"&gt;. Això sense perjudici de qualsevol altre recurs o acció que es consideri pertinent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p class="MsoNormal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="CA"&gt;&amp;nbsp;La interposició del recurs no paralitza la via de constrenyiment, llevat que es garanteixi el pagament de la multa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p class="MsoNormal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="CA"&gt;&amp;nbsp;Si la sanció s&amp;apos;ha imposat per infracció a l&amp;apos;article 25.1 de la Llei orgànica 1/92 sobre seguretat ciutadana, es podrà suspendre als infractors que puguin ser considerats consumidors freqüents o habituals de drogues tòxiques, estupefaents o substàncies psicotròpiques si se sotmeten a un tractament de deshabituació en un centre o servei degudament acreditat, d&amp;apos;acord amb el que disposa l&amp;apos;article 25.2 d&amp;apos;aquesta Llei i els termes del RD 1079/93, de 2 de juliol, que regula la remissió de les sancions administratives en matèria de drogues.
