    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La Comissió de Govern del Consell Insular de Formentera, en sessió de 22 de febrer de 2013, va aprovar les bases que seguidament es transcriuen&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;BASES QUE HAN DE REGIR LA CONCESSIÓ DELS AJUTS PER DESPLAÇAMENT A ESTUDIANTS/TES QUE CURSIN ESTUDIS UNIVERSITARIS, CICLES FORMATIUS O D’EDUCACIÓ POSTOBLIGATÒRIA REGLADA O ENSENYAMENTS ARTÍSTICS FORA DE L’ILLA DE FORMENTERA AL CURS 2012–2013&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El Consell Insular de Formentera té la voluntat d’iniciar una política d’ajudes econòmiques per als estudiants i estudiantes que cursin estudis fora d’aquesta illa, conscient que s’han d’establir mesures per compensar el fet de la insularitat en matèria educativa i, així, corregir les desigualtats o els desequilibris entre els estudiants i estudiantes de l’illa de Formentera i els de la resta de la Comunitat i l’estat espanyol, té la voluntat de compensar el cost econòmic que suposa el desplaçament dels i estudiants i estudiantes de Formentera, tenint en compte que a la nostra illa encara no hi ha una oferta formativa àmplia a l’abast de totes inquietuds estudiantils i que, a més, aquest fet insular comporta un major cost per a les persones que han de viure fora del seu lloc habitual de residència i efectuar-hi els desplaçaments periòdicament durant el curs acadèmic.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;1.- Objecte de la convocatòria&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;L’objecte d’aquesta convocatòria és compensar part del cost del desplaçament, de l’alumnat de l’Illa de Formentera per al curs acadèmic 2012–2013 que es desplaci i resideixi fora del seu domicili familiar per realitzar estudis universitaris, cicles formatius, educació postobligatòria reglada o ensenyaments artístics que no s&amp;apos;imparteixin a Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;2.- Import i crèdit pressupostari&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;L’import que es destina a a&lt;/span&gt;questa convocatòria és de trenta mil euros, a càrrec de la partida pressupostaria 334.48000 dels pressupostos corresponents a l’exercici 2013.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La quantia individual de l’ajuda per desplaçament serà de:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-&lt;/span&gt; Cent cinquanta euros (150 euros),&lt;span style="color: black"&gt; per als estudiants i estudiantes que cursin els seus estudis a Eivissa, sempre que el disponible en la partida pressupostària prevista a l’efecte ho permeti. En cas contrari, l’import mínim s’obtendrà fent un prorrateig a parts iguals, en funció del nombre de sol·licitants.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-&lt;/span&gt; Quatre-cents cinquanta euros (450 euros), per&lt;span style="color: black"&gt; als estudiants i estudiantes que cursin els seus estudis fora de les Illes Pitiüses, sempre que el disponible en la partida pressupostària prevista a l’efecte ho permeti. En cas contrari, l’import mínim s’obtendrà fent un prorrateig a parts iguals, en funció del nombre de sol·licitants.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;3.- Persones beneficiàries&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Poden beneficiar-se de les ajudes previstes en aquesta convocatòria, per al curs acadèmic 2012–2013 les persones que es trobin en alguna de les circumstàncies següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1. Aquell alumnat amb domicili familiar a l’illa de Formentera que cursi estudis universitaris a centres propis d’universitats públiques o privades o a centres adscrits a elles.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2. Aquell alumnat amb domicili familiar a l’illa de Formentera que cursi Cicles Formatius o Educació postobligatòria reglada fora de l’illa sempre que aquests no es puguin fer a Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3. Aquell alumnat amb domicili familiar a l’illa de Formentera que cursin ensenyaments artístics: estudis de música, dansa, art dramàtic i estudis superiors d’arts plàstiques i de disseny.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;No podran obtenir la condició de persona beneficiària les persones en les quals concorrin alguna de les circumstàncies previstes &lt;/span&gt;a l’article 10 del Decret legislatiu 2/2005, de 28 de desembre, text refòs de la llei de subvencions de les Illes Balears, i a l’article 13.2) de la Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;4.- Requisits i documentació a presentar&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Els estudiants que hi estiguin interessats han de sol·licitar l’ajuda mitjançant la presentació en el Registre General d’Entrada del Consell Insular de Formentera, oficina de l’oficina d’Atenció al Ciutadà (O.A.C)., de tota la documentació següent:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a) Imprès de sol·licitud específic per a aquesta convocatòria degudament emplenat. Aquest imprès es trobarà al Consell Insular de Formentera o a la pàgina web &lt;/span&gt;www.consellinsulardeformentera.cat&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b) Imprès de sol·licitud de transferència bancària del qual l’alumne o l’alumna és titular o cotitular. (Annex IV)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c) Fotocòpia del DNI. En el cas d’alumnat estranger: fotocòpia del passaport juntament amb el NIE, o targeta de residència. En cas que al DNI no figuri com a localitat del domicili el municipi de Formentera, certificat de convivència que acrediti el veïnatge administratiu de la persona sol·licitant i el nombre de persones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;d) Imprès de matriculació del curs 2012–2013 on consti el nombre de crèdits matriculats i el nombre d’assignatures.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;e) Les persones que vulguin acollir-se a aquesta convocatòria d’ajuts hauran de justificar que tenen com a mínim un any d’antiguitat de residència, bé amb la presentació del document nacional d’identitat, sempre que tengui una data d’expedició superior a l’any, o bé mitjançant un certificat d’empadronament.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;f) És requisit indispensable per ser persona beneficiària haver aprovat, com a mínim, un 50 % dels crèdits mínims exigits de l’últim curs realitzat. En aquest sentit, les persones sol·licitants hauran d’aportar un document acreditatiu de les notes obtengudes corresponents al curs anterior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;g) Pla d’estudis, programació completa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;h) Així mateix, s’haurà de justificar que per al curs 2012–2013 la persona sol·licitant s’ha matriculat, com a mínim, del 50 % del total de crèdits previstos per al curs.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;i) Model de declaració responsable (Annex II)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En cas d’haver-se matriculat d’un nombre inferior al 50% del total de crèdits previstos per al curs, s’ha d’aportar l’acreditació (original o còpia compulsada) del centre universitari que justifiqui que s’ha formalitzat la matrícula pel nombre màxim de crèdits possible d’acord amb l’organització administrativa del centre o de l’expedient acadèmic.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Així mateix, es podrà emprar qualsevol dels mitjans previstos a l’art. 38.4 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú (LRJPAC).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;5.- Requeriments de la sol·licitud&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Dins el termini de 30 dies, comptadors des de l’acabament del termini de presentació de sol·licituds el Consell donarà a conèixer, mitjançant la publicació al tauler d’anuncis del Consell, una llista on es requeriran les persones interessades perquè en el termini de 10 dies, si la sol·licitud i/o la documentació té cap defecte, l’esmenin d’acord amb el que disposa l’art. 71.1 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú (LRJPAC), i se’ls advertirà que, en el cas que no ho facin, es considerarà desestimada la petició.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;També es farà publicitat d’aquests requeriments a la pàgina web&lt;/span&gt; www.consellinsulardeformentera.cat&lt;span style="color: black"&gt;, del Consell Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;6.- Termini de presentació de sol·licituds&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El termini de presentació de sol·licituds s’inicia l’endemà de la publicació d’aquesta convocatòria al BOIB, fins al&lt;/span&gt; 30 d’abril de 2013.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;7.- Casos especials&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Les sol·licituds de casos especials o excepcionals no previstos en aquestes bases seran objecte de resolució puntual per de la Comissió de Govern, amb informe previ dels serveis jurídics &lt;/span&gt;d’aquest Consell Insular de Formentera (CIF).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;8.- Instrucció resolució i publicitat&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Una vegada realitzats els actes d’instrucció que resultin escaients, es redactaran les corresponents propostes de concessió de les ajudes de desplaçament que s’elevaran a la Comissió de Govern, com a òrgan competent per a la concessió. A les propostes s’expressarà el nom de les persones beneficiàries per a les quals es proposa la subvenció i la quantia, així com de les sol·licituds excloses, amb indicació de la causa d’exclusió.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Les ajudes per desplaçament es faran públiques en el tauler d’anuncis d’aquesta corporació, a l’efecte previst a l’art. 59,6b de la Llei 30/92, de 26 de novembre, i de conformitat amb l’art. 34, 2c del Decret legislatiu 2/2005, de 28 de desembre, pel qual s’aprova el text refós de la Llei de subvencions. També es farà publicitat de les ajudes per desplaçament a la pàgina web &lt;/span&gt;www.consellinsulardeformentera.cat.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;9.- Recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La resolució de concessió de les ajudes exhaureix la via administrativa i davant de la mateixa es pot interpossar, o bé, recurs potestatiu de reposició davant el mateix òrgan que l’ha dictada, és a dir, davant la Comissió de Govern del Consell Insular de Formentera, en el termini d’un mes des de la notificació, o bé, recurs contenciós-administratiu davant els jutjats de lo contenciós-administratiu de Palma de Mallorca, en el termini de dos messos des de la notificació.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;10.- Pagament&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Les ajudes que atorgui &lt;span style="color: black"&gt;el Consell Insular es faran efectives mitjançant transferència bancària.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;11.- Compatibilitat&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Aquestes ajudes seran compatibles amb altres que es puguin rebre d’altres administracions o entitats, públiques o privades, però no pel mateix concepte.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;12.- Verificació i control&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Les persones beneficiàries de les ajudes quedaran en general sotmeses al règim d’obligacions, intervencions i sancions que &lt;/span&gt;estableixen el Decret legislatiu 2/2005, de 28 de desembre, text refòs de la llei de subvencios de les Illes Balears&lt;span style="color: black"&gt;, la Llei estatal 38/2003, de 17 de novembre, general de subvencions, el Reial Decret 887/2006, de 21 de juliol, pel qual s’aprova el reglament de la Llei 38/2003, i altra normativa que hi sigui d’aplicació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;13.- Obligacions&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Són obligacions de les persones beneficiàries:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1. Sotmetre’s a les actuacions de comprovació de l’entitat que concedeix l’ajut i les de control financer.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2. Acreditar la realització de l’activitat al Consell Insular així com el compliment dels requisits i les condicions que determinin la concessió de l’ajuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3. Qualsevol alteració de les condicions tengudes en compte per concedir l’ajuda podrà donar lloc a la modificació de la resolució de la concessió. L’import de l’ajut atorgat pel Consell en cap cas no podrà ser de tal quantia que, aïlladament o en concurrència amb altres subvencions o ajudes procedents de qualsevol administració o ens públic o privat, superi el cost de l’activitat a realitzar per la persona beneficiària.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;14.- Reintegrament de les ajudes concedides&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;L’incompliment d’aquestes obligacions per part de les persones beneficiàries, o l’alteració substancial de les condicions determinants de l’atorgament de l’ajuda o la concurrència de les causes de reintegrament previstes &lt;/span&gt;a l’article 11 del Decret Legislatiu 2/2005, de 28 de desembre, i a l’article 37 de la llei 38/2003, podrà donar lloc al reintegrament de la subvenció.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;15.- Publicació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Aquestes bases es publicaran al BOIB i entraran en vigor l’endemà de la publicació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
