    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La Conselleria de Turisme i Esports, a través de l&amp;apos;Agència de Turisme de les Illes Balears (d&amp;apos;ara endavant &lt;/span&gt;l&amp;apos;ATB&lt;span style="color: black"&gt;), presenta una convocatòria pública dins d&amp;apos;un marc de col·laboració públic i privat que permeti unir esforços i consolidar el posicionament de les marques als mercats i segments que s&amp;apos;estableixen en el Pla Integral de les Illes Balears 2012-2015 (d&amp;apos;ara endavant &lt;/span&gt;PITIB&lt;span style="color: black"&gt;), mitjançant l&amp;apos;aplicació del &lt;/span&gt;&lt;em&gt;cobranding&lt;/em&gt;&lt;span style="color: black"&gt; en accions promocionals en què participi &lt;/span&gt;l&amp;apos;ATB&lt;span style="color: black"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El &lt;/span&gt;&lt;em&gt;cobranding&lt;/em&gt;&lt;span style="color: black"&gt; és la &lt;/span&gt;unió estratègica de dues o més marques amb l&amp;apos;objectiu d&amp;apos;incrementar-ne la imatge de marca, potenciar-ne el valor i la rendibilitat.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Gràcies a la posada en marxa d&amp;apos;accions promocionals en modalitat de &lt;/span&gt;&lt;em&gt;cobranding&lt;/em&gt;&lt;span style="color: black"&gt;, les marques col·laboradores i les que gestiona &lt;/span&gt;l&amp;apos;ATB s&amp;apos;ajudaran recíprocament a assolir els seus objectius d&amp;apos;imatge i comunicació. És una estratègia &lt;em&gt;win-win&lt;/em&gt;&lt;span style="color: black"&gt; que ofereix no només avantatges competitius sinó que permet també capitalitzar la reputació de les marques associades i reduir costos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Amb aquesta convocatòria es pretén la promoció efectiva de &lt;/span&gt;la destinació Illes Balears mitjançant la unió de marques d&amp;apos;organitzacions interessades en participar en la iniciativa amb les marques de la destinació gestionades per l&amp;apos;ATB (Mallorca, Menorca, Eivissa, Formentera i Palma de Mallorca). Amb això, s&amp;apos;estableix una &lt;span style="color: black"&gt;estratègia conjunta de reforç d&amp;apos;imatge, que potencia i enforteix el valor de les marques participants i els aporta un clar element diferenciador al mercat. Així, els atributs més representatius de cada una de les marques es converteixen en &lt;/span&gt;eines de tracció&lt;span style="color: black"&gt; de la demanda cap a cada una de les marques i cap al producte ofert. Entre els atributs de les marques de les &lt;/span&gt;Illes Balears als diferents mercats figuren els següents: satisfacció, qualitat, gaudir, descobrir, conèixer, relaxar-se, entorn natural, destinació experiencial, familiar, sostenible, moder&lt;span style="color: black"&gt;na i segura.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Entre les finalitats de &lt;/span&gt;l&amp;apos;ATB&lt;span style="color: black"&gt;, d&amp;apos;acord amb l&amp;apos;article 2.5 del Decret 26/2012, de 30 de març, pel qual es reorganitza, reestructura i regula l&amp;apos;empresa pública encarregada de la promoció turística de les Illes Balears, cal destacar la de fomentar i impulsar iniciatives del sector turístic amb vista a la promoció del turisme balear, així com la de coordinar, impulsar, gestionar i executar les activitats de promoció turística interior i exterior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Per tot això, aprovat pel Consell de Direcció de dia &amp;nbsp;19&amp;nbsp; de desembre de 2012, es dicten les següents&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;u&gt;&lt;span style="color: black"&gt;BASES&lt;/span&gt;&lt;/u&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;1. Objecte&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;L&amp;apos;objecte d&amp;apos;aquesta convocatòria, pública i oberta, és oferir a empreses o entitats nacionals i internacionals que tenguin marques comercials l&amp;apos;oportunitat de col·laborar a les accions promocionals en què participi l&amp;apos;ATB el 2013 sota la modalitat de &lt;em&gt;cobranding&lt;/em&gt;.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;L&amp;apos;òptic d&amp;apos;accions de l&amp;apos;ATB per a 2013 s&amp;apos;ajusta a la combinació marca/producte/mercat descrita en el PITIB.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Les marques que es presentin a la convocatòria han de respondre a les necessitats d&amp;apos;imatge i comunicació de les diferents marques que conformen les Illes Balears.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;2. Modalitats de &lt;em&gt;cobranding&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El &lt;em&gt;cobranding&lt;/em&gt; és la unió estratègica de dues o més marques amb l&amp;apos;objectiu d&amp;apos;incrementar la seva imatge de marca, potenciar el seu valor i la seva rendibilitat.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Les modalitats de &lt;em&gt;cobranding&lt;/em&gt; aplicables a aquesta convocatòria són:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;A.Shared Product Equity&lt;/em&gt; (equitat en producte compartit):&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 36pt"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Socis en igualtat de condicions de marca (imatge i posicionament però diferents productes que són complementaris) s&amp;apos;uneixen oferint un producte diferenciat a través dels beneficis de cada soci, creant una identitat potent per a ambdues marques.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;B. Ingredient&lt;/em&gt; (ingredient)&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 36pt"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Quan una marca recolza el contingut o part del contingut d&amp;apos;una altra marca o producte principal. La marca principal actua com a amfitrió i la marca secundària com a convidat.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;C. Affinity&lt;/em&gt; (afinitat)&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 36pt"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Les marques que s&amp;apos;associen comparteixen un benefici i/o atribut que permet potenciar el producte més fàcilment.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;D. Value Chain&lt;/em&gt; (cadena de valor): la unió de diverses marques que formen part d&amp;apos;una mateixa cadena de valor. Permet a les marques compartir objectius específics sobre la indústria i ampliar la relació amb els seus clients.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;3. Termes i condicions de la col·laboració&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La participació en aquesta convocatòria subjecta als principis de publicitat i concurrència, suposa l&amp;apos;acceptació dels termes i condicions establerts.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Correspon, en tot cas, a l&amp;apos;ATB&lt;span style="color: black"&gt; resoldre les qüestions relatives a aquesta convocatòria, així com els termes i condicions de col·laboració.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Les condicions de col·laboració, la responsabilitat de les accions, específiques de l&amp;apos;ús dels noms de marca, logos i distintius i la metodologia de treball&lt;span style="color: black"&gt; s&amp;apos;establiran de mutu acord entre les parts a través de co&lt;/span&gt;nvenis de &lt;em&gt;cobranding&lt;/em&gt; que es firmaran amb les marques seleccionades posteriorment a la resolució de la convocatòria esmentada.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Ambdues entitats (ATB&lt;span style="color: black"&gt; i entitat col·laboradora) han de vetlar a tot hora per mantenir un comportament ètic i responsable en la utilització de les marques, potenciant-ne sempre la imatge i els valors positius.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En cap cas els col·laboradors seleccionats mitjançant aquesta convocatòria no poden exigir participar amb caràcter exclusiu en les accions de &lt;em&gt;cobranding&lt;/em&gt; en les quals s&amp;apos;inclogui la seva marca.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;L&amp;apos;ATB&lt;span style="color: black"&gt; es farà càrrec de les despeses de material promocional descrites a cada una de les accions per a la consecució òptima de l&amp;apos;acord de col·laboració de &lt;/span&gt;&lt;em&gt;cobranding &lt;/em&gt;i que quedaran puntualment descrites a l’acord.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Si per causes d&amp;apos;operativitat, funcionalitat, estratègia o pressupostàries &lt;/span&gt;l&amp;apos;ATB&lt;span style="color: black"&gt; decideix no participar a les accions subscrites en algun dels acords, aquesta es compromet a compensar-ho en una altra acció/ons de similars característiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 18pt"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;4. Requisits dels sol·licitants&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Poden sol·licitar la col·laboració totes aquelles empreses o entitats de caràcter nacional i internacional que posseeixen la titularitat de les seves marques comercials i aquesta es troba en vigor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Les empreses sol·licitants, a canvi de la col·laboració esmentada, han d’oferir a &lt;/span&gt;l&amp;apos;ATB&lt;span style="color: black"&gt; una contraprestació en espècie segons els termes que s&amp;apos;indiquen en el punt 8.2 (criteris de valoració objectius). &lt;/span&gt;L&amp;apos;ATB&lt;span style="color: black"&gt; pot disposar de la contraprestació en els termes subscrits a l&amp;apos;oportú conveni de col·laboració mentre aquest es formalitzi i es trobi en vigor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;5. Accions promocionals subjectes a &lt;em&gt;cobranding&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Les accions promocionals subjectes a &lt;em&gt;cobranding&lt;/em&gt; estan catalogades en dos grans blocs, per mercat &lt;em&gt;(bloc 1)&lt;/em&gt; i per producte &lt;em&gt;(bloc 2).&lt;/em&gt; Dins de la classificació esmentada es divideixen en lots als quals els sol·licitants poden optar:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;**Todas les accions del bloc 2 estan contingudes al bloc 1 als seus respectius mercats.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Els sol·licitants poden trobar la descripció de cada un dels lots a l&amp;apos;ANNEX VII, en què es detalla: la marca d&amp;apos;influència de l&amp;apos;acció, la classificació, nom, lloc, tipologia, dates (en cas que estiguin confirmades), producte al qual afecta i oferta que realitza l&amp;apos;ATB&lt;span style="color: black"&gt; per a cada una d&amp;apos;aquelles.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Les empreses i entitats poden optar de forma independent a un o més lots.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;6. Documentació a presentar&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;A fi de facilitar la valoració de les propostes presentades pels sol·licitants, aquests han de presentar la documentació segons s&amp;apos;explica a continuació. Els annexos a què es refereix a continuació seran facilitats via correu electrònic des del Departament Jurídic de l&amp;apos;ATB&lt;span style="color: black"&gt;. Els Interessats poden sol·licitar-los en els &lt;/span&gt;correus electrònics&lt;span style="color: black"&gt; següents: &lt;/span&gt;&lt;a href="mailto:ibalfagon@atb.caib.es"&gt;ibalfagon@atb.caib.es&lt;/a&gt;, &lt;a href="mailto:jrfiz@atb.caib.es"&gt;jrfiz@atb.caib.es&lt;/a&gt;, &lt;a href="mailto:lbuades@atb.caib.es"&gt;lbuades@atb.caib.es&lt;/a&gt; o en els números de telèfon 971 17 72 10 o 971 17 61 89.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;u&gt;A. La sol·licitud&lt;/u&gt;&lt;/em&gt; de col·laboració es realitza mitjançant instància dirigida al president de l&amp;apos;ATB&lt;span style="color: black"&gt;, en la qual s&amp;apos;ha de fer constar&lt;/span&gt; explícitament la marca de l&amp;apos;empresa que es vol unir mitjançant &lt;em&gt;cobranding&lt;/em&gt;.&lt;/span&gt;&lt;/p&gt; 
&lt;br /&gt; 
&lt;p style="margin-left: 36pt"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La instància esmentada ha de ser emplenada íntegrament indicant les dades de l&amp;apos;empresa o entitat, imatge de la marca pròpia, marca gestionada per l&amp;apos;ATB&lt;span style="color: black"&gt; per a la qual sol·liciten el &lt;/span&gt;&lt;em&gt;cobranding &lt;/em&gt;i codi del lot d&amp;apos;accions al qual s&amp;apos;opta. Els interessats han d&amp;apos;utilitzar el model ANNEX I (formulari de sol·licitud) contingut en aquestes bases.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 36pt"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Els interessats han de presentar l’esmentat formulari de sol·licitud imprès per optar a cada un dels lots d&amp;apos;accions en els quals desitgin col·laborar, annexat al sobre tècnic corresponent.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 36pt"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En cas que no es presenti cap sobre adjunt a aquesta sol·licitud, no es requerirà esmena a l&amp;apos;interessat, i quedarà exclòs de la col·laboració.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 36pt"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;No s&amp;apos;acceptaran aquelles sol·licituds que contenguin omissions, errors, ratxades que impedeixin de conèixer clarament la proposta.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 36pt"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El lliurament del formulari, per si mateixa, no és objecte de valoració, sinó que serveix com a document formal de sol·licitud.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 36pt"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Aquesta sol·licitud ha de ser subscrita pel president de l&amp;apos;entitat o qui ostenti la representació de l&amp;apos;entitat que sol·licita la col·laboració, i formulada de conformitat amb l&amp;apos;article 70 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú i d&amp;apos;acord a l&amp;apos;annex que s&amp;apos;adjunta.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 36pt"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Les sol·licituds de col·laboració s&amp;apos;han de presentar en el registre de l&amp;apos;ATB&lt;span style="color: black"&gt; o als llocs prevists a l&amp;apos;article 38 de la Llei 30/1992. En aquest darrer cas, s&amp;apos;ha d&amp;apos;enviar al fax 971 &lt;/span&gt;78 46 00, o via correu electrònic&lt;span style="color: black"&gt; (&lt;/span&gt;&lt;a href="mailto:lbuades@atb.caib.es"&gt;lbuades@atb.caib.es&lt;/a&gt;; &lt;a href="mailto:jrfiz@atb.caib.es"&gt;jrfiz@atb.caib.es&lt;/a&gt;; &lt;a href="mailto:ibalfagon@atb.caib.es"&gt;ibalfagon@atb.caib.es&lt;/a&gt;), un escrit que justifiqui la data de tramesa de la sol·licitud. Així mateix, quan la documentació s&amp;apos;envia per correu, l&amp;apos;entitat ha de justificar la data d&amp;apos;imposició de la tramesa a l&amp;apos;oficina de Correus i anunciar a la Direcció de l&amp;apos;ATB l’enviament &lt;span style="color: black"&gt;de l&amp;apos;oferta el mateix dia, mitjançant qualsevol dels &lt;/span&gt;mitjans&lt;span style="color: black"&gt; permesos&lt;/span&gt; (fax o correu electrònic). Només s&amp;apos;admet la comunicació per correu electrònic quan així figuri indicat, en cas contrari s&amp;apos;entén que no s&amp;apos;admet.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 36pt"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El termini de presentació de les sol·licituds és de 30 dies naturals, comptats a partir del dia següent de la publicació d&amp;apos;aquesta convocatòria al Butlletí Oficial de les Illes Balears (BOIB&lt;span style="color: black"&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 36pt"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Les sol·licituds de col·laboració han d&amp;apos;anar acompanyades de la documentació que s&amp;apos;especifica a continuació, en dos sobres independents, identificant-se en el seu exterior amb el nom i llinatges o raó social, número&lt;span style="color: black"&gt; de telèfon, &lt;/span&gt;adreça electrònica i especificant a quina marca gestionada per l&amp;apos;ATB va dirigida la sol·licitud en funció del seu àmbit territorial.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 36pt"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Són motiu d&amp;apos;exclusió aquelles sol·licituds que no presentin cap sobre o que presentin tota la documentació sol·licitada (administrativa i tècnica) continguda en un mateix sobre.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 36pt"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;u&gt;B. Sobre 1: documentació administrativa&lt;/u&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Fotocòpia acarada o compulsada del certificat d&amp;apos;inscripció al Registre d&amp;apos;Associacions, escriptura de constitució de l&amp;apos;entitat, si escau.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Fotocòpia acarada o compulsada dels estatuts dipositats en el registre esmentat, o degudament inscrita en el Registre Mercantil si escau.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. Còpia acarada o compulsada de la documentació acreditativa de la capacitat de la persona que representa legalment l&amp;apos;entitat sol·licitant per actuar en nom seu, així com del seu DNI&lt;span style="color: black"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. Còpia acarada o compulsada de la targeta d&amp;apos;identificació fiscal de l&amp;apos;entitat sol·licitant.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Testimoni judicial, certificació administrativa o declaració responsable atorgada davant d&amp;apos;una autoritat administrativa o organisme professional qualificat o mitjançant acta de manifestacions davant de notari públic, de no incórrer en les prohibicions per contractar amb l&amp;apos;administració segons l&amp;apos;article 60 del TRLCSP&lt;span style="color: black"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Aquesta declaració responsable, o un altre document, ha d&amp;apos;incloure la manifestació expressa que l&amp;apos;empresa no incorre en cap dels supòsits a què es refereix la Llei 2/1996, de 19 de novembre, d&amp;apos;incompatibilitats dels membres del Govern i dels alts càrrecs de la CAIB&lt;span style="color: black"&gt;.&lt;/span&gt; Quan es tracti d&amp;apos;empreses d&amp;apos;estats membres de la Unió Europea i aquesta possibilitat estigui prevista en la legislació de l&amp;apos;estat respectiu, pot substituir-se per una declaració responsable, atorgada davant d&amp;apos;una autoritat judicial.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;5. Acreditació d&amp;apos;estar al corrent de les obligacions tributàries amb l&amp;apos;Administració autonòmica, estatal i la Seguretat Social.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;6. Acreditació de la titularitat de la marca en qüestió i vigència d’aquesta, bé a través de l&amp;apos;Oficina Espanyola de Patents i Marques o per l&amp;apos;Organització Mundial de la Propietat Intel·lectual (OMPI&lt;span style="color: black"&gt;)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El sobre 1 “Documentació administrativa&amp;quot; ha de ser únic en cas que una mateixa entitat presenti diferents projectes tècnics.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 36pt"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;u&gt;C.&amp;nbsp; Sobre 2: documentació tècnica&lt;/u&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 36pt"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;u&gt;La següent documentació s&amp;apos;ha de lliurar tant en suport digital (&lt;em&gt;pendrive&lt;/em&gt;, CD, etc.) com imprès:&lt;/u&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ol style="margin-left: 40px"&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Criteris subjectius. ANNEX II&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Estudis, anàlisi o memòries que acreditin i verifiquin les dades exposades&lt;/span&gt; a l&amp;apos;ANNEX II &amp;quot;criteris subjectius&amp;quot;. També ha de lliurar-se &lt;span style="color: black"&gt;una declaració jurada de la veracitat de les dades contingudes a l&amp;apos;ANNEX II &amp;quot;convocatòria convenis de col·laboració &lt;/span&gt;&lt;em&gt;cobranding&lt;/em&gt;&lt;span style="color: black"&gt;&amp;quot; firmada pel representant legal de l&amp;apos;entitat o empresa propietària de la marca. Per a això, han de lliurar l&amp;apos;ANNEX III contingut en aquestes bases i una fotocòpia compulsada del &lt;/span&gt;DNI&lt;span style="color: black"&gt; del representant legal de l&amp;apos;empresa o entitat i persona que firma el document. Si no es pot proporcionar la documentació esmentada que acrediti la informació facilitada, la presentació de la declaració jurada és suficient.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Criteris objectius. ANNEX IV&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Per a l&amp;apos;acreditació de l&amp;apos;import total de l&amp;apos;oferta en espècie sense IVA com a preu de mercat han de presentar tarifes oficials de l&amp;apos;empresa/entitat o declaració jurada que subscrigui la veracitat que l&amp;apos;import ofertat s&amp;apos;ajusta a mercat (ANNEX V) i una fotocòpia compulsada del &lt;/span&gt;DNI&lt;span style="color: black"&gt; del representant legal de l&amp;apos;empresa o entitat i persona que firma el document.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Qualsevol altra documentació que els sol·licitants estimin oportú aportar per complementar la informació facilitada a la Comissió Tècnica.&lt;/span&gt;&lt;/li&gt; 
&lt;/ol&gt; 
&lt;p style="margin-left: 54pt"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Els annexos anteriorment descrits són únicament i exclusivament els documents que valorarà la Comissió Tècnica. Els sol·licitants han d&amp;apos;utilitzar els models d&amp;apos;annexos que contenen aquestes bases.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 54pt"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;No s&amp;apos;acceptaran aquells annexos que tenguin omissions, errors o ratxades que impedeixin de conèixer clarament la proposta, ni aquelles que en suports digitals siguin illegibles en entorns Windows o que contenguin virus, spyware o malware.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 54pt"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Els interessats han de presentar tota la documentació tècnica requerida anteriorment, tant impresa com en format digital, per cada un dels lots d&amp;apos;accions als quals desitgen optar.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;7.&amp;nbsp; Revisió de documentació administrativa i esmena d’aquesta &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El Servei General de l’ATB examinarà la documentació administrativa corresponent al sobre núm.1 i si és necessària l’esmena d’algun document de caràcter administratiu la Direcció de l’ATB requerirà a la entitat interessada per escrit, via fax, o correu electrònic, la documentació administrativa que falti, i li concedirà un termini de deu dies naturals perquè presenti la documentació requerida, amb l’advertència expressa que, si no ho fa, se la considerarà desistida i s’arxivarà la seva sol·licitud, segons disposa l’article 71 de la Llei 30/1992.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Pel que respecte a la documentació del sobre núm. 2, es valorarà amb la documentació aportada en el moment de finalització del termini establert, fet pel qual en aquest bloc no se sol·licitarà cap esmena. Això no evita que en qualsevol moment de la valoració, la Comissió Tècnica de l’ATB no pugui sol·licitar, per qualsevol mitjà que permeti deixar-ne constància en l’expedient, els aclariments que estimi necessaris per realitzar una correcta&amp;nbsp;valoració de la seva proposta i de la seva marca. En aquest&amp;nbsp; cas, només s’admeten aclariments de documents que ja constin en la proposta,&amp;nbsp;i no de documentació nova que no s’hagués presentada abans de la finalització del termini establert.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 18pt"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;8. Valoració de les propostes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La valoració de les propostes la du a terme la Comissió Tècnica nomenada a proposta de la &lt;/span&gt;&lt;span style="color: green"&gt;D&lt;/span&gt;&lt;span style="color: black"&gt;irecció de &lt;/span&gt;l&amp;apos;ATB&lt;span style="color: black"&gt;, i avaluarà les sol·licituds segons el procediment següent:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

En relació amb els ponts i dies festius es refereix a territori nacional i, específicament, a la comunitat autònoma de les Illes Balears. Es considera temporada alta els mesos de juny, juliol, agost i setembre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Aquesta Comissió ha d’estar formada per un màxim de 5 membres d&amp;apos;entre personal tècnic d&amp;apos;àrees de &lt;/span&gt;l&amp;apos;ATB&lt;span style="color: black"&gt;, i el seu president és el director gerent de &lt;/span&gt;l&amp;apos;ATB&lt;span style="color: black"&gt;. Si és necessari, es tendrà ajuda de tècnics externs.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;10.&amp;nbsp; Fases posteriors&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Una vegada finalitzada la fase d&amp;apos;examen de la documentació administrativa, i abans de la revisió de la documentació tècnica per la Comissió, la secretària de les comissions executives enviarà la documentació tècnica de les propostes &lt;/span&gt;admeses&lt;span style="color: black"&gt; al tècnic designat per cada marca, perquè en el termini de deu dies naturals faci una valoració prèvia i manifesti el que estimi convenient.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Posteriorment aquestes al·legacions són traslladades a la Comissió Tècnica, la qual en realitza la valoració final. Realitzat l&amp;apos;informe tècnic preceptiu de cada una de les sol·licituds s&amp;apos;eleva a la &lt;/span&gt;&lt;span style="color: green"&gt;D&lt;/span&gt;&lt;span style="color: black"&gt;irecció de &lt;/span&gt;l&amp;apos;ATB&lt;span style="color: black"&gt;, que proposarà al president la resolució per aprovar la realització dels acords de col·laboració en modalitat &lt;/span&gt;&lt;em&gt;cobranding&lt;/em&gt;&lt;span style="color: black"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Dictada la resolució d&amp;apos;aprovació de la col·laboració, l&amp;apos;ATB&lt;span style="color: black"&gt; inicia els tràmits administratius per formalitzar l&amp;apos;oportú conveni de col·laboració&lt;/span&gt; amb cada entitat.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Al conveni de &lt;em&gt;cobranding&lt;/em&gt; que es firma amb les entitats titulars de les marques col·laboradores s&amp;apos;estableixen les condicions d&amp;apos;ús de la marca o marques de les Illes Balears&lt;span style="color: black"&gt; d&amp;apos;acord &lt;/span&gt;amb el manual d&amp;apos;usos de l&amp;apos;ATB, així com les ubicacions de la marca o marques.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Les aportacions en espècie que fan les empreses col·laboradores a l&amp;apos;ATB&lt;span style="color: black"&gt; en contraprestació a la seva participació en l’activitat o activitats de &lt;/span&gt;&lt;em&gt;cobranding&lt;/em&gt; serviran com a aportació que s&amp;apos;usarà per a altres serveis de l&amp;apos;ATB; és a dir, totes les aportacions revertiran en més accions promocionals que dugui a terme l&amp;apos;ATB&lt;span style="color: black"&gt;, mentre estigui en vigència el conveni subscrit.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;11. Protecció de dades&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;De conformitat amb la LO 15/1999, de 13 de desembre, de protecció de dades de caràcter personal, els sol·licitants queden informats i accepten la incorporació de les dades que faciliten al fitxer que creï l&amp;apos;ATB&lt;span style="color: black"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Les entitats sol·licitants estan obligades al compliment de l&amp;apos;establert en la LO 15/1999, de 13 de desembre (&lt;/span&gt;LOPD&lt;span style="color: black"&gt;) i el &lt;/span&gt;RD&lt;span style="color: black"&gt; 1720/2007, de 21 de desembre, pel qual s&amp;apos;aprova el reglament que desenvolupa la &lt;/span&gt;LOPD&lt;span style="color: black"&gt;, en relació amb les dades personals a les quals tengui accés durant la vigència dels convenis que es realitzin en desenvolupament i execució d&amp;apos;aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;12. Confidencialitat&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Qualsevol informació confidencial revelada per l&amp;apos;ATB&lt;span style="color: black"&gt; a l&amp;apos;entitat amb la qual es formalitzen accions de &lt;/span&gt;&lt;em&gt;cobranding&lt;/em&gt; durant la vigència dels convenis, es mantendrà amb caràcter estrictament confidencial per al receptor, comprometent-se a utilitzar aquesta informació únicament per a la finalitat per a la qual li va ser revelada per l&amp;apos;emissor, llevat d&amp;apos;imperatiu legal.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El receptor ha de protegir la informació confidencial de l&amp;apos;emissor contra qualsevol ús no autoritzat o revelació a tercers, de la mateixa manera que protegeix la seva informació confidencial. L&amp;apos;accés a aquesta informació queda restringit només a aquells empleats de l&amp;apos;entitat col·laboradora que l’hagin de conèixer per complir amb el &lt;em&gt;cobranding&lt;/em&gt;.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 18pt"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;13.&amp;nbsp; Règim jurídic aplicable&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Les qüestions litigioses que sorgeixin entre les parts relacionades amb els efectes, execució i extinció del contracte seran competència de l&amp;apos;ordre jurisdiccional civil. Abans de la interposició de l&amp;apos;oportuna demanda s&amp;apos;ha d&amp;apos;interposar, d&amp;apos;acord amb l&amp;apos;article 61 de la Llei 3/2003, de 26 de març, de règim jurídic de l&amp;apos;Administració de la Comunitat Autònoma de les Illes Balears, la corresponent reclamació prèvia a la via judicial.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;14.&amp;nbsp; Eficàcia&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Aquesta resolució té efecte des del dia següent a la seva publicació en el BOIB&lt;span style="color: black"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
