&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;No havent estat possible la notificació personal a la persona interessada en el domicili indicat a l’expedient i d’acord amb l’establert a l’article 59.5 de la Llei 30/1992, de 26 de novembre, de Règim Jurídic de les Administracions Públiques i de Procediment Administratiu Comú, és procedeix a la publicació del present anunci.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;PRIMER.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;En data 24 de septembre de 2012 els agents de la Policia Local de Formentera nº F010005 i F010026, varen procedir a la denúncia d’actes d’edificació sense llicència a &lt;/span&gt;&lt;/span&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="color: rgb(42, 42, 42)"&gt; 
   &lt;span class='lopd'&gt;(dades personals ocultes)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;. Els actes consisteixen en la &lt;strong&gt;“Instal·lació d’una caseta de jardí sense LMO”.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;SEGON.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;En data 25 de setembre de 2012, mitjançant Decret de Presidència es van iniciar les corresponents accions de restabliment contra el &lt;/span&gt;&lt;/span&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="color: rgb(42, 42, 42)"&gt; 
   &lt;span class='lopd'&gt;(dades personals ocultes)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;com a promotor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;TERCER.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;- En el mateix decret, notificat a l’interessat el 2 d’octubre de 2012, es va acordar:&lt;strong&gt; REQUERIR&lt;/strong&gt; al promotor per tal que en un termini de dos mesos sol·liciti la corresponent llicència.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;QUART.- &lt;/strong&gt;L’instructor va sol·licitar informe, en data 21 de febrer de 2013 als serveis tècnics del Departament d’Urbanisme. L’esmentat informe va ser emès i incorporat a l’expedient en data 6 de març de 2013 i es transcriu a continuació&lt;span style="color: rgb(42, 42, 42)"&gt;:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;INFORME SS.TT.EXP. 35/2012 &lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;RESTABLECIMIENTO LEGALIDAD URBANÍSTICA&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;De acuerdo con el oficio interno de fecha 21/02/2013, el instructor del Exp. 35/2012 de Restablecimiento de la legalidad urbanística solicita a los SS.TT. del Área de Urbanismo, la emisión de un informe referente a la instalación de una caseta prefabricada ubicada en &lt;/em&gt;&lt;/span&gt;&lt;span style="font-size: 12px"&gt;&lt;em&gt;&lt;span style="font-family: times new roman"&gt; 
    &lt;span class='lopd'&gt;(dades personals ocultes)&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt; de Formentera. Este deberá contener:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Descripción de las obras realizadas sin licencia y carácter legalizable de las mismas.&lt;/em&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Valoración de las obras realizadas sin licencia.&lt;/em&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Detalle de lo que ha de ser objeto de demolición o retirada.&lt;/em&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Plazo previsto para llevara cabo el restablecimiento de la legalidad urbanística.&lt;/em&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Pronunciamiento en relación a la intervención preceptiva de técnico competente.&lt;/em&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;u&gt;Situación y datos catastrales de la finca:&lt;/u&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;(Fotografia 1)&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;De la consulta realizada en la web de la Oficina Virtual del Catastro se ha obtenido la siguiente documentación:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Referencia catastral &lt;/em&gt; &lt;/span&gt;&lt;span style="font-size: 12px"&gt; 
   &lt;span class='lopd'&gt;(dades personals ocultes)&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;u&gt;Descripción de las obras realizadas sin licencia:&lt;/u&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;De acuerdo con el boletín de denuncia de la Policia Local de fecha 24/09/2012, el hecho denunciado es la instalación de una caseta prefabricada de unos 9 m2 (3x3m) sobre la finca.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;u&gt;Carácter legalizable del acto edificatorio o de uso del suelo:&lt;/u&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Los SS.TT. informan que la colocación del elemento prefabricado denunciado, de acuerdo con la normativa de aplicación resulta prohibido (D.A.6ª Ley 6/1997, de 8 de julio, del suelo rústico de las Islas Baleares y art. 62.2 Revisión NNSS Formentera 2010), por tanto las obras denunciadas no serían legalizables.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;u&gt;Valoración de las obras denunciadas realizadas sin licencia:&lt;/u&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Caseta prefabricada: 600 € (PEM)&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;u&gt;Detalle de lo que tiene que ser objeto de demolición o retirada:&lt;/u&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Se deberá proceder a la retirada del elemento prefabricado.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;u&gt;Plazo prudencial para desinstalación y/o retirada de la obra:&lt;/u&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Se propone un plazo para la desinstalación y/o retirada del elemento denunciado de 1 semana.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;u&gt;Intervención preceptiva o no de facultativo competente:&lt;/u&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Debido a la escasa entidad constructiva del elemento instalado, el técnico que suscribe considera que no resulta necesaria la intervención de un técnico facultativo competente para la desinstalación y/o retirada.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;El presente informe se ha redactado según mi saber y entender y sin perjuicio del mejor criterio a que se someta.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;El presente informe será adjuntado al resto de informes (técnicos y jurídicos) del expediente a fin de dar cumplimiento al articulo 7.6 de la ley 10/1990 de Disciplina Urbanística.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;(...)&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;CINQUÈ.-&lt;/strong&gt;&amp;nbsp; Transcorregut el termini concedit, no s’ha procedit, per part de l’interessat, a la sol·licitud de la corresponent licència. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Als fets esmentats, són d’aplicació els següents&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;FONAMENTS DE DRET&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;I.- DE RESTABLIMENT DE LA LEGALITAT.- &amp;nbsp;&lt;/strong&gt;Estableix l’artcle 66 de la Llei 10/1990, que transcorregut el termini de dos mesos des del requeriment de legalització, “si l’interessat no hagués instat l’esmentada llicència, l’instructor formularà proposta de demolició o de reconstrucció de les obres a costa de l’interessat, i proposarà el que procedeixi per impedir definitivament els usos que se li havien volgut donar. Es procedirà d’igual manera si la licència fos denegada per ser l’atorgament contrari a les prescripcions de la normativa urbanística o a les ordenanças”.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;II.- RESPONSABLES. - &lt;/strong&gt;En aplicació d’allò disposat a l’ Art. 30 de la Llei 10/1990, és responsable de la infracció el &lt;/span&gt; 
 &lt;span class='lopd'&gt;(dades personals ocultes)&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;, en la seva condició de promotor y/o propietario.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Per tot l’anterior,&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;ES PROPOSA,&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;- ORDENAR &lt;/span&gt;&lt;/strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;LA DEMOLICIÓ&lt;/span&gt;&lt;span style="color: rgb(42, 42, 42)"&gt; Y&lt;/span&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;/O DESINSTAL·LACIÓ DELS ACTES D’EDIFICACIÓ denunciats per la Policia Local: “&lt;strong&gt;Instal·lació d’una caseta de jardí sense LMO&lt;/strong&gt;” a &lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(42, 42, 42)"&gt; 
  &lt;span class='lopd'&gt;(dades personals ocultes)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;- NOTIFICAR &lt;/span&gt;&lt;/strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;la present proposta als interessats.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra la Proposta de resolució, no cap interposar cap recurs administratiu, donat que és un tràmit que no determina la impossibilitat de continuar el Procediment, ni produeix indefensió o perjudici irreparable a drets o interessos legítims.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El que és comunica a l&amp;apos;interessat, concedint-li un temini de QUINZE DIES, per formular al·legacions i presentar els documents i informacions que consideri oportuns davant l&amp;apos;Instructor del procediment.&lt;/span&gt;&lt;/p&gt;
