    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La presidenta de l’Institut Mallorquí d’Afers Socials, en data 3 de desembre de 2012, va dictar la següent resolució:&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;Resolució d’atorgament de la convocatòria de les ajudes econòmiques de l’Institut Mallorquí d’Afers Socials per al finançament del transport ordinari i especial dels usuaris amb discapacitat dels centres ocupacionals i centres de dia, per a l’any 2012&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;b&gt;Antecedents:&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;1. En data 20 de setembre de 2012, la presidenta de l’Institut Mallorquí d’Afers Socials (IMAS) va aprovar l’expedient de la convocatòria pública de subvencions per al finançament del transport ordinari i especial dels usuaris amb discapacitat de centres ocupacionals i centres de dia, per a l&amp;apos;any 2012, i va autoritzar la despesa dimanant d’aquest expedient amb càrrec a la partida pressupostària 40.23328.48901 (document RC amb núm. de referència comptable 22012014175) per un import de nou-cents mil euros (900.000,00 €).&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;2. En data 25 de setembre de 2012 es publicà al BOIB núm. 140 l’esmentada convocatòria.&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;3. La Comissió Avaluadora de la convocatòria de referència es va reunir el dia 23 de novembre de 2012 i, segons consta a l’acta de la mateixa data, ha formulat la pertinent proposta de resolució d’acord amb les sol·licituds presentades i els criteris de valoració establerts a les bases.&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;4. El Servei Jurídicoadministratiu i la Intervenció Delegada han emès els pertinents informes. &lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;b&gt;Consideracions jurídiques:&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;1. El Ple del Consell de Mallorca, en data 5 de maig de 2005, aprovà les bases reguladores de les ajudes econòmiques a entitats de la Direcció de l’Àrea de Serveis Socials de l’Institut (BOIB núm. 99 de dia 30 de juny), d’acord amb què preveu la Llei 38/2003, de 17 de novembre, general de subvencions, aplicable en els termes previstos a la disposició final primera, i el Decret legislatiu 2/2005, de 28 de desembre, pel qual s’aprova el Text refós de la Llei de subvencions.&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;2. D&amp;apos;acord amb l&amp;apos;article 3 dels Estatuts de l&amp;apos;IMAS, aquest organisme té personalitat jurídica pròpia i la capacitat d&amp;apos;obrar necessària per complir els seus fins. Entre les seves facultats, es troba la d’atorgar subvencions (apartat &lt;i&gt;m&lt;/i&gt;).&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;3. L’article 7.2 apartat &lt;i&gt;g&lt;/i&gt; dels Estatuts de l&amp;apos;IMAS estableix que correspon a la Presidència aprovar i resoldre els procediments d’ajudes i subvencions.&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;4. D’acord amb les bases i amb la convocatòria, el procediment de concessió de les subvencions s’ha de fer mitjançant concurs, amb el límit del crèdit pressupostari disponible per a aquesta convocatòria, i l’òrgan instructor és l’Àrea de Persones amb Discapacitat de l’IMAS, que ha de dur a terme les actuacions a què es refereixen l’article 23 i següents de la Llei 38/2003, de 17 de novembre, general de subvencions, i ha de formular la proposta de resolució.&lt;/span&gt;&lt;/p&gt; 
&lt;h2 class="western" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;5. La Comissió Avaluadora constituïda per a aquesta convocatòria ha estudiat i comprovat totes les sol·licituds presentades, i ha emès l’informe que serveix de base a l’òrgan instructor per elaborar la proposta de resolució corresponent.&lt;/span&gt;&lt;/h2&gt; 
&lt;p class="western" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;Per tot això,&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;b&gt;RESOLC&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;b&gt;Primer.&lt;/b&gt; EXCLOURE la sol·licitud presentada per l’entitat Associació de Familiars de Malalts d’Alzheimer de Mallorca (AFAM). En el punt 3 de la convocatòria, expressament s’estableix que podran sol·licitar la subvenció les entitats sense ànim de lucre que gestionen centres ocupacionals i centres de dia, en règim de concert o col·laboració amb l’administració pública competent. L’entitat AFAM no gestiona cap centre ocupacional ni centre de dia en règim de concert ni en col·laboració amb l’IMAS.&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;b&gt;Segon.&lt;/b&gt; ATORGAR les ajudes econòmiques per al finançament del transport ordinari i especial dels usuaris amb discapacitat de centres ocupacionals i centres de dia, per a l&amp;apos;any 2012, a les entitats següents, pels imports que seguidament es ressenyaran, així com DISPOSAR al seu favor una despesa per un import total de NOU-CENTS MIL EUROS (900.000,00 €), amb càrrec a la partida 40.23328.48901 del vigent pressupost de despeses de l’IMAS (relació comptable amb núm. de referència Q 2012/1642), d&amp;apos;acord amb el detall següent:&amp;nbsp; &lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Tercer. &lt;/b&gt;Modificar el paràgraf sisè del punt 13 de la convocatòria, que queda redactat així: &lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="font-weight: normal"&gt;El termini per a la presentació d’aquesta primera justificació econòmica finalitzarà el cinquè dia hàbil posterior a la notificació de la resolució de la concessió. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Quart. &lt;/b&gt;Notificar aquesta resolució a la Coordinació de l’Àrea de Persones amb Discapacitat, al Servei de Gestió Econòmica i a la Intervenció Delegada, així com a les entitats interessades, per tal que, d’acord amb el que es preveu a les bases de la convocatòria i en aquesta resolució, presentin la primera justificació &lt;u&gt;en el termini&lt;/u&gt;, improrrogable, &lt;u&gt;de cinc (5) dies hàbils següents a la recepció de la notificació de la present resolució&lt;/u&gt;.&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;Aquesta resolució no posa fi a la via administrativa i contra ella es pot interposar, d&amp;apos;acord amb l&amp;apos;article 27.1 dels Estatuts de l&amp;apos;Institut Mallorquí d’Afers Socials, aprovats pel Ple del Consell de Mallorca en data 9 de febrer de 2012 (BOIB núm. 28 de 21/02/2012), en relació amb l&amp;apos;article 14.4 de la Llei de règim jurídic de les administracions públiques i del procediment administratiu comú, recurs d’alçada davant el Consell Executiu del Consell de Mallorca, dins el termini d’un mes, comptador a partir del dia següent al de la notificació de la present resolució.&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;Contra la desestimació expressa del recurs d’alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en el termini de dos mesos, comptadors a partir del dia següent al de la notificació de la desestimació de l’esmentat recurs.&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;Contra la desestimació per silenci del recurs d’alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en el termini de sis mesos, comptadors a partir del dia següent a la desestimació presumpta (tres mesos des de la interposició del recurs sense que s’hagi notificat la resolució).&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;span style="font-weight: normal"&gt;No obstant l’anterior, es pot exercitar, si n’és el cas, qualsevol altre recurs que s’estimi pertinent. Tot això de conformitat amb la Llei 29/1998, de 13 de juliol, Reguladora de la Jurisdicció Contenciosa Administrativa, i de la Llei 30/1992, de 26 de novembre, de Règim Jurídic de les Administracions Públiques i del Procediment Administratiu Comú.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
