    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La Llei 56/2003, de 16 de desembre, d’ocupació (BOE núm. 301, de 17 de desembre) inclou les polítiques actives d’ocupació de les quals forma part el programa de la promoció de l’ocupació autònoma.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La regulació d’aquest programa es va fer per primera vegada l’any 1986, atenent els importants canvis produïts en l’economia espanyola, principalment en el mercat de treball. Després d’aquella primera regulació, es va aprovar l’Ordre TAS/1622/2007, de 5 de juny, per la qual es regula la concessió de subvencions al programa de promoció de l’ocupació autònoma (BOE núm. 136, de 7 de juny), que deroga expressament la normativa que regulava aquestes subvencions i s’adapta a les directrius de la Llei 56/2003, abans esmentada. La nova regulació del programa manté el finançament dels projectes en les primeres fases d’implantació amb la finalitat de fer més atractiva l’opció del treball per compte propi entre les persones en demanda d’ocupació. D’altra banda, la nova regulació neix amb la intenció de pal·liar les dificultats d’incorporació a l’ocupació de determinats col·lectius com ara les dones, els joves i les persones amb discapacitat, en coherència amb el programa nacional de reformes.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Quant al procediment de concessió, es manté el règim de concessió directa que preveu l’article 2.1, lletres b) i d), del Reial decret 357/2006, de 24 de març, pel qual es regula la concessió directa de determinades subvencions en els àmbits de l’ocupació i de la formació professional ocupacional (BOE núm. 83, de 7 d’abril), segons preveu l’article 2.2 de l’Ordre TAS/1622/2007 abans esmentada.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Les accions subvencionables que preveu aquesta Resolució es financen amb càrrec als fons rebuts del Servei Públic d’Ocupació Estatal.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Atès el procés de traspàs de gestió a les comunitats autònomes de les polítiques actives d’ocupació, l’Ordre TAS/1622/2007 preveu uns continguts comuns, inclosos en el capítol I, que són aplicables en tot el territori nacional, partint de la competència de l’Estat en matèria de legislació laboral, sens perjudici que els executin les comunitats autònomes, mentre que deixa a aquestes últimes els aspectes procedimentals i l’adequació a les seves peculiaritats organitzatives.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;D’acord amb això, atesa la situació de crisi econòmica i l’interès per mantenir l’activitat empresarial i l’estacionalitat pròpia de l’activitat turística d’aquesta comunitat autònoma, que ha donat lloc a una regulació específica en la contractació del personal mitjançant la figura del fix discontinu, es considera necessari preveure també aquesta estacionalitat en el cas dels treballadors per compte propi, ja que es tracta d’una realitat econòmica que no es pot obviar. I, per tant, l’obligació del beneficiari de mantenir l’activitat econòmica durant un període de tres anys (36 mesos) pot ser de forma continuada o per fraccions de sis mesos durant un període superior fins al compliment dels trenta-sis mesos dins un màxim de 6 anys consecutius.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;L’article segon del Decret 12/2011, de 18 de juny, del president de les Illes Balears, pel qual s’estableixen les competències i l’estructura orgànica bàsica de les conselleries de l’Administració de la Comunitat Autònoma de les Illes Balears (BOIB núm. 91 ext., de 20 de juny), atribueix a la Direcció General de Comerç i Empresa les competències relatives al foment i els registres públics de l’economia social i el treball autònom.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;L’Ordre del conseller de Treball i Formació de 4 de maig de 2005 estableix les bases reguladores de les subvencions en matèria de treball (BOIB núm. 73, de 12 de maig). L’article 1.2, apartat 28, preveu que pot ser objecte de subvenció la promoció de l’ocupació autònoma.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="font-weight: normal"&gt;L’article 3 de l’Ordre esmentada estableix que les convocatòries de subvencions s’han d’aprovar mitjançant una resolució del conseller o consellera competent en matèria de treball i formació i s’han de publicar en el &lt;/span&gt;&lt;i&gt;&lt;span style="font-weight: normal"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/i&gt;&lt;span style="font-weight: normal"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Per tot això, de conformitat amb l’article 15 del Text refós de la Llei de subvencions, aprovat mitjançant el Decret legislatiu 2/2005, de 28 de desembre (BOIB núm. 196, de 31 de desembre), i l’article 3 de l’Ordre de bases reguladores abans esmentada, dict la següent&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;RESOLUCIÓ&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;&lt;b&gt;Primer&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Objecte &lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;L’objecte d’aquesta Resolució és aprovar i regular la convocatòria d’ajuts per a fomentar la creació d’ocupació autònoma amb la finalitat de convertir persones desocupades en treballadors autònoms o per compte propi.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Segon &lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Persones beneficiàries &lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Poden ser beneficiàries dels ajuts que estableix aquesta convocatòria les persones desocupades i inscrites com a demandants d’ocupació en l’oficina del servei públic d’ocupació corresponent que es donin d’alta en el règim especial de treballadors autònoms o règim especial per compte propi que correspongui o mutualitat del col·legi professional, i que estiguin incloses en algun dels col·lectius següents:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;i&gt;a&lt;/i&gt;) dones víctimes de violència de gènere desocupades i persones amb discapacitat desocupades&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;i&gt;b)&lt;/i&gt; dones desocupades i joves desocupats de 30 o menys anys&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;i&gt;c)&lt;/i&gt; desocupats no inclosos en els col·lectius anteriors&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En tot cas, la persona sol·licitant ha d’estar domiciliada a la comunitat autònoma de les Illes Balears i l’activitat s’ha de dur a terme en el mateix àmbit territorial.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Igualment, han d’estar donats d’alta en el cens d’obligats tributaris i en l’impost sobre activitats econòmiques.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La data d’alta en el Règim Especial de Treballadors Autònoms, en el règim especial per compte propi que correspongui o mutualitat del col·legi professional, es considerarà data d’inici de l’activitat.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Els treballadors autònoms o per compte propi que formin part de comunitats de béns o de societats civils en poden ser beneficiaris sempre que sol·licitin les subvencions a títol personal.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. Queden exclosos dels ajuts que estableix aquesta convocatòria els socis de societats mercantils de capital, cooperatives i societats laborals.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;També s’exclouen els autònoms col·laboradors: s’hi considera les persones que col·laboren en una activitat de naturalesa autònoma sense ser-ne titulars, encara que sigui de manera personal, habitual i directa.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Igualment, queden exclosos dels ajuts els treballadors que hagin exercit la mateixa o similar activitat com a autònoms o per compte propi (en el mateix o similar epígraf de l’impost d’activitats empresarials o de la declaració censal per al qual se sol·licita l’ajut) durant l’any anterior a la data d’inici de l’activitat per a la qual se sol·licita la subvenció, i els qui ja hagin percebut l’ajut per a l’establiment com a treballadora o treballador autònom amb anterioritat.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Tercer&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Import econòmic &lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El crèdit inicialment assignat a aquesta convocatòria per a l’exercici de 2012 és de 700.000,00 € amb càrrec a la partida pressupostària 14701 315C01 47000.00 19202 FF del pressupost vigent de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Quart&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Sol·licituds i documentació&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Les sol·licituds, dirigides a la Direcció General de Comerç i Empresa de la Vicepresidència Econòmica, de Promoció Empresarial i d’Ocupació, segons el model normalitzat de l’annex 1 d’aquesta Resolució, s’han de presentar en el Registre de la Vicepresidència Econòmica, en les seves delegacions o en qualsevol altre lloc dels que estableix l’article 38.4 de la Llei 30/1992.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Els sol·licitants han de presentar la documentació següent:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;i&gt;a)&lt;/i&gt;&lt;i&gt; &lt;/i&gt;Annex 1 de sol·licitud de subvenció d’aquesta convocatòria.&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="ca-ES" style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="text-decoration: none"&gt;&lt;i&gt;b)&lt;/i&gt;&lt;/span&gt;&lt;span style="text-decoration: none"&gt; Alta de la persona sol·licitant en el règim especial de la seguretat social de treballadors autònoms o règim especial que correspongui o mutualitat del col·legi professional corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal; text-decoration: none"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="text-decoration: none"&gt;&lt;i&gt;c)&lt;/i&gt;&lt;/span&gt;&lt;span style="text-decoration: none"&gt; Alta de la persona sol·licitant en el cens d’obligats tributaris, en la qual consti la data d’inici de l’activitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal; text-decoration: none"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;i&gt;d&lt;/i&gt;)&lt;i&gt; &lt;/i&gt;Fotocòpia del DNI/NIE (només en el cas de no figurar en la base de dades de la Direcció General de Comerç i Empresa) i certificat d’empadronament, en cas que la residència a les Illes Balears no figuri en el DNI/NIE.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;i&gt;e)&lt;/i&gt; Document bancari acreditatiu de la titularitat del compte o model TG-002 de sol·licitud de transferència bancària per a pagaments de la Comunitat Autònoma de les Illes Balears, emplenat adequadament, si escau.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;i&gt;f&lt;/i&gt;) Memòria justificativa del projecte empresarial completa, d’acord amb l’annex 2.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. A més, si escau, la persona interessada ha d’aportar la documentació següent, en original o còpia compulsada, juntament amb la sol·licitud:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;i&gt;a)&lt;/i&gt; Acreditació de la condició de persona amb discapacitat.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En els supòsits de subvencions per a persones amb discapacitat, tenen aquesta consideració les que tinguin reconegut un grau de minusvalidesa igual o superior al 33 %, d’acord amb la Llei 51/2003, de 2 de desembre (BOE núm. 300, de 16 de desembre).&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="text-decoration: none"&gt;&lt;i&gt;b)&lt;/i&gt;&lt;/span&gt;&lt;span style="text-decoration: none"&gt; Acreditació de la condició de víctima de violència de gènere.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal; text-decoration: none"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. En el supòsit que algun dels documents esmentats, amb ocasió de la tramitació d’altres expedients a la Direcció General de Comerç i Empresa, ja s’hagi presentat, no és necessari aportar-lo de nou, sempre que es facin constar la data i l’òrgan o dependència en què es va presentar o, si s’escau, en què es va emetre, que no hagin transcorregut més de cinc anys des de l’acabament del procediment corresponent i que no hagi sofert modificacions.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal; text-decoration: none"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;5. La Direcció General de Comerç i Empresa, en qualsevol moment, pot sol·licitar a les persones interessades la documentació i la informació complementària que consideri necessària per a resoldre l’expedient.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Cinquè&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Període subvencionable i presentació de sol·licituds&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. El termini per a iniciar les activitats que es poden subvencionar ha de comprendre des de l’1 de maig de 2011 fins a la finalització del termini de presentació de sol·licituds.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. El termini per a presentar les sol·licituds és de 15 dies hàbils comptadors a partir del dia següent de la publicació d’aquesta Resolució en el &lt;i&gt;Butlletí Oficial de les Illes Balears&lt;/i&gt; o fins que s’exhaureixi la quantia econòmica assignada a aquesta convocatòria&lt;i&gt;.&lt;/i&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. Si la quantia assignada a aquesta convocatòria s’exhaureix amb anterioritat a la finalització del termini per a la presentació, s’ha de suspendre la concessió de les ajudes mitjançant la publicació corresponent en el &lt;i&gt;Butlletí Oficial de les Illes Balears &lt;/i&gt;de la resolució del vicepresident econòmic, de Promoció Empresarial i d’Ocupació.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Sisè&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Procediment per a resoldre les ajudes&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Les sol·licituds de subvenció s’han de resoldre per ordre d’entrada dels expedients complets, fins que s’exhaureixin els crèdits destinats a la convocatòria o a la finalització del termini.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Una vegada resolts els expedients complets, si no s’ha exhaurit el crèdit previst, es tramitaran els expedients amb deficiències i, en aquest cas, la data de presentació de l’esmena establirà l’ordre per resoldre l’expedient.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Setè&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Competència i resolució&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. La Direcció General de Comerç i Empresa és l’òrgan competent per a tramitar les sol·licituds d’ajuts d’aquesta convocatòria. El director general de Comerç i Empresa ha d’emetre les propostes de concessió o denegació dels ajuts, les quals han de contenir la llista dels beneficiaris proposats per a atorgar la subvenció, així com les sol·licituds excloses amb el motiu de l’exclusió.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;D’acord amb l’article 59.6 de la Llei 30/1992, els actes a què es refereixen l’apartat sisè, punt 2, i el paràgraf anterior s’han de notificar a les persones interessades mitjançant la publicació, durant el període de vigència d’aquesta convocatòria, en la pàgina web de la Direcció General de Comerç i Empresa i al tauler d’anuncis de la Vicepresidència Econòmica, de Promoció Empresarial i d’Ocupació de la seu de Son Castelló (plaça de Son Castelló, 1).&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. La resolució expressa del vicepresident econòmic, de Promoció Empresarial i d’Ocupació finalitza el procediment de concessió de la subvenció i ha de motivar i fixar, amb caràcter definitiu, la quantia individual de la subvenció concedida. Aquesta resolució s’ha de notificar a les persones interessades d’acord amb l’article 59 de la Llei 30/1992, mitjançant la publicació en el BOIB. A més, la resolució s’ha de dictar i s’ha de notificar dins el període de sis mesos comptadors des de la data d’acabament del termini per a presentar les sol·licituds.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. La resolució de concessió ha d’especificar els aspectes següents: beneficiari, període durant el qual han de mantenir l’activitat, quantia, partida pressupostària a la qual s’aplica i forma de pagament.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. En cas que el beneficiari rebi altres subvencions o ajudes per a la mateixa activitat o tipus d’actuació, l’import de les subvencions que estableix aquesta Resolució no pot ser en cap cas de tal quantia que, de forma aïllada o en concurrència amb altres subvencions o ajudes, superi el cost de l’activitat subvencionada.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Vuitè&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Quantia de les ajudes&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Les quanties han de ser les següents, en funció del col·lectiu de què es tracti:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;i&gt;a)&lt;/i&gt; 8.000 € per a dones víctimes de violència de gènere i persones amb discapacitat desocupades.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;i&gt;b)&lt;/i&gt; 7.000 € per a dones desocupades i joves de 30 o menys anys.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;i&gt;c)&lt;/i&gt; 5.000 € per a desocupats no inclosos en els col·lectius anteriors.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Novè&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Pagament i justificació d’activitats&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-right: -0.75cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Una vegada presentada tota la documentació conforme i completa, i dictada la resolució d’atorgament, s’ha de continuar la tramitació per al pagament de l’ajut al beneficiari, atès que amb la documentació aportada amb la sol·licitud s’entén acreditada la justificació.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Desè&lt;/b&gt;&lt;i&gt;&lt;b&gt; &lt;/b&gt;&lt;/i&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Obligacions dels beneficiaris&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-right: -0.75cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Els beneficiaris queden obligats a:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal; margin-right: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="text-decoration: none"&gt;&lt;i&gt;a&lt;/i&gt;&lt;/span&gt;&lt;span style="text-decoration: none"&gt;) Mantenir la seva activitat empresarial i la seva alta en la seguretat social o equivalent durant almenys tres anys comptadors des de la data d’alta en la seguretat social o equivalent. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal; text-decoration: none"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="text-decoration: none"&gt;Això no obstant, el còmput d’aquest període de 36 mesos es pot comptabilitzar de forma no continuada sempre que en el projecte empresarial presentat es justifiqui l’estacionalitat per a executar-lo i sempre que l’alta en la seguretat social o equivalent sigui per períodes de 6 mesos, dins un màxim de 6 anys consecutius.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal; text-decoration: none"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En cas d’incompliment, la persona beneficiària ha de reintegrar les subvencions percebudes de manera proporcional al temps que falti per al compliment del preceptiu termini, excepte en el cas que s’acreditin causes alienes a la voluntat de la persona beneficiària i sempre que el compliment s’aproximi de manera significativa al compliment total.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal; margin-right: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;i&gt;b)&lt;/i&gt; Informar la Direcció General de Comerç i Empresa sobre qualsevol alteració de les condicions que s’han tingut en compte per a concedir la subvenció.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal; margin-right: -0.75cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;i&gt;c)&lt;/i&gt; Sotmetre’s a les actuacions de comprovació que faci la Direcció General de Comerç i Empresa, i a les actuacions de control financer de la Intervenció General de la Comunitat Autònoma de les Illes Balears i de la Sindicatura de Comptes.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal; margin-right: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;A aquests efectes, la Direcció General de Comerç i Empresa farà les comprovacions de manteniment de l’activitat empresarial per mitjà d’informes de vida laboral emesos per la Tresoreria General de la Seguretat Social, excepte en el supòsit que la persona beneficiària no l’hagi autoritzada a obtenir-los, o estigui inscrita en un règim especial o mutualitat del col·legi professional corresponent, cas en què el beneficiari haurà de presentar, abans del dia 30 de juny de cada any, un informe acreditatiu del manteniment de l’activitat empresarial.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal; margin-right: -0.75cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;i&gt;d)&lt;/i&gt; Comunicar l’obtenció d’altres subvencions o ajudes per a la mateixa finalitat procedents de qualsevol administració o entitat pública o privada, nacional o internacional.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal; margin-right: -0.75cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;i&gt;e)&lt;/i&gt; Conservar els documents justificatius de l’aplicació dels fons percebuts, mentre puguin ser objecte d’actuacions de comprovació i control.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="font-weight: normal; margin-right: -0.75cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;i&gt;f)&lt;/i&gt; Reintegrar els fons percebuts en els supòsits prevists en l’article 44 del Decret legislatiu 2/2005.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Onzè&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Normativa d’aplicació&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="font-weight: normal"&gt;1. La convocatòria es regeix per &lt;/span&gt;&lt;span style="font-weight: normal"&gt;l’Ordre del conseller de Treball i Formació de 4 de maig de 2005 per la qual s’estableixen les bases reguladores de les subvencions en matèria de treball (BOIB núm. 73, de 12 de maig); pel Reial decret 357/2006, de 24 de març, pel qual es regula la concessió directa de determinades subvencions en els àmbits de l’ocupació i de la formació professional ocupacional (BOE núm. 83, de 7 d’abril); per l’Ordre TAS/1622/2007, de 5 de juny, per la qual es regula la concessió de subvencions al programa de promoció de l’ocupació autònoma (BOE núm. 136, de 7 de juny), i per aquesta Resolució.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="font-weight: normal"&gt;En el cas que durant la tramitació de les subvencions d’aquesta convocatòria la Direcció General de Comerç i Empresa implanti qualsevol procediment o actuació de tramitació telemàtica, els beneficiaris podran tenir accés per mitjans electrònics a la informació i al procediment administratiu.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Catorzè&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
