Sobre Altres Matéries.]] CAIB ca 2013-01-12 2013-01-12 2013-01-02 CAIB 610 1458 ![CDATA[<p> &nbsp;</p> <p style="text-align: center"> <span style="font-family: times new roman, times, serif; font-size: 12px"><strong>CEDULA DE NOTIFICACION</strong></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">En el procedimiento de referencia se ha dictado la resolución del tenor literal siguiente:</span></p> <p style="text-align: center"> <span style="font-family: times new roman, times, serif; font-size: 12px"><strong>SENTENCIA</strong></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">En Manacor, a 7 de noviembre de dos mil doce.</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">Vista por mí, Ángel Mateo Goizueta, el procedimiento seguido en este Juzgado como Juicio ordinario Numero 121/2.010 promovido por SA NOSTRA DE INVERSIONES E.F.C S.A representado por procurador y defendido por Letrado, contra BIOPROMOCIONS CAP DE FERRUTX S.L Y MIGUEL LOPEZ GONZALEZ en situación de rebeldía procesal.</span></p> <p style="text-align: center"> <span style="font-family: times new roman, times, serif; font-size: 12px"><strong>FALLO</strong></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">Que estimando la demanda presentada por la representación procesal de SA NOSTRA DE INVERSIONES E.F.C S.A debo:</span></p> <p style="margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px">- Declarar y declaro resuelto el contrato de arrendamiento financiero suscrito por esta con la entidad BIOPROMOCIONS CAP DE FERRUTX S.L como arrendataria y MIGUEL LOPEZ GONZALEZ como fiador solidario el dia .12 de mayo de 2006 sobre el vehiculo Mercedes Benz modelo ML 320 CDI con numero de bastidor WDC1641221A094505.</span></p> <p style="margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px">- Debo condenar y Condeno a BIOPROMOCIONS CAP DE FERRUTX S.L y a MIGUEL LOPEZ GONZALEZ a hacer entrega a la entidad SA NOSTRA DE INVERSIONES E.F.C del vehiculo Mercedes Benz modelo ML 320 CDI con numero de bastidor WDC1641221AO94505.</span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px">Las costas se devengaran en la forma estipulada en el fundamento jurídico cuarto de esta resolución.</span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px">Notifíquese la presente sentencia a las partes.</span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px">Líbrese testimonio de la misma para su unión a la causa llevándose el original al libro de Sentencias.</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">Esta resolución no es firme, y, contra la misma cabe interponer Recurso de Apelación (art. 455LEC2000) que se interpondrá en este Juzgado en el plazo de 20 DIAS desde su notificación a las partes (art. 457LEC2000), siempre que previamente haya acreditado haber efectuado la consignación de cincuenta euros (50 euros), en la Cuenta de Consignaciones de este Juzgado de la entidad BANESTO.</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">Y como consecuencia del ignorado paradero de BIOPROMOCIONS CAP DE FERRUTX SL Y MIGUEL* LOPEZ GONZALEZ , se extiende la presente para que sirva de cédula de notificación.</span></p> <p> &nbsp;</p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px">MANACOR a veintisiete de Noviembre de dos mil doce.</span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px">EL / LA SECRETARIO.</span></p>]] CAIB 26 ca 507138 text/html
