&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. L’article 3.2 c) de la Llei 2/1997, de 3 de juny, de taxes de la Comunitat Autònoma de les Illes Balears, estableix que les disposicions d’aquesta no són aplicables a les prestacions que retribueixin serveis i activitats administratives, quan concorrin ambdós sectors, públic i privat, i, a més, siguin encomanades per la persona interessada amb tota espontaneïtat.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Quan es va aprovar la Llei 11/1998, de 14 de desembre, de règim específic de taxes de la Comunitat Autònoma de les Illes Balears, es varen reintegrar a l’àmbit de les taxes, per imperatiu de la Sentència del Tribunal Constitucional 185/1995, de 14 de desembre, i per tal de respectar el principi de legalitat, determinats recursos financers que fins aleshores eren preus. Eren fonamentalment preus relatius a determinats serveis que presta l’Escola Nacional de Vela Calanova; en canvi, altres preus, tant d’aquest servei com del poliesportiu Príncipes de España, continuaren sent preus públics.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. La Comunitat Autònoma de les Illes Balears no té un règim jurídic específic per als preus públics, per la qual cosa, d’acord amb l’article 149.3 de la Constitució espanyola i l’article 87.3 de l’Estatut d’autonomia de les Illes Balears, aprovat per la Llei orgànica 2/1983, de 25 de febrer, modificat, entre d’altres, per la Llei orgànica 1/2007, de 28 de febrer, és d’aplicació supletòria la legislació estatal i, concretament, la Llei 8/1989, de 13 d’abril, de taxes i preus públics (modificada, entre d’altres, per la Llei 25/1998, de 13 de juliol).&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. La realitat ha demostrat que la quantia de determinats preus no cobreix els costs econòmics originats per la realització de les activitats o la prestació dels serveis, o bé no és equivalent a la utilitat que se’n deriva, requisits exigits per l’article 25 de la Llei 8/1989, per la qual cosa és necessari canviar la quantia d’alguns d’aquests preus. Tot això, d’acord amb l’informe de la Direcció del poliesportiu Príncipes de España.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;5. D’altra banda, la Llei 3/2003, de 26 de març, de règim jurídic de l’Administració de la Comunitat Autònoma de les Illes Balears, disposa en l’article 42 que els actes dictats pels consellers adopten la forma de resolució.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;6. D’acord amb l’article 59.6 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú (modificada per la Llei 4/1999, de 13 de gener), quan l’acte administratiu té per destinatari una pluralitat indeterminada de persones, s’ha de substituir la notificació per la publicació corresponent.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;7. Els preus públics per a la utilització dels serveis corresponents al poliesportiu Príncipes de España estan fixats a l’annex &amp;nbsp;de la resolució del conseller de Turisme i Esports, de 19 de març de 2012, publicada al BOIB núm. 44 de 27 de març de 2012.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Modificar l’annex de la resolució del conseller de Turisme i Esports de 19 de març de 2012, que queda redactat tal com es disposa a l’annex d’aquesta Resolució.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Publicar aquesta Resolució en el Butlletí Oficial de les Illes Balears, moment a partir del qual els nous preus aprovats per aquesta Resolució seran plenament aplicables i deixaran de regir els publicats anteriorment.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra aquesta Resolució –que exhaureix la via administrativa- es pot interposar un recurs potestatiu de reposició davant el conseller de Turisme i Esports en el termini d’un mes comptador des de l’endemà que s’hagi publicat, d’acord amb l’article 117 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú, i l’article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l’Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;També es pot interposar un recurs contenciós administratiu davant la Sala Contenciosa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l’endemà que s’hagi publicat, d’acord amb l’article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;* La piscina de 50 m no disposa de servei de socorrisme, per tal de utilitzar-la s’hauran d’aportar els socorristes pertinents.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;** Les sessions fotogràfiques tenen un preu de 78 €/hora, tret que la instal·lació que s’hagi de fotografiar tengui un cost superior. En aquest cas s’ha de pagar el preu superior.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;*** El preu del rocòdrom i del monòlit és de 34 €/hora per a grups que duen material propi i una persona responsable titulada.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El preu per als centres educatius per a l’any 2013 és de 0,8 € per alumne, hora i espai. Quan són centres educatius que ja van habitualment al poliesportiu, se’ls aplica sempre el preu mensual comptabilitzant quatre setmanes. Si es tracta d’ocasions puntuals, es comptabilitzaran els dies i les hores de manera estricta.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El preu per a usuaris puntuals per poder accedir als espais dels abonats és de 7,5 € per dia i persona. Si són menors de 4 anys aquest accés és gratuït (sempre han d’anar acompanyats d’una persona major i responsable).&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Tota activitat que es realitzi dins les instal·lacions del poliesportiu, que generi qualsevol ingrés, benefici o lucre per l’organització (persona, associació, federació, club etc.), precisarà d’una autorització prèvia i escrita per part de la direcció del poliesportiu. A més s’ haurà d’abonar un 20% del ingressos percebuts per la realització de l’esmentada activitat.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El preu d’ús dels diferents espais esportius, amb l’excepció de les pistes de tennis, les aules, la sala de juntes i la sala d’actes, es redueix en funció de la quantitat d’hores setmanals que es concedeixin (la llum és independent). Aquests descomptes s’apliquen si els usuaris finals són de les Illes Balears. Es tenen en compte dos nivells diferents.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- 1r nivell: activitats de cinc a nou hores de pràctica setmanal. Se’ls aplica un descompte del 15 %.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- 2n nivell: activitats a partir de deu hores de pràctica setmanal. Se’ls aplica un descompte del 20 %.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El preu mínim amb els descomptes aplicats no pot ser inferior a 15 €/h. La quantitat d’hores setmanals ve determinada per dues possibilitats.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Usuaris habituals: es comptabilitza la setmana natural.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Usuaris puntuals: es comptabilitzen des de l’inici de l’activitat, set dies, el primer inclòs, així com els caps de setmana.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El pagament s’ha de fer abans de la realització de l’activitat o de l’ús del servei, i és necessari presentar el resguard bancari acreditatiu a les oficines del poliesportiu.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La Direcció General d’Esports pot aplicar descomptes a determinats usuaris i a determinats cursos, activitats i serveis, depenent de l’interès per a la promoció i la difusió de l’esport balear, així com pel benefici social evident.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt;]]</env:contingut>
