&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;TAXA PRESTACIÓ DEL SERVEI MUNICIPAL D&amp;apos;AIGÜES&amp;nbsp; POTABLES, NOUS SUBMINISTRAMENTS I EXPANSIÓ DE LES XARXES&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;FONAMENT LEGAL&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Article 1. D&amp;apos;acord amb el que disposen els articles 15 a 27 del Text refós de la Llei reguladora de les hisendes locals, aprovat pel Reial decret legislatiu 2/2004, de 5 de març, s&amp;apos;estableix la present taxa per la prestació del servei municipal d&amp;apos;aigua potable, nous subministraments i expansió de les xarxes.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;MOTIU&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Article 2. Els serveis a què es refereix la present Ordenança són:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;a) subministrament d&amp;apos;aigua potable&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;b) realització d&amp;apos;escomeses a la xarxa&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;c) subministrament de comptadors&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;d) contractació consums a les instal·lacions contra incendis&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Article 3. L&amp;apos;obligació de contribuir pel servei de subministrament d&amp;apos;aigua potable naixerà en el moment en què sigui efectiva l&amp;apos;escomesa, i tindrà caràcter continuat encara que no se&amp;apos;n gaudesqui per motius aliens al propi servei. Amb aquesta finalitat s&amp;apos;estableixen en aquesta Ordenança unes quotes mínimes de servei per a cada cas en què, tenint escomesa a la xarxa general, no hi hagi consum d&amp;apos;aigua.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;SUBJECTE PASSIU&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Article 4. 1. És subjecte passiu la persona natural o jurídica, nacional o estrangera, que hagi sol·licitat i obtingut la prestació de qualsevol dels serveis regulats en aquesta Ordenança.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Tindran també la consideració de subjecte passiu les herències jacents, comunitats de béns i altres entitats que, amb manca de personalitat jurídica, constitueixen una unitat econòmica o un patrimoni separat susceptible d&amp;apos;imposició.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. Les empreses, entitats o particulars beneficiaris dels serveis.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Article 5. Si el subjecte passiu o contribuent no fos, al mateix temps, propietari de l&amp;apos;immoble afectat pel servei, el propietari respondrà com a substitut de les obligacions tributàries del contribuent.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Article 6. El subjecte passiu, tant principal com substitut, podrà actuar mitjançant un representant, amb el qual s&amp;apos;entendran les successives actuacions administratives, si no es fa manifestació formal en contrari.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;BASE IMPOSABLE, TARIFES I TIPUS DE GRAVAMEN&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Article 7. Les tarifes pel servei de subministrament d&amp;apos;aigua, que es facturarà per trams, inclouen el manteniment del servei i el de comptadors, i seran les següents:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;D) ESPECIALS&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Usuaris que formin part d’un nucli familiar que sigui beneficiari d&amp;apos;ajudes econòmiques individuals, temporals i d&amp;apos;emergència social gestionades per la Comunitat Autònoma de les Illes Balears, el Consell Insular de Menorca o que acreditin reunir les condicions objectives per a això, segons informe del servei d’Atenció Primària de l’Àrea de Serveis a les Persones d’aquest Ajuntament: 25% de la tarifa domèstica.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Usuaris amb domicili en el qual pernoctin habitualment més de quatre persones: 70% de la tarifa domèstica (aquesta tarifa no s&amp;apos;aplicarà en el cas de segones residències).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. Conjunt d&amp;apos;habitatges que per raons urbanístiques o legals no tenguin comptador individualitzat: 50 % de la tarifa domèstica.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. Instituts d’Educació secundaria i centres educatius concertats: 50 % de la tarifa domèstica.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;5. En el cas d&amp;apos;excés de consum per fuita d&amp;apos;aigua, s&amp;apos;aplicarà com a tarifa, per a tots els m3 consumits, el preu mitjà que resulti de la facturació immediatament anterior a la que va posar de manifest la fuita.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Article 8. Les tarifes per a nous subministraments i expansió de les xarxes seran:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;NORMES DE GESTIÓ, LIQUIDACIÓ I COBRANÇA&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Article 9. Normes d&amp;apos;aplicació de les tarifes anteriors:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;a) Per a les tarifes reflectides en l&amp;apos;article 7:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Les liquidacions s&amp;apos;efectuaran trimestralment. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Si com a conseqüència de la planificació de les lectures es produís un defecte de menys de 86 dies, o un excés de més de 95, en els inclosos en el període de facturació, es procedirà al prorrateig dels trams previstos en aquesta Ordenança.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. Els serveis de manteniment no comprenen el valor de les peces a substituir, però sí la rectificació davant el Ministeri d&amp;apos;Indústria.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. Les liquidacions pel servei d&amp;apos;aigües es meritaran trimestralment, i el període de cobrança començarà el dia u del mes següent al venciment de cada un dels períodes impositius.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;5. Tarifes especials:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;L&amp;apos;aplicació de tarifes especials podrà ser sol·licitada en qualsevol moment i, si és concedida, tindrà vigència a partir del trimestre natural següent al qual s&amp;apos;hagi produït la resolució positiva:&lt;/span&gt;&lt;/p&gt; 
&lt;ol style="list-style-type: lower-alpha"&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;durant un any natural per a les tarifes D1 i D2&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;mentre es mantengui la situació que ha donat lloc a l’aplicació de les tarifes especials D3 i D4&lt;/span&gt;&lt;/li&gt; 
&lt;/ol&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La documentació a presentar amb la sol·licitud serà la següent:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Tarifa D.1.: Còpia de la resolució per la qual la CAIB o el CIME ha atorgat a l’interessat ajudes econòmiques de caràcter social. En el cas de les atorgades per l’Ajuntament, l’aplicació de la tarifa es tramitarà d’ofici, prèvia comunicació dels serveis municipals que l’hagin tramitat als Serveis de Gestió tributària.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Tarifa D.2.: La pernoctació habitual de les persones que resideixen al domicili o local es comprovarà&amp;nbsp; directament pel mateix Ajuntament.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Tarifa D.3.: Informe de l&amp;apos;empresa concessionària del Servei que confirmi l’existència de comptador col·lectiu.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Tarifa D.4.: Acreditació del regim que tengui el centre escolar.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Tarifa D.5.: Informe de l&amp;apos;empresa concessionària del Servei que confirmi la fuga com a motiu de l&amp;apos;excés de consum.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;6. Liquidació en cas d&amp;apos;impossibilitat de la lectura del consum:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En aquests casos figurarà com a consum el corresponent al mateix trimestre de l&amp;apos;exercici anterior, i, si açò no és possible, se’n farà una estimació fent la mitjana dels consums d&amp;apos;un màxim de tres trimestres anteriors o, en defecte de l&amp;apos;anterior, aplicant la mitjana de consums del tipus de contracte que es tracti.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;7. Tarifa d&amp;apos;ús industrial i de serveis&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Al consum d&amp;apos;aigua exigit per l&amp;apos;activitat ramadera i al produït als locals en què l&amp;apos;activitat exercida sigui fonamentalment de les enquadrades en les divisions 1 a 5 (ambdues incloses), a efectes de l&amp;apos;IAE, se&amp;apos;ls aplicarà la tarifa d&amp;apos;ús industrial.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La tarifa de serveis s&amp;apos;aplicarà al consum d&amp;apos;aigua als locals amb activitats fonamentalment enquadrades en les divisions 6 a 9 de la secció 1a (sector serveis), secció 2a (professions liberals) i 3a (artistes), a efectes de l&amp;apos;IAE.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Si és el cas, l&amp;apos;acreditació de l&amp;apos;activitat es farà amb la corresponent alta de l&amp;apos;IAE o del Cens d’obligats tributaris corresponent o amb qualsevol altre que consideri convenient l&amp;apos;Ajuntament.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;b) Per a les tarifes reflectides en l&amp;apos;article 8:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Les tarifes 1, 2 i 3 a) es liquidaran per a cada petició de servei formulada i es faran efectives en sol·licitar la prestació del mateix pel sistema de liquidació provisional.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. La liquidació provisional es podrà revisar segons informe dels serveis realment prestats.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. Les següents quotes de la tarifa 3 b) es liquidaran anualment per padró.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Article 10&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Les entitats o particulars interessats en la utilització dels serveis regulats per la present ordenança presentaran sol·licitud detallada dels serveis requerits.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. També hauran de presentar l&amp;apos;oportuna declaració en cas d&amp;apos;alteració o baixa en l&amp;apos;aprofitament dels serveis ja concedits en el moment en què es produesqui aquesta o es desitgi procedir a la baixa.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;DISPOSICIÓ ADDICIONAL&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Tot el que no estigui previst en aquesta Ordenança es regirà pel Text refós de la Llei reguladora de les hisendes locals i la Llei general tributària.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;DISPOSICIÓ FINAL&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La present Ordenança tindrà vigència a partir del dia següent a la seva publicació definitiva en el BOIB, fins a la seva modificació o derogació expressa.&lt;/span&gt;&lt;/p&gt;
