    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En relació amb l’assumpte de referència, i d’acord amb la Llei 16/2002, d’1 de juliol, de prevenció i control integrats de la contaminació, us comuniquem que el Ple de la CMAIB, en sessió de 27 de setembre de 2012&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ATÈS&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1.Que CEMEX SA ha sol·licitat una modificació de l’AAI consistent en la incorporació de silicat de ferro com a matèria primera.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2.Que CEMEX ha informat que la transformació del servei mèdic en sala de cures implica que deixaran de produir residus sanitaris del grup III, amb codi LER 18 01 03*, actualment autoritzats a l’AAI vigent.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3.Que la documentació aportada justifica que es tracta d’una modificació no substancial, en compliment de l’art. 10.2 de la Llei 16/2002, d’1 de juliol.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ACORDA&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;informar favorablement l’atorgament de la modificació no substancial de l’Autorització Ambiental Integrada de la fàbrica de ciment de Lloseta, consistent en la incorporació de silicat de ferro com a matèria primera, amb les condicions d’explotació, capacitat i processos indicats a la sol·licitud i amb subjecció a les següents condicions:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Es modifica la taula de matèries primeres del condicionant 4.1 per tal de reflectir la nova quantitat de silicats consumits estimat:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;“&lt;em&gt;4.1 S’estima que els consums de matèries primeres, auxiliars i matèries d’addició prevists al projecte seran els següents:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;em&gt;Aquesta autorització s’atorga per a l&amp;apos;àmbit territorial de la Comunitat Autònoma de les Illes Balears i es concedeix sense perjudici de les que corresponen a altres organismes o administracions i que afecten l&amp;apos;activitat de la qual és objecte. És a dir, aquesta concessió no eximeix el titular de l&amp;apos;obtenció d&amp;apos;altres llicències i autoritzacions legalment procedents. Tots els residus perillosos que apareixen a la taula anterior han d’ésser lliurats a gestors degudament autoritzats per al seu tractament.”&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Interposició de recursos&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra aquest acord, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el Ple de la Comissió de Medi Ambient de les Illes Balears en el termini d’un mes comptador des de l’endemà d’haver-ne rebut&amp;nbsp; la notificació, d’acord amb l’article 117 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques&amp;nbsp; i del procediment administratiu comú, i l’article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l’Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l’endemà d’haver rebut la notificació de l’acord, d’acord amb l’article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/p&gt;
