    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Un cop realitzades, sense efecte les notificacions per correu certificat amb justificat de recepció i atès que no s’han efectual per ignorar-se el domicili o no haver-s’hi trobat les persones interessades que s’hi relacionen es procedeix, en compliment del que estableix l’article 59.5 de la Llei 30/1992 de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú, a la publicació en el Butlletí Oficial de les Illes Balears del següent: &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;“DECRET 436/2013.. Vist els expedients de vehicles abandonats que es relacionen a continuació per haver-se retirat de la via pública i haver estat durant més de dos mesos al dipòsit municipal de vehicles sense que la persona titular hagi realitzat cap gestió per a la retirada o hagi formulat al·legacions&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;I un cop s’ha intentat notificar al titular dels mateixos. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Atès que segons l’article 50.2.a) de l’Ordenança Municipal de Gestió de Residus urbans i Neteja Pública en relació amb l’article 86 del RDL 339/1990 una de les causes possibles a fi d’iniciar expedient de tractament residual és haver estat dos mesos al dipòsit municipal. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;RESOLC:&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;1.- &lt;/strong&gt;Requerir a les persones titulars dels vehicles, amb anterioritat a l’orde de trasllat al Centre autoritzat de tractament de vehicles, a fi de que procedeixin a la retirada del vehicle en el &lt;strong&gt;&lt;u&gt;termini d’un mes&lt;/u&gt;&lt;/strong&gt;, d’acord l’article 86.1 del RD legislatiu 339/1990 de 2 de març pel que s’aprova el Text articulat de la llei sobre tràfic, circulació de vehicles a motor i seguretat vial, previ pagament de les despeses generades per la grua municipal com per la custòdia del vehicle tal i com s’estableix a l’article 85.2 del RDL 339/1990 i a l’article 107 de l’Ordenança de Policia i Bon Govern. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Si en aquest termini no es retira el vehicle en qüestió, es procedirà al tractament del vehicle com a residu domèstic amb les següents conseqüències: trasllat a un centre autoritzat de tractament per la seva posterior destrucció i descontaminació &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Sense perjudici de la incoació de l’oportú expedient sancionador en base a l’article 46.3.c de la Llei 22/2011 de 28 de juliol, de residus i sols contaminats, amb multa de 901 fins a 45.000 euros. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;2.-&lt;/strong&gt; Avisar a les persones titulars dels vehicles que en aquest termini poden presentar declaració de renúncia voluntària del vehicle a favor de l’Ajuntament, previ pagament&amp;nbsp; de les despeses ocasionades, i en aquest cas no s’incoarà el corresponent expedient sancionador.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;3.-&lt;/strong&gt; Publicar aquest Decret al BOIB.”&lt;/span&gt;&lt;/p&gt;
