2012-12-06 ca ![CDATA[<p> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">El Ple de l’Ajuntament, en sessió ordinària celebrada el dia 1 d’octubre de 2012, amb la majoria legal procedent, va adoptar l’acord d’aprovació inicial de la ordenança reguladora de la taxa per recollida i eliminació de fems domiciliària, impost sobre béns immobles de naturalesa urbana i taxa per instal.lació de caixers automàtics a les façanes dels immobles amb accés directe des de la via pública.</span></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Aquests acord juntament amb la resta de l’expedient, han estat exposats al públic durant el termini legal de 30 dies, al BOIB núm.152 de data 18 d’octubre de 2012, sense que en aquest termini s’hagin formulat cap tipus de reclamacions, pel que els referit acord ha quedat definitivament aprovats de forma automàtica. El text íntegre de les ordenances aprovades és el següent:</span></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><b><span style="background: none repeat scroll 0% 0% transparent">IMPOST SOBRE BÉNS IMMOBLES DE NATURALESA URBANA:</span></b></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">VI. QUOTA I ACREDITACIÓ</span></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Art. 8è</span></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">1. La quota d&apos;aquest impost serà el resultat d&apos;aplicar a la base liquidable el tipus de gravamen.</span></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">2. La base liquidable d’aquest impost serà el resultat de practicar, en el seu cas, a la imposable les reduccions que legalment s’estableixin.</span></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">3. El tipus de gravamen serà el 0,473% quan es tracti de béns de naturalesa urbana.</span></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">4. El tipus de gravamen per aplicar quan es tracti de béns de naturalesa rústica serà del 0,718 %.</span></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">5. La quota líquida serà la resultant d’aplicar a la quota íntegra les bonificacions que procedeixin en aplicació de les condicions i requisits que siguin exigibles.</span></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><b><span style="background: none repeat scroll 0% 0% transparent">TAXA PER RECOLLIDA I ELIMINACIÓ DE FEMS DOMICILIARI</span></b></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><b><span style="background: none repeat scroll 0% 0% transparent">Article 6 Beneficis fiscals:</span></b></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Beneficis fiscals de caràcter socio-econòmic</span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">c) Tindran una reducció del 50 % de la taxa els subjectes passius següents:</span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">- L’habitatge amb un sol resident, els ingressos del qual siguin iguals o inferiors al SMI.</span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">- L’habitatge amb més d’un resident, els ingressos conjunts dels quals siguin iguals o inferiors a l’1,5 del SMI.</span></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">d) L’habitatge amb un sol resident, el qual acrediti un grau de discapacitat igual o superior al 65%, i els seus ingressos siguin iguals o inferiors al SMI, tindrà una reducció del 70%</span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">f) Tindran una reducció del 30 % de la taxa els subjectes passius següents:</span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">- L’habitatge amb un sol resident, els ingressos del qual siguin iguals o inferiors a 1,5 SMI.</span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">- L’habitatge amb més d’un resident, els ingressos conjunts dels quals siguin iguals o inferiors a 2 SMI.</span></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">g) L’habitatge amb un sol resident, el qual acrediti un grau de discapacitat igual o superior al 65%, i els seus ingressos siguin iguals o inferiors a 1,5 SMI, tindrà una bonificació del 60%.</span></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Per gaudir d’aquestes bonificacions, el resident l’habitatge ho pot ser en condició de propietari, usufructuari o llogater. </span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">No gaudiran de les bonificacions assenyalades quan:</span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">- Quan el beneficiari sigui propietari o usufructurari de més d’un immoble, en el cas de llogaters quan sigui propietari d’un o més immobles.</span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">- Quan, qualsevol dels membre de la unitat familiar, siguin propietaris o usufructuaris de més immobles del que resideixen.</span></span></p> <p style="margin: 0px"> &nbsp;</p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">En tot cas les circumstàncies que s’al.leguin s’hauran d’acreditar amb la següent documentació:</span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">- Atur amb o sense prestació.</span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">- Subsidi d’atur.</span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">- Declaració de renda o certificat negatiu si no i ha obligació de presentar-les.</span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">- Certificació de béns mobles o immobles si s’escau.</span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">- Certificat o justificants de la Seguretat social sobre les pensions.</span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">- Certificat de minusvalia.</span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">- Contracte de lloguer</span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">- Certificat de convivència </span></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Les sol.licituds es podran presentar durant els cinc primers mesos de l’any i una vegada informades per la comissió de Serveis Socials, la comissió de govern resoldrà les sol·licituds.</span></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><u><span style="background: none repeat scroll 0% 0% transparent">Beneficis fiscals de caràcter mediambiental</span></u></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Bonificació per bon comportament ambiental: recollida selectiva:</span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">- Gaudiran d’una bonificació del 5% de la taxa per recollida i eliminació de fems, totes aquelles activitats del sector de restauració, hospedatge i comerç mixt o integrat en grans superfícies o supermercats que reciclin el paper – cartó.</span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">- Gaudiran d’una bonificació del 7% de la taxa per recollida i eliminació de fems, totes aquelles activitats del sector de restauració, hospedatge i comerç mixt o integrat en grans superfícies o supermercats que reciclin el vidre.</span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">- Gaudiran d’una bonificació del 3% de la taxa per recollida i eliminació de fems, totes aquelles activitats del sector de restauració, hospedatge i comerç mixt o integrat en grans superfícies o supermercats que reciclin els envasos lleugers.</span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">- Gaudiran d’una bonificació del 20% de la taxa per recollida i eliminació de fems, totes aquelles activitats del sector de restauració, hospedatge i comerç mixt o integrat en grans superfícies o supermercats que realitzin la selecció orgànica.</span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">- El total de bonificacions de que es puguin gaudir s’incrementarà amb un 5% en els casos en que la preparació del material a reciclar es faci d’una forma adequada que faciliti la seva retirada.</span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">- Gaudiran d’una bonificació del 25% de la taxa per recollida i eliminació de fems, totes aquells habitatges que realitzin la selecció orgànica.</span></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Per gaudir d’aquestes modificacions caldrà adreçar la sol·licitud a la regidoria de Medi Ambient, que emetrà informe verificant que es compleixen les condicions per obtenir la bonificació.</span></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Les bonificacions establertes anteriorment és podran minorar quan pels serveis municipals s’acrediti que no és realitzen sistemàticament i de forma continuada les condicions establertes, a aquest efecte, l’Ajuntament inspeccionarà periòdicament el grau de compliment dels beneficiaris, emetent el corresponent informe.</span></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">En cas d’altres tipus d’activitats que per la seva naturalesa, siguin significatius generadors de residus reciclables, la Junta de Govern els hi podrà atorgar l’anterior bonificació, sempre i quan es comprovi fafaentment el compliment de les obligacions referides.</span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Bonificació per gestió pròpia de la fracció orgànica de residus (autocompostatge)</span></span></p> <p style="margin: 0px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">- Gaudiran d’una bonificació del 25 per cent, els contribuents que acreditin que durant l’exercici anterior al de la meritació de la taxa s’han autogestionat la fracció orgànica de residus, en condicions que no causin molèsties als veïns, ni problemes higiènics de cap mena.</span></span></p> <p> <span style="font-family: times new roman, times, serif;
