&lt;p style="margin: 0px"&gt; Vist l’article 72 del Reglament de Població i Demarcació Territorial, que literalment diu “Els Ajuntaments donaran de baixa d’ofici, per inscripció indeguda, a les persones que figurin empadronades incomplint els requisits establerts a l’article 54 d’aquest reglament, un cop comprovada aquesta circumstància en el corresponent expedient, en el que es donarà audiència a l’interessat. Aquest haurà de comunicar el municipi o país en el que viu habitualment i sol.licitar, per escrit, l’alta al padró municipal o registre de Matrícula de l’oficina o Secció Consular corresponent. L’esmentada sol.licitud serà tramitada per l’Ajuntament que acordi la baixa d’ofici. Si l’interessat no manifesta expressament la seva conformitat amb la baixa, aquesta només es podrà dur a terme amb l’informe favorable del Consell d’Empadronament”&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; Vist l’article 54 del mateix cos legal que diu “ Tota persona que visqui a Espanya, està obligada a incriurer-se al padró del municipi on resideix habitualment, en cas que visqui a més d’un municipi s’haurà d’inscriure únicament al que habiti durant més temps a l’any”. Així mateix aquests habitants també incompleixen l’article 57 del Reglament Territorial de les entitats locals, que diu .” la inscripció en el padró municipal contendrà com a obligatoris els següents camps de cada veí: nom, llinatges, sexe, domicili habitual, lloc i data de naixement, &lt;u&gt;DNI&lt;/u&gt;, ...”&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; Atès que, en els casos de referència s’ha donat audiència als interessats, tal com queda reflectit al corresponent expedient de baixa.&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; Atès que el Consell d’Empadronament ha informat favorablement el referit expedient, en data 17de desembre de 2012.&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; Vist l’article 21.1r de la Llei 7/1985 de 2 d’abril, Reguladora de les Bases de Règim Local, que atorga al Batle una competència residual quan estableix: “les demés atribucions que expressament li atribueixin les lleis i aquelles que la legislació de l’Estat o de les Comunitats Autònomes assignin al municipi i no atribueixen a altres òrgans municipals”,&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; Per tot això, HE RESOLT&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; 1er.- Declarar la baixa d’ofici, per inscripció indeguda, de les següents persones:&lt;/p&gt;
