    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Havent transcorregut el termini d’exposició al públic de l’expedient relatiu a l’Ordenança fiscal reguladora dels preus públics d’aplicació a les operacions d’adquisició de places turístiques a Formentera, l’exposició de la qual va ser publicada en el Butlletí Oficial de les Illes Balears núm. 84 de data 12 de juny de 2012, i no constant-hi la presentació de reclamació en aquesta Entitat, en compliment del que preveu l’article 17 del Reial decret legislatiu 2/2004, de 5 de març, pel qual s’aprova el text refós de la Llei reguladora de les hisendes locals, es fa públic que ha quedat definitivament aprovada l’Ordenança fiscal reguladora dels preus públics d’aplicació a les operacions d’adquisició de places turístiques a Formentera, el text de la qual és el següent:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;ORDENANÇA FISCAL REGULADORA DELS PREUS PÚBLICS D’APLICACIÓ A LES OPERACIONS D’ADQUISICIÓ DE PLACES TURÍSTIQUES A FORMENTERA.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Article 1&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Concepte&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;De conformitat amb el previst en l’article 127, en relació amb l’article 41, del Reial decret legislatiu 2/2004, pel qual s’aprova el text refós de la Llei reguladora de les hisendes locals, aquest Consell Insular de Formentera estableix el preu públic d’aplicació a les operacions d’adjudicació i gestió de places turístiques.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Article 2&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Naturalesa&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La contraprestació econòmica de les operacions d’adjudicació de les places turístiques té la naturalesa de preu públic, per ser una prestació de serveis i realització d’activitats competència d’aquesta entitat i no concórrer en ella cap de les circumstàncies especificades en la lletra B) de l’article 20.1 del Reial decret legislatiu 2/2004, pel qual s’aprova el text refós de la Llei reguladora de les hisendes locals.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Article 3&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Objecte&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Aquests preus públics consisteixen en la contraprestació que han d’abonar els titulars del establiments d’allotjament turístics per l’adquisició de places turístiques titularitat del Consell Insular de&amp;nbsp; Formentera.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Article 4&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Obligats al pagament&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Estan obligats al pagament d’aquests preus públics els que sol·licitin o resultin beneficiats o afectats per les gestions realitzades per l’òrgan gestor de places de Formentera i que tinguin per finalitat la legalització, ampliació o obertura d’establiments turístics d’allotjament.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Article 5&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Tarifes&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;a) OPERACIONS DE LEGALITZACIÓ DE PLACES (art. 12 Ley 4/2010)&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- 2.800 euros per plaça, fins les 5 primeres places per establiment.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- 3.800 euros a partir de la sexta, aplicant a aquesta i a les successives un increment del 1,5% a partir de la desena segons la següent fórmula&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;P=S&lt;sup&gt;n=5&lt;/sup&gt;&lt;sub&gt;n=1 &lt;/sub&gt;(2800)+ S&lt;sup&gt;n=N&lt;/sup&gt;&lt;sub&gt;n=6 &lt;/sub&gt;(3800)+ S&lt;sup&gt;n=N+1&lt;/sup&gt;&lt;sub&gt;n=7 &lt;/sub&gt;(0,015*3800)&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;on&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;P= Valor total en euros de les places turístiques objecte d’adquisició.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;N= Nombre de places turístiques que s’adquireixen&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Els preus d’aplicació són els que es deriven del següent Q&lt;strong&gt;UADRE DE TARIFES&lt;/strong&gt;:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Hagin millorat la seva categoria amb posterioritat a l’any 2.007 i que com a conseqüència de l’anterior es trobin inscrits en el registre de turisme amb categoria igual o superior a quatre estels en el cas d&amp;apos;hotels i tres claus superior en el cas d’apartaments.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;b) OPERACIONS D’ADQUISICIÓ DE PLACES PER AMPLIACIÓ D’ESTABLIMENTS EXISTENTS.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- 4.200 euros per plaça per als establiments classificats en els grups d&amp;apos;hostals, hostals-residència, pensions, fondes i cases d’hostes.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- 3.800 euros per plaça per als establiments classificats en els grups d&amp;apos;hotels, hotels apartaments i apartaments turístics amb categoria igual o inferior a 2 estels i/o 2 claus i habitatges turístics vacacionals (VTV).&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- 2.800 euros per plaça per a la resta d&amp;apos;hotels, hotels apartaments i apartaments que en el moment de la sol·licitud tinguin la seva inscripció en el registre de turisme amb categoria igual o superior a tres estels en el cas d’hotels i tres claus en el cas d&amp;apos;apartaments.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Si realitzada la corresponent inspecció per part de l’Autoritat competent en matèria de Turisme es demostra que no es compleixen els requisits als quals es refereix el paràgraf anterior, l&amp;apos;establiment vindrà obligat al pagament de 3.800 euros per plaça adjudicada, la qual cosa tindrà lloc sense perjudici de les sancions que poguessin ser aplicable.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;c) OPERACIONS D&amp;apos;ADQUISICIÓ DE PLACES COM A CONSEQÜÈNCIA DE L&amp;apos;OBERTURA DE NOUS ESTABLIMENTS.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En els casos d’obertura de nous establiments d’allotjament en la modalitat d’hotel, hotel apartament i apartament turístic, s&amp;apos;estableix el preu unitari de 3800 euros per plaça, prèvia presentació de la corresponent declaració responsable per la qual el titular del nou establiment es comprometi a:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Complir amb tots els requisits exigibles per la normativa turística per iniciar l&amp;apos;activitat en la categoria la inscripció de la qual se sol·licita &lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- No operar amb la modalitat del tot inclòs.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Mantenir les instal·lacions obertes durant almenys 7 mesos a l&amp;apos;any.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Es reduirà el preu unitari a 2.800 euros per plaça per a la resta d&amp;apos;hotels, hotels apartaments i apartaments que realitzin la seva inscripció en el registre de turisme amb categoria igual o superior a quatre estels en el cas d&amp;apos;hotels i tres claus superior en el cas d&amp;apos;apartaments.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;L&amp;apos;incompliment de l&amp;apos;anterior o la reducció de categoria posteriorment, comportarà l&amp;apos;obligació per part del titular de l&amp;apos;establiment a abonar a l&amp;apos;òrgan gestor la quantitat resultant de multiplicar 3.800 euros per plaça adjudicada, sense perjudici de les sancions que poguessin ser aplicable.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;d) OPERACIONS DE REOBERTURA D&amp;apos;ESTABLIMENTS DONATS DE BAIXA DEFINITIVAMENT.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En els casos de reobertura d&amp;apos;establiments donats de baixa definitivament, amb la consegüent reactivació de places turístiques, s&amp;apos;estableix el preu unitari de 2.800 euros per plaça, prèvia presentació de la corresponent declaració responsable per la qual el titular de l&amp;apos;establiment es compromet a:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Complir amb tots els requisits exigibles per la normativa turística per iniciar l&amp;apos;activitat en la categoria la inscripció de la qual se sol·licita &lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- No operar amb la modalitat del tot inclòs.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Mantenir les instal·lacions obertes durant almenys 7 mesos a l’any.&lt;/span&gt;&lt;/p&gt; 
&lt;h3 style="text-align: left"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;DISPOSICIÓ FINAL&lt;/span&gt;&lt;/h3&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La present Ordenança entrarà en vigor el mateix dia de la seva publicació íntegra en el Butlletí Oficial les Illes Balears.&lt;/span&gt;&lt;/p&gt;
