&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Notificació de proposta de resolució d’expedients sancionadors de l’ajuntament d’Inca en matèria d’infracció de la Llei 22/2011 de residus i sòl contaminats&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Les notificacions fetes per correu certificat, amb avís de rebut, no han tingut efecte o no s’han pogut fer efectives per ignorar-se el domicili o no haver-hi trobat els interessats que es relacionen, per la qual cosa, es procedeix en compliment de l’establert a l’article 59.5 de la Llei 30/1992 de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;VIST que en data de 17 d’octubre de 2011 es va emetre informe per part de la Policia Local d’Inca, per no haver retirat del dipòsit de vehicles municipal o haver renunciat expressament als vehicles relacionats a continuació:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;VIST que en data de 28 de març de 2012 es va iniciar, mitjançant decret de batlia núm. 2012/223, expedient sancionador contra les persones relaciones anteriorment, per la infracció de l’article 43.3 c) de la Llei 22/2011, per abandonament i/o abocaments de residus no perillosos sense que s’hagi produït un dany o deteriorament greu pel medi ambient o s’hagi posat en perill greu la salut de les persones. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;VIST que no s’han presentat al•legacions en temps i forma.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ATÈS que l’expedient en qüestió es tramita pel procediment ordinari que estableix el Decret 14/1994, de 10 de febrer, pel qual s’aprova el Reglament del procediment a seguir per l’Administració de la Comunitat Autònoma en l’exercici de la potestat sancionadora.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ATÈS que els fets són constitutius d’una infracció greu de l’article 43.3 c) de la Llei 22/2011, de 28 de juliol, de residus i sòl contaminats, que poden ésser sancionats amb una multa de 901’- euros fins a 45.000’- euros, d’acord amb el estableix l’article 47.1 b) de la llei esmentada, la qual s’haurà de valorar en funció del risc que comporti per a les persones o als béns, així com l’existència d’intencionalitat o reiteració i de la naturalesa dels perjudicis causats.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Per tot això, i d’acord amb el que disposa el Decret 14/1994, de 10 de febrer, i el capítol II del Títol IX de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i procediment administratiu comú, l’instructora dicta la següent PROPOSTA DE RESOLUCIÓ, perquè si ho considera convenient el Sr. Batle-President ho elevi a resolució definitiva:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.- DECLARAR responsables a les persones relacionades anteriorment, per una infracció de l’article 43.3 c) de la Llei 22/2011, de 28 de juliol, de residus i sòl contaminats, sense que s’hagi produït un dany o deteriorament greu pel medi ambient o s’hagi posat en perill greu la salut de les persones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2.- QUALIFICAR la infracció esmentada com a greu.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3.- IMPOSAR la sanció de NOU-CENTS UN EUROS (901’- €) a les persones relacionades anteriorment, com a responsables de la infracció esmentada, d’acord amb el que disposa l’article 43.3 c) de la Llei 22/2011, de 28 de juliol, de residus i sòl contaminats.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.- NOTIFICAR la present proposta de resolució als interessats en forma reglamentaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;De conformitat amb el que disposa l’article 14 del Decret 14/1994, de 10 de febrer, l’interessat disposarà d’un termini de QUINZE DIES hàbils, comptadors a partir del dia següent a la notificació de la present proposta de resolució, per formular al·legacions i per presentar els documents o altres elements de judici que consideri pertinents; així mateix dins el termini esmentat l’interessat podrà consultar l’expedient amb l’assistència, si n’és el cas, dels assessors que necessiti.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;L’interessat podrà obtenir còpies dels documents que contingui l’expedient en els termes legalment o reglamentàriament establerts.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt;
