CAIB CAIB ![CDATA[<p> <span style="font-family: times new roman, times, serif; font-size: 12px">L’apartat 8.3 de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) d’11 de maig de 2012 per la qual es convoquen subvencions per a les inversions no productives, corresponents a l’any 2012, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació en el Butlletí Oficial de les Illes Balears d’acord amb els termes que preveu l’article 60.2 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú.</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), en compliment del que disposa l’article 59 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú.</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">L’import de l’ajuda concedida s’abonarà als beneficiaris mitjançant transferència bancària, una vegada justificat el compliment de la finalitat i de l’aplicació de la subvenció, i amb l’autorització prèvia del director gerent del FOGAIBA.</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">El vicepresident del FOGAIBA, en data de 28 de desembre de 2012, dicta la següent:</span></p> <p style="text-align: left"> <span style="font-family: times new roman, times, serif; font-size: 12px"><strong>RESOLUCIÓ DE CONCESSIÓ</strong></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><strong>Programa Regional de Desenvolupament Rural Sostenible 2007-2013</strong></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><strong>Mesura 2.1.6 – Inversions no productives</strong></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><strong>ANTECEDENTS</strong></span></p> <ol> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">En data de 17 de maig de 2012 es va publicar, en el BOIB núm. 70, la Resolució del president del FOGAIBA d’11 de maig de 2012 per la qual es convoquen subvencions per a les inversions no productives, corresponents a l’any 2012.</span></li> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">De conformitat amb l’apartat sisè de l’esmentada Resolució, el termini de presentació de sol·licituds era des del dia 18 de maig de 2012 fins al dia 15 de juny de 2012.</span></li> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">Les persones interessades que assenyala l’<strong>Annex II</strong> han presentat dins el termini establert i en la forma escaient tota la documentació necessària prevista en la convocatòria, i s’ha comprovat que compleixen els requisits exigits a l’apartat tercer de l’esmentada Resolució per poder ser beneficiaris d’aquesta ajuda; així com també s’ha comprovat el compliment dels requisits exigits a les explotacions.</span></li> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">Així mateix, les actuacions sol·licitades pels interessats compleixen amb els requisits exigits a l’apartat quart de l’esmentada Resolució per tal de poder ser subvencionables.</span></li> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">Atès l’apartat cinquè de l’esmentada Resolució, l’ajuda màxima és del 50% de l’import de la inversió auxiliable aprovada amb els límits següents:</span></li> </ol> <ul> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">15.000,00 euros per beneficiari, en el supòsit que la inversió es justifiqui per factures.</span></li> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">6.000,00 euros per beneficiari, en el supòsit que la inversió es justifiqui mitjançant el sistema de mòduls d’inversió.</span></li> </ul> <ol> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">L’<strong>Annex I </strong>indica el número d’expedient, la identificació nominal del beneficiari, el NIF, l’import elegible, i l’ajuda concedida amb el corresponent cofinançament.</span></li> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">Les inversions elegibles corresponen als tipus (marge/paret), mètode de justificació (mòduls/factures), medicions, i ubicacions exactes detallades a les sol·licituds presentades i comprovades a les visites prèvies.</span></li> </ol> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><strong>FONAMENTS DE DRET</strong></span></p> <ol> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">Reglament (CE) núm. 1698/2005 del Consell, de 20 de setembre de 2005, relatiu a l’ajuda al desenvolupament rural a través del Fons Europeu Agrícola de Desenvolupament Rural.</span></li> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">Reglament (CE) núm. 1974/2006 de la Comissió, de 15 de desembre de 2006, pel qual s’estableixen disposicions d’aplicació del Reglament (CE) núm. 1698/2005.</span></li> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">Reglament (CE) núm. 65/2011 de la Comissió, de 30 de gener de 2011, pel qual s’estableixen disposicions d’aplicació del Reglament (CE)&nbsp; núm. 1698/2005.</span></li> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">Reial decret 1852/2009, de 4 de desembre, pel qual s’estableixen els criteris per subvencionar les despeses en el marc dels Programes de Desenvolupament Rural, cofinançats pel Fons Europeu Agrícola de Desenvolupament Rural (FEADER).</span></li> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">Text refós de la Llei de Subvencions (Decret legislatiu 2/2005, de 28 de desembre).</span></li> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">Ordre de la consellera d’Agricultura i Pesca, de 18 de desembre de 2007, per la qual s’estableixen les bases reguladores de la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears, amb la seva posterior correcció publicada en el BOIB núm. 13, de dia 26 de gener de 2008, i modificada mitjançant Ordre de 5 de juny de 2009, publicada en el BOIB núm. 86, de dia 11 de juny de 2009.</span></li> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">Decret 64/2005, de 10 de juny, de creació del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA).</span></li> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">&nbsp;Decret 65/2007, de 25 de maig, de constitució, organització i funcionament de l’Organisme Pagador de les despeses del Fons Europeu Agrícola de Garantia (FEAGA) i del Fons Europeu Agrícola de Desenvolupament Rural (FEADER) a la comunitat autònoma de les Illes Balears.</span></li> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">&nbsp;Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) d’11 de maig de 2012 per la qual es convoquen subvencions per a les inversions no productives, corresponents a l’any 2012.</span></li> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">&nbsp;Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 15 de juny de 2012 de correcció d’errades de la Resolució del president del FOGAIBA, d’11 de maig de 2012, per la qual es convoquen subvencions per a les inversions no productives, corresponents a l’any 2012, i d’increment del crèdit destinat en aquesta convocatòria.</span></li> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">&nbsp;Decret 12/2011, de 18 de juny, del President de les Illes Balears.</span></li> </ol> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">Atesa la proposta del cap de l’Àrea de Gestió d’Ajudes del FOGAIBA de dia 22 de novembre de 2012;</span></p> <p style="text-align: center"> <span style="font-family: times new roman, times, serif; font-size: 12px"><strong>RESOLC</strong></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><strong>PRIMER</strong>.- Concedir una subvenció a favor de cada un dels beneficiaris detallats a l’<strong>Annex I</strong>, adjunt, en el marc de la Resolució del president del FOGAIBA d’11 de maig de 2012 per la qual es convoquen subvencions per a les inversions no productives, corresponents a l’any 2012.</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><strong>SEGON</strong>.- Autoritzar i disposar la despesa assenyalada a cada un dels &nbsp;beneficiaris detallats a l’<strong>Annex I</strong>, són 2 expedients i comença amb </span><span style="font-family: legacysanitcboo, sans-serif"><span style="font-size: 12pt"> <span class='lopd'>(dades personals ocultes)</span></span></span><span style="font-family: times new roman, times, serif; font-size: 12px">amb un import total de&nbsp; TRETZE MIL TRES CENTS QUARANTA SIS AMB TRENTA VUIT&nbsp; CÈNTIMS (<strong>13.346,38</strong> €), amb càrrec als pressuposts del FOGAIBA per a l’exercici 2012, que suposa un 50% de l’import total de la inversió elegible <strong>26.692,75</strong> <strong>euros</strong>, que serà cofinançat en un 35% a càrrec del FEADER, en un 37% a càrrec del MAGRAMA i en un 28% a càrrec de la CAIB, i anirà distribuït&nbsp; de la manera següent:</span></p> <ul> <li> <span style="font-family: times new roman, times, serif; font-size: 12px"><strong>4.671,24</strong> euros amb càrrec a la línia FEADER núm. 050405012161004</span></li> <li> <span style="font-family: times new roman, times, serif; font-size: 12px"><strong>8.675,14</strong> euros, dels quals corresponen <strong>4.938,17 </strong>euros al MAGRAMA i <strong>3.736,97 </strong>euros a la CAIB.</span></li> </ul> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><strong>TERCER</strong>.- Determinar, d’acord amb l’establert en els apartats 4, 9 i 10 de la Resolució del president del FOGAIBA d’11 de maig de 2012, dalt esmentada, que seran obligacions dels beneficiaris:</span></p> <ul> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">Realitzar i notificar les inversions auxiliades (que corresponen als tipus: marge/paret i mètode de justificació, medicions, i ubicacions exactes detallades a les sol·licituds presentades i comprovades a les visites prèvies) així com sol·licitar el seu pagament, dins el termini establert de <strong>6 MESOS</strong>, a comptar des del dia següent de la data de notificació/publicació d’aquesta resolució.</span></li> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">Justificar les despeses relacionades amb la inversió per a la recepció dels fons comunitaris en la forma i els terminis determinats en la Resolució del president del FOGAIBA d’11 de maig de 2012.</span></li> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">Mantenir la inversió objecte de l’ajuda i la seva destinació durant almenys cinc anys comptats a partir de la data de la possible resolució de concessió de l’ajuda; així com mantenir els requisits i les condicions exigibles respecte a l’explotació i el beneficiari, durant l’esmentat període.</span></li> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">Continuar amb l’activitat agrària a l’explotació on es realitzi la inversió sol·licitada durant almenys els cinc anys següents a la data de la possible resolució de concessió de l’ajuda.</span></li> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">Sotmetre’s a les actuacions de comprovació i control indicades per part de les administracions autonòmiques, estatal o comunitària, Intervenció General, Sindicatura de Comptes o altres òrgans de control intern o extern, així com facilitar tota la informació que requereixin aquests organismes en relació a les ajudes concedides.</span></li> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">Les restants que siguin d’aplicació segons la normativa d’alt esmentada.</span></li> </ul> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><strong>QUART</strong>.- Notificar a les persones interessades aquesta resolució mitjançant la seva publicació en el Butlletí Oficial de les Illes Balears d’acord als termes que preveu l’article 60.2 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú.</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><strong>CINQUÈ</strong>.- Notificar als interessats que contra aquesta Resolució, que no exhaureix la via administrativa, es pot interposar recurs d’alçada davant el conseller d’Agricultura, Medi Ambient i Territori, en el termini d’un mes a partir del dia següent al de la seva notificació, d’acord amb el que estableix l’article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l’administració de la comunitat autònoma de les Illes Balears, i els articles 114 i 115 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú.&nbsp;
