    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Antecedents &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. L’article 12 de la Llei 3/2007, de 27 de març, de la Funció Pública de la comunitat autònoma de les Illes Balears, estableix que correspon a l’Escola Balear d’Administració Pública (EBAP) la formació, la capacitació i el perfeccionament del personal al servei de l’administració autonòmica i de les entitats que en depenen, així com en els termes establerts en aquesta llei i en la normativa de desplegament, la realització d’activitats formatives al personal al servei de les altres administracions radicades a les Illes Balears. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. El Decret 31/2012, de 13 d’abril, aprova els Estatuts de l’Escola Balear d’Administració Pública. Segons l’article 4 d’aquest Decret, són objectius fonamentals de l’EBAP la formació i l’avaluació, la capacitació i el perfeccionament del personal al servei de l’Administració de la Comunitat Autònoma de les Illes Balears i, si escau, de les altres administracions públiques del seu àmbit territorial. Així mateix, segons l’article 5 d’aquest mateix Decret, per tal d’aconseguir els objectius esmentats, l’EBAP té com a funcions promoure, organitzar i gestionar la formació, el reciclatge i el perfeccionament del personal de la Comunitat Autònoma i, si escau, de la resta d’administracions del seu àmbit territorial.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. Altrament, l’article 11.2.e dels Estatuts inclou entre les competències del Consell de Direcció de l’EBAP&amp;nbsp; l’aprovació dels plans de formació. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. La Resolució de 27 de desembre de 2012 de l’Institut Nacional d’Administració Pública per la qual es convoquen per a l’exercici de 2013 subvencions destinades al finançament de plans de formació en el marc de l’Acord de formació per a l’ocupació de les administracions públiques (BOE núm. 4, de 4-01-2013), estableix els promotors i els beneficiaris dels plans de formació en el marc de l’Acord formació per a l’ocupació de les administracions públiques (AFEDAP).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;5. Així mateix, la Resolució esmentada estableix com a activitats objecte de finançament, entre d’altres, els plans interadministratius, els quals es caracteritzen per anar destinats no solament al personal de l’administració promotora, sinó també als empleats públics d’altres administracions.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;6. El Pla Interadministratiu és un dels instruments de l’EBAP per a aconseguir tant els objectius que s’han especificat més amunt, com la millora del rendiment dels serveis públics i la promoció professional. A través d’aquest Pla Interadministratiu, el personal al servei de les distintes administracions públiques de l’àmbit de les Illes Balears té dret a participar en les activitats formatives de l’EBAP en els terminis i les condicions que determina l’annex 1 d’aquesta Resolució. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;7. El Consell de Direcció de l’EBAP ha aprovat, a la sessió de&amp;nbsp; 10 d’abril &amp;nbsp;de&amp;nbsp; 2013&amp;nbsp; el Pla Interadministratiu programat per l’EBAP per a l’any 2013 i les instruccions que han de regir les activitats formatives programades. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Per tot això, fent ús de les atribucions que m’atorga l’article 9 del Decret 31/2012, dict la següent&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;RESOLUCIÓ&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Aprovar la convocatòria del &amp;nbsp;Pla Interadministratiu programat per l’EBAP per a l’any 2013. Les instruccions &amp;nbsp;que han de regir les activitats formatives programades s’adjunten com a annex 1 i l’oferta formativa del Pla Interadministratiu s’adjunta com a annex 2 d’aquesta Resolució.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Publicar aquesta Resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. Publicar la informació referent a l’oferta formativa del Pla Interadministratiu de 2013 a la pàgina web de l’EBAP (http://ebap.caib.es).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra aquesta Resolució —que exhaureix la via administrativa— es pot interposar un recurs potestatiu de reposició davant el president de l’EBAP en el termini d’un mes, comptador des de l’endemà d’haver estat publicada en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;, d’acord amb l’article 117 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment comú, i l’article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l’Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;També es pot interposar directament un recurs contenciós administratiu davant el Jutjat Contenciós Administratiu en el termini de dos mesos, comptadors des de l’endemà d’haver estat publicada la Resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;, d’acord amb l’article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px; text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Instruccions per les quals es regeixen les activitats formatives del Pla Interadministratiu de l’Escola Balear d’Administració Pública (EBAP) per &lt;/span&gt;&lt;/strong&gt;&lt;strong&gt;a &lt;span style="color: rgb(35, 31, 32)"&gt;l’any 2013&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Punt 1. Persones destinatàries&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;1.1. Les persones destinatàries de les activitats formatives del Pla Interadministratiu de l’EBAP de l’any 2013 són el personal al servei de les administracions locals, excepte el personal dels cossos de policia local, i el personal de l’administració estatal&lt;/span&gt;.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1.2. En cas que, una vegada admès &lt;span style="color: rgb(35, 31, 32)"&gt;el personal al servei de les administracions local i estatal, quedin places vacants a les activitats formatives,&lt;/span&gt; podran participar-hi alumnes provinents de l’Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;1.3. El personal esmentat en els punts anteriors té dret a participar en les activitats formatives de l’EBAP en els termes i en les condicions que es determinen en aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Punt 2. Sol·licituds&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2.1. Personal &lt;span style="color: rgb(35, 31, 32)"&gt;al servei de les administracions públiques sense &lt;/span&gt;accés al Portal del Personal&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Aquest personal pot tramitar la seva sol·licitud&lt;span style="color: rgb(35, 31, 32)"&gt; mitjançant dos procediments:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;a)&lt;/span&gt;&lt;/em&gt;&lt;span style="color: rgb(35, 31, 32)"&gt; Mitjançant l’imprès habilitat a aquest efecte, en el qual ha de fer constar totes les dades que es demanen, incloent-hi l’adreça electrònica, que és l’eina per a comunicar l’admissió als cursos. La manca de dades pot ser motiu d’exclusió. Les sol·licituds s’han de presentar en el Registre de l’EBAP, en el de la Conselleria d’Administracions Públiques o en qualsevol de les formes que determina la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;b)&lt;/span&gt;&lt;/em&gt;&lt;span style="color: rgb(35, 31, 32)"&gt; Mitjançant la matriculació per Internet. Per a matricular-se per aquest sistema, s’ha d’accedir a la pàgina web &amp;lt;&lt;/span&gt;http://ebap.caib.es&amp;gt;; a continuació, s’ha d’accedir a &amp;lt;Plans de formació de l’EBAP 2013&amp;gt;; a continuació, s’ha d’accedir a &amp;lt;Pla Interadministratiu 2013&amp;gt;; finalment, s’ha d’accedir a &amp;lt;Matriculació per Internet&amp;gt;.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2.2. Personal &lt;span style="color: rgb(35, 31, 32)"&gt;al servei de les administracions públiques amb &lt;/span&gt;accés al Portal del Personal&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Aquest personal ha de tramitar la seva sol·licitud directament des d’aquest Portal. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2.3. El personal esmentat en els punts 2.1 i 2.2 anteriors ha d’enviar a l’EBAP la capçalera de la darrera nòmina&lt;span style="color: rgb(35, 31, 32)"&gt; o un document que acrediti que està en situació laboral activa&lt;/span&gt;. La capçalera o el document es poden adjuntar a la sol·licitud o es poden enviar al número de fax 971 17 76 19 o a l’adreça electrònica &amp;lt;formaciogeneral@ebap.caib.es&amp;gt;.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Punt 3. Termini de presentació de sol·licituds &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3.1. El termini d’inscripció als cursos corresponents al Pla Interadministratiu de l’EBAP de l’any 2013 és de quinze dies naturals, a comptar des de l’endemà d’haver estat publicada aquesta Resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt; i a la pàgina web &lt;span style="color: rgb(35, 31, 32)"&gt;&amp;lt;&lt;/span&gt;http://ebap.caib.es&amp;gt;. Les sol·licituds presentades fora de termini no es tindran en compte. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3.2. Són d’aplicació al Pla Interadministratiu les noves formes d’inscripció a les accions formatives —«darrer minut»—, aprovades mitjançant la Resolució de la presidenta de l’EBAP d’11 de juliol de 2009 (BOIB núm. 110, de 30 de juliol de 2009). En aquest sentit, una vegada publicada la llista definitiva de persones admeses, les persones interessades que, d’acord amb el punt 1 de l’annex de la Resolució esmentada abans, presentin una sol·licitud dins un nou termini d’inscripció en el registre de qualsevol ens o òrgan d’una administració diferent a l’EBAP, han d’avançar la sol·licitud i els justificants dels requisits, si escau, al número de fax 971 17 76 19 o a l’adreça electrònica &amp;lt;formaciogeneral@ebap.caib.es&amp;gt;.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Punt 4. Requisits i selecció&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;4.1. L’EBAP comprovarà que les persones interessades compleixen les condicions per a ser admeses als cursos. Només s’admetran les sol·licituds que compleixin els requisits establerts en aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;4.2. Si el nombre de sol·licituds per a participar en una determinada activitat formativa supera el nombre de places previst, l’EBAP en farà la selecció corresponent, d’acord amb els següents criteris de prelació de la selecció:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;1r. La relació de l’activitat formativa amb les funcions que desenvolupi la persona sol·licitant, la qual cosa s’ha d’acreditar amb un document signat pel càrrec superior jeràrquic responsable del lloc de treball de què es tracti.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;2n. Ser personal funcionari de carrera, personal laboral fix o personal estatutari en propietat. En aquest punt s’ha de tenir en compte la situació en actiu.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;3r. &lt;/span&gt;En igualtat de condicions, tenen preferència les persones aspirants que no hagin participat en altres activitats de l’EBAP convocades els anys 2012 i 2013. A continuació tenen preferència les persones aspirants que hagin participat en menys activitats de l’EBAP &lt;span style="color: rgb(35, 31, 32)"&gt;convocades durant l’any en curs.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4t. La data de presentació de la sol·licitud.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;4.3. En tots els apartats anteriors, en igualtat de condicions, tindran preferència en les activitats formatives d’aquesta convocatòria les persones que acreditin, en el moment de la presentació de sol·licituds, que s’han incorporat durant l’any anterior al servei actiu després d’un permís de maternitat o paternitat, o que hagin reingressat des de la situació d’excedència per raons de guarda legal i atenció a persones dependents o amb discapacitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;4.4. Les referències que es fan en l’apartat de persones destinatàries als grups de personal funcionari són extensibles als nivells correlatius del personal laboral al servei de l’Administració. Així mateix, les referències que es fan en l’apartat de persones destinatàries als grups de personal funcionari són extensibles als nivells i grups correlatius del personal estatutari al servei de l’Administració.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Punt 5. Llistes de persones admeses&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;5.1. L’EBAP publicarà la llista de persones admeses a la pàgina web &amp;lt;&lt;/span&gt;http://ebap.caib.es&amp;gt;&lt;span style="color: rgb(35, 31, 32)"&gt; i també comunicarà individualment l’admissió mitjançant l’adreça electrònica facilitada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;5.2. En cas que les persones sol·licitants hagin canviat d’adreça electrònica, o ja no sigui operativa la que facilitaren inicialment, ho han de comunicar a l’EBAP.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;5.3. L’admissió als cursos no suposa cap autorització de l’EBAP per a deixar el lloc de treball, si coincideix amb l’horari laboral.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Punt 6. Anul·lació i modificació de les activitats formatives, i resolució de casos especials&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;6.1. L’EBAP, per a desenvolupar millor les funcions que té encomanades, pot suprimir activitats formatives; organitzar-ne de no programades amb anterioritat per necessitats puntuals que hagin sorgit; efectuar-ne diverses edicions, tenint en compte la demanda que hi hagi, i modificar-ne, si és pertinent, els continguts, la durada, les dates i els programes anunciats per a adaptar-los als requeriments de la formació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;6.2. Correspon a la cap del Departament de Formació i Selecció de l’EBAP, a proposta dels caps d’estudis corresponents, resoldre els dubtes, les confusions o les incidències que puguin sorgir sobre l’aplicació d’aquestes instruccions, o sobre els casos concrets que no s’hi prevegin o que sorgeixin de manera excepcional.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;6.3. Les persones que, amb el seu comportament i la seva actitud, impedeixin el desenvolupament normal de les activitats formatives, en poden ser excloses, amb l’informe justificatiu de la cap del Departament de Formació i Selecció de l’EBAP, a proposta dels caps d’estudis corresponents.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Punt 7. Llista d’espera&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;7.1. En totes les activitats formatives es poden establir places de reserva per a cobrir les baixes que hi hagi. La llista d’espera es publicarà a la pàgina web &amp;lt;&lt;/span&gt;http://ebap.caib.es&amp;gt; &lt;span style="color: rgb(35, 31, 32)"&gt;en el moment de la selecció. &lt;/span&gt;No es publicarà cap actualització de la llista d’espera, sinó que l’EBAP, permanentment, l’actualitzarà de manera interna.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;7.2. En qualsevol cas, correspon a l’EBAP confirmar i comunicar l’admissió a una activitat formativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Punt 8. Obligació d’assistència i comunicació de baixa&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;8.1. Amb la sol·licitud es contreu l’obligació d’assistir a l’activitat formativa. Si no s’hi pot assistir, s’ha de comunicar per escrit a l’EBAP i s’ha de justificar amb una antelació mínima de cinc dies hàbils abans de començar l’activitat. El fet de no comunicar una baixa pot ser causa d’exclusió, durant un any, per a altres activitats formatives que l’EBAP organitzi amb posterioritat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Això no obstant, l’assistència a un mínim del 50&lt;/span&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;°&lt;/span&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;% de l’activitat formativa no representa motiu de penalització.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;8.2. Les persones admeses tenen l’obligació d’assistir a la primera hora del primer dia de l’activitat formativa. En cas que no hi assisteixin sense haver-ho justificat prèviament a l’EBAP, la seva plaça podrà ser ocupada per persones assistents en la modalitat del «darrer minut», d’acord amb el que estableix la Resolució &lt;/span&gt;de la presidenta de l’EBAP d’11 de juliol de 2009&lt;span style="color: rgb(35, 31, 32)"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;8.3. Les persones en situació de llicència per maternitat o paternitat, excedència per maternitat o paternitat, o cura de familiars poden assistir a les activitats formatives de l’EBAP. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;8.4. Les persones en situació d’incapacitat temporal no poden assistir a cap activitat formativa de l’EBAP. La incapacitat temporal s’ha de comunicar per escrit a l’EBAP, per tal que, si escau, es pugui cobrir la plaça vacant amb una altra persona i per a evitar la penalització.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;8.5. Les absències superiors als límits fixats en el punt 10 (20&amp;nbsp;%), encara que estiguin justificades, suposen la pèrdua del dret a obtenir el certificat d’assistència i el certificat d’aprofitament que es regulen en el punt 10 d’aquestes instruccions. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Punt 9. Nombre de persones assistents&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;9.1. En general, les activitats formatives han de tenir entre quinze i trenta alumnes. Aquesta quantitat pot augmentar o disminuir en cas que la matèria o l’estructura de l’activitat formativa ho permetin.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;9.2. Es poden suspendre les activitats formatives que tenguin un nombre d’inscrits i admesos inferior al &lt;/span&gt;75&amp;nbsp;% &lt;span style="color: rgb(35, 31, 32)"&gt;de les places ofertes o menys de quinze persones inscrites.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Punt 10. Certificats d’aprofitament o d’assistència&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;10.1. Les activitats formatives objecte d’aquesta convocatòria donen lloc a obtenir el certificat d’assistència o d’aprofitament, segons correspongui.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;10.2. Certificat d’assistència&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;10.2.1. El certificat d’assistència es lliurarà als alumnes que hagin assistit, com a mínim, al 80&amp;nbsp;% de les hores lectives de l’activitat formativa. No es computaran les signatures dels assistents que corresponguin als dies en què la persona interessada hagi estat en situació d’incapacitat temporal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;10.2.2. L’única forma de demostrar l’assistència a una activitat formativa és mitjançant la signatura; per això, els alumnes s’han d’assegurar que han signat el full de control d’entrada i de sortida de cada una de les sessions de l’activitat formativa a què assisteixin.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;D’altra banda, la falsificació de la signatura suposa la pèrdua del dret a certificat i l’exclusió, durant un any, de les activitats formatives de l’EBAP. &lt;/span&gt;En qualsevol cas, la signatura ha de coincidir amb la del DNI i amb la de la sol·licitud d’inscripció. La penalització es farà extensible a la persona autora de la falsificació, independentment de totes les altres accions conforme a dret que es puguin dur a terme.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;10.3. Certificat d’aprofitament&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;10.3.1. Els alumnes que hagin assistit, com a mínim, al 80&amp;nbsp;% de les hores lectives i que hagin superat l’avaluació corresponent obtindran el certificat d’aprofitament; en cas de no superar l’avaluació, obtindran el certificat d’assistència. Els coneixements s’avaluaran mitjançant la superació de proves escrites o treballs, o mitjançant &lt;/span&gt;altres modalitats d’avaluació&lt;span style="color: rgb(35, 31, 32)"&gt; relacionades amb el contingut de les activitats formatives.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Punt 11. Llista de persones amb dret al certificat d’aprofitament o al certificat d’assistència. Enviament del certificat i reclamacions&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;11.1. En el termini d’un mes, comptador des de l’acabament del curs, l’EBAP publicarà a la pàgina web &amp;lt;&lt;/span&gt;http://ebap.caib.es&amp;gt;&lt;span style="color: rgb(35, 31, 32)"&gt; la llista de persones participants que tenen dret al certificat d’assistència o al certificat d’aprofitament.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;11.2. Si no se sol·licita expressament el contrari, l’EBAP utilitzarà la via del correu electrònic per a enviar als alumnes, amb la signatura digital, els certificats d’assistència i d’aprofitament.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;11.3. Es poden presentar reclamacions en el termini de trenta dies naturals, comptadors a partir de l’endemà d’haver estat publicada la llista de persones participants que tenen dret al certificat d’assistència o al certificat d’aprofitament. Una vegada finalitzat aquest termini de reclamacions, l’acta de l’activitat formativa serà definitiva i l’expedient quedarà tancat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
