&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. L’article 12 de la Llei 3/2007, de 27 de març, de la Funció Pública de la comunitat autònoma de les Illes Balears, estableix que correspon a l’Escola Balear d’Administració Pública (EBAP) la formació, la capacitació i el perfeccionament del personal al servei de l’administració autonòmica i de les entitats que en depenen, així com en els termes establerts en aquesta llei i en la normativa de desplegament, la realització d’activitats formatives al personal al servei de les altres administracions radicades a les Illes Balears.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. L’article 1 del Decret 191/1996, de 25 d’octubre, pel qual es regulen les condicions generals de les activitats formatives que organitza la Conselleria d’Interior (ara, Conselleria d’Administracions Públiques), indica que l’Institut Balear d’Administració Pública (ara, Escola Balear d’Administració Pública) és el principal instrument de la política formativa de l’Administració pública de les Illes Balears i elabora periòdicament diferents plans de formació que responen als principis d’eficàcia i de qualitat de les activitats formatives, amb la finalitat d’afavorir la participació del personal al servei de l’Administració.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. L’article 4 dels Estatuts de l’EBAP, aprovats pel &amp;nbsp;Decret 31/2012, de 13 d’abril, inclou entre &amp;nbsp;els objectius específics de l&amp;apos;EBAP:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La formació, la capacitació i el perfeccionament del personal al servei de la Comunitat Autònoma de les Illes Balears i, si escau, de la resta d&amp;apos;administracions públiques del seu àmbit territorial.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Ateses les&amp;nbsp; necessitats formatives&amp;nbsp; pròpies&amp;nbsp; del&amp;nbsp; professorat, l’EBAP ha considerat addient&amp;nbsp; dissenyar un pla específic de formació del personal docent.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. Altrament, l’article 11.2.e dels Estatuts inclou entre les competències del Consell de Direcció de l’EBAP&amp;nbsp; l’aprovació dels plans de formació.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;5. També s’ha de fer referència a l’Acord de Formació per a l’Ocupació de les Administracions Públiques de 22 de març de 2010 (IV Acord de Formació Contínua en les Administracions Públiques, de 21 de setembre de 2005), publicat en el BOIB&amp;nbsp; núm. 147, de 17 de juny de 2010, del qual forma part la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;6. L’objecte de la resolució és la convocatòria dels cursos &amp;nbsp;del Pla de Formació del&amp;nbsp; personal dels cossos &amp;nbsp;docents de la Comunitat Autònoma de les Illes Balears, &amp;nbsp;que ha programat l’EBAP per al segon trimestre de l’any 2013.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;7. Per dur a terme el pla de formació del personal docent el 5 d’abril de 2013 s’ha signat un Acord del col·laboració entre l’Escola Balear d’Administració Pública i la conselleria d’Educació, Cultura i Universitats en matèria d’accions formatives adreçades al personal docent al servei de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;8. El Consell de Direcció de l’EBAP ha aprovat, a la sessió de 10 d’abril de 2013,&amp;nbsp; &amp;nbsp;&amp;nbsp;el pla de formació del personal docent que ha programat per al &amp;nbsp;primer trimestre de l’any 2013 i les instruccions que han de regir les activitats formatives programades. &amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Aprovar la convocatòria del Pla de Formació del personal dels cossos docents &amp;nbsp;programat per l’Escola Balear d’Administració Pública per al segon trimestre de l’any 2013. S’adjunten com a annex 1 les instruccions que han de regir les activitats formatives programades i com a annex 2 l’oferta formativa del segon trimestre del Pla de Formació per a Docents&amp;nbsp; de l’any 2013&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Publicar aquesta Resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. Publicar l’oferta formativa amb indicació dels destinataris, el calendari, els llocs de realització dels cursos i, en general,&amp;nbsp; tota&amp;nbsp; la informació, dels cursos &amp;nbsp;del Pla de formació del personal dels cossos docentes programats per l’EBAP &amp;nbsp;per al segon trimestre de l’any 2013 en la pàgina web &amp;lt;http://ebap.caib.es&amp;gt;.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra aquesta Resolució —que exhaureix la via administrativa— es pot interposar un recurs potestatiu de reposició davant el president de l’Escola Balear d’Administració Pública en el termini d’un mes, &amp;nbsp;comptador des de l’endemà d’haver-se publicat la resolució al &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;, d’acord amb l’article 117 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment comú, i l’article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l’Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;També es pot interposar directament un recurs contenciós administratiu davant el Jutjat Contenciós de Palma en el termini de dos mesos comptadors des de l’endemà d’haver-se publicat en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt; la Resolució, d’acord amb l’article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Punt 1. Persones destinatàries&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;1.1. Les persones destinatàries de les activitats formatives del Pla de Formació per a Docents de l’Escola Balear d’Administració Pública (EBAP) són el personal empleat públic dels cossos docents de l’Administració de la Comunitat Autònoma de les Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;1.2. El personal esmentat en el punt anterior té dret a participar en les activitats formatives de l’EBAP en els termes i en les condicions que es determinen en aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Punt 2. Inscripció als cursos i presentació de documentació&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2.1. El personal docent de la Conselleria d’Educació, Cultura i Universitats ha de tramitar la sol·licitud directament a l’apartat de Formació de l’EBAP del Portal del Personal.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2.2. &lt;span style="color: rgb(35, 31, 32)"&gt;D’altra banda, &lt;/span&gt;&lt;strong&gt;han d’enviar la capçalera de la darrera nòmina o document acreditatiu de la situació activa al número de fax 971 17 76 19 o a l’adreça electrònica &amp;lt;formaciogeneral@ebap.caib.es&amp;gt;.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2.3. Si no es cobreixen totes les places d&amp;apos;un curs, es pot obrir un nou termini de presentació de sol·licituds. En aquest cas, les sol·licituds s&amp;apos;han de presentar també per mitjà del Portal del Personal&lt;span style="color: rgb(102, 102, 102)"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Punt 3. Termini de presentació de sol·licituds &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3.1. El termini d’inscripció als cursos corresponents al del Pla de Formació per a Docents per al segon trimestre del 2013 és de quinze dies naturals, a comptar des de l’endemà d’haver estat publicada aquesta Resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;. Les sol·licituds presentades fora de termini no es tindran en compte.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Punt 4. Material didàctic dels cursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;4.1. És d’aplicació a aquest Pla de Formació la Instrucció del gerent de l’Escola Balear d’Administració Pública (EBAP) de 2 de novembre de 2011 per la qual l’EBAP deixa de reproduir material didàctic en format de paper i en format de CD per als cursos que organitza. Llevat d’excepcions degudament justificades, el material didàctic dels cursos es publicarà en el repositori de material que hi ha a la pàgina web &amp;lt;&lt;/span&gt;http://ebap.caib.es&amp;gt;.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4.2. En cap cas, el material didàctic no s’enviarà per correu electrònic. Transcorregut un mes des de l’acabament del curs, el material didàctic s’eliminarà del repositori.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Punt 5. Requisits i condicions preferents&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;5.1. Quan el Pla de Formació estableixi persones destinatàries preferents per a participar en l’activitat formativa, l’EBAP comprovarà que les persones interessades compleixen les condicions preferents. En cas de no haver-hi aspirants suficients, l’EBAP podrà fer extensiva l’activitat formativa a aspirants que no compleixin les condicions preferents, però que &lt;/span&gt;tenguin un perfil que s’adigui amb el contingut del curs.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;5.2. Quan el Pla de Formació estableixi un requisit excloent per a participar en l’activitat formativa, no s’admetran les sol·licituds de les persones interessades que no el compleixin.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Punt 6. Selecció&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;6.1. Només s’admetran les sol·licituds que compleixin els requisits establerts en la convocatòria corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;6.2. Si el nombre de sol·licituds d’una determinada activitat supera el nombre de places previst, l’EBAP en farà la selecció corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Els criteris de prelació de la selecció són els següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;1r. Les persones destinatàries preferents, quan així ho estableixi l’activitat formativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;2n. Ser personal funcionari de carrera&lt;/span&gt;&lt;span style="color: red"&gt;. &lt;/span&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;En aquest punt s’ha de tenir en compte la situació en actiu.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;3r. &lt;/span&gt;En igualtat de condicions, tenen preferència les persones aspirants que hagin participat en menys activitats del Pla de Formació per a Docents&lt;span style="color: rgb(35, 31, 32)"&gt; convocades durant l’any en curs.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4t. La data de presentació de la sol·licitud.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;6.3. En cas d’igualtat de condicions en tots els apartats anteriors, les persones que acreditin, en el moment de la presentació de sol·licituds, que s’han incorporat durant l’any anterior al servei actiu després d’un permís de maternitat o paternitat o que han reingressat des de la situació d’excedència per raons de guarda legal i atenció a persones dependents o amb discapacitat, tindran preferència durant un any en la participació en activitats formatives. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;6.4. En el cas que no es cobreixin totes les places de l’activitat formativa, es farà la selecció per a cobrir les places vacants amb la resta de sol·licituds del personal amb penalització. En qualsevol cas, els criteris de prelació de la selecció són els que s’indiquen en el punt 6.2.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;6.5. Si hi ha activitats presencials que coincideixin parcialment o totalment en dates, les persones interessades només seran admeses en una.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Punt 7. Llistes de persones admeses&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;7.1. L’EBAP publicarà la llista de persones admeses a la pàgina web &amp;lt;&lt;/span&gt;http://ebap.caib.es&amp;gt;&lt;span style="color: rgb(35, 31, 32)"&gt; i també comunicarà individualment l’admissió mitjançant l’adreça electrònica facilitada a l’EBAP. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;7.2. En el cas que les persones sol·licitants hagin canviat d’adreça electrònica, n’han d’informar l’EBAP. També han d’informar l’EBAP si ja no és operativa l’adreça electrònica que facilitaren en un principi.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;7.3. L’admissió als cursos, sigui quin sigui l’horari d’impartició, no suposa cap autorització de l’EBAP per a deixar el lloc de treball, si coincideix amb l’horari laboral.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Punt 8. Anul·lació i modificació dels cursos, i resolució de casos especials&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;8.1. L’EBAP, per a desenvolupar millor les funcions que té encomanades, pot suprimir cursos; organitzar-ne de no programats amb anterioritat per necessitats puntuals que hagin sorgit; efectuar-ne diverses edicions sempre que les circumstàncies ho aconsellin així, i modificar-ne, si és pertinent, els continguts, la durada, les dates i els programes enunciats per a adaptar-los als requeriments de la formació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;8.2. Correspon a la cap del Departament de Formació i Selecció de l’EBAP, a proposta dels caps d’estudis corresponents, i una vegada consultat el Servei Jurídic de l’EBAP, resoldre els dubtes, les confusions o les incidències que puguin sorgir sobre l’aplicació d’aquestes instruccions, o sobre els casos concrets que no s’hi prevegin o que sorgeixin de manera excepcional.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;8.3. Els comportaments i les actituds dels participants en els cursos que impedeixin el seu desenvolupament normal podran donar lloc a l’exclusió dels cursos, o a la seva modificació o cancel·lació, amb l’informe justificatiu de la cap del Departament de Formació i Selecció de l’EBAP, a proposta dels caps d’estudis corresponents.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Punt 9. Llista d’espera&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;9.1. En totes les activitats formatives es poden establir places de reserva per a cobrir les baixes o les renúncies que hi hagi. La llista d’espera es publicarà a la pàgina web &amp;lt;&lt;/span&gt;http://ebap.caib.es&amp;gt; &lt;span style="color: rgb(35, 31, 32)"&gt;en el moment de la selecció. &lt;/span&gt;No es publicarà cap actualització de la llista d’espera, sinó que l’EBAP, permanentment, l’actualitzarà de manera interna.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;9.2. En qualsevol cas, correspon a l’EBAP la confirmació i la comunicació de l’admissió a un curs.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Punt 10. Obligació d’assistència i comunicació de baixa. Penalització&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;10.1. Amb &lt;/span&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;la sol·licitud es contreu l’obligació d’assistir&lt;/span&gt;&lt;/strong&gt;.&lt;span style="color: rgb(35, 31, 32)"&gt; Si no es pot assistir a un curs s’ha de comunicar per escrit a l’EBAP i s’ha de justificar, com a mínim, cinc dies hàbils abans de començar el curs. El fet de no comunicar una baixa pot ser causa d’exclusió, durant un any, per a altres cursos que l’EBAP organitzi amb posterioritat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Això no obstant, l’assistència a un mínim del 50&amp;nbsp;% de l’activitat formativa no representa motiu de penalització.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;10.2. &lt;span style="color: rgb(35, 31, 32)"&gt;Les absències superiors als límits fixats en el punt 12.2.1 (20&amp;nbsp;%), encara que estiguin justificades, suposen la pèrdua del dret a obtenir el certificat d’assistència i el certificat d’aprofitament que es regulen en el punt 12 d’aquestes instruccions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;10.3. Les persones amb situació d’incapacitat temporal —excepte les que estan en situació de llicència per maternitat o paternitat, excedència per maternitat o paternitat o, cura de familiars— no poden &lt;/span&gt;assistir &lt;span style="color: rgb(35, 31, 32)"&gt;a cap de les activitats formatives que hi ha en l’annex 2 d’aquesta Resolució. Aquesta circumstància s’ha de comunicar per escrit, perquè, si escau, es pugui cobrir la plaça vacant amb una altra persona i per a evitar la penalització.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Punt 11. Nombre de persones assistents i horari dels cursos presencials&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;11.1. En general, els cursos presencials han de tenir entre quinze i trenta alumnes. Aquesta quantitat pot augmentar o disminuir només en el cas que la matèria del curs i/o l’estructura de l’activitat formativa ho permetin.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;11.2. Es poden suspendre els cursos que tenguin un nombre d’inscrits i no exclosos inferior al &lt;/span&gt;75&amp;nbsp;% &lt;span style="color: rgb(35, 31, 32)"&gt;de les places ofertes o menys de 15 persones inscrites i no excloses, a Mallorca; o inferior al 70&amp;nbsp;% o menys de 10 persones inscrites i no excloses, a Menorca i a Eivissa; o inferior al 70&amp;nbsp;% o menys de 7 persones inscrites i no excloses, a Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Punt 12. Certificats d’assistència o d’aprofitament&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;12.1. Les activitats objecte d’aquesta convocatòria donen lloc a obtenir el certificat d’assistència o d’aprofitament, segons correspongui.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;12.2. Certificat d’assistència&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;12.2.1. El certificat d’assistència es lliurarà als alumnes que acreditin una assistència, com a mínim, del 80&amp;nbsp;% de les hores lectives del curs. No es computaran les signatures dels assistents que corresponguin als dies en què la persona interessada hagi estat en la condició d’incapacitat temporal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;12.2.2. L’única forma de demostrar l’assistència a un curs és mitjançant la signatura; per això, els alumnes s’han d’assegurar que han signat el full de control d’entrada i de sortida de cada una de les sessions del curs a què assisteixin.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;D’altra banda, la falsificació de la signatura suposa la pèrdua del dret a certificat i l’exclusió dels cursos de l’EBAP durant un any. &lt;/span&gt;En qualsevol cas, la signatura ha de coincidir amb la del DNI o amb la de la sol·licitud d’inscripció. La penalització es farà extensible a la persona autora de la falsificació, independentment de totes les altres accions conforme a dret que es puguin dur a terme.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;12.3. Certificat d’aprofitament&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;12.3.1. Els alumnes que hagin assistit, com a mínim, al 80&amp;nbsp;% de les hores lectives, i que hagin superat les avaluacions corresponents, obtindran el certificat d’aprofitament; en cas de no superar l’avaluació, obtindran el certificat d’assistència. Els coneixements s’avaluaran mitjançant la superació de proves escrites i/o treballs, o mitjançant &lt;/span&gt;altres modalitats d’avaluació&lt;span style="color: rgb(35, 31, 32)"&gt; relacionades amb el contingut de l’activitat formativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;Punt 13. Llista de persones amb dret al certificat d’aprofitament o al certificat d’assistència. Sol·licitud de certificat i reclamacions&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;13.1. En el termini d’un mes, comptador des de l’acabament del curs, l’EBAP publicarà a la pàgina web &amp;lt;&lt;/span&gt;http://ebap.caib.es&amp;gt;&lt;span style="color: rgb(35, 31, 32)"&gt; la llista de persones participants que tenen dret al certificat d’assistència o al certificat d’aprofitament.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(35, 31, 32)"&gt;13.2. Es poden presentar reclamacions en el termini de trenta dies naturals, comptadors a partir de l’endemà d’haver estat publicada a la pàgina web de l’EBAP la llista de persones participants que tenen dret al certificat d’assistència o al certificat d’aprofitament. Una vegada finalitzat aquest termini i resoltes les reclamacions, l’acta del curs serà definitiva.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;13.3. Si no se sol·licita expressament el contrari, l’EBAP utilitzarà la via del correu electrònic per a enviar, amb la signatura digital, els certificats d’assistència i d’aprofitament.&lt;/span&gt;&lt;/p&gt;
