&lt;p lang="ca-ES" style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Assumpte: notificació per mitjà del BOIB&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="ca-ES"&gt;Atès que no ha estat possible notificar l&amp;apos;acord sancionador per incompliment de l&amp;apos;establert a l&amp;apos;article 17 punt 1.1 de l&lt;/span&gt;&lt;span lang="ca-ES"&gt;&amp;apos;Ordenança municipal de neteja,&lt;/span&gt;&lt;span lang="ca-ES"&gt; procedim a notificar-lo, conforme amb el que determina l&amp;apos;article 59.5 de la Llei 30/1992 de règim jurídic de les administracions públiques i del procediment administratiu comú, a les persones que es detallen a l&amp;apos;annex adjunt, tot fent constar&lt;/span&gt;&lt;span lang="ca-ES"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt; que amb aquesta publicació es notifica a la persona que s&amp;apos;indica que s&amp;apos;ha dictat el següent acord:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Decret d&amp;apos;alcaldia número 2012-0606 de data 20 de setembre de 2012 mitjançant el qual s&amp;apos;ha resolt:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;“&lt;/span&gt;&lt;span lang="ca-ES"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Primer. Sancionar el senyor &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span lang="ca-ES"&gt;&lt;span style="background: none transparent scroll repeat 0% 0%"&gt;
   &lt;span class='lopd'&gt;(dades personals ocultes)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="ca-ES"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;amb una multa de 200 euros,&lt;/span&gt;&lt;/span&gt;&lt;span lang="ca-ES"&gt;&lt;span style="font-style: normal"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt; com a presumpte responsable d’una falta de caràcter lleu per incompliment de l’establert a l&amp;apos;article 26.1&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span lang="ca-ES"&gt;&lt;span style="font-style: normal"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt; de l’Ordenança municipal de neteja,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span lang="ca-ES"&gt;&lt;span style="font-style: normal"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt; publicada en el BOIB de data 29 de maig de 2001, que estableix que «queda totalment prohibit llençar o abandonar a la via pública qualsevol objecte, tant si és sòlid, líquid com gasós. Els petits residus, com papers, llosques, embolcalls i similars s’hauran de dipositar a les papereres corresponents.»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Segon. Notificar aquesta Resolució a l&amp;apos;interessat.”&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Us notific l&amp;apos;acord establert i la liquidació emesa, així com els terminis per efectuar l&amp;apos;ingrés, d&amp;apos;acord amb l&amp;apos;art. 62 de la Llei 58/2003 general tributària:&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;ol&gt; 
 &lt;li&gt; &lt;p lang="ca-ES" style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Si la notificació es rep entre els dies 1 i 15 de cada més: des de la data de notificació fins al dia 20 del més següent o, si aquest no fos hàbil, fins a l&amp;apos;immediat hàbil següent.&lt;/span&gt;&lt;/p&gt; &lt;/li&gt; 
 &lt;li&gt; &lt;p lang="ca-ES" style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Si la notificació es rep entre els dies 16 i darrer de cada més: des de la data de notificació fins al dia 5 del segon mes posterior o, si aquest no fos hàbil, fins a l&amp;apos;immediat hàbil següent.&lt;/span&gt;&lt;/p&gt; &lt;/li&gt; 
&lt;/ol&gt; 
&lt;p lang="ca-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Si un cop transcorreguts els terminis esmentats no s&amp;apos;ha efectuat l&amp;apos;ingrés, s&amp;apos;incorrerà en el recàrrec executiu del 5 % i s&amp;apos;iniciarà el procediment de constrenyiment amb el recàrrec, els interessos de demora i les costes que siguin procedents. (Art. 28, 163 i següents de la Llei 58/2003 general tributària).&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="ca-ES"&gt;Formes d&amp;apos;efectuar l&amp;apos;ingrés&lt;/span&gt;&lt;span lang="ca-ES"&gt;. L&amp;apos;ingrés es pot efectuar a l&amp;apos;oficina de recaptació d&amp;apos;aquest Ajuntament, al carrer de la Sala, núm. 5, o en qualsevol oficina de la Caixa d&amp;apos;Estalvis i Pensions de Barcelona &amp;quot;la Caixa&amp;quot;, Caixa d&amp;apos;Estalvis de Balears &amp;quot;Sa Nostra&amp;quot;, Banca March, BBVA, BSCH, Banc de Crèdit Balear o CAM, indicant el número d&amp;apos;expedient i el nom de la persona interessada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="ca-ES"&gt;Recursos&lt;/span&gt;&lt;span lang="ca-ES"&gt;. Contra aquesta Resolució es pot interposar un recurs de reposició davant la batlessa en el termini d&amp;apos;un mes comptador des de l&amp;apos;endemà d&amp;apos;haver-ne rebut la notificació, d&amp;apos;acord amb l&amp;apos;article 14 del Text refós de la Llei reguladora de les hisendes locals (Reial decret legislatiu 2/2004, de 5 de març) o ser impugnat directament davant l&amp;apos;òrgan jurisdiccional contenciós administratiu competent en el termini dos mesos comptadors des de l&amp;apos;endemà d&amp;apos;haver-ne rebut la notificació, d&amp;apos;acord amb el que disposa la Llei 30/1992, de 26 de novembre, de règim jurídic comú, amb les modificacions introduïdes per la Llei 4/1999 de modificació de la Llei 30/1992.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Tot això, de conformitat amb el que s&amp;apos;estableix en els articles 42.4 i 42.5 en relació amb l&amp;apos;article 44.2 de la Llei 30/1992, de 26 de novembre, segons redacció donada per la Llei 4/1999, de 13 de gener, de modificació de l&amp;apos;anterior.&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt;
